Peter DeBlasio, a member of the Southold Senior Citizens Club met with the Board to discuss the purchase of an oxygen inhalator for the Senior /Youth Center. Mr. DeBlasio demonstrated an oxygen inhalator , as well a res-uscitator. The Board agreed to authorize Mr. DeBlasio to purchase an oxygen ihalator .for installation at the Center. A resultion will be placed on the agenda. EXECUTIVE SESSION 10: 05 A.M. - Reverend William Coleman, Attorney George Stankevich and the Administator of San Simeon by the Sound nursing home met with the Board concerning litigation that they are involved with the Town. They requested the Board to contact the attorney represent- ing the Town and evaluate the situation. Town Attorney Tasker advised the Board that since the matter is in litigation the Board should not discuss this. Supervisor Pell will contact the Town' s attorney and arrange a meeting to discuss .the case. WORK SESSION 10: 40 A .M. - Mr. Harold Dombeck of Holzmacher, McLendon and ._Murrell, P.C. met with the Board at Councilman Townsend' s request.. to -discuss the landfill and proposed Wastewater Disposal District . Councilman Townsend said he would like to hire H2M on a per diem basis to evaluate the solid waste disposal proposals and submit a report incor:p. rating H2M' s suggestions. Councilman Townsend would also like'-'.to„s-e<t up a system to Monitor the amount of garbage and debris . going.', i:nt,o the disposal area. This project will be undertaken by parttime "Town employees such as traffic officers. The proposed wastewater disposal district was discussed. The first step is to form a district. Town Attorney Tasker will have a resolution for the April 20th meeting. Mr . Dombeck said H2M is presently working on a map for the proposed district. 11: 45 A.M. - The Board audited the outstanding bills for March. 12: 30 P.M. - Recess for lunch. 1: 45 P.M. - Work Session reconvened. Numerous off-agenda items were discussed, including letter from E. M. Kontokosta concerning the Soil Removal Permit issued to Jem Realty. Supervisor Pell was.. instructed to reply to Mr. Kontokosta that any change in the provision of the permit, other than decreasing the amount of fill to be removed, would require a new public hearing. PUBLIC HEARINGS - 3: 00 P.M. Application of Cheryl Pagnozzi to construct a float, ramp, catwalk and four mooring piles at Jockey Creek, Southold. 3: 05 P.M. - Application of Enconsultants, Inc. for Friedrich Krug to replace bulkhead and backfill at Budd' s Pond, Southold. 3: 15 P.M. - Work Session reconvened. At this time it was the 'Board' s opinion that the Regular Meeting scheduled for 7: 30 P. M. be recessed until Wednesday evening at 7: 30 P.M. due to the snow storm in progress. APRIL 6 & 7 , 1982 M, 99 On motion of Supervisor Pell, seconded by Councilman Murphy, it was RESOLVED that at the conclusion of the Work Session, at 3: 20 P.M. , with a majority of the Board present, it was the decision of the Town Board that the meeting to beheld tonight at 7: 30 P.M. be recessed until Wednesday, April 7, 1982 at 7: 30 P.M. , because of inclement weather conditions. Vote of the Town Board: Ayes: Councilman Townsend, Councilman Murphy, Councilman Murdock, Councilman Nickles, Supervisor Pell. This resolution was declared duly ADOPTED. ' It was the decision of Supervisor Pell to call the meeting of the Town Board to order at 7: 00 P.M. on Wednesday, April 7, 1982, rather than 7: 30 P. M. as scheduled at the Work Session on April 6th. The Board members signed a Waiver of Notice of Town Board Meeting and the meeting was called to order at 7: 00 P.M. A Special Meeting of the Southold Town Board was called to order at 7: 00 P.M. , Wednesday, April 7, 1982 at the Southold Town Hall, Main Road, Southold, New York. Supervisor Pell opened the meeting with the Pledge of Allegiance to the Flag. Present: Supervisor William R. Pell, III Councilman John J. Nickles Councilman Lawrence Murdock, Jr. Councilman Francis J. Murphy Councilman Joseph L. Townsend, Jr. Town Clerk Judith T. Terry Absent: Justice Raymond W. Edwards Moved by Councilman Murdock, seconded by Councilman Nickles, it was RESOLVED that the following audited bills be and hereby are ordered paid: General Fund Whole Town bills in the amount ofr $56, 229. 