ing Board of the Town of Southold, that the following covenants
will attach to the said described lands
1. All prospective purchasers of lots within this sub-
division shall be advised that this subdivision is
located within one (1) mile of Elizabeth Field and
may be subject to noise from the operation of the air-
port, and noise from aircraft movement. '
2. No lot shall be subdivided or changed in any manner
unless authorized by the Southold Town Planning Board.
3. Clearing and grading within each lot shall be limited
to' that necessary for siting and constructing a house
with the intent of preserving as much of the natural
vegetation on the site as possible. Limiting clearing•
and grading will minimize stormwater, runoff and erosion.
4. No stormwater runoff resulting from the development of
the subdivision or any of the lots shall be discharged
directly into the adjacent body of water, Hay Harbor,
or the tidal wetlands within the subdivision parcel.
5. ' No residential structure' shall be constructed within 100
feet of the upl,-lnd edge of the tidal wetlands and the
shoreline of Hay Harbor.
6. No sanitary disposal facility shall be installed or con-
structed within 100 feet of the upland edge of the tidal
wetlands and the shoreline of Hay Harbor.
7. Thar Owner reserves the. sole right to grant franchise and
consent for the installation and maintenance of any
public utility in, over and upon and across any of the
streets in the development, including, without limitation,
the right to lay water and gas mains, erect pole lines
for the transmission' of electric power and .install other
utilities in, fiver, upon and across the said streiats.
The Owner does also 'reserve for herself and her successor
in interest a perpetual easement not to exceed five (5)
feet in width, along the rear and side lines of each lot
in the• developmentfor utility installation and mainten-
ance.
8. Thu Owner reserves the right to dedicate all streets,
roads, drainage areas and easements, if any, to the
Town of Southold for highway and drainage purposes.

Dear Sue,
it 'has been brought to my attention that Mr. Fred Tedeschi, attorney
for Mrs . Zabohonski had never requested an extention of the time
limit for her minor sub -division application. I was under the im-
pression that he had, but alas , i was wrong. I don' t know if this is
what is supposed to be done, but since I originally submitted the
application on Mrs. Zabohonski, I would request the extension at
this time . There should be no problem as the petitioner, Mrs .
Zabohonski, has complied with all that the Planning Board has re-
quirements . .
I will be gone for several days next week, another trip to Florida,
but will try to call you.

Dear Mr. RalTnor:
I am writing to you at the recommendation of Susan Long
of your office with respect to some questions that have
arisen on the "Annette Zabohonski" subdivision on Fishers
Island. These questions resulted from some recent
correspondence I have had with The Office of Building
Inspector (see enclosed) on issues pertaining to flood
insurance and flood zones applicable to the subdivision.
These inquiries were prompted because I am one of the
perspective buyers of a plot (plot #1 to be specific)
in the subdivision. Susan Long felt your office would be
in the best position to provide the needed answers.
Of main concern is that the F.I .R.M. panel does not appear
to be up to date as it doesn't even show Cresent Avenue.
Nor is it evident that the demarcation line between the
A&V zones running through the subdivision follows the actual
contour as shown on the survey. The question that arises
is how to get the A&V zone line redrawn to reflect actual
elevations. I am also told that your office has and uses
a survey map with different A&V zone elevations from what
the F.I .R.M. panel shows.
It has also been noted that the F. I .R.M. panel elevations
are based on mean sea level, whereas The Palmer, Chandler
survey elevations are based on mean low water. I am told
that your office has dealt with this problem before and
that you can provide the information on what the difference
would be between the two measurements for the area around
the subdivision.

Naturally, I am aware that the subdivision has yet to obtain
it' & final approval . Nonetheless, it would be extremely helpful
to know exactly where the A&V zones will be located on the
subdivision survey as that will have an effect on availability
and cost of flood insurance and also on building requirements
(or restrictions) .
Additionally, it would be extremely helpful to have any copies
of documents, minutes which refer to actions that have to be
undertaken and completed by the owner of the subdivision prior
to final approval beyond what is specified in the September
22nd loiter i.e. certain road work on Crecent Avenue, test
hole dug and the drilling of a test well. The latter two I
understand are County requirements . The work to be done on
the road, I understand, was a requirement by the Town of Southold.

r3 I am enclosing a copy, that I have made , of the Flood In-
surance Rate Map , from panel #14 which takes in the area of the
property you are inquiring about .
t>>� Note the very faint white line in the area circled in yellow;
Ah this line divides the A & V zones . Note also that Crescent Avenue
`.V does not run through to Fox Avenue as it shows on your survey. It
is very difficult to define your lot #1 and your friends , lot #2 ,
a on the F . I . R .M, panel .
The elevations shown on the F .I , R.M. panel are based on a
fi mean sea level. The elevations on your survey, it appears , are
taken from mean low water; this would not be the same .
I have outlined in pencil the approximate location of the
lots shown on the survey. It would be advisable to have a survey
made showing the line through property that divides the' A & V
g zones with elevations from mean sea level .
Should construction be located in the V-12 Zone , the building
must be built on piles with the lowest member of the structural
part of the building above the 14 ' -0" minimum elevation. Plans of
building shall be made by a New York State licensed architect or
engineer and. shall comply to criteria of the Flood Development
program.

