The Southold Town Board met at the office of Supervisor Lester M.
Albertson ,,at_: Greenport, on Tuesday,, February-14, 1961, at 1:30 P.M. with
the following present: Supervisor Albertson; Councilmen Demarest. and
Grathwohl; Justices Tuthill and. Clark; Supt., of Highways Price;,Town
Attorney Tasker and. Town Clerk Richmond.
Albin Pietrewicz spoke for the Cutchogue Chamber of Commerce on parking
signs in. the Cutchogue ,Parking: lot, ,suggesting 1) that a sign be erected ,
at the .South end of the west boundary fence of the Main Street Parking.
Field in the Village of Cutchogue with NO- PARKING 25 feet North of .side-
walk and a notice of a 3-hour parking. limit be established for the rest
of this field,, and 2) That 6 sign be erected at the north boundary of
the New Suffolk parking field (opposite the' Fire House) stating-ALL -DAY
PARKING. The Board agreed that this woyld-be a help and' -that they would
contact Harold Price, Supt. of Highways on the matter.

At 2:00 P.M. in accordance with a notice published according to law,
bids were opened for proposalCi .for furnishing to the Town of Southold

PM of said day in the matter 'of the application' of -the Long Island Rail-
road Company requesting the right, franchise, permission or consent to
operate an omnibus line on and over the streets, highways and public
places in the Town of Southold, Suffolk County, New York.

WHEREAS, a vacancy exists in the office of Commissioner of the Cutchogue-
New Suffolk Park District caused by the resignation of Corwin. C. Grathwohl,
and
WHEREAS, the, Town Board desires to appoint a qualified person to fill
such vacancy pursuant to the provisions of Section 215 of the Town Law, .
NOW, THEREFORE, BE .IT RESOLVED: that John Earl Timpson -be and he hereby
is appointed Commissioner of the Cutchogue-New Suffolk Park District in
the Town of Southold, Suffolk County, New York, to fill the vacancy created

by. the resignation of Corwin C. Grathwohl, the said John Earl: Timpson
to hold such office until the 31st day of December, 1961.

.. WHEREAS,,- the Town Board of the Town of Southold<::.at a meeting held on the
4th day of. October, 1960, duly enacted an ordinance entitled "Boat
ordinance of the Town 'of Southold;' and
WHEREAS, the Town Clerk of -the Town of Southold thereafter caused a copy
of said ordinance to be submitted to the Conservation Hommissioner of
the State of New York for his written approval pursuant to the provisions
of Section 130 of the Town Law, and
WHEREAS, on November 18, 1960 the Conservation Department advised the
Town Clark that they suggested that Section 7 subdivision (a) of said
ordinance be amended to read as follows: "No person shall operate a
vessel for towing a person on water skiis, a surf-board or similar
device unless there is in such boat or vessel a person, other than the
operator, of a t least tem years of age, in a position to observe the
progress of the person being towed. " And also suggested that Section 7 ,
subdivision (b) be amended to read as follows: "No person shall ride on
skiis, a surf-board or similar device or use or operate a boat to tow
a person thereon between the period of one hour after sunset to one
hour after sunrise" and
WHEREAS, said ordinance 'cannot become effective until the same has been
approved in writing by the Conservation Commissioner of the State of
New York and the Conservation Commissioner will not approve, said ordin-
ance until the aforesaid amendments have been made,
NOW, .THEREFORE, BE IT RESOLVED: That a public hearing be held by the
T.own 'Bo'ard of the Town of Southold at the Supervisor' s Office, 16 South
Streeti, .Greenport, New York on the 7th day of March, 1961 at 7:00
o'clock P.M. of said day in the matter of the amendment of the Southold
Town ordinance entitled "Boat Ordinance of the Town of Southold."as4�follows;
1. By amending Section 7 subdivision (a) to read as follows:
(a) No person shall operate .a vessel `for towing a person on water skiis
a surf-board or similar' device unless there is in such boat or vessel
a person, other than the operator, of att least ten years of age, in
a position .to observe the progress of the person being towed.
II. . By amending Section- 7 subdivision (b) to read as follows:
(b,) No person shall ride on `water skiis,, a surf-board or similar device
or use or operate a boat to tow a person thereon between the period
of one hour after sunset to one hour after sunrise.
BE IT FURTHER RESOLVED: that the Town Clerk of the Town of Southold cause
written notice of said hearing to be published once in the Suffolk Times,,
the official newspaper of said Town at least 10 days prior to the date
of said hearing:

WHEREAS, a petition was received from Procan Inc. , William Baxter and
Martin 'Filla requesting. a change of zone of certain property situated
on',Main Rd. , Mattituck, and morefully described. in said petition from
"A"" Resdettial and agricultural District to "B" Business District, and
WHEREAS, this request left a 60 foot section zoned as "A" Residential
and Agricultural -District, it:'was' the opinion of the Board to rezone all
this section on its' own motion to . "B" Business District,
NOW, THEREFORE, BE IT RESOLVED: That the Town Board, on its own motion,
amend the Southold Town Building Zone' Ordinance (including the Building
Zone Maps) as' follows:
l.. By changing from "A" Residential and Agricultural District to "B"
Business. District the following described property, to wit:

ed with their recommendation pursuant to section 901. of the Building
Zone Ordinance of the Town of Southold.

