Board of 'Appeals was held 7:30 P.M. , Thursday, . June 29, 1961 at the Town Clerk Office, Main Road, . Southold, New York. There were present: Messrs. Robert W. Gillispie, . Jr. , . Chairman, . Robert Bergen, and Herbert- Rosenberg. Absent: Messrs. Charles Grigonis, Jr. , . and Serge -Doye; Jr. Also present: Mr. Howard M. Terry, Building Inspector. PUBLIC FEARING: Appeal No. 389 _- Upon application of Harold-R. Reeve & Sons, . Main Street, Mattituck, New York, a/c John and Marie Kloppenberg, Cedar Lane, Mattituck, New York, for recognition of 'access in accordance with .State of New York Town. Law, Section 280A. Location of property: north side Cedar= Lane, .Mattituck, New York, bounded north by Muttitt, east by Suter, south by Cedar-Lane, . and west by-Demchuk and Jackowski. Fee -not required for- access. The 'Chairman opened the hearing by reading application for a variance, legal notice of hearing and affidavit attesting to its publication - in the official newspaper. Southold Town Board of Appeals -2- June 29, 1961 THE 'CHASRMAN: Is there anyone present who wishes to speak - for this application? (There was no response. ) THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (These was no response. ) MR. ROSENBERG: Is this the only access to the lot? MR. HOWARD TERRY: Yes, it is. The Board finds strict application of the Ordinance will produce practical difficulties or unnecessary hardship because this is the only possible access to the lot in question. -The hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district because this is one of the shortest private roads in the area and the lot in question is the furthermost lot on the road. The variance does observe the spirit of the Ordinance and would not change the character of the district because this lot is of sufficient size and a dwelling in keeping with the area will be erected, therefore On motion of-Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED that Harold R. Reeve & Sons, a/c John & Marie Kloppenberg be granted recognition of access in- accordance with State of New York Town Lawr Section 280A, to property on the north side Cedar Lane, Mattituck. This access is 35 ft. in width running from Grand Avenue east along land of Demchuk and Kloppenberg on the North and Hansen and Muttitt on the South and ending at the land of Suter. The length of this access is approximately 258 ft. Vote of the Board: Ayes:- Mr. Gillispiet Mr. Bergen, and Mr. Rosenberg. 'Mr. Robert'.Ketcham appeared before the Board of-Appeals and presented a letter requesting that his application for a special Southold Town Board of Appeals -3- June 29, 1961 exception on behalf of the Coronet Restaurant, Appeal No. 361, be cancelled. On'motion of Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED that the Board of Appeals accept the letter of Robert Ketcham requesting the cancellation of Appeal No. 361 on behalf of the Coronet Restaurant. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. Mr. Ketcham next spoke . to the Board with reference to erecting a sign on the property of Fismer for the Crescent Beach Colony. He stated the wording would be: "In East Marion, Crescent Beach Colony Motel, Efficiency Apartments. " The Chairman stated he thought the wording would be acceptable. Mr. Ketcham stated he would check with theCrescent Beach Colony and submit his application before the next Board of Appeals meeting. Mr. Ketcham brought up the matter- of Topper Beer signs being erected on the property of. Krukowski in Southold and also Telles in Greenport. This matter was turned over to the Building Inspector for his attention. In a brief discussion relative to size of directional signs Mr. Ketcham stated he is of the opinion 32 sq. ft. signs would be much more attractive and pleasing to the eye. He does not believe billboards are necessary and that small signs are much more dignified. ' Mr. Ernest E. Belfi appeared before the Board of Appeals to file for a variance to the Zoning Ordinance to reduce his easterly side yard. Mr. Belfi erected an addition to his house 11' 3" from the side yard rather than 15 ft. as required by the Zoning Ordinance. Mr. Belfi stated that he did not file for a building permit because he was under the impression that his original permit for the house , covered any future construction. He stated that the -main part of the house was erected by Lido Construction.Company and he had instructed them to locate the house at least 15 ft. from the westerly property line. After' he completed this new addition he found that the westerly line was only 11 ' 2" and he had violated the easterly side yard restriction of 15 ' by having only an 11 ' 3" easterly side yard. Southold Town Board of Appeals -4- June 29, 1961 Mr. Noel Albrecht, . Mattituck, appeared before the Board for an informal discussion relative .to starting an amusement to ter- prise in Mattituck west of the Mattituck Lanes Bowling Alley. He planned to have a miniature golf driving range and a custard stand. He also was considering a go-cart track on the rear of the lot. The Board discussed the noise element and safety factory of a go-cart track. Mr. Albrecht had not looked too far into the project:, and stated he would .try to obtain more information and speak to the Board again. On motion of Mr. Bergen, seconded by Mr. Rosenberg, the Board set 7: 30 P.M. (E.D.S.T. ) , Thursday, July 13, 1961, Town Clerk Office, Main Road, Southold, New York, as time and place for hearing upon application of Ernest E. Belfi, 165 Clearland Avenue, Rockville Center, New York, for a variance in accordance with the Zoning Ordinance, Article III, Section 307, for permission to reduce side yard. Location of &roperty: south side Waters Edge Way, Lot No. 5 on Map of Terry aters, Southold, New York. Vote of the Board: Ayes: - Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. On motion of Mr. Rosenberg, seconded by Mr. Bergen, the Board set 8: 00 P.M. (E.D.S.T. ) , Thursday, July 13, 1961, Town Clerk Office, Main Road, Southold, New York, as time and place for hearing upon application of Robert L. Bergen, Main Road, Mattituck, New York,. for a special exception in accordance with the Zoning Ordinance, Article VIII, Section 801-C, Subsection II (a) , for permission to adjust the boundary line into the more restricted area. Location of property: north side Route 25, Mattituck, New York, bounded north by Railroad, east by Tidewater Realty, south by Main Road, and west by Herman Hubbard. Vote of the Board: Ayes: - Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. It was further 'RESOLVED that legal notice of hearing be published in the official newspaper July 7, 1961. Vote of the Board: Ayes: - Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. The minutes of the meeting of June 22, 1961, on motion of Mr. Gillispie, seconded by Mr. Rosenberg, were approved as submitted. Southold Town Board of'Appeals -5- June 29, 1961 Vote of the Board: Ayes: - Mr. Gillispie, Mr. Bergen, and M r. - Ros enberg. The next meeting of the Southold Town Board of 'Appeals will be held 7: 30 P.M. , Thursday; July 6, 1961, at the Town. Clerk Office, Main Road, Southold, New York. Meeting adjourned at 11: 00 P.M.
