Meeting of October 5 ,, 1971
The Southold Town Board met at the office of Supervisor Albert
M. Martocch-ia, 16 South Street, Greenport, New York; on Tuesday,
October 5 , 1971 at 3 :00 P.M. , with the following present:
Supervisor Albert M. Martocchia, Councilman James H.
Rich, Jr. , Justice Martin Suter, Councilman Howard . C.
Valentine, Justice Louis M. Demarest, Town Attorney
Robert W. Tasker, Supt. of Highways Raymond C. Dean,
and Town Clerk Albert W. Richmond.
Absent: Justice E. Perry Edwards.
Moved by Councilman Valentine, seconded by Councilman Rich, it was
RESOLVED that the next meeting of the Town Board of the Town of
Southold will be held at the office of Supervisor Albert M.
Martocchia, 16 South Street, Greenport, New York, on Tuesday,
October 12, 1971 at 3 :00 P.M.
Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman
Rich, Councilman Valentine, Justice Suter, Justice Demarest.
Moved by Justice Suter, seconded by Justice Demarest, it was
RESOLVED that the minutes of September 21, 1971 be and they
hereby are approved.

Moved by Councilman Valentine, seconded by Justice Suter, it was
RESOLVED that the reports of Supervisor Martocchia, Justice
Suter, Building Inspector Terry and Town Clerk Richmond, for the
month of September 1971, be accepted by the Town Board and
placed on file.

Rich, Councilman Valentine, Justice Suter, Justice Demarest.
Moved by Justice Demarest, seconded by Justice Suter, it was
RESOLVED that .the Supervisor, Albett M. Martocchia, be authorized
to advertise for bids for 300, 000 gallons of premium gasoline,
or as much as may be needed, for the Town of Southold.
Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman
Rich, Councilman Valentine, Justice Suter, Justice Demarest.
Moved by Justice Suter, seconded by Councilman Valentine, it was
RESOLVED that the Southold Town Board approves the action of .the
Fishers Island Ferry District in the hiring of Gary Lee Thompson
of 101 . Connecticut Blvd. , Oakdale, Connecticut, in place of
Donald Sweet, who resigned as watchman at the New London Terminal.,
and be it
FURTHER RESOLVED that Gary Lee Thompson be compensated at the
same rate of compensation as Donald Sweet, namely at $90. 00 per
week, to be employed for the remainder of the season only.

Moved by Councilman Valentine, seconded by Councilman Rich, it was
RESOLVED that Supervisor Albert M. Martocchia be and he hereby is
authorized to obtain Attorney Joseph Lite to represent the
Southold Town Assessors .in the tax review proceedings, and that
he be paid a reasonable compensation for his services. Review
proceedings are : Johh Evans, Greenport Play House, Westbury
Equipment, William Seligson.

Rich, Councilman Valentine, Justice Suter, Justice Demarest.
On motion of Justice Demarest, seconded by Councilman Rich, it was
RESOLVED that the following transfer of monies be made: $2500.00
from A1990.4 Contingent Fund, to A8160.4 Refuse &Garbage Fund.

Moved by Justice Suter, seconded by Councilman Valentine,
WHEREAS,, Sophie Saunders applied to the 'Town Board for a single
trailer renewal permit dated October 1, 1971, `
NOW, THEREFORE, BE IT RESOLVED that the application of Sophie
Saunders to locate, a single trailer on her property at Main Road,
Laurel,' New'York, be and hereby is granted for a period of six
(6) months.

Rich, Councilman Valentine, Justice Suter, Justice Demarest.

WHEREAS William A. Steiner applied to the Town Board fora single
trailer renewal permit dated September 30, 1971,
, NOW, THEREFORE, .BE. IT RESOLVED that the application of William
A. Steiner to locate a single trailer on his property at John
Road, east side Main Road, Mattituck, New York, be and hereby
is granted for a period of six (6) months.

Moved by Justice Demarest, seconded by Councilman, Rich, it was
RESOLVED that the Southold Town Board _release the bond of Donald
and Lorna Tuthill in the amount of $47, 000, a-s. recommended by
the Southold Town Planning Board, , for the completion' of roads in
the subdivision known as Yennecott Park, Southold, L.I. , New York.

