Townsend, Jr. , Councilwoman Ruth D. Oliva, Justice Louisa P. Evans, Town Clerk Judith T. Terry, Town Attorney Laury L. Dowd. Absent: Supervisor Jean W. Cochran. 9:05 a.m. - The Town Board interviewed Sharon Shine for a vacancy on the Conservation Advisory Council (see resolution 21) . 9:15 a.m.- - Councilwoman Hussie presented a packet of information to the Board concerning drug prevention programs, and asked whether the Board would be interested in changing the DARE Program. She has done considerable research, and finds that other programs may be more effective. She is not proposing abandonment of drug education and prevention, but looking for an alternative to the existing program. It was decided to invite Clement Charnews, Jr. , Chairperson of the Town's Substance Abuse Committee to one of the upcoming Town Board work sessions. 9:30 a.m. - Senior Accountant John Cusliman met with the Board to required adjustments to the 1998 Budget before adoption by the Town Board. One item pertains to the anticipated sales tax revenue of $38,000 which should be removed, inasmuch as a communication from the Suffolk County Comptroller indicates the Town has been paid twice for the year 1995 for the Town's share of the 1 /4% Sales Tax- Water Protection Program. Secondly, the fund deficit in the Lands End Road Improvement District can be reduced by $120.00. The Board members had question about the need for a new boat for the Marine Division, an item placed in the 1998 Capital Budget, and . agreed to remove $57,200.00 before adoption of that budget. 9:45 a:m. - Councilman Townsend again discussed the request from Superintendent of Highways to install a street light at Sound Beach Drive, Mattituck. He will ask Senior Accountant Cushman to prepare an estimate for the cost of installation and maintenance of a street light and discuss this again at the November 25th work session.----The Town Board discuss the appeal of Eric J . Bressler with regard to the Planning Board's denial of his request for access to the Draft Environmental Impact Statement filed by Cross Sound Ferry. The Town Board placed a resolution (20) on the agenda directing the release of the DEIS, with the provision that it is not a complete document, and will not be until declared so by the Planning Board.----Request from the Griswold-Terry-Glover Post American Legion, Southold, to place the Suffolk County Parks reviewing standing in front of Town Hall at the time of the Suffolk County American Legion convention in June, 1998. The Town Clerk was instructed to contact the G-T-G representative to determine exactly where the trailer would be located.- -The Board discussed a policy proposed by the Town Attorney with regard to use referrals. It was decided that the Building Inspectors would make the certification of the proposed use as being a use allowed in the appropriate zone.----A resolution (22) was placed on the agenda to set a public l hearing on "A Local Law in Relation to Appearance Tickets", which is a minor change to Chapter 26 (Appearance Tickets) to give authority to the Director of Code Enforcement to issue appearance tickets.----A resolution (23) was placed on the agenda creating the Scenic Byways Advisory Committee, and a resolution (24) appointing individuals to the committee.----Town Justice Evans proposed the name of Terry Crupi for the new Fishers Island Senior Citizen Aide (resolution 25) .---- The Board set 9:00 a.m. ,. Tuesday, November 25th to interview applicants for the Fishers Island Board of Appeals member.----A resolution (27) was placed on the 4 5 NOVEMBER 12, 1997 regular meeting agenda to request the NYS Department of Transportation to conduct traffic speed surveys at the school zones throughout Town, in response to a request from The Kiwanis Club of Southold Town.----Councilwoman Hussie again reviewed the contracts with Power Alternatives, Inc. for municipalization of electric and gas. There were several changes to be made to • the contract, which will be accomplished by Town Attorney Dowd, and a budget modification will be necessary to provide 'the funding for Power Alternatives, therefore, this item will be on again on November 25th for discussion-----A memorandum was received from Director of Human Services Venetia McKeighan requesting , a change in title for Karen McLaughlin. The Board raised questions with regard to this request, and will bring it up again on November 25th for discussion, with Senior Accountant Cushman.----Mrs. McKeighan also informed the Board that Christine Droskoski, Clerk Typist at the Human Resource Center, has requested a transfer to another department. She would like to fill the vacancy with a Senior Citizen Aide II , therefore, the Board will call for the civil service list for that position.----A memorandum from Councilman Moore concerning the administration of the merger ordinance was discussed. He has met with the Building Department staff to discuss the amount of time they must devote to the merger ordinance as they make determinations as to whether or not given properties have merged. It has been suggested that this determination, which is effectively a legal determination, should be made by the Town Attorney and not the Building Inspector. The Town Board agreed, and delegated this responsibility to the Town Attorney. EXECUTIVE SESSION 12 :15 p.m. - On motion of Justice Evans, seconded by Councilwoman Hussie, it was Resolved that the Town Board enter into Executive Session to discuss employment history and acquisition of property. Vote of the Board: Ayes: Councilman Moore, Councilwoman Hussie, Councilman Townsend, Councilwoman Oliva, Justice Evan. Also present: Town Clerk Terry, Town Attorney Dowd.----As a result of this Executive Session two resolutions were placed on the regular meeting agenda : (28) Authorize Supervisor Cochran to execute a Covenant Not to Sue between the Town, Anne Fiore and Peconic Land Trust with regard to the preservation of the, agricultural lands of Anne Fiore, (29) Authorize the Town Clerk to readvertise for members of the -s Police committee. 1 :05 p.m. - Work Session adjourned. _s 4 5. 1 REGULAR MEETING A Regular Meeting of the Southold Town Board was held on November 12, 1997, at the Southold Town Hall, Main Road, Southold, New York. This resolution was duly ADOPTED. 6.-Moved by Councilwoman Oliva, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs the Town Clerk to readvertise for bids for the removal of Scrap Tires from the Disposal Area for calendar year 1998. 6.-Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie. This resolution was duly ADOPTED. v 7:-Moved by Justice Evans, seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Jean W. Cochran to execute an agreement between the County of Suffolk, acting through its duly constituted Office of the County Executive/STOP-DWI Program and the Town of Southold for the 1998 STOP-DWI funding for enforcement activities of the Town of Southold police personnel, effective January 1, 1998 through December . 31, 1998, at a total contract amount not to exceed $19,000.00; said agreement all in accordance with the approval of the Town Attorney. 7.-Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie. This resolution was duly ADOPTED. 8a.