Chairman Orlowski: Good evening. I would like to call this meeting to order. Board to
set Monday, June 10, 2002 at 6:00 p.m. at the Southold Town Hall, Main Road,
Southold, as the time and place for the next regular Planning Board Meeting.

WHEREAS, Raymond J. Akscin is the owner of the property known and designated as
SCTM#1000-88-2-17 on Bayview Road, Southold; and
WHEREAS, the applicant proposes to subdivide a 9.77 acre parcel into 4 lots where Lot
1 is equal to 3.32 acres; Lot 2 is equal to 2.16 acres; Lot 3 is equal to 2.07 acres and
Lot 4 is equal to 2.22 acres; and
WHEREAS, on December 19,1999 the Planning Board granted conditional sketch plan
approval on the map, dated November 27, 1999; and
WHEREAS, the applicant has met all the conditions outlined in the sketch plan
approval; and
WHEREAS, the Suffolk County Water Authority issued a letter of water availability for
lots 1, 2, 3, and 4; and
WHEREAS, the Planning Board, pursuant to the State Environmental Quality Review
Act, (Article 8), Part 617, performed a review of this unlisted action, made a
determination of non-significance and granted a Negative Declaration on January 24,

six (6) months of the resolution:
1. The submittal of the $15,000.00 Park & Playground fee ($5,000.00 for each
unimproved lot) to the Planning Board Office.
2. The filing of the Declaration of Covenants and Restrictions with the Suffolk
County Clerk's Office and upon filing, recording the Liber and Page number
upon the final subdivision map.
3. The submittal of a performance bond in the amount of$35,200.00 and an
administration fee of$2,112.00 as determined by the Town Engineer on
March 29, 2002.

notices and have supplied the verified receipts back to the office.

WHEREAS, this proposed site plan, to be known as site plan for St. Peter's Lutheran
Church, is to construct a 3,945 sq. ft. addition to an existing church on a 4.3 acre parcel
on SR 25 in Greenport; and
WHEREAS, St. Peter's Lutheran Church is the owner of the property known and
designated as St. Peter's Lutheran Church, SR 25, Greenport, SCTM#1 000-45-2-7.1;
and
WHEREAS, a formal application for the approval of this site plan was submitted on
February 14, 2002; and
WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental
Quality Review Act, (Article 8), Part 617, declared itself lead agency and issued a
Negative Declaration on April 8, 2002; and
WHEREAS, the Zoning Board of Appeals granted a Special Exception for an expansion
to an existing place of worship in a Limited Business Zone on November 15, 2001; and
WHEREAS, this site plan, dated January 15, 2002, was certified by the Building
Inspector on March 30, 2002; and
WHEREAS, the Town Engineer has reviewed the drainage calculations and the
Planning Board has accepted his recommendation for approval; and

then the Planning Board has the right and option, if the change is material to any of the
issues properly before the Planning Board, to hold a public hearing on this "revised" site
plan application and review its conditional approval; and
WHEREAS, on January 28, 2002, the applicant signed a statement agreeing not to
object to a new public hearing and Planning Board review of the revised application;
and

Chairman Orlowski: 6:15 p.m.: Grace's Place - This proposed site plan is to construct a
7,000 sq. ft. nursery school facility on a 4.6 acre parcel. The property is located on CR
48 in Peconic. SCTM#1000-74-4-4.7 & 4.8
1 will ask if anyone has any comments or questions on this. This hearing will be held
open because there are some items still missing.
Frank Murphy: Benny, could I address the Board on that?

