SOUTHOLD TOWN BOARD JUNE 24, 1997 WORK SESSION Present: Supervisor Jean W. Cochran, Councilwoman Alice J . Hussie, Councilman Joseph L. Townsend, Jr. , Councilwoman Ruth D. Oliva, Justice Louisa P. Evans, Councilman, William D. Moore, Town Clerk Judith T. Terry, Town Attorney Laury L. Dowd. 9:10 A.M. - Town Historian Antonia Booth met with the Board to request that members of the History Cooperative be invited on the annual Town Board trip to Fishers Island on August 13th. Board approved. 9:15 A.M. - George Weiser and Executive Assistant James McMahon met with the Town Board to discuss Mr. Weiser's request for Town Board support, as Project Sponsor, for an affordable housing project at Richmond Creek Estates, an existing subdivision located on the easterly side of Indian Neck Lane and south of Route 25 in Peconic. The pre-existing subdivision is located on 27.2 acres and has 24 one- half acre lots and 10.6 acres of open space. No change of zone or variances are required. . Mr. Weiser asked the Town Board to be the sponsor of an application to the New York State Affordable Housing Corporation and the Suffolk County Community Development Block Grant Program, for $1 .2 million in grant subsidies for the project. Mr. McMahon advised the 'Board that the project is similar to the Southold Villas, Cedarfields and Elijah's Lane Estates projects. He recommends a lottery in this case to award the lots. _ Mr. McMahon submitted a proposed resolution authorizing the Supervisor , to sign grant applications and certifications, but Councilman Townsend asked that the resolution be held for the July 8th Town Board meeting to give him time to research prior affordable housing projects. 9:45 A.M. - Robert S. Hughes, Attorney for Edward- and Daniel Latham, met with the Town Board to request their approval of an exchange of a parcel of farmland development rights property for a parcel without that designation, at Narrow River Road Orient. (Also in attendance was William H. Price, Jr. , Attorney .for the purchasers of the Latham property) . Mr. Hughes explained that the purchasers wish to develop 40 acres of the property as a horse farm, -and plan to build a farm house and appropriate out-buildings. They want to build their farmhouse away from Narrow River Road, therefore, they wish to swap the Development Rights to the 7.973 acre plot with the Town in return for the Town permitting one building lot on the 32.0027 acre plot. The Town Board will refer the proposal to the Land Preservation Committee and Agricultural Advisory Committee for their recommendations and reports. EXECUTIVE SESSION 10:15 A.M. - On motion of Justice Evans, seconded by Councilman Moore, it was Resolved that the Town Board enter into Executive Session to meet with Robert Brown, of Fairweather-Brown, to discuss the possible purchase of property. Vote of the Board: Ayes: Supervisor Cochran, Councilwoman Hussie, Councilman Townsend, Councilwoman Oliva, Justice Evans, Councilman Moore. Also present: Town Clerk Terry, ,Town Attorney Dowd. 10:45 A.M. - For Discussion Items: Request from Don Patanjo Cesspool Service Corp. for the Town to pay the dumping fee directly to the Suffolk County Department of Public Works ' for the Bergen Point disposal site for .scavenger waste. Before approving the proposal, Supervisor Cochran will seek additional information JUNE 24, 1997 81 from the Towns of Islip, Southampton and Brookhaven who Mr. Patanjo advises handles the dump fee payment directly with the DPW.----Town Board rejected all bids for the construction of a Tourist Information Booth at S. Wentworth Horton Park, and placed a resolution (24) on the agenda authorizing the Town Clerk_ to rebid when the specifications are rewritten.----A resolution (25) was placed on the agenda appointing Richard C. Ryan to the Land Preservation Committee.----A resolution (26) was placed on the agenda reappointing James H. Rich, Jr. and James H. Pim as members of the Land Preservation Committee.----Resolutions (27 S 31) were placed on the agenda to appoint Maureen P. Byrne as a part-time Clerk Typist for the Trustees and David M. Hodgson as a summer Clerk Typist for the Building Department. Ed Forrester, Building Department Head, met with the Board to discuss Mr. Hodgson's appointment.----Town Board set July 8th to interview applicant for the. Conservation Advisory Council. Director of Human Services McKeighan will interview applicants for Mini-Van Driver and part-time Custodian for the Human Resource Center.----Request from Chief Conway to retain Charles Greenblatt, Inc. , supplier of police department uniform clothing, for an additional year (1998) . Town Attorney Dowd will research the question, but advised the Board the bid documents were for 1997, and did not provide for an extension -for an additional .year.----A resolution (28) was placed on the agenda to allow Detective Beth Dzenkowski to attend a NYS Juvenile Officers Training Association annual training conference.----Town Board placed a resolution (30) on the agenda to create the position of Director of Code Enforcement and set the salary scale.----Request from ZBA Chairman Gerard 'Goehringer for in increase in the per hour rate of part- time Clerk Typist Lucia Farrell. A review of Ms. Farrell's employment history shows that she has received all of the required increases, and is due for another one on July 1st.