-Moved by Councilwoman Hussie, seconded by Justice Evans, WHEREAS, the Town Board of the Town of Southold has met at the time and place specified in the notice of public hearings on the Preliminary Budget for the fiscal year beginning on January 1, 1998, and heard all persons desiring to be heard thereon; now, therefore, be it RESOLVED that the Town Board of the Town of Southold does hereby adopt such Preliminary Budget, as amended, as the Annual Budget of this Town for the fiscal year beginning on the 1st day of January, 1998; and be it FURTHER RESOLVED that such budget as adopted by this Board be entered in detail in the minutes of the proceedings of this Town board; and be it FURTHER RESOLVED that the Town Clerk of the Town of Southold shall prepare and certify copies of said Annual Budget as adopted by the Town Board of the Town of Southold, together with the estimates, if any, adopted pursuant to Section 202a, .Subdivision 5 of the Town Law; and deliver a copy thereof to the .County Legislature of the County of Suffolk. Each of the bonds authorized by this resolution and any bond anticipation notes issued in anticipation of said bonds shall contain the recital of validity prescribed by Section 52 . 00 of the Law and said bonds, and any notes issued in anticipation said bonds, shall be general obligations of the Town., payable as to both principal and interest by a general tax upon all the taxable real property within the Town without limitation as to rate or amount. The faith and credit of the Town are hereby irrevocably pledged to the punctual payment of the principal of and interest on said bonds and any notes issued in anticipation of the sale of said bonds and provision shall be made annually in the budget of the Town by appropriation for (a) the amortization and redemption of the bonds and any notes issued in anticipation thereof to mature in such year and (b) the payment of interest to be due and payable in such year. I was going to speak on the neon sign issue tonight, but after reviewing : it, looking at it, and I notice that local business people are not coming here and speaking on it. I notice that the Chamber of Commerce is not getting involved in it, so I am going to let that one ride, but I will say this much, and I have said it before, a town without businesses goes nowhere. You need business in town, not all open space. What I wanted to speak on tonight is back in- this Stewardship draft. They made that back in 1994 on adopting the Lighting Ordinance. I'll speak a little bit on that. Evidently it was adopted by the Town Board at that time, but before I go into a few items on this, I read this whole thing over, and the other night 1 started laughing, and my wife didn't know what I was laughing at. I said, when you read this thing some of the stuff in there makes me laugh. I will go through a few of them, but before I start on that, I want to set the stage here for something. On this issue of Suffolk Times, March 31, 1994, Task Force says, lights out. Here we go now. Southold, the Stewardship Task Force has looked at lighting pollution in Southold Town, and came up with recommendations to make the night skies more suitable for star gazing. Some of these recommendations may make business owners see red. What a statement to say. Star gazing. More important than worrying about star gazing, proper lighting for safety, or whatever we have in this town for the business people. Let me go through a few of these highlights on this Draft. I have one also here, I'm not NOVEMBER ,12, 1997 %479 going to go into it tonight, on the signs.' That's another beauty. They claim that street lights cause environmental problems, and pollution. Where do you see environmental problems and pollution with street lights? I don't see none. Where? Can anybody prove that? Here's another one. Thirty-three B, lights, poles should be as short as practical with shielded sources, and as low in intensity as feasible. What good is having the light, if you are going to have it as low in intensity as possible, low as possible, and shielded, what good is the light? I could go on with this thing, but I want to try to keep it as short as possible. Unnecessary street lights waste electricity, and light pollution, making the cost to the Town money that could be better spent elsewhere. Okay, now, number one, keep saying this. On the last item they say, we recommend that the Town allocate funds and seek funding from the hamlet merchants, and outside sources, State, for new appropriate light fixtures for the hamlet centers. I tell you one thing, I noticed going through Riverhead the other day in Jamesport they were Installing new lights in Jamesport. The kind they got in Polish Town. It's going to be nice. I should call up Supervisor Stark, and say to him, you can't out those lights up, they are going to cause pollution. The Draft Law in Relation to Wireless Communications Facilities seeks to balance the treed for adequate wireless communication service with the need to rnirtiml the potential i npacxs of new cotnmuntcation structures on local communities. The construction of an 90 to 100 foot tower does present the potential fvr significant impacts on land use, aesthetics and historical areas. The intent of the Code is to limit these impa= by encouraging location of new structures within industrially zoned areas or on existing towers, and by regulation of the design and site plan for new facilities. In order to locate a struc=e within a residential area, the applicants have the burden of proof to show tlat they have considered alternative sites and that there is a clear public need for location of the structure as proposed. 4®.® NOVEMBER 12, 1997 Reasons Supporting This Determination: This determination is issued in full consideration of the Criteria fvr Determination of Significance contained in 6 NYCRR Part 617.11, the Long Environmental Assessment Form Pam I, II and III, and the foilowing specific reasons: 1. In comparing the proposed action with SEQR Criteria for Determination of Significance it is noted that the action will not change, destroy or impair air, water or natural/open space resources, or historic/archaeological resources in the Town of Southold. Chapter 100•(Zoning) of the Code of the Town of Southold is hereby amended as follows: 1. Section 100-13 (Definitions) is hereby amended as follows: BUILDING - Any structure having a roof supported by such things as columns posts, piers, walls or air intended for the shelter, business, housing or enclosing of persons, animals, property or other materials; also any combination of materials forming any construction, except where entirely underground so as to permit the use of the ground above the same as if no "building" was present. The term "building" shall include the term "structure" as well as the following: (1) Signs. (2) Fences. (3) Walls. NOVEMBER 12, 1997 .481 (4) Radio, television, receive-only satellite dish antennas amateur radio antennas and wireless communication facility receiving and transmitting antennas, except for radio, and- television, 6WGh receive-only satellite dish antennas amateur radio antennas installed on the roof of a building and extending not more than twenty (20) feet above the highest level of the'roof of such building. (5) Porches, outdoor bins and other similar structures. WIRELESS COMMUNICATION FACILITY. A wireless communication facilitv is anv unstaffed facility for the transmission and/or reception of wireless telecommunications services usually consisting of an wireless communication facility array connection cables an equipment facility, and a support structure to obtain the necessary elevation The support structure is either a building, telecommunication tower, or other approved structure. WIRELESS COMMUNICATIONS. Wireless communications shall mean anv personal wireless services as defined in the Telecommunications Act of 1996 which includes FCC licensed commercial wireless_telecommunications services including cellular telephone services personal communication services specialized mobile radio, enhanced specialized mobile radio paging and similar services that currently exist or that may in the future be developed. TELECOMMUNICATION TOWER. A telecommunication tower is a type of wireless communication facility designed and constructed specifically to support an antenna array, and may include a monopole self-supporting tower auv-wire support tower and other similar structures. A wireless communication facility attached to an existing building or structure shall be excluded from this definition. 