HomeMy WebLinkAboutTB-11/24/1953 go MEETING OF. NOVEMBER 24, 1953•_ . The Southold Town Board met at the office of Supervisor Norman E. Klipp, at Greenport, on Tuesday, November 24, 1953. The meeting was called to order at 1:30 P.M. with the following present: Supervisor Klipp; Justices Terry, Tuthill and Albertson; Town Superintendent of. Highways Price; Town Attorney Terry and Town t'lerk .Booth. Moved by Justice Albertwon; seconded by Justice Terry: RESOLVED: That the minutes of the previous meeting be and hereby are duly approved as read. Vote of Town Board: Ayes-Supervisor Klipp; Justices Terry, Tuthill and Albertson. Moved by Justice .Albertson; seconded by Justice Terry: RESOLVED: That the regular monthly audit meeting of this Board will be held at the office of Supervisor Norman E. Klipp at Greenport, on Tuesday, December 8, 1953, at 1:30 P.M. Vote of Town Board: Ayes-Supervisor Klipp; Justices Terry, Tuthill and Albertson. The Bond of Austin C. Burt, Receiver of Taxes, was pre- sented .to the Board for its approval. Moved by Justice Albertson; seconded by Justice Tuthill: RESOLVED: That Bond No. 2591408, issued by the Fidelity and Casualty Company in the sum of Fifty Thousand Dollars ($50,000) on behalf of Austin C. Burt, be and the same is hereby approved as to its form, sum, manner of execution and sufficiency of surety therein. Vote of Town Board: Ayes-Supervisor Klipp; Justices Terry, Tuthill and Albertson. _Moved by Justice Albertson; seconded by Justice Terry; RESOLVED: That Mrs. Otto Wahl of Southold, Edward Skwara of Cutchogue, Irving M. Rogers of Greenport and Donald S. Edwards of Fishers Island be and they hereby are appointed Dog Enumerators for the Town of Southold for the year 1954. Vote of Town Board: Ayes-Supervisor Klipp; Justices Terry, Tuthill and Albertson. Moved by Sup't. of Highways Price; seconded by Justice. Albertson: WHEREAS, Harold Price, the Superintendent offHighways of the Town of aouthold, has recommended to the Town Board the purchase from J. Edward Dickinson Lot E at a price of $300.00 said lot being situated on the Northeasterly corner of Dogwood Lane on a certain map known as Wesland at Southold., Town of Southold, N.Y. NOW, THEREFORE, BE IT RESOLVED: That Norman E. Klipp, Supervis of the Town of Southold, be and he hereby is authorize to contract for and purchase from J. Edward Dickinson fo the sum of $300.00 Lot E on the Northeasterly corner of Dogwood Lane to be used for drainage purposes. Vote of Town Board : Ayes- Supervisor Klipp, Justices Terry, Tuthill, and Albertson; and Sup't. of Highways Price. Moved by Justice Albertson; seconded by Justice Tuthill: WHEREAS THE Town Superintendent of Highways did on the 21st day of November, 1953, duly recommend the purchase of certain machinery pursuant to the provisions of Section 142 of the Highway Law, and a notice of such recommendation has been duly published as provided in such section. NOW THEREFORE BE IT RESOLVED that pursuant to Section 142 of the Highway Law the Town Superintendent of Highways -is hereby authorized to purchase from Alec 's Garage, 659 West Main Street, Riverhead, with the approval of the County Superintendent of Highways: One 1953 Willys 4 WD Pickup with Oil Filter' Heater and Defroster & Directional Signals for a total price of One Thousand Nine Hundred Ninty-four 36/100 Dollars ($1,994.36) , delivered at Peconic L. I. , .b N. Y. , and to - e ..delivered on' or about Dec. 1, 1353. The Town Superintendent of Highways is hereby authorized subject to the approval of the Uounty Superintendent of Highways, to surrender to the above-named vendor One four wheel drive Jeep Pickup as part payment for the above machinery to be purchased. The terms of payment will be as follows; Trade-in allowance---------------- $ 800.00 Check drawn on Machinery Fund----- 1,194.36 A contract of purchase for the item purchased shall be duly executed between the Town Superintendent, of Highways and such vendor, and when duly approved by the County Superin- tendent of Highways, it shall become effective. When such contract has been duly executed and approved, the Supervisor is authorized to complete such purchase upon delivery of the item purchased in accordance with the terms of such resolution and such contract, and to pay the above amount specified to be paid by check (1) by a check drawn on the Machinery Fund (Item 3) for 36. Moved by Justice Albertson; seconded by Justice Tuthill: WHEREAS the Town Superintendent of Highways did on the 24th day of November, 1953, duly recommend the purchase of certain equipment pursuant to the provisions of -Section 142 of the Highway Law, and a notice of such recommendation has been duly published as provided in such section. NOW THEREFOR BE IT RESOLVED that pursuant to Section 142 of the Highway Law the Town buperintendent of Highways is hereby authorized to purchase