©4 1,2ETING OF DECEMBER 30, 19.54. The Southold Town Board met at the office of Supervisor Norman E. Klipp at Greenport, on Tuesday, December 30, 1954. The meet- ing was called to order at 1:30 P.M. with the following present : Supervisor Klipp; Justices Tuthill Albertson Clark and Demar- est; Superfintendent of Highways Price; Town Attorney Terry and Town Clerk Booth. Moved by Justice Albertson; seconded by Justice Clark:, RESOLVEDt That the minutes of the previous meeting be and here- by are duly approved as read. Vote of Town Board: Ayes-Supervisor Klipp; Justices Tuthill.,. Albertson, Clark and Demarest. The Board audited a bill of Otto W. VanTuyl in the amount of $200.00. Moved by Justice Tuthill; seconded by Justice Demarest: RESOLVED: That General Bill in the amount of $200.00 be and the same is hereby ordered paid. Vote of Town Board: Ayes-Supervisor Klipp; Justices Tuthill, Albertson, Clark and Demarest. Moved by Justice Albertson; seconded by Justice Clark: , RESOLVED: That the organization meeting of this Board will be held at the office of Supervisor Norman E. Klipp at Greenport, Jan. 4, 1955, at 11; 30 P.M. Vote of Town Board: Ayes-Supervisor Klipp; Justices Tuthill, Albertson, Clark and Demarest. Supervisor Klipp ordered an executive session of the Town Board to audit the accounts of the Town Officers. Vote of Town Board: .Ayes-Supervisor Klipp; Justices Tuthill, Albertson, Clark and Demarest. 206 Patrick 'Gorman appeared before the Town Board . in regard to a letter he had recently written the Board alleging that on or about December 14, 1954, at approximately 5:30 P.M. at the Cutchgoeu Service Station Chief Otto .Anrig had used vile , obscene and threatening language toohim, and stating that the requirements of the Town Law required that Chief Anrig be brought up on charges within 60 days after he had made known the facts . The Supervisor read- the Town Board Mr. Gorman' s letter, undated, which is as follows : "Town Board Town of Southold Southold, N.Y. Gentlemen: As a law-abiding resident of the Town of Southold and for the benefit of all residents of the Town, I feel obliged to prefer charges against� Chief of Police Otto .Anrig of conduct so serious as to affect his fitness for office and conduct to the predjudice of the good order , efficiency and discipline of the Southold Town Police Department. On December 14, 1954, at about 5:30 P.M. at the Cutchogue Service Station, in the presence of two other individuals , and while he was in uniform, Chief .Anrig used vile and obscene language twards me and made threats against me. I will not put the exact words used in this letter, but I shall attend the next Town Board meeting and personally inform you of the language used and the threats made , and I shall be available to testify under oath at the time you conduct a hearing on the charges. Your attention is respectfully directed to the require- ments of the Town Law that the charges must be brought within sixty (60) days after I have made the facts known to you. Gorman" On Mr. Gorman's request, the Supervisor indicated that he had no objection to Mr. Gorman speaking to the Town Board berbally on the matter, but informed Mr. Gorman that if it were his desire to bring anyone up on charges , he should submit a written complaint in the proper form and state the section of the Town Law he had referred to in his letter. Klipp Supervisor of the Town of Southold 16 So.:th Street Greenport, New York RE : Public Hearing held by Tempory State Commission to study, codify and revise Laws Relating to Town and Village Government , held at Supervisor 's Meeting Room, Old Court House, Mineola, New York,on Wednesday, Dec . 22, 1954, at 10:30 A.M. Dear Mr. Klipp; In accordance with your request, I attended the above mentioned hearing at Mineola on December 22, 1954, and -tkR have the 201 following to report: Because of the poor attendance the meeting did not statt until about 10:45, at which time it was opened by Senator John H. Cooke who immediately turned the meeting over to' Senator Edward F. Larkin. Other members of the committee who were present were Assemblyman Ward, Assemblyman Eagan, Senator Donovan, Mr. Morgan Stron and Mr. Edward F. N. Utho who , as you know, is the Executive Secretary of the Assoc- iation of Towns . Also present were the counsel and assistant counsel to the committee , Mr. John Delius , who is the Town .Attorney of the Town fo Mamaroneck, and Mr. Harold Kelly, an attorney of Depew, New York. The first person to be heard was Mr. William Parrott, who is the 'Millage Clerk of Patchogue, and.,in addition to appearing on behalf of the Tillage he also represented the Suffolk bounty Village Officials Association which had previously met on December 9th and authorized him to appear. Mr. Parrott confined his tally Pri- marily to the Town of Brookhaven, and presented to the Commission a table representing the services that the Village claims to receive from the Town. His main concern seemed to be with items numbered 2, 3 and 4 of the highway budget