2. Article XVI is hereby added and shall be entitled "WIRELESS COMMUNICATION FACILITIES " 3. Section 100-160. Purpose is added as follows: It is the express purpose of this article to minimize the visual and environmental impacts of wireless communication facilities while Protecting the health safety and welfare of Southold's citizens and allowing wireless service providers to meet their technological and . service obiectives. This article allows wireless communication facilities, and particularly telecommunication towers to be reviewed and approved in keeping with the Town's existing zoning and historic development patterns including the size and spacing of structures and open spaces Furthermore, the standards herein reflect two preferences: (1) that wireless communication facilities are preferred in industrial areas and (2) that wireless communication facilities be located on existing buildings and towers rather than on newly constructed towers Any wireless communication facility must take into account the aesthetic aspects of the town, including open vistas scenic byways and historic districts. 4. Section 100-161. Scope is added as follows: The regulations of this section shall govern and control the erection, enlargement expansion alteration operation maintenance, relocation and removal of all wireless 4 82- NOVEMBER 12, 1997 Communication_facilities The regulations of this section relate to the location and design of these facilities and shall be in addition to the provisions of the Southold Building and Zoning Codes and any other Federal State or Local Laws or Federal Communication Commission (FCC) regulations pertaining to such facilities. 5. Section 100-162. Location of Use is hereby added as follows: No wireless communication facility shall be used erected or altered in the Town of Southold except as follows: A. In Residential and Marine Districts including AC R80 R40, R120, R200, R400 AHD. HD RR RO MI and MII a wireless communication facility is subiect to site plan approval and must meet the following requirements. (1) Wireless Communication Facility on Buildings Shall require a special exception approval pursuant to this article Wireless communication facilities on buildings shall be no higher than ten feet above the average height of buildinos (excluding signs fences, and walls) within 300 feet of the proposed facility. The building on which the Wireless Communication Facility is located must be located at least one hundred feet (100) from the nearest property line and three hundred feet (300') from anv landmark property or district listed by federal state or town agencies. (2) Wireless communication facilities on Existing Telecommunications Towers shall require a special exception approval pursuant to this chapter unless otherwise allowed by the terms of a prior special exception approval. (3) Wireless Communication Facility on Telecommunications Towers - Shall require special exception approval pursuant to this article and shall not proiect higher than ten (10) feet above the average height of buildings (excluding signs fences and walls) within three hundred (300) feet of the facility or if there are no buildings within three hundred (300) feet these facilities shall not proiect higher than ten(10)feet above the average tree canopy height in that radius measured from ground level. If there are no buildings within three hundred (300) feet of the proposed facility site all telecommunication towers shall be surrounded bv dense tree growth to screen views of the facility in all directions The base of the tower shall be located at least one hundred (100) feet from the nearest property line and three hundred (300) feet frorn a landmark property or district listed by federal, state or town agencies. (4) A wireless communication facility is a permitted use not requiring site plan approval if located on property owned leased or otherwise controlled by state federal or town government, Provided a license or lease authorizing such facility has been approved by that government The height of such facility may be established by the public agency. (5) A wireless communication facilities is a permitted use not requiring site plan approval if located on property owned leased or otherwise controlled by a special district, provided a license or lease authorizing such facility has been approved by the commissioners of the special district, and provided that it does not exceed the maximum heights specified above. In Commercial Districts including LB 118 and B a wireless communication facility is subject to site plan approval and must meet the following requirements (1) Wireless communication facilities on Buildings are a Permitted use. Wireless communication facilities on buildings shall be no higher than twenty feet above the average height of buildings .(excluding signs fences and walls) within 300 feet of the Proposed facility. Wireless communication facilities on buildings must be located at least three hundred feet (300') from anv landmark property or district listed by federal state or town agencies. (2) Wireless communication facilities on Existing Telecommunications Towers are a permitted use unless otherwise restricted pursuant to the terms of a prior special exception Approval. (3) Wire Communication Facility on Telecommunications Towers area Permitted use, but shall not proiect higher than twentv feet above the average height of buildings (excluding signs fences and walls) within three hundred (300) feet of the facility or, if there are no buildinas within 300 feet these facilities shall not project higher than twenty feet above the average tree canopy height in that radius measured from ground level. If there are no buildings within three hundred (300) feet of the proposed facility site all telecommunication towers shall be surrounded bv dense tree growth to screen views of the facility in all directions These trees may be existing on the subiect property or planted on site The base of the tower shall be located at least one hundred feet (100') from the nearest dwelling unit and three hundred feet (300') from any landmark property or district listed by federal state or town agencies- (4) A wireless communication facility is a permitted use not reguiring site plan approval if located on property