Chairman Orlowski: Yes.
Frank Murphy: I am working to help coordinate for Grace's Place to try to get site plan
approval. I would like to thank the Planning Board and, in particular its staff, for their
assistance in moving this along. We had a Suffolk County Health Department site plan
and it is on the wrong size paper and so it has been redrawn. Suffolk County Health
Department could not re-stamp it today. They did not have enough time to check all six
copies and it should be done no later than tomorrow.
We are in a very tight time frame and the reason is because this is being funded by the
Department of Agriculture and their patience is running out. They need a building permit
or they are liable to lose the funding on a very important project. It is going to employ
approximately thirty people in the Town. It is going to provide daycare for approximately
seventy-five young children which is desperately needed here and many beneficial
effects. If we do have the Health Department Permit, there was also a question on the
site plan. They encroached in the buffer zone about two feet and the Town Engineer
approved all the drainage and just asked that it be moved south about five feet which it
has been on the plan which, in effect, is almost a mute question because the Town now
is going to acquire the twelve acres next to this and so this whole road is going to be
eliminated anyway and a new curb cut is going to have to be put in to the property.
So, I would ask that you do approve the site plan subject to the review and the final
submission of the acceptable size plan for this. Any questions, I would be happy to
answer. It was not the applicant's fault. Joe Baier, former Health Department
Commissioner, did this and he was not aware of the size of the plan, but it is completely
finished now.
Chairman Orlowski: Yes, well, it has never been this Board's policy to approve a map
without the correct map in front of us and we are just going to have to hold it open.
Anything else?
Mr. Murphy: No.
Chairman Orlowski: Any other comments or questions on Grace's Place?
Gary Rempel: Good evening. My name is Gary Rempel. When there is a public hearing,
as in Grace's Place, I believe that certain local laws must be followed - one of these
being a written notice via certified letter be sent to the properties basically within two
hundred feet of the outside boundaries. I live directly across the street from the
proposed project and I received nothing. I feel that Grace's Place has not fulfilled their
legal requirements and this public hearing actually should be held in abeyance until all
the requirements have been met.
Chairman Orlowski: I am not sure about that two hundred feet. I thought it was adjoining
properties but we can talk with the Town Attorney and figure that one out.
Gary Rempel: It is Chapter Fifty-Eight.

Frank Murphy: Benny, can I comment? I did send them all out and one was sent and we
have a receipt from the Post Office. I don't know what happened to it.
Gary Rempel: I know it says I am supposed to get one, you know, no matter what the
situation is, I am supposed to get one.
Chairman Orlowski: O.K. We can check that easy enough. Any other comments?
Gary Rempel: What is your opinion on it?
Chairman Orlowski: I don't know. I will have to find that answer out. Like I said, this
hearing is going to be held open.
Gary Rempel: No. That's all for now.
John Skabry: My name is John Skabry. I live in Peconic on Henry's Lane and, first of all,
I would like to thank the Board for serving and, especially, Chairman Benny Orlowski.
The ...(tape disturbance) on Henry's Lane. I have live there thirty-two years and I have
never had a harder time than the past two years getting out on the road. There are
occasions when we have to make a right turn on 48 to go left on 48. The gas station
causes a lot of accidents - cars coming and going from the gas station. That thing is
marked incorrectly. If Mr. Murphy's - past Supervisor Murphy's - statistics are correct, 75
kids and 30 employees breaks down to like 210 cars every day coming and going. 75
drop-offs and 75 pick-ups. 30 employees coming and 30 employees going. That road
cannot take it. It's a 65 mile an hour road. That's the way it was constructed. It is being
used as a 65 mile an hour road, not 55 as it is supposed to. That area cannot take 210
cars coming and going from it. People are going to be killed on the road. The soil itself
is Bridgehampton loam. I have lived there for thirty-two years. It is some of the finest
agricultural soil that we have in the United States. It is also irrigated. There is deep well
irrigation there. It is my personal opinion that that land should never be developed. It
should be constantly agricultural. Aside from that, my personal opinions are that
daycare is up to the family and not up to the Government. Peconic is already burdened
with many, many municipal buildings. You know them as well as I do. I am opposed to
Grace's Place where it is located and I thank you very much for giving me this
opportunity to speak to you.
Chairman Orlowski: Any other comments?
Margaret Skabry: My name is Margaret Skabry, his wife, and a few more things that I
would like to get cleared up. I just found out about this meeting from a letter that came
to my mailbox which was quite a surprise to me because I really don't bother reading
the legals anymore because there is no more airport being threatened, but I do have
some questions. I want to know how the property is zoned right now and is it part of the
Green Belt?
Chairman Orlowski: The zoning is that the use is an allowed use and he has met all the
conditions. He got a Special Exception from the Zoning Board of Appeals to have that

