SOUTHOLD TOWN BOARD
AUGUST 9, 1983
WORK SESSION
9:00 A.M. - The Board audited the outstanding vouchers..
9: 35 A.M. - The Board met with Chief- Winters to discuss an
increase in salary for Bay Constable Czelatka for 1984. The
Board will consider the request when preparing the 1984 Budget:
9: 50 A.M. - Community Development Administrator 'James McMahon
discussed the proposed addition to the Southold Town Dog Pound
and the possibility of hiring Architect Garrett Strang to draw
the plans. The proposal was approved.--Mr. McMahon also advised
the Board that the Division for Youth which funds the Youth Bureau,
and in turn funds Southold Town Youth Projection is allocating the
same $10,000 for 1984 for youth programs at the Recreation Center,
but those funds must be used on specific individuals. The Town
must . now come up with specific programs to meet the needs of these
individuals for counseling, etc. There will no longer be a general
youth program at the center in 1984. Mr. McMahon is meeting on
Thursday with the YMCA who might be willing to fund a program' in
Southold Town for a. few years. He feels the time has come for
Southold Town to have a recreation program included in the annual
budget.--Mr. McMahon also discussed the Year X Community Development
budget and revisions, and the proposed revolving loan for the Cross
Sound Ferry.
10: 30 A.M. - 1llerlon Wiggin and Historian Magdaline Goodrich met
with the Board to request funding for a Tercentenary Parade. ' The
Board does not have funds in the budget to fund this parade and
suggested the Parade Committee raise funds from the business
community. Further, at this point in time, there does not appear
to be enough enthusiasm for such a parade and unless the scope
can be reduced it was suggested the parade be cancelled.---Mrs.
Goodrich referred to the Bicentennial quilt which is being
displayed in the meeting hall and requested the Board to formally
accept it and send a letter of appreciation to Janice Robinson,
the donor.
10: 45 A.M. - Assessor Chairman Henry Moisa spoke to the Board about
the pending agreement between the Town and the New York State
Department of Equalization and Assessment for computer processing
of the Southold Town Tax Roll for the period from April 1 , 1983 .
through April 1, 1984. It was decided to reduce the agreement
to December 31, 1983 to allow for the possibility this computer
processing may be done in-house after the first of January. (See
Resolution No. 24) .
11:20 A.M. - Mr. Sam McLendon of Holzmacher, McLendon & Murrell , P.C.
met with the Board to bring them up to date on, the water district
feasibility study in the Captain Kidd Water District , 11attituck.
At the present time Mr. McLendon cannot get a commitment from the
owner on a sale price, but he estimates the market value at $74,000.
There is $1, 500, 000 assessed valuation in the proposed value and
Mr. McLendon estimates the replacement cost of the system at $169, 000
less depreciation of the water lines. He said the Town has three
alternatives: The Town operate the system, the Village of Greenport
operate the system, or a private operator. It was the concensus
of the Board that they would favor the Town owning the system and
the Village of Greenport operate it . Mr. McLendon will proceed
with the study and present a final report to the Town Board some-
time in September.
12: 10 P.M. - Recess for lunch.
1: 45 P.M. - Work Session reconvened and the Board began reviewing
the agenda.

2: 40 'P.Al. - Mr. John Wickham, Cutchogue, met with-the Board to
discuss his proposed major subdivision known as Sebastian Cove.
He originally filed on March 27, 1978, a public hearing was held
by the Planning,Board on January 9, 1979, and he received preliminary
approval on January 30, 1979. Mr. Wickham feels he should be
qualified for an exemption from the new zoning regulations. He
was advised that there are several developers in the same position
as he and the matter must be presented to a review board, yet to
be established, but in the process of being formulated. Each
application must be reviewed on an individual basis.

A Regular Meeting of the Southold Town Board was held at

Main Road, Southold, New York. Supervisor Pell opened the
meeting with the .Pledge of Allegiance to the Flag.

