WORK SESSION
Present: Supervisor Jean W. Cochran, Councilwoman Alice J. Hussie, Justice
Louisa P. Evans, Councilman William D. Moore, Councilman John M. Romanelli,
Councilman Brian G. Murphy, Town Clerk Elizabeth A. Neville, Town Attorney
Gregory F. Yakaboski.
UPDATES
9:05 A.M. - Councilwoman Hussie brought to the Board's attention a complaint
she received regarding the Suffolk County Water Authority. It involves a
residence in Pheasant Run which has been connected to them for some time.
The resident is questioning the bill and wants the meter read. She has had
the bill since November 2nd and she is concerned that the meter has not been
read yet. Supervisor Cochran informed the Board that she is meeting with
Michael LoGrande of the SCWA with regard to the moratorium on the water
hook-ups to homes in subdivisions. There are over 39 homes in subdivisions
held in single and separate ownership. that are waiting for hook-ups to water.
Councilwoman Hussie reported that they are still investigating the manner in
which they can appoint a Recycling Coordinator. Councilman Moore asked for
the Board's consensus on a matter before the Code Committee. The issuance of
permits for accessory buildings. Distances and setbacks are the concerns.
Councilman Murphy agreed with the concept in part, but more in the form of one
coming in and filing for an application and the Building Department gives you
the notification of the distances off the property line, etc. and you get the
permit on the spot. Councilman Moore said that his goal was to suggest complete
simplicity and go back to the NYS Building Code. If they find out that it is not
working out, they will review it in a couple of years. But his goal was to get
down to the bare bones and keep it as simple as possible. They are talking.
about minor sheds, fences, gazebos, etc. Mr. Moore said it was being discussed
in the Code Committee and he wanted to bring it before the Town Board to get
their input on it. Councilman Murphy felt that you still need some sort of a
record on it. Justice Evans agreed that it should be kept as simple as
possible. Supervisor Cochran was also of .the opinion that the goal was to keep
it as simple as possible.
9:32 A.M. - IV. FOR DISCUSSION ITEMS. IV. 1. Wicks Law. Councilman
Murphy called attention to the fact that 15 to 25% in costs are added to municipal
projects as a result of this law. The schools are going through it right now and
the Town will go through it when they go to do something with Town Hall. In
effect, this law knocks out the ability for any local contractors to bid.
Supervisor Cochran added that it is the most lobbied law in all government
agencies. The Association of Towns has had it on their agenda for years. The
Board placed Resolution No. 26 requesting our State Assemblywoman Acampora
and State Senator LaValle to introduce legislation to repeal the Wicks Law. IV.
2. Board of Ethics. Councilwoman Hussie reported that there have been a
number of occasions where people working in Town Hall have gone to the Board
of Ethics asking for an opinion. Ms. Hussie thinks that perhaps things aren't
happening the way they should. There was a particular instance this past
summer that she witnessed and the person was told to go to the Town Board.
She feels that perhaps the Ethics Board is not giving any real direction.
Councilman Murphy suggested that it may be more of a matter of perception,
rather than what is actually going on. Ms. Hussie said that what set her on it
was the fact that it was referred to the Town Board. Supervisor Cochran said
that her office is looking for the correspondence on this matter. Councilwoman
Hussie emphasized that she would like to see this matter resolved. Supervisor
Cochran said that the Ethics Board told her that a secretary is not making
decisions, not a voting member. Louisa questioned this and the fact that their
job at town hall gives them insight and knowledge, and they would be benefiting

as a direct result of their employment. Councilman Moore explained that the
Code of Ethics is about financial gain as a result of a vote or action that you
take, then there is a conflict. The State General Municipal Law already covers
Ethics of certain officials. Councilwoman Hussie recommended that the Board of
Ethics and the Code of Ethics be abolished. Supervisor Cochran will ask the
Board of Ethics to clarify their position in writing. IV. 3. - Architectural
Review Committee. Councilwoman Hussie suggested this committee be abolished.
Councilman Romanelli agreed. Supervisor Cochran will call for review of their
duties as this committee has had many conflicts with the Planning Board.
Justice Evans commented that her idea of this committee was for them to just
look at the type of architecture of the building, not the plans. Supervisor
.Cochran said that she looks at Southold and sees its' beauty as the varied, mix
of architectural styles. Councilwoman Hussie quoted the Code "the architecture
should be harmonious with structures within 500 feet". Ms. Hussie advised that
she would like to review the need for the board. It's not the people on the
Board that she is questioning, it's the need for the Board itself. The Board
agreed to reappoint the members and then. appointed Councilman Romanelli and
Councilman Murphy to review the committee itself and the code and present their
findings by January 1st. (See Resolution 27 reappointing the committee
members.) IV. 4. Set date for Public Hearing, Chapter 48, Garbage, Rubbish
and Refuse. (See Resolution No. 28.)
10:10 A.M. The Board recessed for a short break.
10:25 A.M. The Board reconvened and continued to review IV. FOR DISCUSSION
ITEMS - IV. 5. Two Way Communication System for Building Department - Two
Way Radios or and Cellular Phones were considered. Building Department Head
Edward Forrester said that he prefers the two way radio system. The cell phone
would be a higher expense and if your number gets out, there could be abuse.
Mr. Forrester would like to see the two way radios installed in the vehicles.
(Resolution No. 29 for a budget modification was placed on the agenda.) IV. 6
Adoption of 1999 Preliminary Budget and .1999 Preliminary Capital Budget.
(Resolution Nos. 30A & 30B were placed on the agenda.) IV. 7. Southold Town
Substance Abuse Committee.j This committee was originally set up as a support
system for the DARE Program. Justice Evans said that she would like this
committee to review all of the .programs that are available out there. The
schools did away with the programs due to funding. Supervisor Cochran agreed
that a review of the programs was due, and that a new chairman of this
committee was needed and some new members. (See Resolution No. 31) IV. 8.
Advertise for members of the Anti-Bias Task Force. ( See Resolution No. 32)
IV. 9. Appointments to Goldsmith's Inlet/Kenney's Beach Working Croup
Committee - Councilman Murphy suggested reappointment of all members. He
said that they are just waiting for the Cost Benefit Analysis Report to come in,
then they can decide which way to move on it. (See Resolution No. 33) IV. 10
- Local Law in Relation to Golf Courses. Councilman Murphy advised that the
local law has been written so that the golf courses will be strictly for members
and their guests. Public courses were taken out so that they fit in to the LI-LIO
Districts.