RESOLVED: That the following agreement be executed by the Town Board:
THIS AGREEMENT made and executed this 25th day--of January, 1961, by
and between Town of Southold, Suffolk County, New York, as representing
Fishers- Island Lighting District, hereinafter known as Customer, and
Fishers Island Electric Corp. , Fishers Island, New York, hereinafter
known as' Contractor,
WITNESSETH that the Customer hereby makes application for and the Con-
tractor hereby agrees to furnish, equip, maintain and supply the current
for fifty (50) street lights numbered 1 through 50.
Subject also to the following terms and agreements:
That the-Customer hereby agrees to pay the contractor for these fifty
(50) ' lights in the amount of $40.00 per street light, pe: annum.;i, payment
for same to be made at the endoof each month as billed by the Contractor
commencing January 1, 1961. That the Contractor hereby agrees to furnish
all necessary poles, wires, brackets; lights, light bulbs and electric
current that may be . necessary to have said street lights in proper work-
ing order between the hours of one-half hour after sunset until one hour
before sunrise, and for a greater length of time at the discretion of the
Contractor, provided only ; that the aformentoned cost to the Customer
shall not be increased. That each street light shall not be less than
600 lumens. That this agreement shall be effective January 1, 1961 and
shall endure for a Jperiod of five (5) years therefrom, to expire
December 31, 1965 .

WHEREAS, the Superintendent. of Highways has advised the'�Town Board that
a serious highway drainage condition exists in the vicinity of the inter-
section of Railroad Avenue and North Road at Southold, in the Town of
Southold,� and
WIffEREAS, ache Supt. of Highways recommends that the Town acquire a,parcel
of land in this area for purposes of highway drainage and that Antone
Grigonis, Jr, and Estelle Grigonis, the owners of land at said intersection,
have agreed to convey to the Town of Southold a parcel- of land for such
purposes, said parcel being more fully described below, for the sum of
$750.00, and the Highway Supt. recommends that the Town acquire said
property at said -price,
NOW, .THEREFORE, BE IT RESOLVED that the Town of Southold. purchase. ,from
Antone. Grigonis, Jr . and Estelle Grigonisthe real property hereinafter
described, for highway drainage purposes, for the sum of $750.00,. said
premises being described as follows:
BEGINNING at the intersection of the westerly line of Railroad Avenue_
with the southeasterly line of North Roadtand running thence along the
westerly line of.Railroad Avenue, South 15 degrees 15 ' 00" East 70;00 feet; .
thence along other land of the Seller, at right angles to said westerly
line of Railroad. Avenue, South 74 degrees 45 ' -00" West 78.51 feet •to

of the aforesaid real property for the sum of $750.00 and that the .Super-

effect said purchase.

A RESOLUTION AUTHORIZING THE ISSUANCE OF A BUDGET NOTE OF THE TOWN OF
SouTHOLD, SUFFOLK COUNTY, NEW YORK, IN THE AMOUNT OF $15, 000.00 TO PAY
THE COST OF SNOW REMOVAL FOR THE TOWN OF SOUTHOLD
BE . IT RESOLVED, by .-the Town Board of the Town of Southold, Suffolk County, -
..New. York, as _follows:
BUDGET NOTE RESOLUTION DATED FEBRUARY 14, 1961.
RESOLVED: Section 1: Pursuant to subdivision 1 of paragraph .a of Section
29.00 of the Local Finance Law, .for the purpose of paying the cost. of
snow removal, there is hereby authorized to be issued:;. a Budget Note
of the' Town of Southold, Suffolk County, New .York, in the ,principal
amount- of $15, 000.00, which is the maximum cost of such object or purpose.
Section 2. The proposed maturity of .the Budget_ Note hereby authorized, will
not be in excess of one year .
Section 3 . Subject to the provisions of the Local Finance Law, the..power
to sell such note is hereby delegated to the Supervisor, the chief Fiscal
Officer.,. Such Note shall be of such terms, form and contents, and shall
be sold in such manner, as may be prescribed by the Supervisor, consistent
with the provisions of the Local Finance Law.
Section 4.. The faith and credit of the Town of Southold, Suffolk County;
New York, are hereby irrevocably pledged to the payment of the principal
of and interest on this Note, An amount sufficient to pay the principal
and interest on such Budget Note shallbbe included in the next annual
budget and levied as a part of the taxes for the fiscal year in which the
same matures.
Section 5 . The validity of such note may be contested only if:
(1) Such note is authorized for an object or purpose for which said Town
of Southold is not authorized to expend money, or
(2) The provisions of law which should be complied with at the date of
publication of this. resolution are not substantially complied with, and
andaction, suit or proceeding contesting such validity is commenced with-
in twenty days after the date of such publication, orc'
(3) 'Such note is authorized in violation of the provisions of the constit-
ution. .
Section 6. This resolution takes effect immediately, shall be published
in full in the Suffolk Times, Greenport, New York, the official newspaper
of the Town of Southold, together with a notice of the Town Clerk in
substantially the , form provided in Section 81.00 of the Local Finance Law.