49; General Fund Part Town bills in the amount of $38 , 449. 21; Highway Department bills in the amount of $13, 950. 45; Fishers Island Ferry . District bills in the amount of $33, 443. 28; Fishers Island Ferry District Capital Project bills in the amount of $3, 300. 00; Federal Revenue Sharing bills in the amount of $1, 200. 00; and Division of Youth Juvenile Aid Program bills in the amount of $126. 48. Vote of the Town Board: Ayes: Councilman Townsend, Councilman Murphy, Councilman Murdock, Councilman Nickles, Supervisor Pell. This resolution was declared duly ADOPTED. Moved by Councilman Nickles, seconded by Councilman Townsend, it was RESOLVED that the minutes of the Southold Town Board meeting held on March 26, 1982 be and hereby are approved. Moved by Councilman Murdock, seconded by Councilman Nickles, it was RESOLVED that the next regular meeting of the Southold Town Board will be held on Tuesday, April 20, 1982 at 3: 00 P.M. at the Southold Town Hall, Main Road, Southold, New York. (No, not at this time. ) Councilman Murdock? COUNCILMAN MURDOCK: Just a short note to the people and since our Chief of Police is here. We had a meeting with the Disposal Area Committee and ' the North Fork Environmental Council. There seems to be a serious discrepency in .how much municipal solid waste we have. The Town is going to institute a program where we physically count all cars and trucks going into the Disposal Area. I don' t know whether Mr. Dean has contacted Chief Winters . We hope to start that program as soon as we can physically the bodies on site. If anybody sees their car being counted on the way into the Disposal Area_.it ' s :the Town doing it. SUPERVISOR. PELL: Councilman Nickles? (Not at this time. ) Councilman Murphy? COUNCILMAN MURPHY: I would just like to, for any of the press , to remind everyone, and if we could get the word out, that next Tuesday at 7: 30 we are having a public input on two-family conversions and I think it ' s most important for the Town and we should have some input from the people here because I think it ' s going to be most important decision on our part . Thank you, Bill. SUPERVISOR PELL: The Supervisor has progress to report. We got through today so far and we have got to go through this wind storm tonight and if everybody holds up, the Police Force, Highway men and the State keeps 25 opened up I' ll be happy. II . PUBLIC NOTICES COUNCILMAN NICKLES: We have five notices tonight. 1. Public opinion meeting at 7: 30 P.M. on April 13 ,' 1982 at the Southold Town Hall on local needs for two-family housing conversion. 2. Corps of Army Engineers application by Ms . Kathrine Farr to bulkhead, build floats and dredging at Sterling Creek,.- Town of Southold, Greenport. Comments by April 18, 1982. 3. Corps of Army Engineers application by Mr. Anthony E. Vallace to build a catwalk, ramp and float at Broadwaters Cove, Cutchogue. Comments by April 25, 1982. 4. Notice of complete application from the D.E. C. by Norman J. Murray to subdivide a parcel into three lots at west. . shox:e of Brushes Creek, east side of Oakwood Road, Laurel. Comments by 4/14/82. 5. Notice from the Public Service Commission regarding public hearings to receive comments from the public concerning pending rate proposals of Long Island Lighting Company for electric and gas on May 12, 13, and 14th. All these notices are placed- on the Town Clerk' s Bulletin Board and are there for anybody who would like to read them. III . COMMUNICATIONS. SUPERVISOR PELL: There are six on the agenda tonight. 1. Letter from the New York State Parks 8: Recreation relative to the Terry/Mulford House being considered for Historic Preserva- tion for nomination to the National and State Registers of Historic Preservation. 2. Letter from William Watson suggesting that the Town create the position of Coastal Warden for which he is qualified. 