----A resolution (28) was placed on the agenda to refer "A Local Law in Relation to Lot Recognition" to the Town and County Planning Departments.----The . Board discussed the proposed 2% tax to preserve open lands. There is currently legislation in Albany authorizing the Town of East Hampton to establish a preservation fund. Supervisor Cochran asked for. Town Board approval of a letter she sent to the NYS Assembly asking that a' place be reserved in the legislation for the Town of Southold. The Town Board unanimously approved the letter as necessary and proper. EXECUTIVE SESSION 12:20 P.M. - On motion of Justice Evans, seconded by Councilwoman Hussie, it was Resolved that the Town Board enter- into Executive Session to' discuss personnel history, personnel/litigation settlement issues, litigation, sale of Town property. REGULAR MEETING A Regular Meeting of the Southold Town Board was held on June 24, 1997, at the Southold Town Hall, Main Road, Southold, New York. SUPERVISOR COCHRAN: As you know each month the Town Board receives reports from the different departments, and committees, and they are listed on your agenda. They are on file .with the Town Clerk in the Town Clerk's Office, and they are public information, so if you interested in any of the workings of the committee, please, feel free to come in, and it will be shared with you. PUBLIC NOTICES. SUPERVISOR COCHRAN: Public notice, I would like to call your attention to several things .within public notices, and one is Suffolk County Office for the Aging. They will be bringing the citizen mobile information office out to Southold Town Hall on July 23, 1997 from 10:30 to noon. They take an hour for a lunch break, and then from 1 :00 to 2:30, so it will here - on this location. If there is anything, ID cards, referral services, County, and non-County agencies, veteran agencies information, senior employment information, and literature pertaining to senior citizens, this will all be here for your pleasure. Also, I would like call to your attention several traffic control changes from the New York State DOT, and one is an action they have taken to extend the existing 40 MPH area east to Skunk Lane. So it will be a distance of 1 .1 miles in Cutchogue. The second one is that the East Cutchogue Elementary School, the speed limit there has been reduced, as the sign has been put up, but it's acted upon. The action will change the existing 35 MPH school speed zone to 30 MPH, so don't get a ticket. We have these little changes we would like you to be aware of. 1 . Suffolk County Office for the Aging schedule. for Senior Citizen Mobile information Office. 2. New York State, Department of Transportation, Notice of Order to amend speed limit to 40 MPH on 'Route 25 from Stillwater Avenue to Skunk Lane a distance' of 1 .1 miles in the community of Cutchogue. 3. : New York State Department of Transportation, Notice of Order to change the existing 35 MPH school speed to 30 MPH on Route 25 adjacent to the East Cutchogue Elementary School. 4. US Corp of Army Engineers, application of Alan Cardinale, Jr. to dredge with ten years maintenance and upland disposal in Wunneweta Pond, Little Peconic Bay at Cutchogue, New York. Comments to be received by July, 18, 1997. Ill.. COMMUNICATIONS. SUPERVISOR COCHRAN: We have received some communications. One is from Joseph Rizzo, who is Presiding Officer of "the Suffolk County Legislature. They requested one of Southold Town's flags, which , we supplied, and they are very happy that it is in the, Legislature auditorium on display, so I guess they are there with the other ten towns, and nine town in Suffolk. Also, from time to time, more often than not, we get very nice letters from people that have availed themselves of the services from the Nutrition Center, Human Resource Center, and this is a letter that we received singing the praises of the staff, and I believe that when a nice compliment comes in it should be passed along, so we thank the staff up there for the hard work they are doing. Also, received a letter from Steve Jones, Department of Planning for the County, and they are supportive'of the designation of Southold" Historic District here in the hamlet of Southold. They applaud this type of effort, and request that the State support it. Another safety concern, where we did have someone in the last year hit on that curve. in Mattituck, where the blinker light is, we did,. request a traffic survey. Again, from the New York State Department of Transportation, they feel that the investigation has shown that a curve:.,_,. warning sign with a speed advisory of 25 MPH is appropriate westbound on' Route 25, and as soon as the work group is available they will, be putting this up. If you have something other than what is on the agenda, but it is Town business we will entertain your comments at the end of the meeting. So, if there is anything. you would like to share with us in relation to the resolutions, you may do so now. Anything in relation to resolutions, any comments? (No' response. ) If not we will begin the resolutions. We do have some public hearings tonight, and we will .be stopping for those when the time is appropriate. Rambo, Inc., in the amount of $25,000.00, to furnish all labor, materials and equipment as required for the construction of the Bulkhead Replacement at the road end of State Street (Skipper's Lane), Orient, New York, all in accordance with the bid specifications. 