SOUTHOLD TOWN BOARD OF APPEALS
July 6, 1961
A regular meeting of the Southold Town Board of
Appeals was held 7:30 P.M. , Thursday, July 6, 1961,
at the Town Clerk- office, Main, Road, Southold, New York.
There were present: Messrs. Robert-.W. Gillispie, Jr. ,
Chairman, Robert Bergen, and Herbert .Rosenberg.
Absent: Messrs. Charles Grigonis, Jr. , and' Serge
Doyen, Jr.
Also present: Mr. Howard Terry, Building Inspector.
PUBLIC HEARING: Appeal No. 390 - 7:30 P.M. (E.D. S.T. ) ,
upon application of Florence Ziegler, Bay Avenue, . East Marion,
New York, for a special exception in accordance with the Zon-
ing. Ordinance, Article III, Section 300, Subsection 11, for
permission to erect and maintain directional sign on the
propertyof Joseph and Sophie Cherepowich, corner" of= Shipyard
-Lane and .Route 25, East .Marion, New York. X Fee paid $15. 00.

The Chairman opened the hearing by reading application for
a special exception, legal notice of hearing, affidavit attesting
to its publication in the official newspaper and letter of per-
mission from the property owner.
THE' CHAIRMAN: Is there anyone present who wishes to speak
for this application?
MR. CHARLES ZIEGLER, Bay Avenue, East' Marion, New York: The
size of the sign will be 4 ft. by 8 ft. , possibly smaller, with the
words "Cozee Cove Cottages, i Mile, Turn Right at Firehouse. " It
will be located 35 ft. from Old Shipyard Lane.
THE 'CHAIRMAN: How far'will it be from the Main Road?
MR. ZIEGLER: It will be 14 ft. in from the highway. The
owner is going to take down a broken tree and that is where the
sign will be. The sign will be deeper into the woods than the
other signs in the area.
THE CHAIRMAN: How many signs do you have?
MR. ZIEGLER: We do not have any for the moment except for
the one on our property on Bay Avenue.
THE CHAIRMAN: Is there anyone present who wishes., to speak
against this application?
(There was no response. )
The Board finds that the public convenience and welfare and
justice will be served and the legally established or permitted
use of neighborhood property and adjoining use districts will not
be permanently or substantially injured and the spirit of the
Ordinance will be observed, therefore
On motion of Mr. Gillispie, seconded by Mr. Bergen, it was
RESOLVED that Florence Ziegler, a/c Cozee Cove Cottages, Bay
Avenue, East Marion, be granted permission to erect and maintain
dirdctional sign on the property of Joseph and Sophie' Cherepowich,
south side Route 25, East Marion, 35 ft. east of Shipyard Lane and
14 ft. south of Route 25. Dimensions of this sign to be 4 ft. by
8 ft. and not to exceed 50 sq. ft. in area. Exact wording to be:
"Cozee-Cove Cottages, % Mile, Turn Right at Fire House. "

This sign is subject to the same regulations and controls
which affect non-conforming signs.
Vote of the Board: Ayes: - Mr. Gillispie, Mr. Bergen, and
Mr. Rosenberg.
Mr. Ziegler discussed erecting a sign on the residential
property of Ray Dean opposite the post office in East Marion.
The Board felt that this sign location would be unsatisfactory
due to the fact it is on residential property.
Mr. Ziegler also discussed the possibility of putting a
sign at each of the entrances to his property on Bay Avenue.
The Board felt- a sign with the single word "Entrance"or one
with the word "Exit" would be permitted.
PUBLIC HEARING: Appeal No. 39 1 - 7:45 ' P.M. (E.D.S.T. ) , upon
application of The Church of the Redeemer, Sound and WestphaliaAvenues, Mattituck, New York, for a special exception in accord-
ance with the Zoning Ordinance, Article III, Section 300, . Subsec-
tion 11, for permission to erect and maintain a sign on the property
of James B. Wasson, southwest corner of Sound Avenue and Aldrich
Lane, Mattituck, New York. No fee - religious organization.
The Chairman opened the hearing by reading application for
a special exception, legal notice of hearing, affidavit attesting
to its publication in the official newspaper and letter of permission
from the property owner.
THE CHAIRMAN: Is there anyone present who wishes to speak
for this application?
REV. FERDINAND D. SAUNDERS, The Church of the Redeemer,
Mattituck, New York: The reason for wanting the sign is to basically
serve the visitors to the area. Our church building is located in
a place other than the Main Road and we have had many experiences
of people having difficulty finding us and some of them have been
in and out of Mattituck without realizing there is a church located

