Board of:Appeals was held 7:30 P.M. , Thursday,. August 3, 1961 at the Town Clerk Office, Main Road, Southold, New York. There were present: Messrs. . Robert .W. Gillispie, Jr. , Chairman, . Robert Bergen'. and Herbert. Rosenberg. Absent: Messrs. Charles Grigonis, Jr. , and Serge-Doyen, . Jr. Also present: . Mr. Howard .M. .Terry, Building Inspector. PUBLIC HEARING: Appeal No. 402 - 7:30 P.M. (E.D.S.T. ) , upon application of: Edward .Nidds, . Ma.in Road, Southold, New York, . a/c Hartvig Tjornhom, 741 50th. Street, Brooklyn, New York, for recogni- tion of access in accordance with State- of New York Town Law,. Section 280A. Location of.property: north . side Liberty-Lane, . Southold, New . York, part of lots 61 and 62 on map of Nidds, Reydon Heights, bounded north by-C. J. . Schimanski; east by' Edward Nidds, south by Liberty Lane, ., and west by Edward Nidds. No fee _. access. The' Chairman opened the hearing by reading. application for a variance, legal notice of hearing and affidavit attesting to its Southold Town Board of Appeals -2- .. August 3, 1961 publication . in the official newspaper. THE 'CHAIRMAN: Is there anyone present who wishes to speak for this application? MR. EDWARD NIDDS, . Southold, New York: Yes, I do. I have here the signed contract for the construction of the roads and they started on them yesterday. This is a $14,500 job. . THE CHAIRMAN: We have a copy- of that contract for the file. How many lots are there in this development? MR. NIDDS: Right now there are 20 odd left. THE CHAIRMAN: Are there any other questions? (There was no response. ) THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response. ) Strict application of the Ordinance would produce undue hard- ship and practical difficulties because applicant cannot secure a building permit because this lot is located on an unapproved highway. The hardship created is unique and would not be shared by all properties alike in the Ammediate vicinity of this property and. in. the same use district because Liberty Lane is one::of two roads in this development which is not approved ..by the Town. , A contract to complete these roads has been signed and the roads will'be offered to• the Town of: Southold for.. dedication. The variance does observe the spirit of .the Ordinance and will not change the character of the district because applicant will build a one family dwelling in keep- ing with the area. After investigation and inspection the Board finds that inasmuch as the present unimproved access road Liberty Lane is sufficient for the passage of emergency vehicles and a contract has been signed for the improvement of Liberty Lane so that it- may be joined.-'to the other accepted roads in this open development, the Board feels that a 12 months temporary access should be permitted in order that the appli- cant may begin construction of a residence on the lots. Southold Town Board of.Appeals -3- August 3, 1961 On motion of Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED that Edward Nidds, a/c Hartvig Tjornhom be granted a 12 months temporary access to lots 61 and 62 on the north side of Liberty Lane, . Southold. Lane Permitted access will be from the north end of: Summit/to lots 61 and 62, a distance of approximately 150 feet. Vote of the Board: Ayes: - Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. The Board of Appeals received a letter from William S. Midgley, Jr. , Captain of the United Fire Company, No.], Cutchogue, requesting permission to place posters in the Cutchogue Fire District and some outside of the Cutchogue Fire District for the purpose of. advertising the BarBeCue to be held August 26, 1961. On motion of Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED that the Board of�Appeals grant permission to William S. Midgley, Jr. , Captain, United Fire Company, No. 1, . Cutchogue, New York, to place approximately 75 posters in stores and on the Main Road in the Cutchogue Fire District and a few outside of the Fire District from the 5th of.August 1961 to the 28th of:August 1961, a period of approximately 24 days. These posters to advertise the 5th Annual BarBeCue. It is specifically forbidden to place these posters on utility poles or on private property without permission. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Isenberg. On motion of.Mr. Gillispie, seconded by Mr. Rosenberg it was RESOLVED that the minutes of the meeting of July 27,. 1961 be approved as submitted. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. ; Southold Town Board of Appeal: -4- August 3, 19 The next meeting of the Southold Town Board of Appeals will be held 7: 30 P.M. , Thursday, August 10, 1961 at the Town Clerk Office,.