3.- Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilman Townsend, Councilwoman Hussie, Supervisor Cochran. That Supervisor Jean W. Cochran is authorized tr the official representative to act in connection with any contracts between the Project Sponsor and the State and directed to provide such additional information as may be required; 2. This resolution was duly ADOPTED. 13.-Moved by Justice Evans, seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs the Town Clerk to advertise for resumes for one member for, the Southold Town Transportation committee to fill the vacancy caused by the resignation of Dwayne H . Early, to April 5, 1999, and be it FURTHER RESOLVED that the Town Clerk to authorized to advertise for resumes for one youth member for the Conservation Advisory Council to fill the vacancy caused by the resignation of Christy Paliouras (youth member), to June 18, 1998. 13.-Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilman Townsend, Councilwoman Hussie, Supervisor Cochran. -This resolution was duly ADOPTED. 14.-Moved by Councilwoman Hussie, seconded by Justice Evans, WHEREAS, there has been presented to the Town Board of the Town of Southold, on the 24th day of June, 1997, a Local Law entitled, "A Local Law in Relation to Sleepy Hollow Lane and Locust Lane; now, therefore, be it RESOLVED that the Town Board hereby sets 5:00 P.M., Tuesday, July 8, 1997, Southold Town Hall, 53095 Main Road, Southold, New York, as time and place for a public hearing on this Local law, which reads as follows: A Local Law in Relation to Sleepy Hollow Lane and Locust Lane BE IT ENACTED, by the Town Board of the Town of Southold as follows: JUNE 241 1997 87 I . This resolution was duly ADOPTED. SUPERVISOR COCHRAN: We have until eight o'clock for the first public hearing. We have about eight minutes. Maybe I can share a little something with you. As you know we developed a program last year, and it's called SOAR, which stands for Save Our American Resources, and it is directed toward young people, and .they become stewards of America's. resources, in this case they become stewards of Southold's resources. We did receive a grant last year to get it started - this past year from the Lewis Bacon JUNE 24, 1997 97 {Foundation. They gave us a grant for $25,000. One of the ways we hope to raise funds for. this program in the future is by collecting the deposit cans from the waste stream. Coming from Southold is over 40,000 cans that have a nickel deposit on cans, bottles, and so forth, and we feel that there is 30,000 available to us. Some of it we collect directly at the landfill, and there are different categories. There are Code products, Pepsi, Miller, Budweiser, Coors, and Cott. You bring your cans into the landfill, and they are being carted away after they are put in bags, and they are being ' sorted by some of the community workers from the County up at the Camp, , and they sorting them out, and then they returned to Mattituck Beverage, and we receive $12.00 a bag. The money is starting to come in fairly well. We have a meeting the other day, because we want to try to encourage those residents that summer out here, and have second homes, that spend the summer .in Southold to be aware that we certainly would appreciate it if any of the cans they have, rather than being thrown into the garbage is maybe, perhaps, put in a little bag on the side, and dropped off at the landfill, so that we can continue the program with funding in other ways, then hitting the tax base. The committee met two days ago, and we have developed some plans in relation to public announcements, and we are going to redo the brochure, . and hand them out at the landfill, and there were several other ideas for promotion, so this is just the Board's way of reminding everyone, not only our summer residents, but our year round residents that we sure would appreciate your support in bringing your cans to the landfill for the kids. Maybe I can find something to share with you in,..this few moments I have. COUNCILWOMAN HUSSIE: How about I talk about the transfer station? I did that resolution with further engineering cost, and one of the questions that I get occasionally from people. that .1"'meet either at the post office, or the grocery store, or wherever it is, and know that I am involved in this are, why do we have to have the Transfer Station? 