SOUTHOLD TOWN BOARD
REGULAR MEETING
FEBRUARY 23, 1982
WORK SESSION - February 22, 1982
3: 00 P•.M. - Richard G. Ward, Board Chairman of Ward Associates,
P.C. appeared before the Board to present his Park, 'Recreat'ion
and Open Space Survey for the Town of Sout hold. It is a- report
and mapping regarding the park, recreation and' open space amenities
of the Town of Southold and is presented as an overview of the
various park districts, parks, and recreational opportunities of
public and private nature, and open-space preservation to date in
the Town. The report was compiled through discussions with park
district officials and by site investigations of the. various town
and district-owned facilities, and is concerned with the overall
planning and policy decisions regarding park, recreation and open
space. The report included three maps: Developed vs Open Space,
Park and School Districts, and Private Open Space and Recreational
Facilities, and included the following recommendations: (1) Acquisition
of park lands and significant open spaces. (2) Consideration should
be given to changing park district -boundaries and/or consolidate
park districts to be coterminous with school district boundaries.
(3) Town should consider "Southold" Park and Beach Pass to encompass
a coordinated Park District effort to allow all Town residents to
participate in Park District -facilities at `their choice rather than
being limited to home districts. (4) Town should consider negotia-
tions with local park districts to administrate and operate properties
of Town-wide significance, in lieu of remaining as local park district
properties. (5) Town should consider a Department of Recreation
and Parks with professional leadership. (6) Town should consider
a central year-round recreation complex to serve the broad based
needs of the residents. --=Mr. Ward was asked to meet with Planning
Board Chairman Henry Raynor to discuss updating the Town' s Master
Plan.
3: 40 P.M. - Emanuel Kontokosta met with the Board to discuss his
application for a permit to excavate sand , gravel, stone or other
materials from premises of Jem Realty Co. located on the north side
of Main Road (N.Y. S. Route 25), east of Sound Avenue, Greenport .
Mr. Kontokosta asked the Board to reconsider their request for
consent of the mortgagee of the property since the mortgagee has
refused to sign the consent, and such consent is not required under
the conditions of the mortgage. Mr. Kontokosta was asked to submit
a copy of the mortgage for the Board' s .consideration. Mr. Kontokosta
explained the method of rehabilitation of the property and will sub-
mit a rehabilitation plan at the public hearing on March 9th.
3: 50 P.M. - A representative of Pitney Bowes appeared before the
Board to discuss the purchase of a new postage mailing machine.
The Town' s present machine is almost ten years old and after ten
years cannot be covered by a maintenance agreement . At the present
time the Town is paying $105. 00 per month for rental of the meter
and $263. 00 per year for maintenance. A new machine with postage
scale and table would cost $185. 00 per month including maintenance.
It is estimated there would be a considerable savings with the new
machine through reduction in postage. After considerable discussion
it was decided to place the approval of an agreement for the new
mailing machine on the March 9th agenda.
4 : 00 P.M. - Town Engineer Lawrence Tuthill met with the Board to
discuss recently received maps of proposed undeveloped coastal
barriers . Inclusion of properties in the undeveloped coastal
barriers would end federal flood insurance in those areas after
October 1, 1983. Mr . Tuthill advised the Board that there are
four areas on Fishers Island that should be deleted or relocated.
(1) ,The area adjacent to Elizabeth Airport is owned by the Town