Building in the A-10 zone would allow . a regular foundation
for the dwelling. A continuous foundation wall with window or
vent openings shall be constructed so that the bottom of lowest
openings is 12 ' -0" above M.S. L . and all equipment for dwelling
shall be above'fiis elevation.
At this time I would like to point out that the Planning
Board has not approved the final map for this subdivision:and a
building permit could not be issued until this has been done .

Also , other agencies requiring permits would have to be contacted .
Enclosed is a copy of a letter from the Planning. Board stating
conditions to be met for final approval ; if you will note there
is a six month deadline to be met for approval endorsement.

I am writing regarding my recent phone conversation with you
concerning my efforts to purchase land and ultimately built a
one family house on Fishers Island. As mentioned on the phone,
there is a concern with the availability of flood insurance for
any structure that I will be building on our land.
You indicated that with some specific information on the land
and location of the proposed structure you should be able to
provide the basis upon which an insurance agent could determine
what flood insurance would be available. The information that
my insurance agent will need includes the applicable flood zone,
which will then determine the minimum elevation for the structure. .
I would appreciate if you could indicate what this minimum
elevation should be, as well as information on the various
structural building standards that need to be adhered to in order
to qualify for flood insurance.
Enclosed to assist you is a copy of the locator map and the minor
subdivision survey showing the elevations and the proposed
location of .my structure on Plot #1 which is my -plot. I have
also shown the location of a structure on Plot 42 which is the
plot being purchased by a close friend. He has asked me to
request that you provide the same information for him on Plot #2
as you will be doing on Plot #1 for me.

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Actland 6NYCRR Part . 617 , Section
617 . 10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Annette Zabohonski is a three lot
subdivision located at Fishers Island. '
The project has been determined not to have a significant
effect on the environment for the following reasons :
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned
The New York State Department of Environmental Conservation
has stated no. objection to the .1,ead agency. designation.
This subdivision will require permits from this office
pursuant to Tidal Wetlands Land Use Regulations, Part 661.
The Suffolk County Department of Health Services has stated
no objection to the lead agency designation. Prior to
commenting on the water supply and sewerage disposal systems
it is necessary for test wells and test holes to be installed.
In addition it is recommended that clearance be obtained from
New York State Department of Environmental Conservation con-
cerning .wetlands.

The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations .

The following action was taken by the Southold Town Planning Board,
Monday,' September 20, 1982 .
RESOLVED that whereas , a formal -application for the approval of. a
subdivision plat entitled "Annette Zabohonski" located 'at -Fishers
Island was submitted to the Planning Board on April 12, 1982
and, a filing fee in the amount of $75 was paid June 18, 1982
WHEREAS, a public hearing was held on said subdivision application

Dear Mr. Raynor:
The Suffolk County Planning Commission at its regular meeting on August 4,
1982, reviewed the proposed subdivision plat entitled, "Minor Subdivision -
Annette Zabohonski11, referred to it pursuant to Section 1333 of the Suffolk
County Charter. After due study and deliberation it resolved to approve said
map subject to the following eight conditions deemed necessary to alert pro-
spective owners of lots within the subdivision that they are located near
Elizabeth Field and may be subject to noise resulting from airport activities
and aircraft movements and also to help avoid pressures from future residents'
of this subdivision to close the airport or to curtail its activities because
of noise emanating from the facility or from aircraft using the facility and
to help preserve the natural and aesthetic attributes of the shoreline of Hay
Harbor:
1. The recording in the office of the County Clerk on or prior to the
approval of this subdivision of covenants and restrictions advising
all prospective purchasers that this subdivision is located within
one mile of Elizabeth Field and may be subjected to noise from the
operation of the airport and noise from aircraft movements.
2. All residential structures that are erected within the subdivision
shall be constructed using materials and techniques that will reduce
interior noise levels in accordance with the recommendations of HUD
or other similar standards.
3. No lot shall be subdivided or changed in any manner unless author-
ized by the Southold Town Planning Board.
4. Clearing and grading within each lot shall be limited to that neces-
sary for siting and constructing a house with the intent of preserv-
ing as much of the natural vegetation on the site as possible.
Limiting clearing and grading will minimize stormwater runoff and
%lite erosion.

5. No stormwater runoff resulting from the development of the subdivi-
sion or any of the lots shall be discharged directly into the ad-
jacent body of water, Hay Harbor, or the tidal wetlands within the
subdivision parcel.

the upland edge of the tidal wetlands and the shoreline of Hay Harbor.
7. No sanitary disposal facility shall be installed or constructed
within 100 feet of the upland edge of the tidal wetlands and the

The following statements are offered for your consideration
in the review of the above-mentioned minor subdivision and its
referral to the Suffolk County Planning Commission:
(1) No grading, other than foundation excavation for ,a
residential building is proposed.
(2) No new roads are proposed and no changes will be made in
the grades of the existing roads . ;