1 will tell you quite frankly that we have to have it because the DEC requires that we have a tipping floor that we can- dymp the garbage that comes in, and inspect it every now and then. So, we are going through this whole thing. We have been very careful. We had our Solid Waste Committee:work on the design of this, the traffic ,patterns, and all of that very, very carefully. I think we have it down now. I think we've got it the way it should be. I do not know if I'm doing a terrible thing, but I would ask that anybody who has an idea about something that they think is very important about the Landfill that perhaps we haven't looked into, . and that could be taken care of, give me a ring here at the Town Hall, and I will take it under advisement, as they say. SUPERVISOR COCHRAN: Tomorrow fifty thousand phone calls all for Alice. It is important, and if you do have any input we certainly do welcome it on any topic, not just our. Landfill. COUNCILWOMAN HUSSIE: Except this is' a high ticket item. You want to have it right. SUPERVISOR COCHRAN: Okay, we have two minutes. I have to show you something cute. I love things like this, but we had two school groups in this week on Tuesday, one in the morning, and one in the afternoon, and they are second graders, and you know, they always send you a thank you note, and it goes on, and on, and on: but what I got a charge out of, 'my Girl Scout background, I love these, kind of things. They drew a picture down here, and I think what ' impressed them the most was the Tax Receiver. It's probably something they have heard Mom and Dad talk about, so they have this little picture of this lady inside with glasses, saying thank you, and they are handing the money to her, so I thought that was kind of fun to share. These kids, as young as they are, they have some darn good questions. I'll take a moment right now rather than at the end of the meeting to thank the Girls Scout for planting up at the Sound. As you drive by you will see once again, that the building has been painted, and we still have some stone and stuff to put around the landscaping, but the Girl Scouts came down last Friday, and planted all the bright yellow marigolds, then we fed a hot dog and a soda, and they did a lovely job, there-were about twenty girls, and it seemed like in an hours time all three beds were planted, so we had many people comment about it, and they enjoy it through the summer, because it looks a lot more attractive, and we are trying to do that. I know some of. the play equipment, the final part 9`8 JUNE 24, 1997 that was missing up at Taske.r Park arrived yesterday, so that is up at Highway Department, so they will be taking that out, and finishing up that playground up there, so the young people can begin to use that, so lots of exciting thing happening. Just looking at this thing, . it occurred to me that when we have these public hearings they don't seem to have a lot of input in many instances on why we are going to make these changes, and I think if we had a check list, or some sort of part of a record that could indicate that there was concern in the community for x, x, x and x reason, or there was a fair amount of data' relative to incidents, or fees, and so forth, if there was a format of some sort that could be part of the record, much like the Department of Transportation has when they put a stop sign in, or a blinking light or something like that when they have a survey, it might be helpful to understand why we are actually making these changes. I am not sure it is .that critical for these here, but I think in the future maybe we could do something like that. SUPERVISOR COCHRAN: This one here, Joe, if you recall, Jim McMahon, Community Development Office came in, and explained why we were making these changes here at Breakwater. This resolution was duly ADOPTED. COUNCILMAN TOWNSEND: I just want to discuss an issue that come up this morning relative to a Law that is proposed before the Legislature, the State Legislature. Easthampton has requested that the Legislature allow' them to have a 2% tax on sale of property within their town, in order to create a fund for open space, and this is hardly a new idea. It's been going on for at least 1981t, as far .as I know. ' There was even an editorial about us not showing leadership on this issue. I think if you look Into the . record, and I got the minutes and so forth, on three separate occasions we have requested the State to allow us to have the authority to have a referendum on that issue. The potential for developing funds for open space is much greater, save our taxpayers in general a lot of money, if we were •allowed to ' do that. I have heard from embers of the real estate community, that are opposed to it, and I think most of the members on the Town Board are in favor of it. I know Supervisor Cochran wrote a letter asking to be included in this bill, and I don't know if It got there in time, apparently not. But, no on seems to hold a lot of optimism for this bills, because ' it has gone so many. You know, every couple of years it comes up, and it is that along with the authorization to have our own �.912 JUNE 24, 1997 County, Peconic County, is indicative of the fact that, we don't seem to have a lot of influence in the State on issues that are particularly the concern of the East End. I think it would bs good, if anybody that is interested in these issues would write their representatives, both on the State and the County level, to point out that these are important issues, and we should be.allowed to participate in our own destiny. SUPERVISOR COCHRAN: The first step in this is that the State has to pass the bill. COUNCILMAN TOWNSEND: Which will not likely happen, apparently. SUPERVISOR COCHRAN: When I got the call yesterday, as quickly as possible we tried to get information up to LaValle, and Theile, and