MEETING OF JANUARY 26, 1961
The Southold Town Board met at the office of the Supervisor
Lester M. _ Albertson at Greenport on Thursday, . January .26, 1961 at
7: 30 P.M. , with the following present: Supervisor 'Albertson,
Councilman Demarest, Justices Tuthill and Clark, Superintendent of
Highways Price, Town Attorney Tasker and Town Clerk Richmond.
At 7: 30 P.M. the Supervisor opened the public hearing authorized
pursuant to a resolution of the Board adopted on the 15th 'day .of
December 1960, on the change of zone from "A" Residential and -Agri-
cultural District to "B" Business District on certain property in
Mattituck in the vicinity of the intersection of 'Sound Avenue,'
Middle Road and Cox Neck Road. Also ,by amending .the Southold Town
Building Ordinance. The minutes of this hearing were recorded by
George T. Lederle.
The following letters were read from the Southold Town Planning
Board: January 13, 1961, Gentlemen: The Southold Town Planning Board
wishes to. make the . follow ing recommendation to the Southold Town Board:
It is suggested that all small islands, not shown on the zoning map,
either natural or man made, now or in the future,. be interpreted to
take the highest zoning category, namely "A" Residential 'and Agri

January 13, .1961, Gentlemen: The following is a resolution
adopted by ,the Southold Town 'Planning Board at 'their meeting January
121' 1961: "On motion of Mr. Moisa, seconded by Mr. Young and carried
it was RESOLVED that this Board hereby recognizes the interpretation
by. Counsel for the Town of Southold that all lands in the Town which
either are or have been under .the jurisdiction of the, Federal govern-
ment shall revert to the highest zoning classification at any time
that they are released to the jurisdiction of the Town of Southold.
Vote of the Board: Ayes: - Mr. Wickham, Mr. Moisa,. Mr. Grebe, Mr.

WHEREAS, . Florence B. St.Amand has been employed as °Confidential
Secretary to the Supervisor of the Town of Southold since . January,
1960, and
WHEREAS, the said Florence B. St.Mand wals involved in a
serious automobile accident as a result of which she-. sustained
serious personal injuries 'and 'is presently hospitalized as a 'result -
thereof, and
WHEREAS, the said Florence 'B. St:Amand "has not taken any ,
vacation to date and is entitled to a paid vacation of .two weeks,
NOW, _THEREFORE, BE IT RESOLVED, that the Supervisor of the
Town of Southold- be and hereby is authorized and directed. to pay
the said' Florerice B. St.Amand two weeks vacation time and' in alddi-
tion thereto . two weeks sick leave.

RESOLVED, that 'the Supervisor be and he hereby is authorized
to ..employ a confidential secretary and that .the person- so designated
by the Supervisor shall receive the sum of $4, 500. 00 compensation
per yearpayable monthly.

The following resolution was offered by Justice Ralph Tuthill,
who moved its .adoption, seconded by Justice Henry,. A. Clark; to wit:

WHEREAS, the Town Board of the Town of Southold heretofore
authorized the issuance of a deferred.-payment note 'in the amount
of '$20,,000. 00 pursuant to a resolution adopted on February 2; 19591
in connection .with the. purchase of real 'estate -'for 'use as public
bathing beach 'and recreation areas which said-`note was dated and
..issued on March 3, 1959; to the First National Bank of Oreenport,
New York (now .The Valley National Bank of -Long .Island' ) , ' and
WHEREAS, by the terms 'of said deferred payment 'note resolution
dated February- 2, 1959, the deferred payment note authorized pur-
suant thereto provided for the payment o'f -not 1'ess than-'20% of r
the aggregate principal amount of said note, together with interest
..at the rate of 2-1/2% per annum," 'and

WHEREAS, pursuant" thereto, the -sum of $4, 000. 00 was paid on
account -of said note on March 3, 1960, and a renewal of said note in the
principal amount of $16, 000. 00 was •then ,execu.ted and delivered by
the Supervisor to The First National Bank- of Greenport, New York .
(now "The -Valley National Bank of Long Island) and saidnote is due
and payable 'on March 3, 1"961,' .and the Town .Board desires to pay the
sum of not less than 20% of the aggregate principal amount of 'sa.'id
note, to wit, the sum of $4, 000..00 and ,to 'issue .a renewal deferred.
payment note. for the .unpaid balance of .principal due thereon, 'to
wit, the sum of $12, 000.,00
NOW, THEREFORE,. BE IT RESOLVED that the .Town 'Board of' the Town
of Southold, , Suffolk County,- New York,,.. does hereby authorize the
issuance of a deferred payment note in the principal amount of
$12, 000. 00 for a term of.'one year with interest at _the rate of
2-1/2%, . payable at. maturity, and
BE `IT FURTHER RESOLVED, that the power to .sell such deferred
payment note is hereby delegated to the Supervisor;- the chief ,fiscal
_ officer. Such note shall be of such terms, form and contents, and.
shall be' sold in such manner,., as may be 'prescribed by"the-'Supervisor,
consistent with the ,provisions of the Local Finance Law: ;
The question of the adoption- -of the foregoing resolution was
duly put to a vote on roll call, which resulted as 'follows: .
Supervisor Lester Albertson voting yes; Councilman Louis Demarest
voting yes; Justice Ralph W. Tuthill ,voting, yes; Justice ;Henry A.
Clark voting yes. The resolution was thereupon declared duly adopted.
The Town Clerk received "the resignation of Corwin C. Grathwohl,
Commissioner of ,the Cutchogue-New Suffolk Park District, ieffective
January 26, 1961.