10:55 A.M. The Board reviewed the resolutions 1 through 40 to be voted upon at
the regular 7:30 P.M. meeting.
Councilman Murphy suggested adding $18,000.00 the budget for a person to
relieve Valerie Scopaz of some of her duties so that she may work on the
finishing up the "Waterfront Revitalization Project". This person could also do
grants. Supervisor ° Cochran suggested trying to get a college intern for this
position.
On motion by Councilman Romanelli, seconded by Councilwoman Hussie, it was
RESOLVED that the Town Board enter into Executive Session at 11:40 A.M. for
the purpose of discussing the "Initiative for Competitive Energy and Jack Kulka
verses Long Island Power Authority" Decision. Vote of the Board: Councilman
Moore, Councilman Murphy, Councilman Romanelli, Councilwoman Hussie, Justice
Evans, Supervisor Cochran. Also present: Town Clerk (Elizabeth Neville and
Town Attorney Gregory Yakaboski.
Executive Session ended at 11:50 A.M.
The Board discussed some of the added on resolutions. Numbers 36A 8 36B are
the necessary SEQR resolutions for the Local Law In Relation to Wireless
Communication Facilities. 37. Approve the agreement with Mariculture to place
plastic pens at Sandy Beach. 38. Approved a grant to the Henry L. Ferguson
Museum on Fishers Island with the understanding that this is the last year for

the grants. Resolution No. 39 enacting the Wireless Telecommunication Facilities
was held until November 24th. Resolution No. 40 the Local Law in Relation to
Amateur Radio Operations will be adopted.
The Board recessed for lunch at 12:18 P.M.
1:30 P.M. Appointment - Center for Family Activities, Committee Members Larry
Ostermann and Frank Thorp were present as Councilwoman Hussie presented the
final plan and report to the Board. Eight (8) proposals for design and
construction were initially received.The committee selected three (3) of these
proposals from DiLullo Associates of Melrose, Massachusetts, Marren and Newman
Architects of New York City and Weidersum Associates of Hauppauge. It is
estimated that the center will cost approximately $4.5 million to build. Justice
Evans stated without bonding, the cost would be $4 million. Councilman Moore
pointed out that the Town has bonded other recreational facilities, such as ball
fields, in the past. It will go to a referendum to let the people decide.
Councilwoman Hussie reported that they did a survey and 670 of the people
surveyed saw the need for a recreational facility of this sort. It would include a
large multipurpose room full size pool, and basketball courts. Councilman
Romanelli questioned the annual maintenance costs for such a facility. Ms. Hussie
estimates $323,000.00 a year, $200,000.00 for staff salaries, $88,000.00 for
utilities, insurance, supplies, etc. The committee is suggesting that the center
be leased out to a managing firm specializing in operating such facilities. Splish
Splash is operating by such a management firm. Ms. Hussie asked Comptroller
Cushman to check on the cost of bonding. There are still many questions to be
answered. The Board will study the report and then decide on a course of action
to proceed with.
2:15 P.M. Appointment - Richard Ryan, Chairman Southold Town Land
Preservation Committee presented the Town Board with a report of his findings
on the size and configurations of the wetland areas in the Arshamomaque Wetland
Project. It was suggested that a meeting be set up in the near future to
discuss future steps to take towards the completion of this project.
On motion by Justice Evans, seconded by Councilman Moore, it was
RESOLVED that the Town Board enter into Executive Session at 2:38 P.M. for
the purpose of discussing the Reinhardt property acquisition with Richard Ryan,
Chairman, Southold Town Land Preservation Committee. Vote of the Board:
Ayes: Councilman Moore, Councilman Murphy, Councilman Romanelli,
Councilwoman Hussie Justice Evans, Supervisor Cochran. Also present: Town
Clerk Elizabeth Neville,, and Town Attorney Cregory Yakaboski.
This Executive Session ended at 3:10 P.M.
3:10 P.M. (3:00 P.M. Appointment) Special Counsel Frank Yakaboski met with
the Town Board to update them on the Cross Sound Ferry case.
On motion by Councilwoman Hussie, secorded by Councilman Romanelli, it was
RESOLVED that the Town Board enter into Executive Session at 3:15 P.M. for
the purpose of discussing_ the Cross Sound Ferry litigation case with Special
Counsel Frank Yakaboski. Vote of the Board Ayes: Councilman Moore,Councilman
Murphy, Councilman Romanelli, Councilwoman Hussie, Justice Evans, Supervisor
Cochran. Also present: Town Clerk Elizabeth Neville, and Town Attorney
Yakaboski.

A Regular Meeting of the Southold Town Board was held on
November 10, 1998, at the Southold Town Hall, Main Road, Southold, New
York. Supervisor Cochran opened the meeting at 7:30 P.M. with the Pledge
of Allegiance to the Flag.