WHEREAS, athe Village- of Greenport wishes to enter:±.into a contract with
the Town of Southold for the use of the Village Dump to be used by all
residents of the Town of Southold,
RESOLVED: That Supervisor Lester M. Albertson be and he hreby is authori
zed and directed to enter: into the following contract with the Village
of Greenport:
THIS AGREEMENT made this day of February, 1961, between the Town of
Southold, a municipal corporation in the County of Suffolk, having its
principal offices at Greenport and Southold in thb Town of Southold,
Suffolk County, New York, hereinafter called the Town, and the village
of Greenport, a municipal corporation in the Town of Southold, Suffolk
County, New York, having its principal place of business at la South Street,
Greenport, New York, hereinafter called the Village,
WITNESSETH
WHEREAS, suvdivision 20-a of Section 64 of the Town Law authorizes the
Town' to contract with the Village for the use of dumping grounds within
the Village, and
WHEREAS, the Town Board, has by resolution, duly authorized the Supervis-
or to execute this agreement on behalf of the Town and
WHEREAS, the Board of Trustees of the Village has duly authorized the
mayor to execute this agreement on behalf of the Village,
Now, therefore, in consideration of the premises and of the covenants
and conditions herein made, it is mutually agreed by and between the part-
ies as follows:
1) The dumping facilitces and dumping ground now owned and maintained
by the Village shall be available to all residents of the Town for the
disposal of their garbage, ashes, rubbish and other waste matter .- Said
dumping area shall be properly maintained and operated under the exclusive
control of the Village. Such use, by the residents of the Town shall be
in conjunction with use by the residents of the Village and shall be
subject to the orders of the duly authorized attendant (s) and the ordin-
ances, rules and regulations of the Board of Trustees of the Village.
2) The Village agrees to hold the Town free and harmless from any claims
for damages whatsoever arising out of or by. virtue of the use of the afore-
said dumping facilities by tIm Town or the residents thereof.
3) This agreement shall continue in effect until the 31st dgy of December
1966 provided however, that either party, by giving written notice to the
other on or before October 31st in any year, may elect to terminate this
agreement as of December 31st of the year in which such notice is given.
4) For the use of the said facilities the Town will pay to the' Village
annually and on or about March 1st of every year during the term of this
agreement the sum of $4, 000.
IN WITNESS WHEREOF the parties have caused these presents to be. signed
in two counterparts, either of which may-be considered as an original
by their duly authorized officers the day and year first above mentioned.

RESOLVED: That pursuant to Section 11 of the. General Municipal Law, the
Supervisor, the chief fiscal officer, be and he is hereby .authorized
temporarily to depositor invest moneys not required for immediate ex-
penditure in special time deposit accounts in, or certificates of de-
posit issued by, a bank or. Trust Company located and authorized to do
business in the State of New York, provided however,. that such time
deposit account or certificate of deposit shall be payable within such
time as the proceeds shall be needed to meet expenditures for which
such moneys were obtained 'and provided further that such deposit account
or certificate of deposit be secured by a pledge of obligation of the
United States of America or obligations of the State of New York. .

WHEREAS, the Town Board of the Town of Southold has been advised that
the Coast Guard Moorings, New London, Connecticut, as well as the Fishers
Island, New York, Coast. Guard Life Boat Station have hadnpersonnel
reduced, and
WHEREAS, the number of boats in this area is increasing, and
WHEREAS, within the -past year the Coast Guard assisted some 321 boats,
involving 872 persons, and were called on for 98 law enforcement 'missiions,
and transported some 20 emergency cases from Pshers 'Island to 'New London,
Connecticut;
NOW, THEREFORE BE IT RESOLVED: That the Town Board of the Town of South-
old hereby requests that the members of Congress exert their efforts
to insure that the above-mentioned Coast Guard installations should not
suffer a reduction in personnel at this time, beat rather that some
thought be given to an increase of personnel to handle our growinggneeds
in this area, and be it further .
RESOLVED: That a certified copy of this resolution be forwarded to Senator
Jacob. Javits, Senator Kenneth Keating, Congressman Otis Pike, _,and Congress-
Man Horace Seely-Brown at Washington D.C.

RESOLVED: . That Supervisor Lester M. Albertson be and he hereby is author-
ized to petition the State Traffic Comm ission to place 35 M.P.H. signs
at a reasonable distance north and south of "Our Lady of ostrabrama- Church"
on Depot Lane, Cutchogue, New York.
