SPECIAL MEETING HELD
JANUARY 6 , 1981
A' Special Meeting of the Southold Town Board of Appeals was held
on Tuesday , January 6 , 1981 at 4 : 15 o ' clock p.m. at the Office of the
Town Attorney , Robert W. Tasker , 425 Main Street , Greenport , New York .
Present were : Charles Grigonis , Jr. , Chairman ; Robert J . Douglass ;
Gerard P . Goehringer; and Joseph H . Sawicki . Absent was : Serge J .
Doyen . Also. present was Robert W. Tasker , Town Attorney.
Appeal No . 2773. Application of Joseph D. Posillico , Sr .
Variance Requested : To construct new dwelling with insufficient
front and rear yards and for approval of access .
- NEGATIVE DECLARATION - NOTICE OF NO SIGNIFICANT EFFECT UPON THE
ENVIRONMENT :
WHEREAS , applicant has submitted an environmental assessment in
the short form which indicates that no adverse effects were likely to
occur to the environment for the project proposed herein ; and
WHEREAS , the premises in question does contain an existing `
function seawall at least 100 feet in length along the water-lying
edge and therefore would not appear to fall within the jurisdiction
of the N. Y. S . Department of Environmental Conservation pursuant to
Section 661 . 7 of Article 25 of the Environmental Conservation Law ;
On motion by Mr. Goehringer , seconded by Mr. Douglass ,
NOW, THEREFORE , IT IS RESOLVED , that in Appeal No . 2773 , appli -
cation of Joseph D. Posill'ico ; Sr. for permission to construct new
dwelling with insufficient front and rear yard setbacks and for
approval of access regarding property located at the East side of-
Camp Mineola Road (a/k/a Reeve Avenue . ) , Mattituck ; New York ,
this Board determines that this project , if implemented as planned

herein is classified as a Type II Action , not having a significant
adverse effect upon the environment ; and pursuant to the N . Y . S .
Environmental Quality Review Act (SEQRA) , Sections 617 . 13 and 617 . 5 (a ) ,
and the Southold Town Code , Section 44-4 , no further determination or
procedure is required in the SEQRA standards of process by this depart-
ment . [This declaration should not . be considered a determination made
for any other department or agency which may also be involved or any
other project not covered by this application . ]
Vote of the Board : Ayes : Messrs . Grigonis , Douglass , Goehringer
and Sawicki . Absent was : Mr . Doyen .
On motion by Mr . Goehringer , seconded by Mr . Douglass , it was
RESOLVED , that the matter of Joseph D . Posillico , Sr . , Appeal No .
2773 be scheduled and advertised in the local and official newspapers
and posted on the Town Clerk Bulletin Board for a public hearing to
be held at the next Regular Meeting of this Board , to wit , January 22 ,
1981 at 8 : 35 p .m . ( in addition to those previously scheduled ) .
Vote of the Board : Ayes : Messrs . Grigonis , Douglass , Goeh-
ringer and Sawicki . Absent was : Mr . Doyen .
The Chairman declared the meeting closed , being there was no
further business to come before the Board at this time .