so forth, so that perhaps we could be included. I think where it's been defeated in the past three times through the years, since 184, is because the realtors, and real estate industry has very strong lobbyists, and it's been knocked down every time. We see it as a tool to continue to buy open space without increasing taxes. It would be a 20 tax paid by a buyer of a house, or open land in Southold. I noticed in the law, we did get a copy of the law today, and I. noticed in the law that I think the house price was $250,000., and the lot or a open piece of lard was $100,000. Anything above that the buyer would be paying 20, which would come into the Treasury of the town. Last year, if we had it in place we would have had 1 .6 million dollars we would have realized from the sale of this real estate in Southold Town. It was over 80 million dollars, and we would have been able to capture the 1 .6 million. It would have certainly been a great way to continue to buy open space, and land, without raising taxes, and may in lieu of bond resolutions. It is something we have to look at, but I don't think you are going to see any action on it this year, Joe. It is being presented to the State Legislation too late in the season. Hopefully, Easthampton get it through, but it's been turned down three time, and we will certainly continue to work to try to get it through. COUNCILMAN TOWNSEND: It has worked successfully in other areas. SUPERVISOR COCHRAN: We asked for a reservation to the bill for Southold Town, and I don't know if we have received that yet, or not, but as soon as we hear, we certainly will let you know what is going on, and try to keep you informed as much as possible. Thanks, Joe. SUPERVISOR COCHRAN: At this time if there is' anyone with us this evening, that would like to address the Town Board, please, feel free at this time. ALPHONSE MARISSAEL: My name is Marissael, Orient Point. I sent a letter, this the week after the Farmers Bill of Rights, and I sent a letter to the Suffolk Times. They called me on the phone, saying, it was too long to print. I sent you the same letter. Did you received it? SUPERVISOR COCHRAN: Yes, I did. Also, with your note that you had sent. it to the Suffolk Times, and it was too long to print. ALPHONSE MARISSAEL: ' Now, there is such a thing as freedom of speech, and I would like to read the letter in public here. May I do so? SUPERVISOR COCHRAN: I remember it is about two pages long? ALPHONSE MARISSAEL: All of two pages. It is addressed to the newspaper. Dear Sir, the Editor. Noise is noise. - A blasting device repetitively blasting at precisely one minute and 20 seconds and sometimes at 45 seconds for an entire day is not an item to be used in a civilized society, no matter what the reason. It is not be considered as a mere noise. This offensive devise has been used on some farms since 1986, much to the detriment of residents living nearby. The Town Board has decided to make this legal. Never mind about the taxpayers or the value of their property. Everything was fine here until the introduction of this device. Now they have concocted this Farmer's Bill of Rights, because ,as they claim, there were too Many complaints from residents about noise, such as traitors, irrigation pumps, dust, working people, etc. and new residents will have to sign an agreement recognizing these activities of a working JUNE 24, 1997 103 farm. Missing from this document is this offensive device called the Air Cannon. I call this misrepresentation. To be blunt, it is a conspiracy. Anyone building or buying property . near a farm knows what to expect. I can not think of moving somewhere else as the farmer next to my residence suggested, I cannot expect to get the same value for my property. A vineyard manager tells me, you and your tranquility, do you recognize yourself, sir? I suggest you tell that to some of the people in the Village of Orient who are so concerned about the traffic to Cross Sound Ferry, and see if they could be mollified as some lady reporter thought I failed to be at a Town Hall meeting. At the last Town Hall meeting I attended, a farm official remarked, we are. spending millions of dollars to preserve farmland. Where does that money come' from? When big bucks come in from the big city, it is very difficult to say on the farm. When this government can force things down our throats, they can prevent the farmer from selling to a developer or at least make him sell it to another farmer, on who can cut it. Now for the many complaints I made, nothing was ever done. Thus, if .this is legalized now, it means the town officials failed in their sworn duty to apply the law previously. A sample of what we were subject to. 1990 - June 29 thru July 1 (48 hours) 1 min and 20 seconds (daytime) 5 min. thru the night. July 7 thru July 8 (24 hours) same procedure. August 28 thru August 29 (4 PM to 6 AM) . September 1-3-4 thru the night. This was in- the distance. In July of that year, I asked the farmer to attend the Town meeting, but he could not attend as .he explained he had to run a farm market in New York City, however, he had a letter read by the town secretary in his behalf. I asked him again to attend the 'following meeting with the hope this might be resolved, once and