Moved by Justice Suter, seconded by Councilman Valentine,
WHEREAS, Burton Potter Post #$185., American Legion, Greenport, New
York, applied to the Town Clerk for a Bingo License Amendment,
and
WHEREAS, the Town Board has examined the application and after
investigation, made . findings and determinations as required by law,
NOWO THEREFORE, ' BE IT RESOLVED that the Supervisor, be and he
hereby is authorized and directed to execute on behalf of the
. Town Board the findings and determinations required by law., and
it is further
RESOLVED that the Town Clerk be and he hereby is directed to
issue, an amended Bingo License to the , Burton Potter Post ##185 ,
American Legion, Greenport, New York.

Moved' by Councilman Valentine, seconded by Justice Demarest,
WHEREAS Kenneth Watson, Patrolman, Southold Town Police Depart-
ment, presented to Supervisor Martocchia, his resignation to
.become effective September 23 ,, 1971,
NOW, THEREFORE, BE IT RESOLVED that the Town Board accepts , with
regret, the resignation of Kenneth Watson effective September 23,
1971.

Moved by Councilman Valentine, seconded by Justice Suter,
WHEREAS the Senior Citizens, Mattituck, - New York, request the use
of a bus for transportation to West Point, New York,
NOW; THEREFORE, BE IT RESOLVED that the Town of Southold furnish
transportation for the Senior Citizens as request, the sum not
to exceed $214.00.

Moved by Justice Suter, seconded by Councilman Valentine, it was
RESOLVED that the Town Clerk be and he hereby is directed to
request the Long Island Lighting Company to install the follow-
ing overhead street lights':-
1 = 17'5 -MV '- LILCo Pole #1, Tuthill Rd. , off Rt. 27 ,
at entrance to Town Disposal Area, Cutchogue, N.Y. '
1 - 100 CP - Pole # 9 , Summit Drive, Capt. Kidd Estates ,

The Town Clerk presented the Town Board with the tentative
budget for 1972 as required by law.
Moved by Councilman Valentine, seconded by Councilman Rich, ,it was
RESOLVED that General Bills in the amount of $9, 038.69; Fishers
Island Ferry District bills in the amount of $15 , 000. 62 ; Lightiigg
District bills in the amount of $401. 14; Capital account bills
in the amount of ;�-113 . 94; and Highway bills in the amount of
$25,453.47 be and the same- are hereby ordered paid.

Supervisor Albert M. Martocchia stated that he had received
notice from the Civil Service Commission granting a one year
extension to September 30, 1972 for' Alfred Grebe, a member of
the Planning Board of the Town of Southold.
The following letters were read to the Town Board:
"North Fork Environmental Council, Matti tuck, LI, NY, October 5,
1971. Supervisor Albert Martocchia, Members of the Board, Town
of Southold, NY, Gentlemen: As you know, the North Fork
Environmental Council is concerned over the possible adverse
ecological impact of such projects as the ,proposed "Brecknock
Hall" development.. For example, in this instance, we consider
the contemplated "density" of living units to be too high, and
we oppose the idea of a shopping area on the site, all in 'the
grounds of the ecological burden thattheywould impose.
In this connection, we call to your attention a .recent ruling,
reported in the New York Times of Oct. 3rd, (copy of article
attahced) in which, "ECOLOGY IS BASIS FOR ZONING RULING" . ' The
article reports that Stpbe Supreme Court Justice; Joseph F'.
Hawkins, denied a builder ' s petition to- overturn a zoning
ordinance of the town of Wappinger; the builder seeking to erect
342 apartment units in an area zoned as a one-family residential
area.
Justice Hawkins ruled, "Upon a thorough review of the trial
minutes and briefs, as well as the authority cited by the
parties, it appears the courts must consider a new criterion
in reviewing zoning legislation; the factor of ecology. Respect-
ing ecology as a new factor, it appears that the time has=come -
if, indeed it has not already irretrievably passed - for .the courts
to take "ecological" notice in zoning matters" . ( The towns
zoning administrator had denied building permits on the grounds
that the project would overburden the area ' s water and sewage
resources . )
May we urge this Board, "in its further consideration of the
"Brebknock Hall" and similar projects , to hold foremost in
their minds the critical nature of our North Fork water, sewage

"October 4, ' 1971, Dear Mr. Martocchia and Members of the Town
Board: The Abates study group of AAUW and the Riverhead League
of Women Voters Southold unit wish to commend the Town Board in
their efforts to maintain the budget at its previous level. We
would like to suggest, after our recent visit to the Southold
Town dump, that the new budget contain provision for sanitary
facilities for employees of the dump. We further feel that in
view of the well-maintained conditions there, that employees of
the dump are entitled to and should receive equal pay as employees