12. Councilmen ' s reports. Councilmen will make their reports
at this time. Councilman Townsend.
COUNCILMAN TOWNSEND: Not too much. The on-going negotiations with
the Dog Pound seem to be approaching a climax. We 've agreed on the
amount that ' s going to be invested, the number of new runs that are
going to be put in. Greenport has agreed that as long as we can
get the new runs in by November, to sign the contract which our
Animal Welfare League has set down the terms for and looks like
we' re going to complete that probably within the next month--by
the end of this month. Farmland Preservation Committee met last
week and asked Attorney Tasker for information regarding the
amortization of various bonds amounts. Attorney Tasker supplied
them with that and I think they' ll come up with their preliminary
recommendation--not this meeting but the meeting after that . —Nothing
much else, I 've got some estimates for track lighting which we can
use to perhaps display this lovely quilt and other Southold Town
art works at some point , , if I can find it in the budget again,--
if it hasn' t been lost in the budget. That ' s all , Bill.
SUPERVISOR PELL: Thank you, Joseph. Councilman Murdock.
COUNCILMAN MURDOCK: Last Friday Councilman Murphy and I attended
a meeting in Hauppauge. Commissioner Williams of the D.E.C.
addressing the ten -Town Supervisors, or as many of them as were
in attendance as possible. Particularly talking about municipal
solid waste and the effect that the new law closing landfills will
have in 1990. He had a dialogue with everybody--efforts to increase
cooperation between the D.E.C. and governmental agencies. He seemed
to be very willing to talk on local levels and local issues and I
think everybody that was at that meeting walked away with a little
more positive attitude about the future relationships with the D.E.C.
Two weeks ago Friday we had a Landfill Committee meeting some of
which things we ' re still working on. Vie drew the final plans for
our purchase of equipment and trying to get the bid resolution together
for that . It will be on the next meeting. Worked a little bit on
the blueprint for the building. Everything else is progressing along
well. Thank you, Bill.
SUPERVISOR PELL: Thank you. Councilman Murphy.
COUNCILMAN MURPHY: Just add a little on what Councilman Murdock
had to say. We should have the plans for the building very shortly
and should be prepared to go out to bid very shortly. - We progressing
fairly well, I think, with Captain Kidd Water. We heard from H2M
this morning on the progress of their study and I ' d like to report
that the seed clams are growing fantastic. We 've had far better
results than we 've ever expected and the results of those that we

had planted in the creeks last year - are doing fantastically. We
should, very shortly, almost all of them--90 to 100 percent of them,
should be legal size, which will mean that they will start spawning
and next year we should start really seeing results of this program.

JUSTICE EDWARDS: On Fishers Island they completed the blacktopping
of the basketball courts this past week and they' re just in the
process now of finishing up the entrance. Our seed clam program
on Fishers Island is doing extremely well. Our resident aquaculture
man, Steve Malinowski over there, will be coming before the Town
Board sometime in September and I think he ' s got a-proposition
for. the Town Board where he will be able to sell seed clams to
the Town for about half the price they 've been getting them from
at the Cape. Fishers Island has never been busier than what it
is now. There are over 6, 000 people there. We 've never seen this
type of influx and it has been an extremely busy summer out there.