RESOLVED that the minutes of the September 27, 1998, Town Board
meeting be and hereby are approved.

SUPERVISOR COCHRAN: Setting the next Town Board meeting date for

RESOLVED that the next meeting. of the Southold Town Board will be held
at 4:30 P.M., Tuesday, November 24, 1998, at the Southold Town Hall,
Southold, New York.

II. PUBLIC NOTICES
SUPERVISOR COCHRAN: There are no public notices this evening.
III . COMMUNICATIONS.
SUPERVISOR COCHRAN: We have had several letters here that I put on
for communications. The one that I would just like to share with you a
little bit is, we had a Girl Scout Troop request some daffodils bulbs. They
knew that we had funding to buy them. Prior to our scary house we did
have a donation of $400.00, which bought a thousand bulbs. So they have
been distributed to Girl Scout and Boy Scout Troops from Orient to
Mattituck, and they have been planted in the month of October. Mr.
Murphy tells us that is the best time of the year to plant them, six inches
deep, and four inches apart, and these young people have planted these,
so we are hopeful that come Spring they can see the fruits of their labor,
and we just recently raised $680.00 from the haunted house, and that will
be ►ised to buy more bulbs. That is a lot of quarters, and hopefully we can
continue planting those, so I would like to thank all the Girl Scout troops,
all the Boy Scout troops. They are thanking us for. the bulbs, but I think
it is more important that we as a Town Board thank them for the planting.

IV. PUBLIC HEARINGS.
1 . 8:00 P.M., on Citizen Views on Local Housing and Community
Development needs to be met with the Community Development Funds the
Town expects to receive in April, 1999.
2. 8:05 P.M. on a proposed "Local Law in Relation to Wireless
Communication Facilities in the Town of Southold".
V. RESOLUTIONS.
SUPERVISOR COCHRAN: As you know the Town Board has a policy in
relation to resolutions. Prior to the adoption or the action on the
resolutions as presented we give you that attend the Town Board meeting
the opportunity to address the Board on any of the resolutions. If it is
something other than that, but it is Town Board business, we will entertain
your comments after the passage of the resolutions. So, is there anyone
who would like to address the Town Board at this point in relation to the
resolutions. We have two public hearings, one at 8:00 o'clock, and one at
8:05 this evening, so we will be stopping for those. At this point is there
anyone that would like to address the Town Board in relation to any of the
resolutions? (No response.) If not, we will begin the action.

RESOLVED that the "Town Board of the Town of Southold hereby appoints
Lynda M. Bohn to the position of Clerk-Typist in the Office of the Town
Clerk, at a salary of $22,658.00, effective November 12, 1998.

SUPERVISOR COCHRAN: Number 3 and 4 will be held. I don't think we
have to go through the process of voting, because they will attending this
seminar later on. I think it was withheld. They will be attending schooling
later on. The State does pay for it. There is information that we weren't
aware of at the time, so this is being held. Number 5?

7.- Moved by Councilman Moore, seconded by Councilwoman Hussie, it was
RESOLVED that the Town Board of the Town of Southold hereby approves
the amount of $3,964,216.00, for a requisite security for the roads and
improvements for the site plan for Peconic Landing at Southold, Inc. with
an inspection fee of $237,852.96, all in accordance with the recommendation
of the Southold Town Planning Board and Town Engineer James A. Richter.
7.- Vote of the Town Board: Ayes: Councilman Murphy, Councilman
Romanelli, Councilman Moore, Justice Evans, Councilwoman Hussie,
Supervisor Cochran.
This resolution was duly ADOPTED.
8.- Moved by Councilwoman Hussie, seconded by Councilman Romanelli, it was
RESOLVED that the Town Board of the Town of Southold hereby grants
permission to the Raymond Cleaves Post No. 861, American Legion,
Mattituck, New York, to use the following town roads for a Veteran's Day
Parade to begin at 10:30 A.M. and ending at 11 :00 A.M., on Wednesday,
November 11, 1998, provided they file with the Town Clerk a One Million
Dollar Certificate of Liability Insurance naming the Town of Southold as an
additional insured: Pike Street, Westphalia Road, Sound Avenue and Love
Lane, Mattituck, New York.

9.-Moved by Justice Evans, seconded by Councilman Murphy, it.was
RESOLVED that the Town Board of the Town of Southold hereby sets
5:00 P.M., Tuesday, November 24, 1998, Southold Town Hall, 53095 Main
Road, Southold, New York, as the time and place for a public hearing on
the question of the acquisition of development rights in the agricultural
lands of Richard Reinhardt, east side of Alvah's Lane, Cutchogue, New
York, SCTM #100-102-02-p/0005; 14.6 acres, at a price of approximately
1113,880,

Romanelli, Councilman Moore, Justice Evans, Councilwoman Hussie,
Supervisor Cochran.
This resolution was duly ADOPTED.
10.-Moved by Councilman Moore, seconded by Justice Evans, it was
RESOLVED that the Town Board of the Town of Southold hereby
RESCINDS RESOLUTION NO. 15 OF THE OCTOBER 27, 1998 Southold Town
Board Meeting, which resolution reads as follows:
WHEREAS, Suffolk County Legislator Joseph Rizzo has proposed a
resolution (IR2029-1998) entitled "Town Revenue Sharing Using Proposed
Sales Tax Distribution"; and
WHEREAS, this resolution involves the existing 1/4o Sales Tax; and
WHEREAS, Legislator Rizzo has supplied supporting documentation from
the County Budget Review Office, a copy of which is annexed hereto; and
WHEREAS, the legislation would provide the Town of Southold with
approximately $2,247,404.00 under the proposed revenue sharing plan; now,
therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby supports
legislator Rizzo's resolution IR2029-1998.
COUNCILMAN MOORE: That was the resolution where we supported County
Legislator Joseph Rizzo with regard to the 1/4o sales tax. They can't
seem to find an agreement on that 1/40, and bail out the sewer district
down there, and try and get east end support by having 1/4o money spent
out here. They don't seem to be willing to do that right now, so we are not
going support this legislation presently.

