There were present: Messrs. Robert -W. Gillispie, Jr. , Chairman, Robert Bergen and Herbert- Rosenberg. Absent: Messrs. Charles Grigonis, Jr. , and Serge' Doyen, Jr. PUBLIC -HEARING: - Appeal No. 407 ­7:30 P.M. (E.D.S..T. ) , upon application of Astrid Heuer, Bray Avenue, . Mattituck, New York, for . a variance in accordance with the Zoning Ordinance,. Article III, S"'ection 303 and Article X,. Section 1000A, for permission to reduce frontage and use as a single lot. ' Location of property: west- side Bray Avenue, Mattituck, New York, Lots No. 95 and 96 on map of George I. Tuthill & ors., Fee paid $15. 00. The' Chairman opened the hearing by reading application for a variance, legal notice of hearing and affidavit attesting to its publication in the official. newspaper. c Southold Town Board of Appeals -2- September 7, 1961 THE CHAIR1AN: Is there anyone present who wishes to speak for this application? (There was no response. ) THE• CHAIRMAN: Is there anyone present- who wishes to speak against this application? (There was no response. )' THE CHAIRMAN: Are there any questions? (There was no response. ) TheaPplicant, Mrs. Astrid Heuer, purchased a home on Bray Avenue in March 1929. September 1943 she purchased two lots, No. 95 and No. 96 on the filed map of George I. Tuthill, survey March 28, 1928. These lots remained unimproved to date. The applicant now requests avariance to enable her to sell lots 95 and 96 as a unit. There are -only four lots on First Street, two of them 50 feet frontage and two approximately 42 feet. After investigation and inspection the Board finds that it would be an unnecessary hardship to deny applicant permission to separate lots 95 and 96 from the Bray Avenue property which has no connection with the First Street lots other than abutting 70 ft. on the rear of 150 feet lot on Bray Avenue which is the side of the 175 ft. First - Street property, as shown on attached map. The situation is unique as no other properties in the immediate area are so located. The character of the area would not be altered as the proposed division would enlarge the lot area as compared to other lots inthe subdivision, therefore On motion of Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED that' Astrid Heuer be granted permission to reduce frontage and use as a single lot property located on the west side Bray Avenue, Mattituck, New Yor7�. Southold. Town Board of:Appeals -3- September 7, 1961 Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. On motion of Mr. Gillispie, seconded by Mr. Rosenberg, it was RESOLVED that the minutes of the meeting of August 24, 1961, be approved as submitted. Vote of the Board: Ayes: - Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. On motion of Mr. Bergen, seconded by Mr. Gillispie, it was RESOLVED that the Board set 7: 30 P.M. , Thursday, September 21, 1961, Town Clerk Office, Main Road, Southold, New York as time and place for hearing upon application of The Orient Central Cemetery Association, Orient, New York, for a specialexception in accordance with the Zoning Ordinance, Article III, Section 300, Subsection 6B for permission to extend the existing cemetery. Location of property: north side Orchard Street, Orient, New York, bounded north by--W. Y. Terry, Jr. , east by Jagger Estate, south by Orchard Street, and west by other land of The Orient' Central Cemetery Association. Vote of the Board: Ayes: - Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. On motion of Mr. Rosenberg, seconded by Mr. Bergen, it was RESOLVED that the Board set 8: 00 P.M. (E.D.S.T. ) , Thursday, September 21, 1961, Town Clerk Office, Main Road, Southold, New York, as time and place for hearing upon application of James Wasson, Peconic Bay Boulevard, Laurel, New York, for a variance in accordance with the Zoning' Ordinance, Article III, Section 303, and Article X, Section 1000A, for permission to reduce frontage and use as a single lot. Location of property: north side Peconic Bay Boulevard, Laurel, New York, bounded north by Marguerite Wasson, east by Edward Booth, south by Peconic Bay Boulevard, and west by Marguerite Wasson. Vote of the Board: Ayes: - Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. r . Southold Town Board of Appeals -4- September 7, 1961 On motion of Mr. Bergen, , seconded by" Mr. Rosenberg, it was RESOLVED that legal notice of hearing be published in the official newspaper on September 15, 1961. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. The Board of Appeals discussed .and agreed upon the following budget to -1�e_, submitted to the- Southold Town 'Board for the fiscal year beginning January 1, 1962: (this represents a nominal increase of $365. 00 over the 1961 estimate) ANNUAL ESTIMATE "SUBMITTED BY "BOARD OF 'APPEALS TOWN OF SOUTHOLD FOR FISCAL YEAR BEGINNING JANUARY 1, 1962 Secretarial Assistance at- Public hearings $ 250. 00 Stationery, form printing and postage 200. 00 Library and Subscription to Zoning Bulletin. - 75. 00 Advertising of legal notices 500. 00 Travel expenses divided as follows: 1. Estimated expenses for three members of Board attendance at- Association of Towns meeting in Buffalo in February . $375. 00 . 2. Estimated expense of Mr. Doyen, Board member from Fishers Island for" attendance at Board meetings in Southold, N.Y. ' $300. 00 3.
