Albert- son at Greenport, N.Y. on Tuesday, April 11, 1961." `The meeting was called to order at 3:00 P.M. with the following present:-, Supervisor Albertson; Councilmen Demarest and Grathwohl; Justice Tuthill; Town Attorney Tasker; Supt. of Highways Price and Town Clerk Richmond. Moved by Justice Tuthill; `seonded by Councilman Grathwohl; RESOLVED: That the next regugar monthly meeting of the Town Board'will be held- at the- office of Supervisor Lester M. Albertson- at 16 South Street, Greenport„ N.Y. on Tuesday, April 25, 1961, at 3: 00 P.M. Vote of Town Board: Ayes-'Supervisor Albertson; Councilmen Demarest and, Grathwohl; Justice Tuthill . Moved by Councilman Demarest; seconded by Councilman Grathwohl; RESOLVED: That the -minutes of the meeting of March 28, 1961, be- and they hereby are duly approved. Vote. of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; Justice. Tuthill. Moved by Councilman Demarest; seconded by Justice. Tuthill: RESOLVED: That the::-report of- Ralph P. Cos, Dog Warden, for the month of March be accepted by the Town Board and placed on file. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl.; Justice Tuthill. Moved by Councilman Grathwohl; seconded by Justice Tuthill; RESOLVED: That the Auxiliary Police report for the month of March be accepted by the Town Board and placed on fi&6. Moved by Councilman Demarest; seconded by Councilman :',Grathwohl: WHEREAS, the Town Board has for the past several months studied the _ question of the institution of a twc--�i.nstal-3m8 f sttem of payment of real property taxes in the 'Town of Southold and in connection therewith has given consideration to additional administration expenses which may be incurred as a result of such asystem as well as the benefits which will accrue to the taxpayers of the Town of Southold by the installment payment of taxes, and WHEREAS; the Town Board believes that the conveniences and benefit to- the taxpayers of the Town by the institution of a two-payment tax collection system would more that offset any additional administration expenses that May be incurred and that the installment system of collection of taxes. would be in the interests of the people of the Town of Southold, NOW, THEREFORE, BE IT RESOLVED: by the Town Board of the Town of Southold, a as follows: Section I . That after December lst next suceeding, all taxes upon real estate on. the tax roll shall be, due and payable and shall be and become liens on' the real estate affected thereby, and shall be construed as and deemed to be charge thereon on-.'December lst of each year, and not earlier, and shall remain such::,-liens Uhtilt'paid. . Provided, however, that there shall be no penaltyif -'one-haif `ot all such taxes are paid. to the receiver of taxes upon or before the succeeding 10th:,-day of January and the second one-half of all such taxes are paid, to the." receiver of taxes on or before ','.the succeeding 31st day of May. On all such-first one-half of taxes upon real estate remaining unpaid on the loth day:, of"January, one percentum of the amount` of the said one-half of the tax will be added, and an "addit- ional .one ,percentum will be added for each mon'th .thereafter, until the return of the warrant to the County Treasurer. The second- one-half of the tax on real. estate which is due on the preceding 1st day of December may be paid without penalty on the loth day of May or at- any time thereafter, until, but not including, the succeeding lst day of June, providing the first -one-half of such tax -h'all have been paid or shall be paid at the same -time. The warrant annexed to the tax roll of the .Town of Southold shall be made to conform to the provisions of Section 13, Subdivision 5 ,of the Suffolk County Tax Act and the provisions of this resolution. .430 Section 2. Moved by Councilman Demarest-; seconded by,Justice Tuthill: WHEREAS, the Burton Potter Post #185 American Legion has _applied to the ` Town Clerk of the Town 6f ,.Southold fora Bingo License, and WHEREAS, the Town Board has examined-;the application and after investig- ating the matter, duly made findings and determinations as required by Law, NOW, THEREFORE,. BE IT RESOLVED: That the. Supervisor be and he her.e- by is authorized and directed to execute on behalf' of this Board the findings and determinations required by law and it :is further RESOLVED: That the Town Clerk be and he hereby is directed to issue a Bingo License to the Burton Potter . Moved by Justice Tuthill; seconded by Councilman, Demarest: WHEREAS, , THE Town Board