3. Letter from the MattituckCutchogue School District trans- mitting a resolution- that the present tax exemption on real property owned by persons 65 years of age or over and meeting the statutory requirements and earning not .more than $8, 000. 00 per ' year as permitted by law be granted. 4. Letter from the New York State Office of Mental Retardation and Developmental Disabilities concerning various community residences. 5. Letter from the Concern Citizens Group by Barbara Albertson . concerning the proposed . construction of a 7-11 Store in Southold. 6. Letter from New York State Assemblyman Paul Harenberg relative to Assembly Bill '957.9 which he has introd,u:ced. and which will include Suffolk County within the application of the Emergency Tenant Protection Act of 1974. COUNCILMAN MURDOCK: I would ask one thing- with regard to No. 2 from William Watson about a Coastal Wdirabn. Have you sent a copy of that to the Chief of Police? SUPERVISOR PELL: Not yet, it Will go. I will send a copy after tonight. IV. HEARINGS SUPERVISOR PELL: There are no hearings tonight. We had . two held yesterday at 3: 00 and 3: 05. The Board is not ready to discuss them at this time. We move on to Resolutions. V. RESOLUTIONS SUPERVISOR PELL: Some of these things we say "hold" on, we are holding them because yesterday during the Working Session of the 'Board- we did not have ample time to discuss them in detail (due to the snow storm) so we are going to put them on the next Town Board agenda (April 20th) . It is not that we are tabling them, we just didn' t have time because of the weather. We too wanted to get out of here yesterday. Resolution No. 1 (hold) - Apportionment of 1982 Federal Community Development Block Grant Funds - $239, 000. 00. Resolution No. 2 (hold) - Southold Town Board authorizes and creates the Southold Town Cable Television"Advisory Committee - a citizen' s advisory board. 3. Moved by Councilman Murdock, seconded by Councilman Murphy, it was RESOLVED that pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality Review and 6NYCRR Part 617, Section 617. 10 and Chapter 44 of the Code of the Town of Southold,, notice is hereby given that the Southold Town Board, as lead agency �.for the action described below, has determined that the project, which is unlisted, will not have a significant effect on the. environment. Description of Action: Application of Enconsultants, Inc . for Muriel Baldwin for a wetland permit . Permission is requested for construction of 27 ft. timber bulkhead plus two 5 ft . /returns land- ward of line of MHW on certain property located at canal off Southold Bay, at south side of Island View Lane., Greenport, New York. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significiant adverse effect to the environment are likely to occur should the project be implemented as planned. Because there has been no response -in the allotted time from the New York State Department of Environmental. Conservation, it is assumed that there is no objection nor comments by that agency. ' Moved, by Councilman Murphy, seconded by Councilman Nickles, it was RESOLVED that the Southold Town Board declare itself lead agency in regard to the State Environmental (duality Review Act in the matter of the application of Kenneth Strachan, Jr. for a wetland permit on certain property located on Orient Harbor, east of King Street, Orient, New York. Vote of the Town Board: Ayes: Councilman Townsend, Councilman Murphy, Councilman Murdock, Councilman Nickles, Supervisor Pell. This resolution was declared duly ADOPTED. 5 . Moved by Councilman Townsend, seconded by Councilman Murdock, it was RESOLVED that the Town Board of the Town of Southold set 3: 35 P .M. , Tuesday, April 20, 1982, Southold Town Hall, Main Road, Southold, . New York as time and place for hearing upon application of Encon- sultants , Inc. for Kathrine .Farr for a permit under the provisions of the Wetland Ordinance of the Town of ' Southold to construct bulk- head, floating docks, and dredge on the west side of Manhanset Avenue, Sterling Creel:, Greenport, New York. This resolution was declared duly ADOPTED. 