from Vail Bros. , Peconic,_ L. I. , N.Y. with the approval of the "ounty Superintendent of Highways: One 1953 Buick, Model Super 4 dr Sedan, Equipped as follows: Dynaflow drive, Radio & Antenna, Heater & Defroster', Wind- shield washer, Backup lights, Parking Brake Signal, Day & Night Mirror,Foam Rubber Cushion, Wheel Covers, Oil Bath Cleaner, Oil Filter, Directional Signals for a total of Three Thousand Two Hundred Sixty-four & 41/100 Dollars ($3,264.71) , delivered at Peconic, L. I. , N.Y. , and to be delivesd on or about Dec. lst, 1953. The Town Superintendent of Highways is hereby authorized, subject to the approval of the County Superintendent of Highways, to surrender to the above-named vendor One 1951 4 dr Buick Super Sedan as part payment for the above equipment to be purchased. A letter addressed to the Town Board was received from Police Sergeant Theodore B. Howard in reference to the accusations of Mrs. Ann Montgomery pertaining to his duties as Police Sergeant. Fifth Street Greenport, N.Y. November 18, 1953. Hon. Norman E. Klipp, Supervisor and Members of Southold Town Board .Dear Sirs: I understand that at the Town Board meeting held November 5th, 1953, Mrs. Annie Montgomery appeared before the Board and made certain accusations pertaining to my duties as Police Sergeant, with regard to a matter that took place on November 2nd, 1953. The following is my report to you of the action that was taken by me at that time. At 3: 55 A.M. a call was received at Police Head- quarters from Patricia DeJesus of Wiggins Street, Greenport, Southold Town. The complainant stated that he had been robbed of his wallet and keys to his house. I was sent to investigate, and i�hen I arrived at 4:02 A.M. DeJesus was at the home of his next-door neighbor, William Mitchell, and had called from there, DeJesus stated that somebody had stolen his wallet containing about $100.00 and also keys to his house. I asked him where he had been and he stated that he had been at William Mitchell 's house about 10 P.M. November 1st, and paid him for taking care of his chickens, dogs , etc. while he was at work and then he went to Len Jones and Vivian Hodges on Third Street, Greenport, and a taxi brought him home from there. When he could, not find the keys to his house, he fell asleep on his front porch. When he woke up his wallet was missing. I said to him, let 's look around the outside of the knuse, maybe you lost them there. He and I looked around the house and on the front porch, and then in the street, where I found his wallet in the gutter of the street. I opened the wallet in front of DeJesus and there was no money, only papers and cards. He then stated that Mitchell must have rolled him of his money while he was asleep on the porch. I then went to Mitchell 's house with DeJesus and told him about finding the wallet, and what DeJesus had said. Mitchell said that DeJesus was lying because DeJesus had the money in his wallet when he left Mitchell 's house. I then said to DeJesus, maybe you have the keys and money in your pockets, and I proceeded to search him in front of Mitchell at DeJesus ' request, and found $87.00 . and some change in his pants pocket, also the keys to his house in his coat pocket. DeJesus was satisfied with the results and went home. I explained the above investigation to Chief Anrig on November 9th, 1953• Very truly yours , Sgt. Theodore B. Howard A communication dated November 17, 1953, was received from the Mattituck Chamber of Commerce advising the Supervisor that after acre-s.tudyhand detailed discussion of the report of the Suffolk County Highway Superintendent, dated .April 41 1951, in f?eference to Mattituck Inlet. Thu Mattituck Chamber of Commerce fgvors as the most satisfactory and economical method of improving Mattituct inlet Plan 111 as outlined by the County Superintendent of Highways on a map entitled "Map of Mattituck Creek" , Town of Southold, t Suffolk County, New York, dated July, 1950. Moved by Justice Albertson; seconded by Justice Terry: WHEREAS, The Commissioners of the Fishers Island Garbage and Refuse District have advised the Town Board that the N. B. King & Co. , Inc. has violated the terms of its agreement with the Town of Southold, dated November 25, 1952, and WHEREAS, it is the considered opinion of the Town Board of the Town of Southold that inasmuch as the terms of the agreement have been violated, it is in the best interests- o f the town to cancel the aforesaid contract. NOW THEREFORE BE IT RESOLVED: That in accordance with the provisions of the aforesaid contract, the T,own-Boa'rd,.:-�„ of the T'otan.,,af• $oaithol.d ._- ._._ _..: (having found the terms of the contract have been violated) hereby terminates and cancels sqid contract and the Supervisor is hereby instructed to give the contractor thirty days written notice by registered mail, return receipt.