owned leased or otherwise controlled by state federal or town government Provided a license or lease authorizing such facility has been approved by that government. C. In Industrial Districts including LI and LIO a wireless communication facility is subject to site plan approval and must meet the following requirements. (1) Wireless communication facilities on buildings are a permitted use provided the height of the wireless communication facility does not extend more than one hundred feet (100') above the existing grade and the wireless communication facility is located at least one hundred feet (100') from the nearest property line and three hundred feet (300') from any landmark property or district listed by federal state or town agencies. (2) Wireless communication facilities on Existing Telecommunications Towers are permitted unless otherwise restricted pursuant to the terms of a prior special exception approval. NOVEMBER 12, 1997 (3) Wireless Communication Facility on Telecommunications Towers are a permitted use provided the height of the tower above grade does not exceed one hundred feet (100') above the existing grade and provided the base of the tower is located at least one hundred feet (100') from the nearest dwelling unit and three hundred feet (300') from any landmark property or district listed by federal, state or town agencies. (4) A wireless communication.facility is a permitted use, not requiring site plan approval if located on property owned, leased or otherwise controlled by state, federal or town government, provided a license or lease authorizing such facility has been approved by that government. 7. Section 100-163. Special Exception Approval is hereby added as follows: A. Authority. The Zoning U_Q rd of Appeals shall be empowered to issue.a special exception approval for wireless communication facilities, subiect to the provisions of this Chapter. B. Standards. In addition to the standards .in Article XXVI of this code, no special exception approval shall be granted unless the Zoning Board of Appeals specifically finds and determines the following: (1) that the applicant_is a public_utility,.and (2) that construction of the proposed facility or modification of the existing facility is a public necessity,.-in that it is required to meet current or expected demands of the telecomrTrunications provider and to render_adecauate service to the public. and (3) that the applicant has Made_substantial effort to locate or collocate on existing lowersor failing that, that ll�e applicant has made substantial effort to locate_on-federal, state or town land and facilities, and (4) that the facility coi with applicable FCC regulations; and (5) that there are conihelling reasciis,econortric or otherwise, which make it more feasible to construct the proposed facilities than alternatives. C. Matters to be considered. in addition to the matters to be considered in Article XXVI of this code, the Zoning Board of Appeals shall give consideration to the following in issuing a special approval for wireless communication facilities: (1) the height of the_prgp d tower shall be the minimum necessary to render adequate serv_ice1_and (2) the wireless communication facility has been situated to minimize its proximity and visibility to residential structures, residential district boundaries and-landmarks designated by town, federal, or state agencies., and NOVEMBER 12, 1997- 485 (3) the wireless communication facilities is designed and situated to be compatible with the nature of uses on adjacent and nearby property, and (4) the wireless communication facility has been designed to use the surrounding topography to minimize its visual impacts and (5) the wireless communication facility has been designed to use the surrounding tree, building or foliage coverage to minimize its visual impacts: and (6) the wireless communication facility maximizes design characteristics to reduce or eliminate visual impacts or obtrusiveness, and (7) that other adequate conditions have been placed on the wireless communication facility which will minimize any adverse impacts of the facility on adjoining properties. D. Application Requirements. In order to make the above described determination the Zoning Board shall require the following in addition to the requirements of Article XXVI: (1) Each application shall include a survey clearly indicating: (a) the location, type and height of the wireless communication facilities: (b) whether it is located on an existinq structure, collocated or on a telecommunication tower: (c) on-site land uses and zoning: (d) adiacent land uses structures and zoning within 300 feet: (e) distances between all structures,• (f) location of landmark listed by federal state or town agencies within 300 feet: (q) adiacent roadways and/or private rights of way' (h) Proposed means of access, (i) setbacks from property lines (i) elevation drawings of the structures;A) a long environmental assessment form with visual addendum: (1) and other information. deemed by the Zoning Board to be necessary to assess compliance with this law. (2) Each application shall include a written site location alternative analysis describing the location of other sites considered, the availability of those sites, the extent to which other sites do or do_ not meet the provider's service or engineering needs, and the reason why the subiect site was chosen. (3) The applicant shall document to the satisfaction of Zoning Board of.Appeals"that a good faith effort has been made to locate or collocate on existing towers or other available and appropriate buildings and structures, that it is not feasible to collocate on an existing facility and that the rrooposed location is necessary to provide adequate service to the public. The documentation shall include a notarized statement by the applicant as to whether construction of the wireless communication facility will accommodate collocation of additional antennas for future users. (4) Each application shall include a plan which shall reference all existing Wireless Communication Facility locations in the Town of Southold, any such facilities in the abutting towns which provide service to areas within the Town of Southold, any changes proposed within the following twelve (12) month period, including 486 NOVEMBER 12, 1997 applicant's plans for new locations and the discontinuance or relocation of existing wireless facilities. Alternatively, at the beginning of the vear the applicant may submit an Annual Wireless Communication Facility Plan containing the aforementioned information for the calendar year_ (5) A landscape plan showing specific landscape materials, fencing and maintenance arrangements. (6) The Zoning Board of Appeals May retain technical consultants as it deems necessary lo_provide assistance in the review of the needs and site location alternatives analyses and other matters that the Board deems necessary:_The.applicant shall bear the reasonable cost associated with such consultation, which cost shall be assessed as an additional application fee. In no case shall the fee be more than five percent_(5%) of the total protect cost as determined for building permit fee assessment purposes. (7) A copy of the deed or lease agreernent establishing applicant's right to use the parcel on which_ the wireless communication facilities is to be located. (S) An