102 APRIL 7, 1982 Resolution No. 6 - Appoint Harold D. Winters Chief of Police. Will be the last resolution of the evening. Resolution No. 7 (hold) - Trailer permit renewal by Patricia Phillips Marco, Indian Neck Lane, Peconic. 8. Councilman Nickles, seconded by Councilman Murdock., it was RESOLVED-- that the Town Board of the Town of Southold accept the bid of Mullen Motors, Inc. for supplying the Town of Southold with one 1982 1/2 ton Dodge Van at the bid price. of $6, 999. 00. Resolution No. 11 (hold) - Bid of Nassau Electric East Corp. for furnishing and delivering luminaire type outside lighting fixtures . 12. Moved by Councilman Murdock, seconded by Councilman Nickles, it was RESOLVED that the Town Board of the Town of Southold approve the application of Sophie T. Saunders, dated March 25, 1982, , for renewal of her trailer permit located at north side of Main Road, Laurel, New York. Vote of the. Moved by Councilman Murphy, seconded by Councilman Nickles, it was RESOLVED that the Town Board of the Town of Southold accept" the bid of Lansdell Asphalt & Bituminous Corp. for supplying the Town of Southold with 150, 000 gallons, more or less as may be needed, of Grades RC-2 and MC-2 Asphalt Road Materials, delivered and applied, at a cost of . 1, 485 per gallon. Moved by Councilman Nickles, seconded by Councilman Murphy, - WHEREAS, the Town of Southold has requested the County of Suffolk .to dredge a navigation channel at West Creek, Town of Southold, and WHEREAS, the County of Suffolk proposes to do said dredging of West Creek, in the Town of Southold at a nominal cost to the Town of Southold, and WHEREAS, in order to accorrip.lish said dredging, plans, specifications, agreements and other documents must be executed on behalf of the Town of Southold, now, therefore, be it RESOLVED that Supervisor William R. Pell, III be and he hereby is authorized to execute, on behalf of the Town of Southold, all necessary plans and specifications, spill area agreements, assurances to the County of Suffolk, license and/or dredging permit applications to Federal and State Agencies and all other documents that may be required to accomplish said dredging work. Moved by Councilman Townsend, seconded byCouncilman Murdock, it was RESOLVED that the Town Board of the Town of Southold supports Suffolk County Legislature Resolution No ... 1319-1982, authorizing the Suffolk County Executive to enter into an",agreement (s) for a physical inspection of the Shoreham Nuclear Power Plant at no direct cost to the Town."of Southold. Vote of the Town Board : Ayes: Councilman Townsend, Councilman Murphy, Councilman Murdock, Councilman Nickles , Supervisor Pella This resolution was declared duly ADOPTED. COUNCILMAN TOWNSEND: Bill, I ' d like to comment on that. This is something the Town Board initially was going to table but received a fair amount of comment between yesterday and today. The basis of this is a recent legislation proposed by Gregg Blass our Legislator and Wayne Prospect who is Legislator in one of the western towns. They say it' s landmark legislation because it is the first time a political body has asked for the right to inspect for safety reasons, to inspect a nuclear installation which is primarily in consideration of the problem at Three Mile Island and subsequent problems at other . nuclear plants and also in consideration of various in reporting that' s been done both in the New York Times and Newsday. I will admit that initially .I wasn' t . disposed towards it because I 'm not for government intervention in private matters but we are in such a vulnerable area out on the East End of the Island that if there is anything that goes wrong we are the ones that are possibly more hurt than anyone else because we can 't go anywhere. Also in light of. the articles that I ' ve been made aware of I feel it ' s something' we should support. What this does is allow the Suffolk County Execs ive to make a expenditure, for a private and independent inspection to look at the various safety systems at the Lilco plant in Shoreham. I think that' s why the rest of the Board has decided to act on it today. 