SUPERVISOR COCHRAN: It just came across my desk. I looked at it
earlier and you will all get a copy, but there is another Legislator is
asking support of a different direction, so you will have it in your mail
tomorrow.
11 .-Moved by Justice Evans, seconded by Councilman Murphy,
WHEREAS, there was presented to the Town Board of the Town of
Southold, on the 13th day of October, 1998, a Local Law entitled, "A
Local Law in Relation to Amending Certain Sections of Chapter 97, Entitled
Wetlands of the Town Code of the Town of Southold, and
WHEREAS, a public hearing was held on this Local Law on -the 27th
day of October, 1998, at which time all interested persons were given an
opportunity to be heard thereon, now, therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby enacts
the following Local Law:
LOCAL LAW NO. 20 -1998
A Local Law in Relation to Amending Certain Sections of Chapter 97,
entitled Wetlands of the Town Code of the Town of Southold
_ BE IT ENACTED, by the Town Board of the Town of Southold as follows:
I. Chapter 97 (Wetlands) of the Town Code of the Town of Southold is
hereby amended as follows:
1. Section 97-12 (Exceptions) is hereby amended as follows:
(7) The ordinary and usual maintenance or repair of a
man-made pond that is created by using an artificial
seal to prevent water from seeping into the ground and
activities disturbing the bottom lands of, and wetlands
adiacent thereto.

2. Section 97-13 (Definitions) is hereby amended as follows:
WETLAND BOUNDARY OR BOUNDARIES OF A WETLAND -The
outer limit of the vegetation specified in the definition of freshwater,
brackis or tidal wetland. The wetland boundary is to be defined and
flagged at the point where existing wetland indicator species no longer

upland plants will mix together at this transition zone. The methodology
used to determine this boundary shall be the same methodology
utilized in the N Y S D E C Technical Methods Statement relating
to the Freshwater Wetlands Act: to wit, if the innermost portion of
a wetland is effectively 100 percent wetland giants, the next
concentric ring shows an area of 75 percent wetland species, and
the outer ring is a 50 percent mix where the competitive advantage
of upland species is demonstrated the boundary line will be drawn
at the mid-point of the outer ring Where a site is dominated by
facultative species which are characteristic of Long Island wetlands.
such as red maple (Acer rubrum) and black tupelo (Nvssa svivatica),
a community approach shall be used in determining the wetland
boundary, The test of what constitutes a wetland community will be
satisfied if the species are those included in the description of natural
wetland community types as documented by the New York Natural
Herita a Program in the March 1990 manual entitled "Ecological
Communities of New York State."

(c) lands and waters substantially enclosed by aquatic or
semi-aquatic vegetation as set forth in paragraph (a) or be
dead vegetation as set forth in paragraph (b), the regulation
of which is necessary to protect and preserve the aquatic
and semi=aquatic vegetation: and

(d) the waters overlying the areas set forth in (a) and (b) and
the lands underlying (c).
(2) All land immediately adjacent to a "freshwater wetland," as
defined in either Subsection 13(1) or Subsection 13(2) and lying within
seventy-five (75) feet landward of the most landward edge of a-
" " wetland boundary of such "freshwater wetland".
3. Section 97-20:6..(Permits Required) is hereby amended as follows:
(B) Notwithstanding the provisions of Subsection A of this section, the
Trustees may, by resolution, waive the requirement of a permit with respect to
lands immediately adjacent to wetlands, as defined in Subsection A(3) or 130 of
the definition of"wetlands" in §97-13, if the Trustees find and determine that no
operations are proposed on such lands, or that the operations proposed thereon
comply with the standards set forth in §97-28 of this chapter.
II. Severability.
If any section or subsection, paragraph, clause, phrase or
provision of this law shall be judged invalid or held unconstitutional by any court
of competent jurisdiction, any judgment made thereby shall not affect the validity
of this law as a whole or any part thereof other than the part or provision so
adjudged to be invalid or unconstitutional.
III. This Local Law shall take effect upon filing with the Secretary of
State.

respectfully request our State Assembly person and our State Senator to
introduce legislation to repeal the Wicks Law.
COUNCILWOMAN HUSSIE: Why don't you explain just a little bit about the
Wicks Law, because it certainly is a thing that constrains everything that
we do in building.
COUNCILMAN MURPHY: The Wicks Law requires municipal construction to
divide up it's bids into four segments for any project, and what it does is
not allow for a general contractor to do the whole bid. So, what happens is
it tends to add, because construction all the way across rather than having
one general contractor put together a complete bid for the project. As you
read in the local paper recently the school district right here in town,
Mattituck and Southold, are facing 15% to 20% cost increases due the
requirements of this law. So, we felt that because of this, this law be
repealed.
SUPERVISOR COCHRAN: I would just like to add to that. They have been
working on this repealing this Wicks Law for many, many years, for a long,
long time, and the best they have been able to do is make some in-roads in
relation to the level. Your lobbyists for your state, fire and your school
districts, and your municipalities have taken this as one of their projects,
and every year it ends up on the agenda of New York State Towns and
Villages Convention In New York, and every year it is voted on to try to
do something to relieve municipalities in the amount that they must pay for
construction due to this law, so Brian put this one again to reinforce our
position. It will be going to Albany next week when I have to go up on
some business, but it is very important, and any of you that would like to
write a letter to any of your legislators, please, feel free to do it,
because I think the only thing that is ever going to make this move, and it
shojis you how strong your union lobbies are in State government, and
there is nothing that prevents grass roots from expressing themselves, and
perhaps encouraging those that represent us to fight just a little harder.