for all, but he didn't have the courage to do so. I then drafted a letter in response and read it at the following Town meeting. Those letters I have in my possession. Again in July of '90, as I embarked on . my usual complaint, the then Town Attorney remarked, I think we're dealing with an age where certain sounds we have to come to grips with. Three months later this same person expressed concern about noise pollution emanating from a chipper the Oregon Recycling Corp. applied for. At that meeting, a councilman, himself a farmer, questioned, I have two comments. First, I don't understand why anybody would use them at night. Secondly, 1 don't understand what crops they would be using them for in July. Notice the document. These activitie's -may occur on holidays, Sundays and weekends, at night, and in the day. Are presumed to be reasonable.. Who is going to control this, if the authorities will not answer any complaints, about the cannon? In the article of the Suffolk Times dated June 5, 1997, someone compares the air cannon with freedom of speech -and home owners should get used to it. Some attitude. That's a good road to anarchy. And we are asked to have patience? I'd like to correct Mr. Cergela with his statement that farmers use the gun for a few weeks in the Fall. You are talking about the vineyards, sir, none of which are in this area. This farmer here starts at the end of June till the middle of September, six summers out of ten, so far. Now he employs two of them, with some more patience he may wind up with a battleship. If the birds get used to it you must inform him. I would like to speak with you sometime about this issue. You name the time and place, bring as many farmers as you like, and other interested parties. I will show you the two letters that were read at Town Hall of which I mentioned previously and, two pages of a petition containing 37 name's. Not all farmers use -this device.. If some claim losses in thousand due to wildlife, look at the vast farm areas from Narrow River Road to the Village of Orient, it was never used there. Apparently at that road, the bird stops here. Mollified? Use the shotgun. Thank you. Any comments? SUPERVISOR COCHRAN: I would just like to say, that after the last Town Board meeting that you attended and expressed your concern the Bill was sent back to the Code Committee, where it was reviewed, and found to be okay as presented, so then it came back to the Town Board, and we acted, and we did pass the law. So, that's where it is. It is now in affect. ALPHONSE MARISSAEL: So, now my property isn't worth what it was before? SUPERVISOR COCHRAN: I am not an appraiser. I can't judge that. ALPHONSE MARISSAEL: I can not sell my property. People, that would buy it, would have to sign this document, right? '1`,0 4 JUNE 24, 1997 SUPERVISOR COCHRAN: They don't sign anything. They are just notified that the farm is there. The broker that will be selling your property is just going to notify the new owner, that they are near a farm, and that there are certain farm practices, that they should be aware of. ALFONSE MARISSAEL: The Village of Orient, they don't have worry about that. SUPERVISOR COCHRAN: I can't answer for the Village of Orient. Is there anyone else like to address the Town Board? JAY CARGANI : Mr. Car_gani, Southold. Unless I am not correct, I believe at the beginning of each and every meeting your solicit commentary from the listening audience, if they have any commentary on the resolutions as offered. Generally speaking they are quite a number, and regular attendees like myself arrive here approximately ten minutes before the meeting, we tend to be socially polite 'to each other, greeting each other, and saying, what do you know, Joe, and things like that. In this case, the Joe doesn't refer to a Board member. What I am asking here is that in the meeting of these resolutions, assuming that one generates particular interest to an individual would you consider allowing that person to put. a check mark next to that resolution, and then at the end of the meeting elaborate on it further. Now, I notice when a resolution has a dual status of a Local Law, it is fully explored, and I have no problem with that. But, I'm just wondering considering the limited time frame that exists between the commencement of the meeting, and the reading of many resolutions, like tonight, how can one conceivably have really a_ full thought process to offer. SUPERVISOR COCHRAN: Some are printed on the agenda prior to, and the agendas are shared, with not only libraries, but they are available at Town Hall, and they are sent over on Friday, but some of the Town Board work during the day does generate additional resolutions. JAY CARGANI: Being I am not party to those situations, and the one that has been posted on the library board has disappeared in recent weeks. . That is no longer the -situation there, because I check it quite thoroughly. I don't know what the reason for it is. Maybe someone just takes it off. I am not saying that you didn't send it, but apparently it does disappear. COUNCILWOMAN HUSSIE: There is probably no- reason why you couldn't be able to ask at the beginning of the meeting a question about a given resolution. SUPERVISOR COCHRAN: Sir, we would