engineering analysis of the radio emissions and a Propagation map for the proposed wireless communication facility. The analysis shall ber)repared and sicgned by a New York State licensed professional engineer specializing in electrical engineering with expertise in radio-communication facilities. The results from the analysis (Must clearly show that the power density levels of the electromagnetic energy_generated from the proposed facility are within the allowable limits established by the FCC which are in effect at the time of the application. If the wireless communication facilities would be collocated with an existing facility, the cumulative effects of there must also be analvzed. The power density analysis shall be based oil the assumption that all antennas mounted on the proposed facility are simultaneously transmitting radio energy at a_ower level equal to the maximum antenna power rating specified by the manufacturer. (9) A "search ring" prepared signed and sealed by a qualified radio frequency engineer registered in New York and overlaid on an appropriate background reap dernonstratinq the area within which the wireless communication facility needs to be located in order to provide proper signal strength and coverage to the target cell. The applicant must bp_prepared to explain to the Zoning Board why it selected the prppgsed site, discuss the availability or lack thereof of a suitable structure within the search ring for collocation and the extend to which the applicant has explored locating the proposed tower in a more intensive use district. Correspondence with other telecommunication providers concerning colloca(ion is__pari of this requirement. E. Conditions. The Zoning Rgp d_stiall consider the following in establishing conditions on the issuance of the special exception approval. NOV,EMBER 12, 1997,. Q-'87 (1) In reviewing special exception approval applications required by this Section the Zoning Board of Appeals shall consider the Town's policy as stated in this Article. When considering appropriate height in conjunction with such applications, the ZOning Board of Appeals shall be more permissive when a facility is proposed for collocation by more than one service provider, and less permissive when the facility is proposed for use by a single rop eider. (2) In approving a Special Exception the Zoning Board may waive or reduce the criteria in this Article, to the extent specified below, if the Zoning Board concludes that the goals and stated purposes of this law are better served, and that doing so will have no detrimental effect on adjacent properties or on the public health, safety and welfare and thereby: i. Increase the height of the proposed tower up to fifteen feet over the height allowed by this code, with a maximum total height of no more than sixty feet (60'). ii. Minimize proximity of the tower to residential structures or historic landmarks listed by federal, state or town agencies: iii: Modify the planting of surrounding tree coverage and foliage to account for existing vegetation and land contours: iv. Modify the design or the tower, with particular reference to design characteristics that reduce or eliminate visual obtrusiveness; . (3) At the request of the building inspectors, which shall be no more frequently than annually, the provider shall have each wireless communication facility inspected at its own expense, and a copy of the inspection report shall be promptly transmitted to the building_inspector. Radio emission inspections shall be performed by a New York State licensed professional engineer specializing in electrical engineering with expertise in radio communication facilities. The radio emission inspection shall describe the power density levels of the electromagnetic energy generated from the :facility, including the cumulative effects of collocated antennas. In the event that the radio emission inspection indicates that the electromagnetic energy -generated from the facility are-above the allowable limits stated within the applicable FCC or ANSI standards or other applicable state or federal guidelines in effect, the applicant shall cease all use of the facility until such time as it proves to the satisfaction of the building inspector that the power density levels of the electromagnetic energy to be generated are below the applicable standards. (4) Any special exception approval granted under this Article shall have a term of five years, commencing from the grant of the special exception which may be extended for an additional five year term 48°.8 NOVEMBER 12, 1997 upon application to the Zoning Board On a renewal application the applicant shall demonstrate that the wireless communication facility is in compliance with all applicable laws, rules and regulations and with all of the conditions of the special exception approval and site plan that the facility is necessary to provide adequate service. and that there is no reasonable alternative available to the owner which will provide adequate service without the continuing use of the facility. Subseciuent special exception renewals shall be subiect to review by the Zoning Board and subiect to such standards that shall be included in the Town Code at that point in time. 8. Section 100-164. Historic Buildings and Districts is hereby added as follows: No wireless communication facility is allowed on any designated landmark property or district listed by federal state or town agencies, except as specified below: A. Any wireless communication facility located on or within an historic structure listed by federal state or town agencies shall not alter the character-defining features distinctive construction methods, or original materials of the building. B. Any alteration made to an historic structure to accommodate a wireless communication facility shall be fully reversible. C. Wireless communication facilities within an historic district listed by federal, state or town agencies shall be concealed within or behind existing architectural features, so that they are not visible. 9. Section 100-165. Design Standards is hereby added as follows: The following design standards shall apply to wireless communication facilities installed or constructed pursuant to the terms of this chapter. A. Camouflage on Buildings-. When a wireless communication facility extends above the roof height of a building on which it is mounted, every effort shall be made to conceal the facility within or behind existing architectural features to limit its visibility from public ways and residential uses but still permits the facility to perform its designated function. Facilities mounted on a roof shall be stepped back from the front facade in order to limit their impact on the building's silhouette. The wireless communication facilities shall blend in with the existing building's architecture and, if over five (5) square feet, shall be painted or shielded with material which is consistent with the design features and materials of the building. B. The minimum lot size for the siting of a telecommunication tower shall be in accordance with the following. No tower can be built on a lot which is nonconforming in size to the requirements set forth below: a NOVEMBER 12, 19978 Minimum Lot Area-, Minimum Lot Area- Residential and Minimum Lot Area- Commercial Districts Marine Districts Industrial Districts