COUNCILMAN MURPHY: 1. Application of Daniel Silverman for the
construction of an elevated timber pier, ramp and float assembly,
piles and dredging with 10 year maintenance and upland disposal
at Wunneweta Pond off Little Peconic Bay, Nassau Point , Cutchogue.
Comments regarding this permit are to be prepared in writing and
reach the office of the U. S. Army Corps of Engineers by the 17th
of August , 1983. This is posted on the Town Clerk' s Bullein Board-.---
2. Corps of Engineers public notice on the application of
Chester Koloski, Beebe Drive, Cutchogue for maintenance dredging,
Little Peconic Bay. Comments must be received by the Corps in
writing by the 15th of August . Again this is posted on the Town
Clerk' s Bulletin Board.
3. Application of John Bubany, P. 0. Box 49, Southold, for
maintenance dredging, Little Peconic Bay, Cutchogue. Comments must
reach the Corps of Engineers also by August 15th. Again, it ' s
posted on the Town Clerk' s Bulletin Board.
4. U. S. Corps of Engineers application of Peterson Towing
Corp. , Stony Brook, to construct retaining wall and walkway, place
pilings and maintenance dredge at Mattituck Creek. Also comments
must be prepared in writing by the 17th of August , 1983. Again,
this is posted on the Town Clerk' s Bulletin Board.
5. Application for construction of a three foot by seventy-five
foot elevated timber pier over a marsh, and a three foot by twenty-
five foot timber pier extending approximately twenty feet offshore
of the line of mean high water in Mud Creek off Little Peconic Bay,
Cutchogue, by Roger Stoutenburgh, Skunk Lane, Cutchogue. Comments
to the Corps of Engineers within twenty days of the date of this
letter which is July 22nd. This again is posted on the Town Clerk' s
Bulletin Board.
6. Notice of Complete Application of Walter E. Glasser, Jackson
Street , New Suffolk to subdivide a 71,250 square foot lot into two
lots of 43,000 square feet and 28,250 square feet. An existing
garage is to be converted into a one family dwelling approximately
290 ft . from tidal wetlands. Project is located on property .
bounded by Fourth Street , Jackson Street and Third Street , New
Suffolk. Comments to the New York State D.E.C. by no later than
August 12, 1983. This again is posted on the Town Clerk' s Bulletin
Board.
7. Notice of Complete Application of George Wieser, Harbor
Lane, Cutchogue, Tidal Wetlands Permit , to construct an 18 ft . by
34 ft. kidney shaped swimming pool with 51 ft . setback from tidal
wetlands. Comments to New York State D.E.C. by August 12, 1983.

14(a) . From the New York State Department of Transportation
repealing the 40 MPH linea speed on Oaklawn Avenue as Oaklawn Avenue
is now being included in the 35 MPH area speed covering the Southold,
Bayview and Cedar Beach areas.
14(b) . From the New York State Department of Transportation
amending the 35 MPH area speed limit to include Bayview and Cedar
Beach areas of Southold.
III . COMMUNICATIONS.
1. From Utica Mutual Insurance Company who came out and
surveyed all the Town buildings and they do make recommenations .
how to improve safety in the Town buildings.
2. From Suffolk County Department of Health Services
transmitting the Executive Summary, North Fork Water Supply Plan,
March 1983.
3. From the Southold Town Promotion Committee requesting
$800. 00 from the Town to help them advertise Southold Town. The
Town Board has instructed me to give them a negative reply where
we already have granted them $3,000. We are planning to use the
remainder in that account for the celebration of the 300th
Anniversary of the county.
4. From The Long Island Rail Road informing us of a new train
service they are going to put on and take some off and the change
that will go into effect this fall.

5. From the Mattituck Fire Department inviting the Town Board
to participate in a parade to be held in Mattituck on August 13 at
3: 00 P.M.
6. Letter from Union Carbide Corporation thanking the Town
Board for making space available in Town Hall for them to put on
their little show and tell on the chemicals they use. It was
interesting point here--when they came out to the Town Board and
said they were going to hold this show up in Riverhead in the Suffolk
Community College your Town Board said, fine, we would like it to be
held in Southold Town, make it available for our Town residents here.
Of all the five east-end towns involved they had the best turn-out
of people in Southold Town. Eighty people came out to discuss Temik
with them.
7. From Aliano' s Beachcomber Resort Motel & Restaurant asking
the Town Board to assist them in a parking problem up there.
8. From Long Island Cablevision saying the survey they have
made--they have 400 cards back so far and it is going well. . To
early to have any conclusions at this time.
9. From the Town Clerk to be put into the official report of
the Town: Transmitting Abstract of Resolution No. 23, Town of
Southold, Suffolk County, New York, and Proposition for Submission
of Resolution which is to be placed on the voting machine ballot
strip and absentee ballots for the November 8, 1983 General Election
in Southold Town - to change the term of office of the Trustees
from two years to four years.
10. From H2M who works with the Town telling us that we should
consider providing liability insurance for our landfill.
IV. PUBLIC HEARINGS. - At 8: 00 P.M. there will be three public