rather have you address a resolution prior to it's passage than after the fact. JAY CARGANI : Doesn't it tend to become a verbal marathon to a certain extent when you go from one to the other without allowing people to comment. I don't think there would be that many comments to begin with to be honest with you. SUPERVISOR COCHRAN: This is the work of the Board, and we will probably continue to take it as Town policy. We will probably continue to ask for your input at the beginning of the meeting. JAY CARGANI : In regard to reading of the resolutions, again, 1 find the proliferation and abbreviations. I believe at the last meeting there was an organization referred to as COOL. I honestly didn't even know what COOL meant. I don't mind exposing my ignorance, but I did read in the Suffolk Times subsequently, that it was related to something of which I have no objection at all, but if you had so called video typed list of . abbreviations of organizations readily and frequently dealt with, at least a person could have some insight as to what these abbreviations relate to. It is very difficult. SUPERVISOR COCHRAN: COOL is not an abbreviation. That is the name of the program. DUNE 24, 1997 1 .05 JAY GARGANI : In any event, if you heard the word COOL for the first time, 1 thought of it as a slang expression, when I first heard it because you hear the work .cool all over the place. Thanks again to the Suffolk Times for clearing that up. SUPERVISOR COCHRAN: We are so lucky, Timothy, thank you very much. JAY GARGANI : Also, to guard against any misguided evaluations and guidelines that I might have, I would appreciate knowing a little bit more about Peconic Land Trust. I would like to know when it came into being, the purpose of their charter, and how it is funded, and the geographic limits. SUPERVISOR COCHRAN: Why don't you contact the Peconic Land Trust, John Halsey. I am sure he will be very happy to share this information. They are" located in Southampton, and I am sure they will share any information with you. COUNCILMAN TOWNSEND: I would be happy to talk to you about that. I worked with them for years. I was on the Board for years. If you want any specific information I can give it to you. TOWN CLERK TERRY: Jay, I believe I may have a brochure in my office, that you might like to come in; and look at that explains it also. JAY GARGANI : I really think it helps those of us, who sit out here, if we know more about these applications. SUPERVISOR COCHRAN: You are more than welcome to attend any work-,, session of the Town Board during the day. JAY GARGANI : The last is not really that important, but I am just curious to know, does the Board have any moral . differences with the transportation of garbage outside our state. The only reason L.ask that. is because there is extensive coverage in the, newspapers lately, ,.,.and what .,l am concerned about is that- we do have local incinerators on . Long Island built by taxpayers' money, not ours incidentally, and I am not .advocating that, but apparently from reading these articles these burners are. starving for garbage, and I'm just wondering is there any way at all of acting in concert with other people on the Island who have- provided these facilities to keep them alive, so to speak.. SUPERVISOR COCHRAN: It's cheaper to truck it out. COUNCILWOMAN HUSSIE. That's the. thing. We just recently. went through another bidding process for the hauling of the garbage. We, also, contacted local .towns, in fact a number of times. Some of the ,towns have had these incinerators, but their cost per ton, just to accept it at ,the gate was so high, and then we would have to pay about $10.00 to $13.00 a ton to deliver it, that in the interest of the pocketbooks of the people who live in Southold,- we have to take the somewhat dubious moral problem of shipping it out of state. -On the other hand, there is an . economic advantage, too, because a lot of those states, like West Virginia, and parts of Pennsylvania rely on this as a business. JAY GARGANI : I realize that. COUNCILMAN TOWNSEND: We did look at this in more detail_ four years ago. SUPERVISOR COCHRAN: Alice has been up to see some of them. Recently we have checked again to see what the cost would be. COUNCILMAN TOWNSEND: We have even tried to work out some of these inter-municipal agreements wherein we would pay even a little more, because of the very reason you .were saying. We wanted to strengthen ..and take the soundest long term approach. There's a lot of thought, that these other states accepting garbage would stop doing that, because of community opposition, and so forth, so we looked into a lot of municipal agreements with some of the towns that had these incinerators, but we just couldn't JUNE 24, 1997 make it fly financially at the time. You just couldn't justify it. It was a significant difference. JAY CARCANI: Too much hostility was generated in these other states the article went on to indicate. I hope it doesn't reach that point. COUNCILWOMAN HUSSIE: One of things is the Coates Law, which surfaces every now, and then. This Senator from some place who wants to make a law against the transportation of garbage across State lines. I think, again, talking about West Virginia, and some of those places, is