of Southold and therefore should be deleted. (2) At Wilderness
Point, the western third is owned by the U. S. Government. and
should be deleted. (3) The easterly line of the area at. Island
Pond should. be relocated to follow the 10. ft.. contour.' (4) The
easterly line at Barleyfield Cove should follow the 10 ft . contour.
Mr. Tuthill will prepare a letter outlining the above for Supervisor
Pell' s signature and transmittal to Department of the. Interior,
Coastal Barriers Task Force, with a copy to Congressman Carney
since he has cosponsored a barrier islands protection bill, H.R.
3252, to establish the Coastal Barrier Resources System.
4: 15 P.M. - Board of Appeals Chairman Gerard P. Goehringer met
with the Board and presented copies of a report and related
documents concerning " . . . Two-Family Dwellings in the Town of
Babylon" , which is. based upon an update from the Association of
Towns Meeting and which Mr. Goehringer feels are the best of
those researched west of Southold Town. After general discussion.
of the subject, Councilman Murphy advised he would submit a
recommendation on March 9th so an informational hearing can be
scheduled.
4: 40 P.M. - Jim Christy, High School Guidance Counselor a-t the
Mattituck-Cutchogue School appeared before the Board with Youth
Coordinator Jim McMahon' to discuss the Drug/Alcohol Program for
youth he has initiated at Mattituck-Cutchogue School. The program
began last year starting in grades 2 through 6. He is now train-
ing high school students to go into elementary grades to present
lessons. Last summer Mr. Christy went to Illinois with nine students
ready to start programs. March 19-21 there will be a three-day
workshop at St. Gabriel' s Retreat House on Shelter Island. The
workshop has two major objectives: (1) to educate and train 45
teens to become knowledgeable peer leaders- on drug/substance abuse
issues and (2) to organize students to and in the development of
prevention plans for their schools and communities.--Councilman
Murdock suggested such a program at' the recreatiom-;center. Ms.
Christy will consider it . Mr. Christy was assured that the entire
Town Board is ready and willing to promote such a program. .
5: 10 P.M. - Chief H. Daniel Winters met with the Board to request
that Andrew Ficurilli, Greenport ; be appointed. a Relief Radio
Operator; Leonard Green, Cutchogue, be..appointed a Relief Traffic
Warden and Relief School Crossing Guard since George Young has
retired. Resolutions will .be placed on the regular meeting agenda.
5: 15 P.'M. - Supervisor Pell . brief ly apprised the Board. of damage
to property and abuse of privileges he has discovered at the
Recreation Center. He will prepare a ]letter of recommendations
for the Board to consider and further cliscuss it on February 23rd.

A Regular Meeting of the Southold Town Board was held on
Tuesday, February 23, 1982 at - the Southold Town Hall, Main Road,
Southold, New York. Supervisor Pell opened the meeting at 3: 00
P.M. with the Pledge of Allegiance to the Flag.

SUPERVISOR PELL: These reports are placed on file with the Town
Clerk. ' Anybody wishing to review them can do so at the Town Clerk' s

COUNCILMAN TOWNSEND: The committee to discuss purchasing property
for the Landfill met and discussed the options and the need for it
and the result of the meeting is Item No. 12 on the agenda. It' was
decided that because of problems with fill and future space we are'
going to have to expand in some area and I think the first step of
several we are going to be taking in the future regarding the Land-
fill. That ' s all I have today.

SUPERVISOR PELL: Councilman Murdock.
COUNCILMAN MURDOCK: A week ago Thursday night Councilman Townsend,
Councilman Murphy and myself.' as our Landfill Committee met with a..
committee of the North Fork Environmental Council to discuss some
of our problems. Today I distributed to the Town. Board a letter
comprising some eight pages,' I ' ll cull it a position paper for lack
of a better word, on Energy Development Corporation--what they
propose to do on the basis of their interpretation of the Town' s
problems. I have given a copy, to ,Mrs . Oliva and I. int.end- to forward
one to the League of Women Voters and one for each. of. the _ four news-
papers who seem to frequent our. meetings. . I hope to, get .as much
public input as we can. That 's it Bill, thank you.
SUPERVISOR PELL: Councilman Murphy.
COUNCILMAN MURPHY: I ' d like to report that on. the Inland Water-
way Committee the complete survey of all the creeks has been done
and the recommendations of the Town Trustees have been turned in
and we will meet and work with John Guldi of Suffolk. County DPW to
finalize the dredging that hopefully will be done this year. Also,
I ' d like to report that the Seed Clam ]Program is going very well. .
The clams are ordered and we hope. to be starting to build the rafts
next month. Thank- you.