TOWN GARBAGE BAG —A plastic bag bearing the logo of the Seal of the Town
of Southold, of such size and design as shall be determined by the Town Board,
to be used for the disposal of nonrecyclable waste. [Added 9-10-1993 by L.L.
No. 20-1993; amended 2-8-1994 by L.L. No. 1-1994]
2. Section 48-2 (Dumping Prohibited Generally) is hereby amended
as follows:
§ 48-2. Dumping prohibited generally. [Amended 7-31-1973]
A. No person shall collect, store, accumulate, throw, cast, deposit or dispose
of or cause or permit to be collected, stored, accumulated, thrown, cast,
deposited or disposed of any hazardous waste, refuse and/or recyclable upon
any premises or upon any street, highway, sidewalk or publiciprivate place
within the Town of Southold, except when authorized by the Town Board.

B. Nothing contained herein shall be construed so as to prevent:
(1) The temporary accumulation of refuse by a resident of the town upon
premises occupied by him, to the.extent that such accumulation is ordinary and
necessary for his personal household requirements.
(2) The disposal of refuse at any Fefuse dispe6al aFea transfer station
maintained or authorized by the Town of Southold.
(3) The proper use of receptacles placed upon the streets or other public
places in the Town of Southold for the depositing of refuse; provided, however,
that such public receptacles shall not be used for the deposit of accumulated
household garbage.
(4) The engaging in secondhand junk and auto parts activities and
businesses when a license therefor has been obtained pursuant to the
provisions of the Southold town ordinance licensing and regulating secondhand
junk and auto parts activities and businesses.EN
C. Nonrecyclable waste and town garbage bags. [Added 9-10-1993 by L.L.
No. 20-1993]
(1) Nonrecyclable waste shall be deposited only at designated areas within
the town dispesal-area transfer station.
(2) Town garbage bags shall be available at designated areas in the town.
(3) The size and design of the town garbage bag shall be determined by
resolution of the Town Board.
(4) The fee for each size of the town garbage bag shall be determined by
resolution of the Town Board..
(5) No person shall:
(a) Duplicate or imitate a town garbage bag.
(b) Give, sell or issue in any manner a duplicated or imitated town garbage
bag. ..
3. Section 48-3 is hereby amended as follows:

[1] Residential self-haulers. Nonrecyclable waste generated by residential
self-haulers shall be disposed of only in a town garbage bag as defined herein
and deposited only at designated areas within the tevm-disposal-area transfer
station.
[2] Commercial self-haulers. Nonrecyclable waste generated by commercial
self-haulers may be either:
[a] Disposed of in a town garbage bag and deposited at designated areas
within the disposal area transfer station; or
[b] Disposed of at the designated areas within the tewa-disposal-area
transfer station upon paying the appropriate charge as set by Town Board
resolution for the,weight of nonrecyclable waste deposited.
(2) Private residential refuse haulers/carters,
(a) The owners or occupants of all residences within the town which utilize
collection services provided by persons licensed to collect refuse pursuant to the
provisions of this chapter shall place recyclables in separate rigid containers at
curbside for collection on such day or days as the licensee serving such
residence shall designate.
(b) It shall be unlawful for any person to place out for collection any container
in which refuse is mixed with recyclables.
(c) It shall be,unlawful for any person to collect refuse from a residence which
is mixed with recyclables or thereafter to commingle different types of
recyclables or to mix recyclables with refuse.
(d) Recyclables collected by private residential refuse haulers/carters and
transported to the transfer station shall be deposited in
areas designated by appropriate landfill personnel.
(e) Nonrecyclable waste. [Added 9-10-1993 by L.L. No. 20-1993]

(a) The owners or occupants of all commercial establishments within the town
which utilize collection services provided by persons licensed to collect refuse
pursuant to the provisions of this chapter shall place recyclables in separate
figW containers at curbside for collection on such day or days as the licensee
serving such business shall designate.
(b) It shall be unlawful for any commercial establishment to place out for
collection any container in which refuse is mixed with recyclables.
(c) It shall be unlawful for any commercial establishment to place out for
collection any container in which one type of.recyclable is mixed with any other
type or types of recyclables.
(d) It shall be unlawful for any private commercial refuse hauler/carter to
collect refuse from any commercial establishment which is mixed with
recyclables-or thereafter to commingle different types of.recyclables or to mix
recyclables with refuse.
(e) Recyclables collected by private commercial refuse haulers/carters and
transported to the transfer station shall be deposited in
areas designated by appropriate iandf+ll personnel.
B. No garbage, refuse, rubbish or other material that does not have its origin
within the Town of Southold shall be deposited or disposed of in the town fefuse

D. No vehicle,shall be permitted to transport refuse into any fefUse-disposal

vehicles owned and operated by any of the following entitled shall be permitted
to transport refuse into any FBfUse disposal aFea transfer station maintained by
the Town of Southold, provided that at least one (1) valid permit and/or license
has been issued to the particular entity: the State of New York, the County of
Suffolk, the Village of Greenport and fire districts, school districts and park

E. The attendant at the teWR FBfUse aFea transfer station is authorized to
prohibit the disposal of discarded motor vehicles and/or discarded fuel tanks
having a capacity in excess of five hundred fifty (550) gallons at the fe€use

F. All municipal recyclables must be deposited in the appropriate location of
the dispesaltarea transfer station owned by the Town of Southold. [Added 5-3-