of the Town of Southold, pursuant to due notice thereof, held a public hearing on an application of the Long Island RaiM- road Company for a franchise to- operate an omnibus line on or over the streets, highways and public p4aoes of the Town of Southold, Suffolk County, New York, on February;_27, -.1961, at which time .all .interested, persons were given an opportunity to ,be heard, now therefore, be it, RESOLVED: That the Town Board of .the Town of Southold grant said fran- chise to the Long Island Railroad Company, subject to the following terms and conditions: , A. That the route over which said omnibus shall operate shall be New York State Route, #25'. B. That no passengers shall be discharged in the Town of Southold -while said .omnibus -is traveling in a -westerly direction through $aid Town ., and; that no passengers shall be picked up by said omnibus in the Town of Southold while said omnibus is traveling in an easterly direction- through the Town of Southold. C. That this franchise is contingent upon and subject to the Long ,Island Railroad Company obtaining 'a.'-Certificate of. Public Convenience and Necess- ity to operate said omnibus line upon, and over the Highways in the. Town of- Southold from New York State Public Service Commission. In the event that said Long ,Island Railroad Company fails to obtain said Certificate of Public convenience and Necessity from the New York State Public. Serv- ice Commission, then this franchise shall be null and V6id.. D. That this franchise is granted fbt .a term of two years from Apr il, 11, 1961 . E. That the said Long Island: Ra-ilroad Company pay to. the Town of Southold the sum of `thirty dollars 'as :and for a fee for.,the, granting -of this franchise. Vote -of Town Board:. Ayes-Supervisor Albertson; Councilmen Demarest :and ' Grathwohl; Justice Tuthill. Letters concerning erosion were received from: Lillian Tomac, Nelson Axien and Neil Rappa. A letter was received from Mrs:. Ann. Currie-Bell, thanking the Board for its help and interest in the historical work_ in the Town of Southold 0 1 Moved by Justice Tuthill; seconded by Councilman- Grathwohl-WHEREAS, the .term of office of Robert Bergen of .Mattituck as a' member of the Board of Appeals, of the Town' of Southold expires' on April 19, 1961, and WHEREAS, in the. past, as a member of the Board of Appeals Robert Bergen has rendered the Town df Southold a most valuable service, NOW, THEREFORE, BE IT RESOLVED: That Robert Bergen be and he hereby is appoint- ed. as .a member of the Southold' Town Board of .Appeals for a term of five years commencing April 19, 1961' and ending April 19, 1966. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; Justice Tuthill: Moved by Councilman Demarest; seconded by Justice Tuthill: WHEREAS, the term ,of office of Archibald. Young of. Southold as a member of the Planning Board of the Town of Southold expires April 30, 1961, and ..WHEREAS, in. tha past, as a member_ of- the Planning Board, Archibald Young has rendered the Town of Southold 'a most valuable service, NOW, THEREFORE BE IT RESOLVED: That Archibald Young be- and he hereby is appointed as a member of the Southold Town Planning Board for . a term of five years commencing April 30, 1961 ' and ending April 30, 1966. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest; and bra thwohl; and Justice Tuthill. Moved by Councilman Demarest; deconded by Justice Tuthill: WHEREAS, a petition was received from Herbert L. and Lloyd C. Kalin re- questing a "change of zone of certain''proRerty situated in Greenport N.Y. and more fully described' in said petition from "A" Residential and Agricultural District to "B" Business District, NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of South- old be and he hereby is 'directed to transmit said petition to the Planning " Board in accordance with - Section 901, Subdivision C of Article IX of the Building Zone Ordinance.,lrof ,the Town of Southold, Suffolk County, New York. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen- Demarest and Grathwghl; Justice Tuthill. Moved by Justice Tuthill; seconded by Councilman Grathwohl; RESOLVED: That the report of Howard M. Terry,- Building Inspector, for the month of March be accepted by the Town Board and placed on file'.' Justice Tuthill; Seconded by Councilman Demarest: RESOLVED: That General Bills in the amount of $8, 244.84; ' Lighting District . Bills in the amount of $5, 206.80, Fishers Island Ferry District Bills in the amount of $12, 792.26 be and the same are hereby ordered paid.