Per Bulk Schedule per 5 acres Per Bulk Schedule zone per zone C. Setbacks Towers and Equipment Facilities shall adhere to the setbacks for principal uses in the Bulk Schedule applicable to the zone in which the structure(s) are located. D. Fencing The base area of a telecommunication tower and equipment facility shall be enclosed with a black vinyl chain link fence not less than six feet (6') in height. E. Signs Signs shall not be permitted on towers except for signs displaying contact information and safety instructions. Such signs shall not exceed five (5) square feet in surface area. F. Equipment Facility. Equipment accessory to the wireless communication facility may be located within an existing building. In newly constructed buildings and structures an equipment facility is limited to 500 square feet in floor area If the newly constructed equipment facility is designed for collocation the facility may be up to 1000 square feet The equipment facility shall be constructed with a finish similar to that of adjacent structures on the property and integrated into the architectural style. Any newly constructed equipment facility shall be located in accordance with the minimum height and yard requirements of the zoning district applicable to the site and no more than two-adjacent off-street parking spaces shall be provided for service vehicles. Any regrading for stormwater retention that is reec�uired by the Town Engineer shall be accommodated on-site. G. Site Lighting. As independent freestanding facilities on separate sites will not be accessible to the public the lighting permitted shall be the minimum required to protect the public welfare. Facilities_ sited on existing developed sites shall be incorporated into the lighting and land scapinq_plans of those sites. H Access Access to tower or monopole areas shall be from established site access points whenever possible. I. Dish Antennas. Dish antennas shall be colored camouflaged or screened to the extent that they are as unobtrusive as possible and in no case shall the diameter of a dish antenna exceed six feet (6). J. Electric Line Setback. No wireless communication facility shall be located nearer than a distance equal to its height above the roof or other permanent structure to which it is attached to any overhead electric transmission line carrying more than two hundred twenty (220) volts. K. Collocation. Wireless Communication Facilities shall be designed to provide for collocation by multiple providers; or designed so that they can be retrofitted to accommodate multiple providers. 490 NOVEMBER 12, 1997 10. Section 100-166. Appearance is hereby added as follows: A. Scenic Landscapes and Vistas. All telecommunication towers which are riot camouflaged by existing buildings or structures shall be surrounded by a buffer of dense tree growth A wireless communication facility that is located within 300 feet of a scenic vista, scenic landscape or scenic road as designated by the town, shall not exceed the height of vegetation at the proposed location. If the facility is located farther than 300 feet from the scenic vista, scenic landscape or scenic road the height regulations described elsewhere in this article shall apply. B. Base Landscaping A screen of evergreen trees shall be Planted outside the fence of the telecommunication tower base area to provide a visual screen or buffer for adioinina private properties and the public right-of-way. Required front Yard setback areas shall be landscaped. C. Color. Towers shall either be blue/gray in color, have a galvanized finish or be colored appropriate to the tower's locational context to the extent that the tower is as unobtrusive as Possible. unless otherwise required by the Federal Aviation Administration (FAA). If a wireless communication facility is installed on a structure other than a tower, the antenna and supporting electrical and mechanical equipment must be of a neutral color that is identical to or closely compatible with the colors of f the supporting structure so as to make the antenna and related equipment as visually unobtrusive as possible. D. Camouflage by Vegetation for Residential Screening. Where the site proposed for a freestanding tower structure is located within a residential zone or has one or more property Fines abutting or on the opposite side of a street from a residential zone or use permitted in a residential zone large trees and/or existing and proposed buildings on the site shall be used to provide an angle of occlusion from the property line to the top of the structure of 50 degrees or less (50 degrees from the horizon line is the upper limit of the normal vertical cone of vision) To achieve the occlusion. a row of mixed deciduous and evergreen trees shall be preserved and/or-planted at 50% of the distance between the tower and the property line, and a second row at 90% of the distance between the tower and property line (see illustrations below). Transplanted trees shall have a minimum caliper of 3 inches, be spaced on 30 foot centers and have a typical height at maturity of at least 50 feet A three year bond or other assurances shall be required to ensure that the plantings survive and are maintained. Alternate Screening The location of a cellular wireless communication facility on an existing water tower, silo or egujvalent vertical structure Including an existing cellular radio or television tower, is permitted without the need to meet Conditions A B. C and D above, provided that the height of the existing structure is not increased as a result of the attachment of the cellular structure. A decorative disguising structure such as a clock tower may also be approved as an alternative to Conditions A. B. C and D at the discretion of the Zoning Board If the height of the existing structure is to be Increased by the attachment of the new structure, all of the conditions herein shall apply as to a new freestanding structure. F. Commercial and Industrial Siting Towers to be site on developed commercial or industrial properties shall be located to the rear of other principal buildings and shall not encroach on Planting buffers parking areas or otherwise impair the operation of Previously approved systems such as stormwater drainage basins. Existing buildings and structures should be used in the siting of freestanding towers to contribute to the visual screening of the tower. G. Commercial. Towers to be sited on undeveloped Properties in the commercial districts shall apply the standards of the condition to §100-165(C) herein to all property lines, including the streetline, except that a driveway shall be permitted to gain access to the facility for maintenance personnel and egui ment. H. Airport Regulations. AIL towers shall comply with applicable Airport Hazard Regulations and shall be subject to approval from the Federal Aviation Administration for location height and lighting to prevent interference with the operation of an airport or otherwise threaten the public safety. ;4�9 2 NOVEMBER 12-, 1997 11. Section 100-167. Removal is hereby added as follows: A. Any Wireless communication facility that is not operated for a continuous period of twelve (12) months shall be deemed abandoned. At that time the owner of the wireless communication facility shall remove same within ninety days of such deemed abandonment. In the case of a wireless communication facility on preexisting structures`this provision shall apply to the wireless communication facility only. If the wireless communication facility is not removed with the said ninety (90) days, the building inspectors may, with the approval of the Town Board give the owner notice that unless the removal is accomplished in thirty (30) days, the town will cause the removal at the owner's expense The grant of a special exception approval under this Article shall include irrevocable permission to the town to accomplish removal of the wireless communication facility under this Article Any cost to the town for such removal, shall constitute a lien on the tax lot on which the tower is situated and shall be collected in the same manner as a town tax upon real property. 