II . . PUBLIC NOTICES C OUNCILMAN MURPHY:
1.., Application of Mr. Helmut Spi-tzenberger of 4 Beaujeau
Court, Nesconset concerning work o,f a mooring facility, bulkhead
and dredging at Fordham Canal, Gardiners Bay, Town .'iof Greenpor.t.,
Suffolk County. Any criticism or protest has to 'be mailed to the
Corps of Engineers by the 12th of March and this is also posted
on the Town Clerk' s Bulletin Board for anyone who' s. inter.ested.
2. Concerning the placing of Geographic..Names to determine
if there is any local opposition to the following names being
affixed to certain features in our town. One is Little Gull.
Reef and the other is Race Point Ledge. If there is any opposition
this also is placed on the Town Clerk' : Bulletin Board.
3. Public Notice of the D.E..C. the Regulatory Affairs. It
is . a copy of the notice for ice damage permit for the 1982 season.
Anyone in the Town facilities or private who had ice damage it
makes it a much easier way of getting it repaired. It is a small
permit that has to be sent in to D.E.C. and .you could go ahead'.
with the work. Saves about six months time.
4. Notice of a Complete Application of Enconsultants, Inc. ,
, for William Boylhant in Southampton. It is a Tidal Wetlands. .
It ' s for the placement of 1, 500 cubic yards of fill in an- area-
designated as a 'IV,, zone. Comments by March 3rd to the D.E.C.
This again is placed on the Town Clerk' s Bulletin Board.
5. Notice of Complete Application of Patrick Carrig for
John Pope & Joseph Avignon, Richmond Road,. Southold. A Tidal,
Wetlands. Construct 295 feet of bulkheading, not to exceed 30
feet in width. Project is located 'on the south- shore of Mattituck
Creek on the north side of Westphalia Road, Mattituck. Comments
no later than March 10th to the lead agency the 'New York State
Department of Environmental Conservation, Stony Brook. -
6. (a) . Concerning Hampton Jitney, Inc-r, Notice of public
hearing scheduled to be held. in the above matter before F.. E.
Ueberwasser, Administrative Law Judge, on Thursday; March 4, 1982
and has been postponed to Thursday, March 18th at 11: 00 A.M. , at
the Village Hall, Justice Court Meeting Room, Greenport and will
be continued on Friday, March 19th if necessary. .
6. (b) . Petition of Sunrise. Coach Lines, Inc. which is the
same hearing notice that it was postponed to this later date.
This also will be posted on the Town Clerk' s Bulletin Board.
That is the end of the_ public ,notices'.
SUPERVISOR PELL: One more, Frank, that came in late, . On- March
9th at 7: 30 P.M. a hearing .will be held in Southold Town Hall

for the use of Year . VIII. HUD, ,gr,ant ,4So anybody who wishes to have
input in the expenditure of the' grant "for`•the Town which will be
$239, 000. 00. That is the total amount of the grant. Input will
be received by the Town Board on March 9th at 7: 30 P.M. Pan Tech,
the consulting firm that the Town uses, will hold the hearing.
III . COMMUNICATIONS - SUPERVISOR PELL:
1. From Mrs. Stuart Harvey commending a Town employee at
the Cutchogue Landfill. She went in there to help fill it up
and she had a flat tire and one of the Town employees---according
to her it was on his lunch hour---put his lunch box aside and went
and helped her fix the flat tire. She thanks the Town for having
such gracious employees that are willing to help folks.
2. From North Fork Oil Heat, Inc. from Mattituck, commending
our Police Force on the arrest they made of an arson .who set their
place on fire.
3. A request asking the Town Board to help out with the Corps
of Engineers to get a wreck removed from an inlet. The Town Board
will have a resolution today on this request (from John D. Reed) .
4. From our Congressman (William Carney) requesting input
about the land on Fishers Island is considered in the undeveloped
coastal barriers phase of the flood insurance program. There are
seven homes involved in this.. The Town Board is in the process of
reviewing it . The deadline for comments is March 15th. A letter
will be prepared and Mr. Edwards from the Island has had a lot of
input ,yesterday and today on this and a letter will be sent to the
hearing officer saying that we do not agree with all they would like
to do there.
5. Letter from the Greenport-Southold Chamber of Corr�merce
saying that from time to time if the Town has to set up advisory
committees, a lot of their members would like to be considered
to serve on such committees or helping the Town in whatever way
they can.
Hearings we have scheduled at 3: 30 P.M. , and we will have to
come back to them at 3: 30 P.M.

V. RESOLUTIONS
1� Moved by Councilman Murphy, seconded by Justice 'Edwards,.
WHEREAS, Girl Scouting has exemplified and enhanced those qualities
of womanhood most admired, and
WHEREAS, the Girl Scouts of America have fostered the growth of
character, self-reliance, integrity and love of God and Country,
now, therefore , be it
RESOLVED that the Town Board of the Town of Southold proclaim the
week of March 7 - 14, 1982 as American Girl Scouts Week.
Vote of the Town Board: Ayes : Justice Edwards, Councilman

SUPERVISOR PELL: Anybody here from the Girl Scouts? We-::have this
Proclamation and we' ll give it to you after the meeting:
FROM THE AUDIENCE: There is a Song & .Dance Festival on the 7th
of March at 1: 30- P.M. at the Senior Citizen/Youth Center.
SUPERVISOR PELL: I have a letter on that one.
2. Moved by Justice Edwards; seconded by Councilman Murdock,
WHEREAS, through diligence and hard work in your daily living
you have set high standards for yourself, and
WHEREAS, the basis for development for your personal code of
conduct could not provide a better guidance and will contribute,
to a more meaningful life, and
WHEREAS, you will continue to be guided in your daily living by
the- Scout Oath and Code, now, therefore, be it
RESOLVED that Doug Dinizio be congratulated for achieving the
highest rank in scouting - Eagle Scout.