they really want it. They want to be able to accept the garbage. Do we have a contingency plan? I think we can get one in a trice. JAY CARCANI : The last item is targeted to Mr. Moore. More than one week, in fact multiple weeks have expired since the Freedom of Information Act request that you made, and to this date has remained unanswered, and of course, I follow it quite closely, and I am just hoping that you have some startling revelations to make. COUNCILMAN MOORE: . Just so you. know, I put - that request in on my individual capacity as a resident water consumer of the Village living outside of the Village, as do you. I did not do it wearing my hat as Town Board member. I have put in an appeal but I have gotten no information to date, so I'll answer very quickly. There has been no information provided as of today. I would happy to talk to you about it afterwards. SUPERVISOR COCHRAN: Is there anyone else that would like to address the Town Board? (No response.) If not, I'll call for Board reports. Joe, do you have anything in addition to the 2 0? COUNCILMAN TOWNSEND: No. I have said my piece. SUPERVISOR COCHRAN: Bill? COUNCILMAN MOORE: Just a quick update. Our Code Committee has been meeting almost weekly on 'the cell tower wireless communication ordinance. We are going to meet again, if everyone is available next Wednesday at seven o'clock. We have a draft now we can work up. It's a cumulation. We are not there at the end yet, but there has been a lot of work put into it, a lot of material we have gone over to get to where we are,. so I anticipate, and look forward to a successful Local Law coming before the Board for action relatively shortly. I am looking forward to tomorrow, as a guest speaker, at the East End Supervisors' meeting. Supervisor Cochran has invited me to speak on just that topic, which is cell towers and wireless communication on the East End. Lastly, I want to congratulate a lot of local high school graduates, who are going through the ceremonies last week, and this week, and I wish them all very well. SUPERVISOR COCHRAN: Judge Evans, anything to report? Councilwoman Hussie? COUNCILWOMAN HUSSIE: I -have reported. SUPERVISOR COCHRAN: I just have a couple of -other things. The Town Board did walk the Fort Corchaug area last week, and came out with muddy feet, and probably ticks, that we checked ourselves for, but it is certainly a beautiful piece of property. We did walk the Arshamomaque wetlands down here between Albertson Lane and Chapel Lane. That's another exciting piece of property, that we are going to be looking at very closely, and working with the Nature Conservancy. On Monday night I had the pleasure of addressing the Mattituck Chamber. I would like to say, thank you for- my dinner, and shared some of the workings of what the Board is doing at this time with them. They had also done a survey within their membership, and they are going to be doing some projects that will benefit the business community, but in addition beautify .the Mattituck area. There are some things we will be working with them on, and the railroad station certainly is working up there, and that entire area for parking and so forth 'will be landscaped and beautified. They did also ask for a crosswalk, which I passed that on to Mr. Jacobs, our Superintendent of Highways, the next day, and we will be putting a crosswalk on Love JUNE 24, 1997 ;�7 Lane in Mattituck. That is something they wanted for a long time. I, also, had the pleasure of going down to Oysterponds, and they had a house tour last Saturday, and I had the pleasure of seeing some of the lovely homes down in Orient overlooking the harbor. The view is just unbelievable from some of those positions, but it certainly was lovely. Department .head meeting, doing TV shows, they are things I do daily month after month, and week after week, and it becomes a part of your routine, but there is one thing that we did this past Thursday morning. We met with the Mayor from Romania, and Mayor Kapell, and we had Al Krupski, as a farmer, and we had Joe Cargala from the Farm Bureau, and we had Alice attend, Councilwoman Hussie, and we had Doctor Dan from Pindar. We had a nurseryman, landscaper, because evidently planning in Romania is not there since Communism left, and so he is looking for support, and information, and some was forthcoming from the Farm Bureau, and Dr. Dan, so hopefully it is helpful to the Mayor, and it was a very nice visit, and I think some good was accomplished out of it. We would like to wish the Mayor of Romania well. COUNCILWOMAN HUSSIE:• It was interesting that he described his area, his particular town, as being similar to ours, and also having the same principle industries, I guess you could call them, of farming, vineyards, deep harbor, and tourism. So, there is a kinship there. SUPERVISOR COCHRAN: So, we are going to continue to see ways of which we can help him, and I . know Pindar. .he did say that they had one vineyard, and they have good,,<wine according to Dr. Dan. One vineyard has 50,000 bottles alone, and no way to export, to move it, so there is going to be help given to him. I think it's good. It's all a -plus. If there is nothing else to come before the Town Board I will entertain a, motion to adjourn.