there. The property adjoining the church has a barn on it and
the trees and shrubbery is grown up.
This particular sign we desire to erect .is a sort of signal
to the Episcopal Chu,-h people. It is a sign that is used through-
out the country.
THE CHAIRMAN: How far away from the church is the sign to be
located?
REV. SAUNDERS: Approximately z mile at the west entrance to
the Town.
THE 'CHAIRMAN: Do you have any other signs ?
REV. SAUNDERS: We have one other sign on the property of Mrs.
Chew on the south road. We share that sign with the Mattituck
Presbyterian Church and Mattituck Lutheran Church.
THE CHAIRMAN: What is the size of the sign you wish to erect?
REV. SAUNDERS: 24 in. by 30 in.
THE CHAIRMAN: Is there anyone present who wishes to speak
against this application?
(There was no response. )
The Board finds that the public convenience and welfare and

granted
RESOLVED that the Church of the Redeemer be/permission to erect
and maintain sign on the property of James B. Wasson, southwest corner
of Sound Avenue and Aldrich Lane, Mattituck, New York. Size of the
sign to be 24 inches by 30 inches and to be located at least five feet
from any property line. Wording: "The Episcopal Church Welcomes You,
. Church of the Redeemer, Sound and Westpahalia Avenues, Mattituck, Long
Island. "

application of The Church of- the Redeemer, Sound and Westphalia
Avenues, Mattituck, New York, for a special exception in accordance
with the Zoning Ordinance,, Article III, . Section 300, Subsection 11,
forpermission to erect and maintain a sign on the property of
'Elizabeth G. Horton, south side Main Road, . Peconic, New York,
bounded north by Main Road, east by J. Krupski and Klos, south
by-A. V. Doroski, and west- by Grygielko. No fee - religious
organization.
The Chairman opened the hearing by �reading application -for a
special exception , legal notice of hearing and affidavit .attesting
to its publication in the official newspaper. Letter. of 'permission
from the property owner was also read.
THE CHAIRMAN: Is there anyone present .who wishes to speak
for this application?
REV. FERDINAND D. SAUNDERS, The Church of the Redeemer,
Mattituck, New York: our main reason for want the sign at -this
location is to catch the traffic coming from the ferry.
MR. ROSENBERG: Don't you think having the sign on the
south side of.'the road is impractical .for that location?
REV. SAUNDERS: I would prefer it on the north side, °but
on the north side of the road there is a residence and I don't
like to see a sign on residential property.
THE CHAIRMAN: Is there anyone present .who wishes to speak
against this application?
(There was no response. )

On motion of Mr. Gillispie, seconded by Mr. Bergen, it was
RESOLVED that the Church of the Redeemer be granted permission
to erect and maintain sign on the property of Elizabeth G. Horton,
south side Main Road, Peconic, New York, approximately 225 ft. east
of Bay Avenue, . Size of the sign to be 24 inches by 30 inches ard
to be located at least five feet from any property line. Wording:
"The Episcopal Church Welcomes You, Church of the Redeemer, Sound
and Westphalia Avenues, Mattituck, New York: "
This sign is subject to the same regulations and controls
which affect non-conforming signs.
Vote of the Board: Ayes: - Mr. Gillispie, Mr. Bergen, and