SUPERVISOR PELL: I might comment on Eagle Scouting. ' There were,
last year, , six Eagle Scouts in the five east end towns. Southold
Town had two of the six last year, which we can be pretty proud of.
Out of every boy that enter Scouts,, only one out of 100 obtains
the rank of Eagle Scout. This year we expect to have this one
and possibly two more that I know of. Quite an achievement when
the young men do achieve that. There are 18, 000 boys in the
County of Suffolk involved in Scouting.
3. Moved by Councilman Murdock, seconded by Councilman- Murphy, it was
RESOLVED that Bond No. 73 S-1481.7 BCA issued by The Aetna ' Casualty
and Surety Company in the sum of $4,000. 00 on behalf of Kenneth L.
Edwards, Commissioner - Secretary of the Fishers Island Garbage and
Refuse District be and the same is hereby approved as to form, manne
of execution and sufficiency of sureties therein. .

4 . Moved by Councilman Townsend; seconded by .Councilman Murdock; it was
RESOLVED that Bond No. 73 S-688 BCA issued by The Aetna Casualty
and Surety Company in the sum of $1,000. 00. on behalf of Raymond
F. Doyen, Commissioner = Chairman of the Fishers Island Garbage
and Refuse District be and the same is hereby approved as to form,
manner of execution and sufficiency of sureties therein.

5. Moved by Councilman Murphy, seconded by Justice Edwards , it was
RESOLVED that the Town Board .of the Town of Southold appoint
William Weinheimer as a member of the Southold Town-' Board of
Assessment Review, for the term February .22, 1982 through
February 22, 1987.

6: Moved by Justice Edwards, seconded by Councilman Murdock, it was
RESOLVED that the Town Board of the Town of Southold hereby;
authorizes the establishment of a Fishers Island ' Sewer District
Account (Account No. 044-426210) with The North Fork Bank & Trust
Co.

Townsend, Councilman Murphy, Councilman Murdock, Supervisor Pell.

7 . Moved- by Councilman Townsend, seconded by Councilman Murdock., it was
RESOLVED that Supervisor William R. Pell, III be and -he hereby is
authorized 'and directed to execute a contract between the Town of
Southold and New York State Department of Environmental Conservation,
Bureau of Shellfisheries, for the 1982 Shellfish Transplant Project,
to be partially funded through the D. E.C. ' s federally funded Grant-
In-Aid Program (50% reimbursement to the Town) . The program shall
include (1) The relay of adult spawning' stock from "deep" water to
"Shallow water" areas, to supplement native spawning, and (2). The
purchase and grow-out of sub-legal size "seed" stock through.
on-bottom and off-bottom cultivation.
Vote of the Town Board: Ayes: Justice Edwards, Councilman.
Townsend, Councilman Murphy, Councilman 'Murdock; Supervisor Pell.
This resolution was declared duly ADOPTED.
COUNCILMAN TOWNSEND: Bill, you might explain. what this is all•
about and it represents an. expansion of the Town program.
SUPERVISOR PELL: Okay. You're doing a good job, Councilman,
go right ahead, take it from square one.
COUNCILMAN TOWNSEND- I think actually Frank has pushed - the
second one. We have right now. in the offing. two clam. programs.
One that has been going on for several years in Town, and is
just the transplanting of large adult clams known as chowder
clams from deep water that has no.t been certified--usually from .
water that is not- certified usually as a claming area--into our
waters and after they're kept there for a certain period of time.,
thirty days, then our residents -and baymen are allowed to clam.