4. Section 48-4 (Fees; Issuance and Duration of Permits and
Licenses) is hereby amended as follows:
§ 48-4. Fees; issuance and duration of permits and licenses. [Added 10-9-

22-1995] The fees for the issuance of permits and/or licenses for vehicles
transporting refuse into any FeWse disposal aFea transfer station maintained by
the Town of Southold shall be in the amounts prescribed by the Town Board, by
resolution and as amended from time to time. Permits shall be issued as follows:
(1) Resident landfill disposal permit: for noncommercial vehicles of less than
one-ton capacity owned by a resident and/or taxpayer of the Town of Southold
and transporting only household refuse, provided that such vehicle displays a
valid resident landfill permit issued in accordance with the following:
(a) A resident landfill disposal permit shall be issued by the Town Clerk or a
person designated by her to all persons who are qualified residents of the Town
of Southold. Persons applying for a resident landfill disposal permit shall be
requested to sign an application in affidavit form and submit for inspection the
following as proof of residence:
[1] A valid tax receipt stub for the current year for any taxable real property
within the Town of Southold assessed in the name of the applicant.
[2] A valid motor vehicle registration in the name,of the applicant and to an
address located within the Town of Southold or to an kaddress corresponding to
the address of a validated tax receipt stub for the current tax year for any taxable
real property within the Town of Southold affixed to the application.
[3] Such other proof of residence as is satisfactory to the Town Clerk.
(b) The Town Clerk or a person designated by the Town Clerk shall inspect
such application to determine that the applicant is a qualified resident of the
town. Upon approval of the application, a resident landfill disposal permit shall
be issued and inscribed with the vehicle license registration number. Such
permit shall not be transferred to any other vehicle.
(c) Resident landfill disposal permit for motor vehicles shall be permanently
affixed to the left'side of the front bumper of such vehicle.
(2) Lessee landfill disposal permit: for noncommercial vehicles of less than
one-ton capacity owned by a lessee in the Town of Southold and transporting
only household refuse, provided that such vehicle displays a valid lessee landfill
permit issued in accordance with the following:
(a) A lessee landfill disposal permit shall be issued by the Town Clerk or a
person designated by her to all persons who lease or rent property within the
Town of Southold but do not qualify as residents as defined in § 48-4A(1) hereof.
Persons applying for a lessee landfill permit shall present an application in
affidavit form, signed by the lessee and the owner of the property, setting forth:
[1] The location of the leased or rented property.
[2] The persons occupying the same.
[3] The term of such tenancy.
(b) Upon a determination by the Town Clerk or person designated by her that
the applicant is entitled to a lessee landfill disposal permit and upon the payment
of the permit fee, such permit shall be issued and inscribed with the vehicle
license registration number and shall be affixed to the vehicle in the same
manner as provided in §48-4A(1)(c) hereof.
(3) Guest landfill disposal permit: for noncommercial vehicles of less than
one-ton capacity owned by a guest of a resident in the Town of Southold and
transporting only household refuse, provided that such vehicle displays a valid
guest landfill permit issued in accordance with the following:
(a) A guest landfill dis osal permit shall be issued by the Town Clerk or a
person designated by leF the Town Clerk to all persons who are qualified
residents of the Town of Southold, as defined in §48-4A(1) hereof, for use by.
guests temporarily residing in the dwelling of such resident. A resident applying
for a guest landfill disposal permit shall present an application in affidavit form,
signed by the applicant, setting forth:

[1] The location of the property to be occupied by the guests.
[2] The names and permanent addresses of the guests.
[3] The length of time of the guest occupancy.
(b) Upon a determination by the Town Clerk or person designated by her that
the applicant is entitled to a guest tandttN-disposal permit and upon the payment
of the permit fee, such permit shall be issued and inscribed with the vehicle
license registration number and shall be affixed to the vehicle in the same
manner as provided in § 48-4A(1)(c) hereof.
(c) The fee for the issuance of a guest landfill disposal permit shall be such
fee as shall be prescribed by a resolution of the Southold Town Board.
L41 Commercial Permits: for all vehicles engaged in the commercial
disposal of any material other than mandated
recyclables as defined herein and/fer-or all vehicles with a rated load-
carrying capacity of one ton or greater.
(a) A commercial permit shall be issued by the Town Clerk or a person
designated by the Town Clerk to commercial businesses qualified to
operate within the Town. Persons applying for a commercial permit
shall be requested to sign an application in affidavit form.
(b) Upon approval of the application, a commercial permit shall be issued
and inscribed with the vehicle license registration number. Such permit
shall not be transferred to any other vehicle. Such permit shall be
affixed to the vehicle in a spot clearly visible to attendants at the
disposal area.
(c) The fees for issuance of commercial disposal permits shall be as
Prescribed by a resolution of the Southold Town Board.
5) Single-Entry Fees: A single entry fee shall be charged to any
residential or commercial vehicle that delivers for disposal non-recyclable
debris generated within the Town and which does not display a valid
permit. Single entry fees shall be in an amount prescribed by a resolution
of the Town Board.

(1) Heavy Brush, landscaping and yard wastes, including but not limited to
stumps, branches, shrubs, plants, trees, bushes and grass clippings the4iI%, but
not including leaves and sod.
(2) Construction debris, including but not limited to scrap and waste material
discarded as refuse resulting from construction.
(3) Wood, including but not limited to timber, logs, boards and the like,unless
sur.h weed is designated by the la�dfill attendant as FeWralable wood as defined
herein.
(4) Demolition and construction debris, including but not limited to waste and
rubble resulting from remodeling, demolition and extensive repair of structures,
waste cement, concrete, masonry work, bricks, tile, sheetrock, plaster, wood,
shingles and the like.
(5) Rubbish, including but not limited to furniture, fixtures, appliances,
television sets antennas, carpets, awnings, boats and other like objects that are
not considered normal everyday household waste.

