SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 34,552 sq. ft. parcel is shown on the Amended Map A of Nassau Point filed August 16, 1922 in the Office of the Suffolk County Clerk. The property is improved with a variable one-story and two-story, single- family dwelling and accessory garage as shown on the survey dated October 15, 1998, revised August 29, 2000, prepared by Joseph A. Ingegno, L.S. BASIS OF APPLICATION: Building Department's April 4, 2003 Notice of Disapproval, amended July 14, 2003, citing Section 100-30A.3 (100-244), Bulk Schedule, in its denial of a building permit to construct an addition to the existing dwelling with side yards at less than 35 feet combined. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on July 24, 2003 and September 11, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants applied for area variances for a proposed 19' x 40' two-story addition at the north side of their dwelling at 21.7 feet from the northerly property line and for approval of the as-built location of the existing open wood deck at 18.8 feet from the northerly property line at its closest point. The existing setback of the applicants' dwelling from the southerly property line is 3.7 feet. The total combined setback area for both side yards is proposed at 22.5 feet, at the closest points. ADDITIONAL INFORMATION:AMENDED RELIEF: During the July 24, 2003 public hearing, the applicants offered to obtain and furnish information relative to a final set of construction diagrams with the adjacent landowner (R. Sturdy). On September 4, 2003, the applicants submitted the first and second floor diagram dated 8/2003, prepared by Donald G. Corazzini 118-5-4.1 at Cutchogue REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The code requirement is 20 feet on one side and 15 on the other for lots containing 34,551 sq. ft. in area. A portion of the existing deck at the northerly end does not conform to the code's minimum single side setback requirement. The proposed two-story addition, also on the north side of the dwelling, conforms to the minimum single side yard requirement of 15 feet, however, when combined with the opposite side setback existing at 3.7 feet, does not conform to the total requirement of 35 feet for both sides. The applicants' property is widest along the road with 191.89 feet, and narrows to a width of 37.01 feet along the bulkhead and lagoon. The distance between the applicants' house and the neighboring house to the north (without their proposed addition) is at least 99 feet. The southerly side yards of the applicants' dwelling is substantially nonconforming, and the area variance is at the opposite side of the dwelling which has a large degree of conformity. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The proposed addition and open deck substantially conform to the code's minimum setback on the northerly side. The alternative to increase the setback on the opposite (southerly) side yard is not a feasible alternative because that setback has existed with its nonconforming setbacks at 3.7 feet and 5.4 feet for many years. 3. The relief granted herein is not substantial. While the code requirement for combined side yards is 35 feet, the single side yard is required at 15 feet. Both the deck and proposed addition will exceed the code's requirement on the single side yard of 15 feet. 4. The difficulty was self-created when the applicants planned and designed the deck and addition which did not conform to the current Town Code requirements. 5. There is no evidence that the grant of the relief will have an adverse effect or impact on physical or environmental conditions in the neighborhood or district. The applicants have obtained a letter of authorization dated June 13, 1994 under Ref. #1-4738- 00911/00001-0 from the New York State Department of Environmental Conservation and have contacted the Southold Town Board of Trustees at its meeting of 4-30-2003 for a determination under the wetland codes. 6. Grant of the relief requested is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an open deck and addition, while preserving and a Page 3—September 25,200 Appl. No.5348—R. and C.Corazzini 118-5-4.1 at Cutchogue protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairwoman Tortora, seconded by Member Oliva, and duly carried, to GRANT the variance as applied for and shown on the survey prepared by Joseph A. Ingegno, L.S., revised March 25, 2003 (with a ZBA date stamp of April 9, 2003) and Drawing 1 of 1 prepared by Donald G. Fieler Architect, dated 8/2003, subject to the following CONDITIONS: 1. Maximum 30 ft. height to the ridge. 2. Maximum 18 ft. width 3. Minimum 21.7 ft. setback on the north side. 4. The existing landscape buffer between property lines shall be continuously maintained. 5. The Board of Appeals reserves the right to inspect regarding this approval with conditions. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. An architectural plan of our proposed addition has been on given to our north side property line neighbors on August 25th, as requested,in the hearing by Mr. and Mrs. Robert Sturdy. The plan is attached for your review. Our case is re-scheduled on calendar for the September 11, 2003 zoning board meeting. Our proposed addition on our survey shows a 19' x 40' structure to be built, and in reality the addition is tentatively smaller. The attached architectural plan diagrams an 18' x 34' addition to the north side of house to commence six (6) feet set back from the existing house and would extend approximately eight (8) feet further from the current deck. The existing roof line would increase t approximately three (3) feet. Our neighbors to the north side, the Sturdys have discussed building an addition to their current summer house. Their attached survey proposes a 20.33'x 54.33' two story addition to the south side of the house, and plans to relocate the screened porch 11 feet from the property line.