and in that regard he indicated that the Village Officials Association had passed a resolution recommending that there be some form of equalization to provide relief tothe Village ( a point which I felt was rather ably rebutted by Mr. Edward Utho by the questions which he put to Mr. Parrott at the end of his talk) . Mr . Parrott also requested that the villages be excluded from paying town charges for police and also mentioned the matters of home relief, and school district superintendents , about which he did not appear to be too familiar. After Mr. Parrott had spoken, the Chairman asked if there was anyone else from Suffolk Uounty who wished to be heard, whereupon I stated to the Commission that I appeared as attorney for the Town of Southold on behalf of Supervisor Klipp, who at the last minute found himself unable to be present. I spoke very briefly as far as the Town Police charges were concerned, and that you wished to let the Com- mission know that you hoped they would not go too far in the matter of changing the existing Town Law. I then indicated that a matter of grave concern to us was the provisions relative to the extention of village boundaries and explained that while you did not wish to hamper the growth of tillages the Town Board felt that the expansion should be accomplished in an orderly manner without any gerrymandering inso- far as possible. The only questions put to me were whether I was familiar with Chapter 18 of the Laws of 1954 relative to the extention of village boundaries in Nassau County, which I had to indicate that I was not, and questions ad to the manner and technical operation of the collection of school distrct taxes . Supervisor Paul Gibbon of Smithtown then spoke very brief- ly indicating that he has three incorporated villages in his town . He did not appear to have anything to offer and was apparently not seeking any information either. John P. Dohalan, Esq. , attorney for the Town of Islip, then spoke briefly on the matter of special districts and indicated that he is taking up with Assemblyman Barrett a proposal to empower the town'.,boafd, subject to a permissive referendum, to set up special districts such as garbage collection districts , etc. , without the elaborate procedure of petitions as now required (I have mentioned this matter to Senator Horton and he has indicated that he is well aware that such proposal is being offered) . Mr. Charles Matthews , Deputy Town Attorney for the Town of Huntington then spoke briefly; and he was followed by Richard J. Fraf, Village .Attorney of the Village of Northport , who supported Mr. Parrott and recommended that the study of the Commission be continued. 08 There being no further representatives from Suffolk �'ounty, the Commission then stated that it would hear from representatives of Nassau County; and the first man to speak was Mayer W. Harry Lister of Rockville Centre (who is the owner of property known as Boat- men's Harbor, Fleets ' Neck, Cutchogue, in the Town of Southold) . Mr. Lister was not too familiar with matters pertaining to town government , but was concerned about state aid distribution to villages , the formula used for apportionment of mortgage taxes , and certain annexation problems , his main complaint being that every year his population increases byt his state aid decreases. He was questioned by Mr. Anthony Sansone, Counsel of the Village of Mamaroneck, in regard to his annexation problems; and he was followed by a Mr. Harry Wellable who represented the Nassau County Village Officials Asscoiation and requested reconsideration of the so-called "Moore Plan" . He suggested that the use of the word "aid" be discontinued and indicated that he liked to fefer to it as state collected taxes . It was now 12:30 and the Commission asked whether we wished to continue or to adjourn for lunch and then resume after lunch. Since there was apparently only one speaker left the Commission continued and John A . Morhouse , Esq. Town .AtL rney of the Town of Hempstead , read a prepared statement concerning principally the matter of annexation anddSection 348 of -t'n.e Village Law, which he called basically unsound, and Section 355. 20 of the Nassau Administrative Code. He indicated that the Appellate Division of the Second Department has held that the town board has no power to withhold its consent and is relegated to the position of town clerk in the matter of giving consent under Section 348 of the Village Law, and that he feels very strongly that this section should be changed and should also contain some provisions for continuing liability for previous- ly incurred debts by the area which is annexed. Aside from the -fact of reading his memorandum, Mr. Morhous6s talk was nost pertinent and ably presented; and before the hearing adjourned I again indicated to the members present that the Town of Southold wholeheartedly supported the position taken by Mr. Morhouse and requested that the Commission give serious consideration to changing the provisions relative to 'annexation.
