The following resolution was adopted: WHEREAS, the proposed site plan, to be known as the site plan for North Fork Foods, is for an alteration of an existing restaurant space of 2,048 sq. ft. gross floor area and a 246 sq. ft. addition on a 0.521 acre parcel in the LB Zone; and WHEREAS, Patrick Mettes & Lisa Callaghan are the owners of the property known and designated as 43715 County Road 48, located at the intersection of Hortons Lane and CR 48, on the northwest corner, in Southold, SCTM#1000-59-3-30; and WHEREAS, on August 8, 2003, the applicant signed a statement agreeing not to object to a new public hearing and Planning Board review of the revised application; and WHEREAS, on August 13, 2003, a formal application for approval of this site plan was submitted; and WHEREAS, on September 9, 2003, the Southold Town Planning Board, acting under the State Environmental Quality Review Act (6 NYCRR), Part 617.5, made a determination that the proposed action is a Type II and not subject to review; and WHEREAS, on August 23, 2003, the Architectural Review Committee reviewed and approved the proposed site plan application as submitted; and t JJ North Fork Foods — Page Two— 12/9/03 WHEREAS, on October 16, 2003, the Southold Fire District responded, after review of the site plan, and found that there is adequate fire protection; and WHEREAS, on November 6, 2003, the Southold Town Zoning Board of Appeals reviewed an application, Appeal Number 5413, and granted a variance as applied for with the condition that the screening buffer be maintained in good condition at all times along the northeast sides of the proposed northerly addition; and WHEREAS, on November 11, 2003, the Suffolk County Department of Public Works reviewed a work permit in accordance with Section 239-f of the General Municipal Law and approved with comments; and WHEREAS, on November 17, 2003, the Southold Town Building Inspector reviewed and certified the site plan; and WHEREAS, on November 17, 2003, the Town Engineer reviewed and approved the site plan and the Planning Board has accepted his recommendation for approval; and WHEREAS, on November 26, 2003, Reference Number C10-0300-16 was approved by the Suffolk County Health Department on the drawing by Condon Engineering, P.C., dated 11%24/03; and WHEREAS, the Southold To n Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, a final public hearing was closed on said application at Town Hall, Southold, New York on December 8, 2003; and WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold have been met; be it therefore RESOLVED that the Southold Town Planning Board grant final approval on the site plan prepared by Samuels and Steelman, Architects, dated November 13, 2003, and authorize the Chairman to endorse the final site plans with the following conditions and subject to a one year review from the date of the building permit: 1. All outdoor lighting shall be shielded so that the light source is not visible from adjacent properties and roadways. Lighting fixtures shall focus and direct the light in such a manner as to contain the light and glare within property boundaries. The lighting must meet the Town Code requirements. 2. The screening buffer must be maintained in good condition at all times along the northeast sides of the proposed northerly addition. This Department strives to be fair and consistent with regard to highway improvements that are required along the frontage of all developments on Suffolk County right-of-way. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' 22,709.11 sq. ft. parcel is located on the corner of Hortons Lane and Middle Road (a/k/a C.R. 48) in Southold. The property is improved with a one-story building with an existing restaurant business use in this Limited Business (LB) zone district. The existing building with deck is shown on the survey prepared March 14, 2003 by Stanley J. Isaksen, Jr. and is approximately 28 feet from the southerly front property line along Middle Road and approximately 23 feet from the arc of the curve along Horton's Lane, at 7.5+-feet from the northerly property line (to a corner of a deck), and 68+-feet from the westerly property line, at its closest points. BASIS OF APPLICATION: Building Department's July 17, 2003 Notice of Disapproval, citing Section 100-244B, in its denial of a building permit under Section 100-82A, for proposed additions/alterations to an existing commercial building with a side yard at less than 20 feet. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 23, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and.other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants wish to construct to place a walk- in cooler addition at the northerly side of the existing restaurant, after removing the existing stoop and wood deck, and constructing a new concrete stairs to basement with a roof, as shown on the site plan prepared July 15, 2003, and revised 7/15/03 by Samuels & Steelman, Architects. The'property is located in the Limited Business (LB) Zone District. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: Page 2—November 6,2003 Appl.No.5413—P. Mettes and L.Callaghn 59-3-30 at Southold 1. Grant of the variance relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Applicants indicated a need for a walk-in cooler attached to the renovated building, which will reduce the side yard with a 7 ft. setback, after replacement of the stairs to the basement and removal of the deck. At the hearing, applicants indicated that this is the only location on site that the walk-in cooler could be screened from view and also be accessible. Evergreens are proposed as a screening buffer on both the north and east sides of the cooler, and the cooler will not extend beyond the established front building line facing Horton Lane, and the deck at the north side of the building will be removed, and the fence will be replaced for additional screening adjacent to the house on the north side. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The parcel has two front yards facing a town street and county highway route. There is no reasonable alternative if the structure were placed on the other side of the building, 60 to 80 feet away from the building, and in plain sight from the driveway and parking area 3. Although the relief granted is the minimum necessary, the variance requested is substantial, representing a 65% reduction, partially in the side yard, from the 20 ft. minimum code requirement to seven feet at its closest point 4. The difficulty is self-created based on the property size and nonconformity of the building setbacks. 5. There is no evidence that the relief granted will have an adverse effect or impact on physical or environmental conditions in the neighborhood or district. 6. Grant of the relief requested is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a walk-in cooler addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. It had a great location, but most importantly, it was a property with a pre-existing use as a restaurant. We knew this would save us untold time and money in our start- up. In April we purchased Johnny's and started working with Fancy Steelman, a local architect, to renovate and bring the building up to code. We have had a home in Cutchogue since 1998 and will be full-time residents as of this fall. We love the North Fork's rural and rustic character and plan to work to keep those qualities alive in our community, We will work to support the existing fabric of the North Fork in our business too. The food we serve will use local produce and provisions whenever possible. We will renovate the existing building, dating from around 1955, with sensitivity to our neighbors and community, bringing it up to code, beautifying the exterior and enhancing the landscaping surrounding it. The basic business use will remain the same. The restaurant will operate year'round with interior seating expanding during the summer months with seating on the deck.