Il. Severability.
If any section or subsection, paragraph, clause, phrase or
provision of this law shall be judged invalid or held unconstitutional by any court
of competent jurisdiction, any judgment made thereby shall not affect the validity
of this law as a whole or any part thereof other than the part or provision so
adjudged to be invalid or unconstitutional.
III. This Local Law shall take effect upon filing with the Secretary of
State.

1999, subject to them providing a certificate of insurance in the amount of
$1,000,000.00 naming the Town of Southold as an additional insured, and all
in accordance with the approval of the Town Attorney.

Wireless Communication Facilities. I am going to hold this, and the Town
Board can give it one final go over. I would like to see a resolution
setting this. We have to refer it to the County and local Planning Board,
and set the hearing on this amendment. We are talking about the amendment
in relation to the amateur. What we are talking about is, whenever we do a
law we have refer it to the Suffolk County Planning Department and to our
own Planning Department for review, and then they have input, they
support or object or whatever. All we want to do tonight is refer it out to
the two Planning Departments, and set a public hearing. We can do that
tonight.

§ 100-161. Scope.
The regulations of this article shall govern and control the erection, enlargement, expansion,
alteration, operation, maintenance, relocation and removal of all wireless communication facilities.
The regulations of this article relate to the location and design of these facilities and shall be in
addition to the provisions of the Southold Building and Zoning Codes and any other federal, state or
local laws or Federal Communication Commission(FCC) regulations pertaining to such facilities.
Nothing herein shall be construed to al2ply to, prohibit, regulate, or otherwise affect the erection.
maintenance, or utilization of antennas or support structures by those licensed by the Federal
Communications Commission pursuant to chapter 47 of the Code of Federal Regulations Part 97 to
operate Amateur radio stations.
II. This Local Law shall take effect upon its filing with the Secretary of
State.

SUPERVISOR COCHRAN: I am going to hold resolution #39 due to the
input from the hearing. While I have all of you people here, Don, I would
like to express on behalf of the Town Board and the town our thanks for
your involvement these many years in Southold Town as far as our
Emergency Preparedness Plan. We have worked very closely with developing
the plan for Fishers' Island. We have worked drills together. We went up
and visited radio . operators up at Horton's not too long ago, and it's is
amazing every time I learn a little bit more, and people like Ralph and Don
make you learn a little bit more, but on behalf of the Board we would like
to thank each and everyone of you for the part you play, because thank
God we have never , had a tragedy happen to us, but if it does we have
some good people in , place, so we offer our thanks to you. Thank you for
coming in.
COUNCILWOMAN HUSSIE: I never knew that you did all the things that
you do. I never knew you did those important things. They are obviously
very important.
DON FISCHER: We could have told you even more, but we would have
gone on to 11 :00 o'clock.
SUPERVISOR COCHRAN: If there is anyone else in the audience who would
like to address the Board on any other Town business.
JOE GOLD: Joe Gold, Southold. I would like to make a suggestion to the
Board as a citizen of the Town of Southold. It has nothing do with my
position with the Democratic party. I think in this bias-free year it is
very important for the people in town to,-give a forum to show their dismay
and outrage over the killing of that young man in Wyoming in a bias related
crime. I don't think we need to do anything elaborate. A couple of other
communities on Long Island have had candlelight vigils. If we could do
something quickly and simply while it is still in people's minds. My
thought is a candlelight vigil on Friday evening in Silversmith Park just to
give people a chance to get together and maybe hear a few words from some
of the members of the Anti-Bias Task Force about this kind of thing, and
how the assiduous disease spreads on our society.
COUNCILMAN MOORE: As you bring it up the Anti-Bias Task Force is
meeting next Thursday, and one of our members specifically brought this
issue up for us to start thinking about some kind of. .
JOE GOLD: What is a little disturbing to me is I think this can be done
quickly and soon.
COUNCILMAN MOORE: Come to the meeting you will see eight different
ideas on what should be done.
HANK KUHN: Hank Kuhn from Laurel. I wonder if you could bring
me up to date on the status of the situation with the Huntington lawsuit
against LILCO.
SUPERVISOR COCHRAN: That was given to the Town Attorney. Greg,
can you report anything?
TOWN ATTORNEY YAKABOSKI: I don't have too much to report, .but if
you just leave your name and number I can give you a call on Thursday or
Friday with an update.
SUPERVISOR COCHRAN: Anyone else like to address the Town Board on
Town business?
DONNA DZUGAS-SMITH: Donna Dzugas-Smith, Tuckers Lane. I just want
to know if you could give us an update on the moratorium since we are
about three months into it?
SUPERVISOR COCHRAN: Councilman Moore has been working. Melissa
Spiro of the Planning Department has been assigned to it. They have been
working. We have hired the consultant. He is busy at work right now. A
timetable is being laid out. We are hoping to meet all our timetables.
Things are moving, Donna.