12. Section 100-168. Nonconforming Uses is hereby added as follows: Pre-existing telecommunication towers shall be allowed to continue their usage as they presently exist. New construction other than maintenance on a ore-existing tower, shall comply with the requirements of this ordinance. 13. Section 100-169. Severability is hereby added as follows: The various parts, sections and clauses of this local law are hereby declared to be severable. If any part.,sentence, paragraph, section or clause is adiudged unconstitutional or invalid by a court of competent jurisdiction the remainder of the ordinance shall not be affected thereby. 14. Section 100-31. Use regulations in A-C, R-80, R-120, R-200 and R-400 Districts is hereby amended as follows: B. Uses permitted Uy special exception by the Board of Appeals. The following uses are permitted as special exception by the Board of Appeals, as hereinafter provided, and, except for two family dwellings and the uses set forth in Subsection B(14) hereof, are subject to site plan approval by the Planning Board: 6) Public utility rights-of-way as well as structures and other installations necessary to serve areas within the town, except that wireless communication facilities must obtain approval pursuant to Article XVI, subject to such conditions as the Board of Appeals may impose in order to protect and promote the health, safety, appearance and general welfare of the community and the character,of the neighborhood in which the proposed structure is to be constructed. 15. Section 100-131. Use regulations in the LIO District, is hereby amended as follows: NOVEMBER 12, 1997 497J B. Uses permitted by special exception of the Board of Appeals. The following uses are permitted as a special exception by the Board of Appeals as hereinafter provided, subject to site plan-approval by the Planning Board: (4) Public utility structures and uses, except that wireless communication facilities must obtain approval pursuant to Articie XVI. 16. Section 100-230 (D) Exceptions and modifications, is hereby amended as follows: D. Height exceptions. The height limitations of this chapter shall not apply to: (1) Spires, belfries, cupolas and domes not for human occupancy; and monuments, transmission towers, excluding telecommunication towers, chimneys, derricks, conveyors, flagpoles, radio towers, television towers and television aerials, provided that any television or radio aerial shall not be located nearer than a distance equal to its height above the roof or other permanent structure to which it is attached to any overhead electric transmission line carrying more than two hundred twenty (220) volts. (2) Bulkheads, observation towers, monitors, fire towers, hose towers, cooling towers, water towers, grain elevators or other structures where a manufacturing process requires greater height but excluding wireless communication facilities, provided that any : such structures that are located on any roof area that exceed in height the limits in the particular district shall not in the aggregate occupy more than twenty percent (20%) of the horizontal area of the roof and are set back one (1) foot from the edge of the roof for each additional foot in height greater than the specified height. (3) All mechanical equipment necessary to operate building services, which equipment is located on the roof of a structure, shall be screened in a manner approved by the Planning Board. II . She just recently presented to the Town of Southold the deed for two wetland parcels totally about 35 acres all together, and these, many people probably know, have been held in the continuous ownership by. early Southold families since the founding of the town in 1640. She is very concerned about the look of her town, and the course we are going to' take, and she writes, to Southold Town Board. wish to register my strong disapproval of any zoning change for the main street of Southold for it's whole length, be it for Mullen Motors or any other business. Colonial Corners is in good taste and should not be altered in any way. Car dealerships, sprawling parking lots, gas stations, and neon lights are a blot, an ugly blot, on our quiet village. Seven/eleven should never have been allowed. Route 25 in Mattituck is a disgrace, and do we want to look like that? A thousand times, no. Your truly, Katherine Mayne. COUNCILMAN MOORE: Thank you. Anyone else care to address the Board? FRANK CARLIN: I wrote some things down while I was waiting. Getting in little shape, because we are getting in shape for the main event, November 20th. I did see W.C.W. wrestling. We are going to rumble that night. Ask Jean Cochran. She will tell you. Not in this Town Board, I'll tell you that. You can relax. . I'll give you a clue. Do you put in funding for the street lights from the State, or anything? Do you put in for any money to install street lights? That's what I want to ask you. COUNCILMAN MOORE: Superintendent Jacobs would know if he goes that way for money. I don't know if he does, or doesn't. I don't know. FRANK CARLIN: There must be money out there for that. I'm sure there is. Kind of hard to have all. . COUNCILMAN TOWNSEND: Just to address the question, the cost per street light is something just under $200. a year per street light for electricity. That doesn't include the maintenance of the light, and in of the light, and so forth. That is what it is per street light. FRANK CARLIN: You take that up with Ray Jacobs, because he didn't tell me that, Joe, so you go back. COUNCILMAN TOWNSEND: That's the bottom line. FRANK CARLIN: He's the Supervisor of Highways, and he puts the lights up, and he handles the street lights, and this is what he told me. Don't tell me. You check with him. That's what lie told me. That is why they don't like to see a light that is always on all the time, because it is NOVEMBER 12, 1997 495 waste, if it is on all the time. Keep it off during the day. Wouldn't it be hard to have all our neon signs out in Southold, but yet you go to Greenport, you see all you want. Street lights are very important, especially on the Main Road, 25. We should have more on the Main Road. This road was never designed to handle the traffic we have now. It was built back in the 1920's. My father-in-law remembers it when it was a dirt road. It was never designed to handle this kind of traffic with the curves we have in here, and the dangerous two lane highway we had with all the traffic. We could have more street lights along 25. 