16. Moved by Councilman Murphy, seconded by Councilman Nickles, it was RESOLVED that the Town Board of the Town of Southold approves the action of the Board of Commissioners of the Fishers Island Ferry District in hiring Evelyn Clarke as a Reservation Clerk for auto- mobiles- leaving Fishers Island, effective April 1, 1982, _ at a salary of $4. 00 per hour, and an average of 15 hours per week. Vote of the Town Board: Ayes Councilman Townsend, , Councilman Murphy, Councilman Murdock, Councilman Nickles, Supervisor Pell. This resolution was declared duly ADOPTED. 17 . Moved by Councilman Murdock, seconded by Councilman Murphy, it, was RESOLVED that the Town Board of the. Town of Southold hereby author- izes Mr . Peter DeBlasio to purchase, on behalf of the Town of Southold, one #1313 Oxy-Duo-Pak, for use at the Senior/Youth Recreation Center, Peconic , at a cost of $199. 75. Vote of the Town Board: Ayes: Councilman Townsend, Councilman Murphy, Councilman Murdock, Councilman Nickles, Supervisor Pell. This resolution was declared duly ADOPTED.. 18. Moved by Councilman Townsend, seconded by Councilman- Murdock, it was RESOLVED that a public hearing will. be held by the Town Board of - the Town of Southold "on the 4th day of may, 1982,. at 3: 00 P.M. upon the matter of the application of Long Island Lighting Company requesting the granting of the right, franchise, permission and consent of the use of the streets , highways, avenues, lanes and other public places or any part thereof, or the space above or under them, or any of them, in the Town of Southold, which are now or may hereafter be under the control of the municipal authorities of said Town and to consent that Long Island Lighting Company may exercise the powers set forth in the Transportation Corporation Law, as and for a gas franchise, all ,for a period of ninety-nine (99) ,years. Moved. by Councilman Murdock, seconded. by Councilman Townsend , it was RESOLVED that the Town Board of the Town of Southold retain-the . services of Charles E. Graves for the forthcoming contract negptia- tions with the CSEA and the PBA. Total contract fee for the negotia- tions not to .exceed $20=000. 00.. This resolution was declared duly ADOPTED.. 104 APRIL 7, 1982, 20. Moved by Nickles, seconded by Councilman Murdock, WHEREAS, . this Board has learned with deep sorrow of the death 'of A. John Gada, Sr . , and WHEREAS, in his service to the people of the Town. of Southold as a Special Constable on Fishers Island for many ,years, Mr�.. Gada distinguished himself as a dedicated and conscientious public servant, now, therefore , be it RESOLVED that ,the Town Board of the Town of Southold hereby gives formal expression of its loss in' the death of A. John Gada, Sr. , a man esteemed by his associates and respected b37 all , and be itj further RESOLVED that when the Town Board adjourns this day, it does so out of respect to the memory of A. John Gada, Sr. , and be it further RESOLVED that a copy of this resolution be spread upon the minutes of this Town Board meeting and a copy be transmitted to the family of A. COUNCILMAN TOWNSEND: I think it is worthy of note that Dan did very well -on the test and we all expected he would and wish to. offer our congratulations. SUPERVISOR PELL: I' m going to swear Dan in. . (Supervisor ,Pell administered the Oath of Office to Police Chief Winters. ) There were 83 that took the test and Dan came in number 15 out of 83 which is quite an honor. I also think he is the first local man that has taken the. test and passed it and got the appoint- ment.. CHIEF WINTERS: , Thank you very much, Bill, for your kind words. and I 'd like to thank the Board,- each and every one of you for your'' ' support. I feel very honor and privileged tonight. As' I think , back 25 years when I started. I can remember working for Otto Anrig- I don ' t know if any of you ever did work for Otto, but he made 'it quite clear that the Office of Chief of Police was a very unique position and if you didn' t think so all you had to do is ask him. He was quite a , man. But I'm not going to make any rash promises tonight. The only think that I' m going to do is promise to give 100 percent. Thank you.