DONNA DZUCAS-SMITH: Have we given the consultant a deadline?
COUNCILMAN MOORE: Absolutely. We met with him last week. I met with
him last week along with Melissa, and we roughed out a timetable working
backwards to meet the requirements we got for SEQRA and everything else
to accomplish that. He is off with his charge. We have broken the task
down to smaller tasks. We each are supposed to take up certain
responsibilities and it is off and rolling.
DONNA DZUCAS-SMITH: We are taking everything into account on
previous studies that were done?
COUNCILMAN MOORE: Absolutely. Everything we had on the shelf he has.
DONNA DZUCAS-SMITH: Do you feel any need, or do you have any plans
of including any present public opinion, especially people that live on 48,
or live within a certain distance of 48?
COUNCILMAN MOORE: We have to have public hearings. In some instances
you would have hamlet meeting, community meetings, a variety of things,
but those have already been over the years. We have studies coming out of
our ears. The last one that was done was a formal study, a bunch of
meetings that tell us all what everybody has a pretty good sense of what
that should be up there.
SUPERVISOR COCHRAN: There were will be room for public input, yes.
DONNA DZUCAS-SMITH: You don't have a lot of people that come and
want to talk at public hearings. They would rather sit home and watch this
on TV later on, and talk later on. As I am going through my building
process on the winery on 48, 1 went around with a public petition for all
my neighbors, not only the ones that you by law tell me -I have to notify,
but also who I thought would directly be affected, and I came across some
very interested citizens, that are right on 48 or they are right off 48, and
they had a lot to say, a lot to say about Southold.
SUPERVISOR COCHRAN: Thank you. Anyone else like to address the Town
Board on any Town business? (No response.) (tape change)
COUNCILMAN ROMANELLI: Came to me a few months. back, and mentioned
how there should be bigger signs of public hearings, so this will be our
new public hearing sign, so people can see it from the road, slow down,
and read the fine details. You should be able to realize that a public
hearing will be going on when you see this sign. It took a few months, but
we do listen to you when you speak.
SUPERVISOR COCHRAN: He has to show you the other one, because this
isn't the one we have settled on. It will appear the same way. The
difference is the cost.
COUNCILMAN ROMANELLI : It will be in this type of material, because it is
cheaper, but the wording, the writing everything will be the same, and
this is more of a throw away disposal sign.
SUPERVISOR COCHRAN: It will be printed similar, but one is $7.00, one
is $100.00. There was no question of which one you would pick.
COUNCILMAN ROMANELLI : This sign does not take in the Code change of
notifying earlier. It just gives you more visual notification.
SUPERVISOR COCHRAN: Mrs. Hussie?
COUNCILWOMAN HUSSIE: No.
SUPERVISOR COCHRAN: Councilman Moore?
COUNCILMAN MOORE: I will save it for another day.
SUPERVISOR COCHRAN: Councilman Murphy?
COUNCILMAN MURPHY.; Nothing at this time.

SUPERVISOR COCHRAN: Louisa? I have several things I would like to say
before closing, and that is to thank everyone that were involved in the
haunted house. We have heard absolutely wonderful responses. As you read
in the paper we had over 700 people each evening. We took in over- $680,
which is a heck of a lot of quarters. I carried them home nights, so I
know how heavy they were. We would like to thank North Fork Bank and
Trust, .Suffolk County .National Bank, Bridgehampton Bank, Fleet Bank for
their donations to enable us to do this. The high schools, the three high
schools, and the young people that came in and worked evenings, and after
school, and Cornell. Extension down at the Ceder Beach facility, the Town
Board itself, different volunteers from the town in relation to doing the
outside and the hallway inside, and most of all to Pat Moore, who's idea was
to do this for the young people of Southold, and you learn after awhile if
you come up with an idea you kind of end up chairing it, so Pat chaired it
for us, and we were grateful, because I think everyone had a great time,
and it was well enjoyed. We would also like to congratulate Reverend
Dozier. He church, the Unity Baptist Church in Mattituck on Friday night
honored him as their pastor for the service that he has given to the
congregation after serving for ten years. So, we offer him our
congratulations. Bill went to represent the Town Board, and thank you,
Bill. We have been busy with budget meetings. I attended the East End
Roundtable's Executives at the college in Riverhead. They have a
meeting once a month, and it was kind of fun to have newspapers as the
speaker. Each of the papers were represented with the exception of one.
It gave me the opportunity to kind of give a little back from when they
give us once in awhile: I would like to on behalf of the Board, and the
many residents of Southold say, thank you to the many people on the east
end that voted for the 2% Land Bank Preservation Fund. We are hopefully
that this will help us to save many of the areas, that we hold dear in the
Town of Southold, and I would just like to say thank you for your support,
and thank you for supporting this. As it moves along we will continue to
give you reports. I think it is important that if you still have any
questions, . because I found right down to the last minute of. the. vote that
people were still asking questions, because they were with the opposition
doing a campaign at the last minute that was negative, of course, to the
position we had. They became confused in some instances, and were calling
to get clarification, so I think it is important that we still continue to
explain that law itself, so that all of us understand thoroughly, and when
you understand something it kind of takes away some of the apprehension,
so I think it is important that we still do some PR and information in
relation to the law,; as we take the steps, as we move along, as we put it
into the operational mode. It is important that everyone understands.
Diversity Day was held not too long ago up at the American Legion. The
Anti-Bias Committee- chaired it, and they presented their cookbook, which is
called the Melting Pot. The Melting Pot is a great cookbook from many,
many people in the community. It is on sale in the Town Clerk's Office. It
would make a great Christmas present. So, we have two cookbooks going
right now, one that is from Town Hall itself, and one from the Anti-Bias
Task Force. So, do your Christmas and holiday shopping early. It was a
great affair. Different kinds of foods from all sort of walks of life and
background was excellent. The only other thing I want to share with you,
and anyone of you that is listening, take the time to stop up to the new
METS center in Mattituck at the Human Resource Center. That has been
open now for approximately a month. It is being used. They are providing
services, and it is a fantastic facility, so if you have the opportunity no
matter what age, and you are going through Mattituck stop in and say,
_ hello. They would be very happy for you to see the site, and what it
offers. I think that is all I have at this point, and now I will entertain
a motion to adjourn.
