WHEREAS, the proposed site plan, for a 359 sq. ft. radio room addition to the main building and a new 2,762 sq. ft. equipment storage building on a 1.34 acre parcel in the HB Zoning District; and WHEREAS, Mattituck Fire District is the owner of the property, known and designated as Mattituck Fire District, located on the southwest corner of Pike Street and Wickham Avenue, in Mattituck, SCTM#1000-140-3-11.1; and WHEREAS, on February 26, 2004, a formal site plan application was submitted for approval; and WHEREAS, on March 4, 2004, the Architectural Review Committee recommended conditional approval of the architectural drawings and the Planning Board has accepted the recommendation and conditions; and WHEREAS, on March 4, 2004, the Southold Town Zoning Board of Appeals granted a variance as applied for under Appeal Number 5485 and the conditions have been incorporated into the plan; and WHEREAS, on March 8, 2004, the Mattituck Fire District indicated no additional wells or hydrants will be required and the Planning Board has accepted the recommendation for approval; and WHEREAS, on March 9, 2004, the Southold Town Planning Board, acting under the State Environmental Quality Review Act (6 NYCRR), Part 617.5, made a determination that the proposed action is a Type 11 and not subject to review; and 1 � ` l Mattituck Fire District— Page Two—4/13/04 WHEREAS, on March 16, 2004, Frank G. Relf, Architect P.C. certified the current design load of the existing septic system as capable of supporting the new toilet room and the Planning Board accepts this septic certification; and WHEREAS, on April 1, 2004, the Southold Town Building Inspector reviewed and certified the site plan; and WHEREAS, on April 1, 2004, the Architectural Review Committee reviewed the architectural drawings in accordance with its March 4, 2004 conditional approval and determined they were satisfactory and the Planning Board has accepted this recommendation; and WHEREAS, on April 8, 2004, the Southold Town Engineer reviewed and commented on the site plan and the Planning Board has accepted his recommendation for approval; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold have been met; be it therefore RESOLVED that the Southold Town Planning Board;,ant final approval on the site plan prepared and certified by Frank G. Relf, Architect P.C., dated December 29, 2003 and last revised March 16, 2004, and authorize the Chairperson to endorse the final site plans with the following condition and subject to a one year review from the date of issuance of the building permit: 1)All outdoor lighting shall be shielded so that the light source is not visible from adjacent properties and roadways. Lighting fixtures shall focus and direct the light in such a manner as to contain the light and glare within property boundaries. The lighting must meet the Town Code requirements. Current conditions at the site would suggest that the existing drainage systems is adequate and has the ability to contain run-off generated by severe weather conditions. Please consider the following comments for review. 1. Drainage calculations have not been provided. The proposed improvements indicate that approximately 75% (+/-)of new work is located within existing paved areas and, as such, will not provide a major increase in the total run-off generated. However, the new annex building is located over an existing drywell that will be filled and it also appears to extend out into an existing lawn area that would increase the amount of run-off generated at the site. This should be reviewed by the design professional and calculations should be provided to address all increase runoff as well as all existing drainage facilities that will be demolished. 2. The North Easterly corner of the proposed annex building indicates a new electrical conduit that is to be installed 42"below grade and is shown running over what is labeled a "Sinking Storm Drain". It is recommended that there should be a minimum lateral separation of ten (10')feet between these two items. Planning BoarA SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions,without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 59,935 sq. ft. (1.3097 acre) lot is a corner lot with 306.75 feet along the south side of Pike Street and 199.10 feet along the west side of Wickham Avenue in Mattituck. The property is improved with a one and two story brick firehouse, office building, and one-story frame garage, as shown on the July 5, 1994 survey, revised January 16, 2004 by Peconic Surveyors, P.C. BASIS OF APPLICATION: Building Department's, January 2, 2004 Notice of Disapproval, amended January 16, 2004, Notice of Disapproval, citing Sections 100-92 and 100-33B(3), in its denial of a building permit application concerning a proposed addition with a front yard setback at less than 15 feet, and concerning a proposed annex building at less than five feet from the side and rear lot lines. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 26, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct an 376 sq. ft. radio room at the front of the existing fire house and a new 2,762 sq. ft. garage/storage annex building. The radio room is proposed at 2214" at its widest point and 26' at its deepest point,with a minimum 10 ft. setback from the front line along Pike Street. The height of the one-story addition is proposed at 17'8" from grade. The 247' high accessory garage/storage annex building is proposed in the southwest corner of the property set back a minimum of five(5)feet at its closest point to the southerly and westerly lot lines. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections,the Board makes the following findings: 1. Grant of the relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because the firehouse has existed for many years and has been expanded upon to serve the growing needs of the community. 2.