use. We have to look at it as conforming. I am not exactly sure what the zoning is. A-C
- Agricultural Conservation - two acres and they went to the Zoning Board of Appeals
and got the Special Exception.
Margaret Skabry: It is just fine because they went and did this. O.K. Not really but -
Chairman Orlowski: I did not say that but the Zoning Board Appeals said that.
Margaret Skabry: Who owns that land right now?
Chairman Orlowski: Who owns it? The person that owns it? I am not sure. Aliano, I
think.
Frank Murphy: Grace's Place owns five acres.
Margaret Skabry: And who proposed this plan to begin with?
Chairman Orlowski: Who proposed it? Grace's Place.
Margaret Skabry: Who is Grace's Place? Is it a corporation? Is it a philanthropist? What
is it?
Chairman Orlowski: I can't tell you. It is an organization that does this.
Margaret Skabry: What does it do - like who would go to this daycare?
Chairman Orlowski: I don't know. Well, those are questions that we really can't ask. I
mean, you know-
Margaret Skabry: But, if I had to ask them, right, and you are going to vote on what you
are doing on that, would we get to ask you after it is a done deal? I mean, I am not
angry with you people either. I know you are up here because you care about the Town.
I do, too, especially our little place -what is left of it. O.K. So, we don't know any of that.
We don't know - has the proposal even been turned down by any other Town? We don't
know that either, do we?
Unidentified Person in Audience: It was turned down by Riverhead - Doctor's Path. It is
also funded by New York State — Grace's Place.
Chairman Orlowski: You have to address the Board. Anybody that talks, we would like
you to give your name for the record, but I don't want this to be a debate. You can have
your chance.
Margaret Skabry: So, it has been turned down by somebody else who, evidently, did not
think it was a really terrific idea for their area. Does Southold have its own Town-
sponsored daycare center, right now, for its local residents?

Chairman Orlowski: I'm not familiar with it.
Ms. Skabry: Why are we building this? Why are we getting approval for this?
O.K. — location. Terrific location for a bunch of kids in front of a railroad track, in back of
a highway. Perfect. I am sure, Benny, you would have stuck your kids out there to play
anytime on their little quads and stuff. All of us -that is not where you want your
kids to be; that is not where they belong. And what my husband said about the traffic - if
you don't live there, you don't believe it. If you live in Orient, you believe it. If you live in
Peconic, three houses from the highway, you believe it. If you try to get out and have to
go right, you believe it. If you come out of the gas station and try to go west from the
east exit and cause accidents and rollover all the time - every summer. You can check
the police records. It is not really a safe place so I think there are plenty of reasons that
it probably shouldn't have got here. But hear the reasons I am asking you to maybe not
pass it. This is a little overview of what Peconic is now, thirty-two years after we came
here. Peconic has a gas station that serves all the people in the Town and all the
visitors to the Town. It has a Water Authority building which is not exactly a legacy to
architecture but it is there and it serves the people of the Town. The water comes from
the Peconic area and goes throughout the Town. That's what Peconic has done. It is a
tiny, little place. O.K. We also have the Post Office and a laundermat for many summer
people and everybody else. We have Jean Cochran Park with the hockey rink and all
for the kids. I think we've done a lot for the Town in that respect, too. None of us voted it
down; none of us came before you and said no. Then, we have Tasker Park. I think that
is a pretty good thing for the Town. It is a good thing for the youth, the youth of this
Town. Not the youth of some other town that would be brought in here because the
government says somebody has to do it so, you're going to do it so we are going to give
you the money to pay somebody to buy land for you. Peconic Lane Elementary School
is still there. Who knows. It may be re-used again. It has been an elementary school for
years. I am sure when it was built, somebody that lived nextdoor was not too thrilled but
it was built and it was for the kids of your Town. Then we had the beautiful senior/youth
center and recreation center in Peconic. It is, again, not an attractive piece of
architecture but it is functional for the Town. Again, in the little hamlet of Peconic. Then,
you have the Highway Department. I make no comments. These guys work really hard
but it is there to serve the entire town, not just us. Then, we have the animal shelter
soon to be improved and more attractive, I am sure, and no comment whether it should
be there or not. It is there. We do that, again, for the Town. Then, we have the Police
Station. God knows they are there for the whole Town. O.K. That's Peconic. Now you
are asking us to go ahead and say ...(tape disturbance) to one more thing that we don't
need and it's not for the people of our Town and we will just be happy with it because
there are not many of us here and I am not going to say that to you. I am going to say to
you: go back, find out who turned it down, why they turned it down, who is for it and why
our kids don't have it already- the people who pay taxes in the Town already. We have
daycare for our seniors. If we are going to have daycare for our children, it is going to be
for our own kids. And I am very sorry for these other kids but the Government will work
something else out some place else. Call it mean of me, if you want to. I am just really
hoping that you turn it down when it finally does come up for a final vote. Thank you.