1 know, because when I worked many time at night coming home, twelve, one o'clock in the morning, in the fog, in the snow, and the rain. It wasn't for street lights I don't think I ever would have found my way home. You need, more street lights here. They -are like gold. You handle them like gold in this town. don't understand it. I think we can go with the changing times in this town, and still maintain the rural character of this town within reason. I tell you it's a good thing we don't have our own utility company here, because the Stewardship Task Force Committee would probably come along, and say, lights out at anybody's house at nine o'clock, and all the street lights go out at nine o'clock. It's a good thing we don't have our own utility here, and if we ever do try to have it, I'm going to fight that again, because in 1984 the people voted that down, the proposal number one here. In 1986 they didn't want it, so let's don't bring that back up again, because I know we ain't going to handle it. We got a problem with what we got now with light. What are we going to have then? That's about it. I'm winding up now. I'm getting in shape , now. It is going to be good November 20th, which covers Greenport lights, and maintain roads. We do need, if anything, more lights on the Main Road. All these curves we have in this road, and a dangerous road it is. More lighting would help the safety of traveling on Route 25. As far as pollution goes, I get sick every time somebody mentions that to me. Pollution. What pollution? 'Prove it to me, that there is pollution in the street light. Unbelievable. Anyway, that's it for tonight, and see the Supervisor. She will tell you what the big event is, November 20th. COUNCILMAN MOORE: Okay, so it's not mud wrestling. Thank you. Anyone else care to address. the Board this evening? (No response. ) Councilwoman Hussie, do you have a report? COUNCILWOMAN HUSSIE: No report. COUNCILMAN MOORE: Joe? COUNCILMAN TOWNSEND: Yes, I want to discuss a couple of things. The Street Light Committee did turn down another street light request in town today. It was unanimous, and I also want to discuss the votes on the budgets. If you note -that the votes on the operating budget, and the Capital Budget were divided up into two resolutions, 8a and 8b, and I voted for the operating budget, while I did have some concerns. I do have some ongoing concern about that budget the rate of increase for a variety of reasons in taxes is below the rate of inflation, at least I expect it will be. However, I do see a disturbing trend in that budget, and that is an ever increasing size of Town payroll. We did hire, probably eleven, or twelve new employees when you include the Police, and new clerks, and so forth. Some of these are replacements of people, that have retired, or been disabled, but I would guess that probably there is an addition of about six new employees, a net increase of six new employees. We know that is what causes local taxes to increase, and I think, as 1 have said in the past, and presented a proposal, I don't think in the past we have adequately evaluated the need for, or the alternatives to these hirings, and I would hope that before we actually hire these people to see there are alternatives, or ways we can do it less expensively: I voted against the Capital Budget, and the reason I voted against the Capital Budget was because it goes back to last spring, when the Planning Board, at the Supervisor's request presented a list - of ongoing projects that were benefited by grants, and tried to create a coordinated method of grantsmanship, that might help increase the money the Town gets for large scale projects. Well, the Capital Budget is a Budget that is designed for large scale projects, big ticket items, you know, landfill closure, major new land purchases, machinery purchases of large, you know $100,000 pieces of equipment. I spent some time preparing a Capital Budget, which included a couple of things which I think were important to the future. Two 496 NOVEMBER 12, 1997 of them were related to acquisition of property. One was putting seed money in for the acquisition of parking lots, and parks in downtown areas. If our hamlet areas are going to compete, I think we have to start planning right now for parking areas, and for parks in that area, make them attractive, to make them competitive with, you know, the outlining areas, where you the convenience of ease of traffic, and accessibility. The other thing that I wanted to consider was the purchase of certain scenic overlooks off the Town's major roads. We. have discussed from time to time creating—once it was in conjunction with the cellular tower law, that 'we should have scenic areas, scenic districts, which we could try to keep in a pristine condition. In order to do that I think it would help to have vantage points, areas where we could have mini parks off the main roads, and I think it would be a relatively modest investment, and the rewards would be great if we acquired some of these areas. Those are two of the items. I had another one in there, also, relative to the arts that were considered. We didn't consider the Capital Budget in any great depth. In fact, I wasn't that concerned, because I thought that next year I could probably find areas where we could do that, but since I am not going to be here I am voting against the Capital Budget, because I think it is important that in be in the Capital Budget, and basically that's it. I know that is a little rambling, but I didn't prepare a speech. COUNCILMAN MOORE: Ruth? COUNCILWOMAN OLIVIA: I don't think so. I just wish everyone a good evening. I am delighted that we were finally able to pass the Telecommunications, and I am, also, glad that the Town Board kind of reversed the decision of the Planning Board not to release that document, because I feel all documents, and they have always been as far as the Town Board are concerned, public information. I think this one should be, too, because even I was not allowed to see. Thanks. COUNCILMAN MOORE: I will say just in comment, we had an opportunity to present our Capital Budget and ideas we had, when we could have put a resolution amending it, and requesting certain things, so I am sorry to say those things weren't put in, but you could have stepped up at the time, and done that. I, too, am happy that the Telecommunication Law is now is on books. The Code Committee can move forward to other things. We have quite a laundry list of. things to work on. I don't know what I am going to do without certain of my new found friends helping along, but you are very welcome to join us on the next issue of interest that the Code Committee is going to work on. Two weeks ago, I hardly encouraged everyone watching here, listening, whatever, to go listen to a fourteen year old piano virtuoso. If any of you had the chance to hear this young man. I did. If you didn't hear it, it was your loss. I don't think anything like that will come to this town again. This young man is unbelievable. David Alec Burnoff came and played at the Church of the Open Door for our Arts in Southold Town Program, that brings the classical series out here through the winter months. Families, parents were in tears' listening to this kid play. It was just unbelievable. I am very grateful I got to go, took my little girls with ;me, and my wife, and -had a great time. So, those of you who went, bless you, because you had a great opportunity.