RESOLVED that the Town Board of the Town of Southold has inspected
the property of R. J. and F. A. Dehaan, known as "Cranberry Acres
at Bayview" , located on the north side of Cedar Beach Road, Southold,
New York, containing 24. 25 acres, and approves said property as
being developed in the cluster concept . Complete legal description

SUPERVISOR PELL:, Resolution No. 2 (request of Alexander Kaminski
to extend his Wetland Permit for one year) the gentleman will have
to submit a new application according to the Town Attorney. It
cannot be extended.
3. Moved by Councilman Townsend, seconded by Councilman Murdock, it was
RESOLVED that the Town Board of the Town of Southold hereby goes
on record as supporting a 1. 33 foot increase in clearance of the
Jockey Creek Bridge, Southold, for waterway traffic, and authorizes
and directs the Town Clerk to transmit a certified copy of this
resolution to Suffolk County Legislator Gregory J. Blass.

4. Moved by Councilman Murdock, seconded by Councilman Murphy, it. was
RESOLVED that the Town Board of the Town of Southold declare itself
lead agency in regard to the State Environmental Quality Review Act
in the matter of the petition. of Alfred E. and Claire Bouffard for
a change of zone from "B" Light Business District to "C" Light
Industrial District on certain property located on the south side
of Westphalia Avenue, Mattituck, New York.

Townsend, 'Councilman Murphy, Councilman Murdock, Councilman
Nickles, Supervisor Pell.
This resolution was declared duly ADOPTED.
5. Moved by Councilman Murphy, seconded by Justice Edwards,
WHEREAS, a petition was received from Alfred E. and Claire Bouffard
requesting a change of zone on certain property at Mattituck, New
York, said petition for a change of zone from "B" Light Business
District to "C" Light Industrial District , now, therefore, be it
RESOLVED that the Town Clerk of the Town of Southold be and she
hereby is directed to transmit this application to the Southold
Town Planning Board in accordance with Article XV, Section 100-150(B)
of the Code of the Town of Southold.

Chapter 100 of the Southold Town Code (Zoning) is hereby amended as follows_
l. .Section 100-31 thereof is hereby amended to read as follows:
Section 100-31 - Bulk and Parking Requirements
No building or premises shall be used and no building or part
thereof shall be erected or altered in the A Residential 'and
Agricultural District unless the same conforms to the following Bulk
and Parking requirements, to wit:
A. In the case of a lot held in single and separate ownership prior.
to November 23, 1971 and thereafter, with an area of less than
forty thousand (40, 000 sq. ft.) square feet, a single family
dwelling may be constructed thereon, provided that the
requirements of Column A of the Bulk and Parking Schedule
incorporated into this Chapter are complied with.
B. The Bulk and Parking requirements for single family dwellings
as set forth in -Column A-40 of the Bulk and Parking Schedule
incorporated into this chapter shall apply to the following lots,
to wit:
(1) All lots shown on Major and Minor subdivision maps which
were granted final approval by the Planning Board

D. The Bulk and Parking requirements for two family dwellings set
forth in Column A-160 of the Bulk and Parking Schedule
incorporated in this chapter shall apply to the following lots, to
wit:
( 1) All lots shown on Minor, subdivision maps which have been
granted sketch plan approval by the Planning Board on or
after May 20, 1983.
(2) All lots shown on Major subdivision maps upon which` the
Planning Board has held a hearing for preliminary approval
on or after May 20, 1983. --
(3) All lots setoff or created by Approval of the Planning
Board on or after May 20, 1983:
II . Section 100-34 thereof is repealed.
III .- The "Bulk and ParkingSchedule" applicable to the "A" Residential and"
Agricultural Districts is amended to read as follows, to wit:

RESOLVED that the Town Board of the Town of Southold hereby .
appoints Kevin I . Lynch A Southold Town 'Pol1ceOfficer, effective
August 10, 1983, for a one year probationary .,beriod, at a salary .
of $7,500. 00 per annum.

RESOLVED that the Town Board of the Town of Southold hereby -.-
appoints Howard W. Sawicki a Southold Town Police Officer, effective
.August 10, 1983, for a one year probationary .period, at a salary of
$7,500.00 per annum.