WHEREAS, a vacancy exists 'in the office ,of Councilman of the
Town of Southold, Suffolk County, New York, caused by the resign-
atibm.:of Lester M. 'Albertson who was elected to -such office on the

NOW THEREFORE ,BE IT. RESOLVED, that, pursuant to the authority

of the Town Law,' that Corwin IC.I Grathwohl, be and he hereby 'is
appointed`to the office of Councilman `of the Town -of 'Southold to
fill the ,vacancy existing in said office, and that such appointment
shall take effect immediately and _the said Corwin C. Grathwohl. shall
hold such office until January- 1, 1962.

Three (3) new 1961, 2-door sedan, 8 cylinder., standard"model
automobiles ,(minimum wheelbase 118 inches) color black, for use as
pQl_i.ce .cars, ,each to ,be :,equipped with heater and defroster;. spare

The delivery date must be specified and "each bid must be
. .accompanied by the deposit of a certified 'eheck made payable to
the order of the. Supervisor of the Town of Southold in the sum 'of
$100. All deposits .except -'that of the . successful bidder will 'be
returned. Upon acceptance of his bid, if the successful bidder
fails to enter into a contract pursuant to the requirements df
the Town Board, then the check deposited as aforesaid and the
moneys standing to the credit of the 'same shall be forfeited to
the Town' of -Southold as liquidated •ddmages. If the successful'
bidder enters into the .contract and delivers the automobiles '
pursuant thereto, the deposit will be returned:
The Town Board reserves the right to reject any and all. bids
and to waive any defect or informality in any bid should it be

WHEREAS, �the. New York Town Law establishes four year terms
for certain elective officers and two Year terms for other -elective
officers, and
.WHEREAS; the establishment of .four year terms for all elective
town officers is desirable 1to attract. the most able and most :qual=
, ified persons for public office in .the .Town..Government, and.
WHEREAS, an officer elected for a four year term attains . -
greater experience and can thereby render more competent and ,
efficient service, and
WHEREAS, the institution .of four year terms for .al� -elective
town officers would result in significant tax savings through
reduced election expenses and more eff cient governmental ;operation,
and
WHEREAS, the New York Town Law'.Sec. . 24-A establishes a . .
procedure for instituting four year terms for ,all : elective; town;`
officers in Erie County through resolution of the Town' Board ;and
Public .Referendum, and
WHEREAS, the adoption .of enabling legislation such as New,
York Town Law Sec. 24-A ' for the County of Suffolk is, desirable, ,
now., therefore, be- it
RESOLVED BY THE TOWN BOARD OF THE TOWN OF :SOUTHOLD, IN THE.
COUNTY OF; SUFFOLK, NEW YORK, as-follows,:

This Board favors and recommends the enactment of. the following
legislation to permit institution of ;four gear terms for all
elective town officers" on" a. local option" basis:
An Act to amend the Town Law, in relation to empower-
ing_ Town. in Suffolk County" to. establish - four year terms
of office for elective town officers..
The- people of the- State of New- York-, represented in Senate
and' Assemblyl do enact as follows: .
SECTION 1. The Town Law is hereby amended by adding thereto a
new section, . to be .section twenty-four-B, to read as follows: •
S-24-B Notwithstanding the provisions; of section twenty-four of
this chapter or any other ,general law, and, at. least, one hundred
fifty days prior to any biennial town election, the Town Board, of
any town", of the first class. or second class in Suffolk .Count may
" adopt a resolution, to, provide that the term of office of, each
elected town- official thereafter elected shall be four years; and
such•,xesolution shall be submitted to the qualified electors of
the-. town. for their approval or disapproval at the newt. biennial
town election. No such -resolution shall become effective until
approved by the affirmative vote of the majority of-the qualified
electors of the town voting on such proposition. The submission
of. such proposition shall be as provided in Article Seven of this
chapter -for a referendum thereunder in like manner as if a petition
therefor had been filed in accordance with, th.e provi-sions of this
chapter, except that ?.such. proposition shall be submitted only at
a biennial town election_ as hereinbefore provided. If the "Town
Board shall have adopted such- a resolution and if a majority -of
the voters cast on any such proposition "when submitted," as here-in
provided shall- be in the affirmative, the terms of office of all
town .officers thereafter elected shall, be for a. period of four
years.
SECTION 2. . This act shall take effect immediately.