PUBLIC HEARING: Appeal No. 393 - 8: 05 P.M. (E.D.S.T. ) , upon
application of The Church of the Redeemer, Sound and Westphalia
Avenues, Mattituck, New York, for a special exception in accordance
with the Zoning Ordinance, Article III, Section 300, Subsection 11,
for permission to erect and maintain a sign on the property of
Arthur N. Penny, north side Middle Road, Mattituck, New York,
bounded north by Martin Sidor, east by John Northridge, south by
Middle Road, and west by Adelaide Tuthill. No fee - religious
organization.
REV. FERDINAND SAUNDERS: I wish to withdraw this application,
On motion of Mr. Gillispie, seconded by Mr. Rosenberg, it was
RESOLVED that' Appeal No. 393, application of The Church of
the Redeemer, be withdrawn upon request of the applicant.
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and
Mr. Rosenberg.

PUBLIC HEARING: Appeal No. 394 - 8:15 P.M. (E.D.S.T. ) , upon
application of The Church of the Redeemer, Sound and Westphalia
Avenues, Mattituck, New York, for a special exception in accordance
with the Zoning Ordinance,- Article III, Section 300, - Subsection 11v,
. for permission to e rect ,and maintain a sign on the property of
Arch and Ann Davis, south side Peconic Bay Boulevard, . Mattituck,
New York, bounded north by Boulevard, east. by J. L. Battenfeld,
south by Peconic Bay and west by'C. E. Smith. No fee - _religious
organization.
REV. FERDINAND SAUNDERS: • I also wish to withdraw this appli-
cation.
On motion of Mr. Gillispie, seconded by Mr. Bergen, it was
RESOLVED that Appeal No. 3942 , application of The Church of the
Redeemer, be withdrawn upon request of the applicant.
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and
Mr. Rosenberg.
Rev. . Saunders asked the Board if 'he would be permitted to
erected cn e of the .24 inch by 30 inch signs on the church property
in Mattituck. He stated he does not have a ground sign at the
presenttime. The Board advised he would be permitted to erect
one .ground sign on the church. property.
. Mr. Stanley Corwh, Greenport, spoke to the Board with reference '
to the application of 'Mr. Constantine King for a special exception
to erect a bowling alley on Moore's Lane, Greenport. The Board
advised that the application is incomplete and they are unwilling
to accept - it. There must be a map of the property showing the
proposed bowling alley and parking area for same, also proof of
ownership. The point was also brought up that Mr. King is planning
to purchase ,a piece of property 20 ft. by 50 ft. from Mr: Albert
.Herzog, . Jr. Mr: Corwin was advised that-Mr. Herzog ,is not permitted
to sell this land and reduce his lot since it is presently undersized.
The minutes of the meeting of. June 29, 1961, on motion of
. :Mr. Gillispie, seconded by Mr. Rosenberg, were approved as submitted.
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and
Mr. Rosenberg.

Board of Appeals set 7: 30 P.M. , Thursday, July '20, 1961, Town

East .Marion, New York, for a special exception in accordance with
the Zoning Ordinance Article III, Section 300, Subsection 11, for
permission to erect and maintain directional sign on the property
of-.A. . W. Fismer Estate, south side Main Road, East of Bay Home Road,
Southold, New York.
Vote of the Board: Ayes: - Mr. Gillispie, Mr. Bergen, and
Mr. Rosenberg.

of =Appeals set 8: 00 P.M. (E.D.S.T. ) , Thursday, July -20, 1961, Town

hearing upon.- application of C. Gray Smith and Hope P. Smith, 39-14
215 Place, Bayside 618 New York, . for a special exception in accord-
ance with the Zoning Ordinan ce,. Article III, Section 300, Subsection
3A, for permission to install marina facilities for private boats.
Location of property: north side Pine Neck- Roadt. Southoldt New York,
bounded north by Creek, south by Frank -Zazeski, east by Ed Worth and
west- by E. A. Lademann.
Vote of the. Board: Ayes:- Mr. Gillispie, Mr. Bergen, and
Mr. Rosenberg.
It _was further 'RESolved that legal notice of hearing be
published in the official newspaper under date of 'July 14, 1961,