The second is A program.-that Franks,,has,:been to the Board for some
time, it is a, seed clam program ''wfiich allows for the development
of pre-adult clams in certain wooden frames. I think the contract
is for some 68 , 000 of these clams to be grown and added to- regular--
. to. the creek bottoms in our creeks and bays. The significance of
this resolution is that we Ere getting half of it, a total of„up
to $4, 000. 00 from the Grant-In-Aid Program through the Department
of Environmental Conservation. The other. $4, 000. 00 comes from
our budget .
SUPERVISOR PELL: Thank you. On Number 8 (Affirmative' Action .
Plan) I want to apologize to Mr. Randall who is here with us
today. This was on the agenda for adoption today. The plan
was submitted to the Board. Councilman Nickles, who is not
with me today, he is in Albany, wants to sit down prior to it
and go over certain aspects of the plan with you, Charlie. And
so he asked me if the Board would table it Until March '9th to
have you come out. I apologize for not calling you this. morning
or yesterday when I talked with John before he left for Albany
and telling you that we were going to wait until he got back to
bring it up. I would like to set a. date with you on Monday,
March 8th at 3: 00 P.M. to be here. The Town -Board. will meet
then and it will be on the agenda to discuss it with- the entire
Town Board. I know you're disgusted. You wanted it to go through
and I led you to believe it would and I apologize for that, but.
John is in Albany and I do respect another Councilman' s wish on
this subject. Anything you would like to ask the Board or add?

SUPERVISOR PELL: That ' s one out of six, yes, and he had- some
questions and he wants to discuss them with you. I told. him---
MR. RANDALL: This is a very important matter for us. It '.s been
over a year that we' ve been dealing and negotiating and discussing
this. I, therefore, certainly wouldn' t be- too upset with. a little
delay, but that ' s all it should be is a slight delay.
SUPERVISOR PELL: We agree, Charlie, and the Town Board's working
session will, start, as it did this week, on the 8th at 3: 00 P.M.
MR. RANDALL: I will be' there on that date.

COUNCILMAN MURDOCK: What ' s the reason for us being here.. in session
Monday the 8th? We had extenuating circumstances two weeks ago
pertaining to the Robins Island issue. I -for one am not' pr,epared
to be here on Monday, March the 8th. You didn' t bring it up:;, n
the working session at all to, discuss-it. I don't know if this
was your plan---

SUPERVISOR PELL: Charlie, I will get. in touch with you and let

of the 8th or or Tuesday, morning first thing.

authorizes Building Inspector Curtis Horton to attend the
Seventh Annual Building Officials School to be held April 26,

for travel, meals and lodging shall be a charge•. against the
Town of Southold in an amount not to exceed: $250. 00.

authorizes the Board of Commissioners of the Fishers Island Ferry.
District to award the bid for drydocking M/V' s Munnatawket and
Olinda to Thames Shipyard and Repair C. at a contract price of
$11, 030. 00 for the application of . epoxy marine paint system, plus
$40. 00 each for sacrificial anodes on the M/V Munnatawket and
$6, 690. 00 for the application of regular marine paint, plus $40. 00
each for sacrificial anodes on .the M/V Olinda, and be it further
RESOLVED that the Town Board authorizes the following supplemental
work dependent upon conditions found at the time of drydocking:
A. 'Ins,pect and renew, if required, strut bearings at a cost
of $500. 00 each.
B. Pull both shafts for inspection and gauging at a cost of
$900. 00 each.
C. Platework at a cost of $20. 00 per hour, plus $. 30 per
pound, and be it further
RESOLVED that the Town Board authorizes the Board of' Commissioners
of the Fishers Island Ferry District to enter into a contract with
Thames Shipyard and Repair. Co. to accomplish the abovementioned work.

in regard to the State Environmental Quality Review Act in. the

unauthorized use of a Town automobile assigned to James McMahon,
Youth Coordinator : Mr. McMahon shall immediately reimburse the
Town of Southold the sum of $80. 00, which represents 400 miles
at 20� per mile, and a documentation of the reason for this
disciplinary action shall be placed in Mr. McMahon' s personnel
file.

MR. HENRY LYTLE: I would like to speak on behalf of the Southold-
Peconic Civic Association. Is there any news about what ' s going
to happen to the Pine Crest .Dunes Camp?
SUPERVISOR PELL: Last scuttle-but I got on that the County--and
Town Board members correct me if I'm wrong--the County is looking
for a lessee for it for the summer. SCOPE has taken a good part
of- the time. . SCOPE is an educational outfit working with all the
schools around here. They are very much interest and I think
they have signed up for an extended period of time over what they.
had last year. But I do not know if they signed up for the whole
summer season or what . But SCOPE is involved with it.
MR. LYTLE: One other thing. Have you appointed your Chairman
of the Street Lighting Committee?
SUPERVISOR PELL: The Chairman, yes, Councilman Murphy.
MR. LYTLE: Councilman Murphy, we have with us today the Chairman
of the Street Lighting Committee of the Civic Association and she
Wants to get together with you sometime. We have some things to
discuss.
COUNCILMAN MURPHY: If you have time right after this meeting, I 'd-
