The subject premises_ is nearly. 10 acres in size and lies between -Main Road and the Long Island Sound in Orient. As depicted on -the attached- site plan, the Coastal Erosion Hazard Line runs through the rear yard of the property. The proposed.location of the pool and cabana in the side yard is intended to minimize impacts on the adjacent wetlands and neighboring.properties. For the following,reasons, the Applicant submits that variance relief from 280-15 is warranted: 1. An undesirable change will not be produced in the CHARACTER.of the neighborhood or a detriment to, nearby properties if granted, because: The proposed construction of a swimming pool and .pool house in the side.yard of the existing home on this generously sized 9.93 acre parcel will not produce an undesirable change in the character of the neighborhood or pose any'detriment to nearby properties. The side yard location is landward of the CEHL and the neighboring home a few hundred feet southeast of the proposed location. Existing dense vegetation:on the eastern property line also provides . ample screening of the.,pool and cabana from neighboring properties. The pool will be essentially invisible to the neighbors. 2. The benefit sought by the Applicant CANNOT be achieved by some feasible method for the applicant to pursue other than an area variance, because: The side yard is the least impactful location for the proposed pool and cabana but, despite.the large size.of the parcel, achieving the benefit of a pool for family recreational'use will necessitate variance relief. Locating the pool in the required rear yard or the allowable front yard is not feasible and would be more detrimental to the environment and to nearby properties. F F 3. The amount of requested relief is not substantial because: While the relief requested may be considered mathematically substantial it is not practically substantial based on the size of the parcel,. the location of the home on the neighboring parcel and location of the CEHL. 4. The variance will NOT have an adverse impact on the physical or environmental conditions in the neighborhood or district because: As a Type II action, and in light of the Applicant's efforts to respect the Wetland boundary and the Coastal Erosion Management boundary; the granting of a.side yard variance will have no perceivable adverse impacts on the .physical or environmental conditions in the neighborhood, particularly in light of the size of the parcel.