Chairman Orlowski: O.K. Any other comments?
Gary Rempel: I know you had asked some questions about the history of Grace's Place
so maybe, hopefully, I can fill in some of the blanks. If you ever have the opportunity to
peruse through the Riverhead Town Board minutes, you will find out that Grace's Place
had its birth in Riverhead by Doctor's Path. It was turned down by the Board. You might
ask why was Riverhead chosen? Well, a survey was performed by Grace's Place -
ABCD - the survey found that the majority of the families would be from Riverhead.
Ironically, the survey only found that one family would be from Southold. Now, at the
last meeting when they were proposing this whole project, basically, they said that
Peconic was a good location. Their own survey said that Riverhead was a good
location. And you might ask what she was asking - this thing is going to be built. Who is
it going to service? It is only going to service a select group. It is only going to service
farm workers. A million dollar project. You ask where are these children from? Well,
they can come up to an hour—two-hour round trip to get to this place in Peconic on
busses - young children. It would be like taking your kids - your children -from Southold
and sending them to Medford, Farmingdale or perhaps even Lake Ronkonkoma. There
are families right here that work in other industries - low paying jobs such as retail,
restaurants - but they will not be allowed to use this nursery service but a child from one
hour away will be allowed to come into your community and use this service. Imagine
that. I don't know. Does Southold want to deal with something like this? Segregation?
don't know. When you come into Town, there is a sign that says they foster diversity
and antibias. Is this in concert with your ideology? I don't know.
You were asking more about the nursery school. Well, this nursery school, originally,
when it we came to, oh, about a year ago, the meeting in Southold, basically, it said the
operation would be from eight to four p.m. This is what we were told. This would be the
impact - eight to four p.m. Well now, if you go back and you read the minutes to the
same proposal of this plan in the Riverhead Town Meeting, the Director, which I believe
is Maggie Evans, basically states that she is looking to open up and expand it at
evening hours. So, you know, I find that troubling. Will there be parties? Will there be
loud music? Where is it? Is it an eight to four operation or is it going to be something
different? You know, you've got to have credibility when you are trying to introduce
something. And, also, it has to serve the community. It is not serving the community so

Betty Constantine: My name is Betty Constantine and I just want to say that I am very
opposed to this. Not that I don't think it is a very good idea for children that are
unfortunate but I don't feel that it's serving them. I think that they need more of a central
location and if New York State is going provide for them, they should provide it in an
area that is more accessible. I can't - I mean, I look at these children - seventy-five
children - where are they going to have their medical treatment? We don't have medical
facilities out here for them. I don't feel that it is right to have it in our community.
Lori Kalinke: My name is Lori Kalinke. I am also a neighbor to the site and I just want to
say that I did not know anything about this at all until we got this letter a few days ago
and I just want to say that I oppose it because, myself as a parent, have had a very hard
time finding child care out here and I don't feel it is the right thing to do to have it open
for these type people and not for everyone. Not that I would have my child go to this
facility but at least offer it to everyone in this area. I commute an hour and a half every
day to Stony Brook. My children have to find alternative child care up west - not out here
because I am not able to find it out here and I just feel that this is not a good thing and
not good area and also our property value - what is it going to do to our values of our
properties - having something like this? These people migrate and they hang out and
they know there have been problems up west. So, I just wanted to say that I just don't
feel it is a good thing and I'm opposed to it. Thank you.

Frank Murphy: I don't think you would have to look very far in Southold Town to find out
who is doing the work in the nurseries, in the greenhouses, in the restaurants - where
ever-who is doing the work. This is going to be for children of farm workers which
would include all of those people. It is needed and there are quite a few people around
here and quite a few little children right in this area who would be eligible and who
would be using it. It is not going to be coming from down west. We would not be able to
exist out here in this market if it was not for these people doing their work and there is a
real serious need for them and it is not going to increase traffic any great amount. It is
the best road possible in the Town for this to be coming. The children are going to be
bussed in three or four busses; they are not coming individually. O.K. Any other
questions on it?
Chairman Orlowski: You answered my question by saying no, that local people can't
use this facility. Is that what you are said?
Frank Murphy: They can.
