WORK SESSION
Present: Supervisor Jean W. Cochran, Councilwoman Alice J . Hussie, Councilman

9:10 A.M. - The Board discussed the sale of a parcel of Town-owned property on
Sound View Road, Orient, and agreed the property. should be sold. Supervisor Cochran
will seek an appraisal of. the property so they can move forward with the
process.----Town Board agreed to request resumes (resolution 37) for the Board
of Ethics member term which is expiring on May 2nd (term of Richard Ploth) .----
The Board reviewed a notice from the State Liquor Authority with respect to the
application of Phyllis Schoenhaar for an on-premises liquor license for the Mill _Creek
Restaurant, and has no objection to the issuance of the license.----A resolution (38) .
was placed on ' the agenda approving the March 1997 Update of the Town. of Southold
Solid Waste Management Plan and authorizing its submission to the NYS-DEC.
9:35 A.M:. • - Town Justices William H. Price, Jr. and Rudolph H. Bruer met with
the Town Board to discuss staffing needs in their office. They explained that the
workload has increased tremendously since the employment of new police officers,
and .they need their full,-time clerk back as soon as possible. Upon examination of
their budget, it was discovered there are not sufficient funds for a full-time person,
but the Board agreed to advertise for --'a part-time Clerk Typist (resolution 39) .----
On another subject, the Judges asked the ,Board to look into the status of the Senior
Court Clerk civil service list on behalf of Court Clerks Stulsky and Andrade whose
names appear on the most recent list. Supervisor Cochran said this will be done,
as well .as the possibility of a desk audit of those positions.----Lastly, Justice Price
and Justice Bruer approved the proposed Parking Pleas by :Mail code amendment with
the removal of the word "minimum" with regard to a fine of $35.00. The Town
Attorney will prepare' a Local Law for consideration by the Board at the April. 28th
meeting.
10:10 A.M. - Barbara Michelson, member of the Transportation Committee, met with
the Board to discuss the adoption of a procedure for trail system uses to "Park E
Ride" or "Park & Kayak" at waterfront locations, where the law prohibits parking
without a permit. Ms. Michelson said the Committee has examined possible solutions,
including areas dedicated to kayakers/bikers which do not require a sticker, locked
box with envelopes provided, mechanical device such as parking meter,or a system
like that used: for yellow bags at the dump, or expanded hours and locations for
attendants. Some of the solutions would be costly to the Town, and the money is
not in the budget, therefore, the possibility of a locked box appealed to the Board.
The Transportation Committee will work on this and bring a firm proposal back to ,
the Town Board in the near future.
EXECUTIVE SESSION
10:40 A.M. - On motion of Councilwoman Oliva, seconded by Councilwoman HussieI .
it' was Resolved that the Town Board enter into Executive Session to discuss
employment history. Vote of the Board: Ayes: Supervisor Cochran, Councilwoman
Hussie, Councilman Townsend, Councilwoman Oliva, Justice Evans, Councilman
Moore. Also present: Town Clerk Terry, Town Attorney Dowd, Senior Accountant
Cushman.

11 :25 A.M. Land Preservation Chairperson Joseph Gold met with the Board to
present a . proposal to hire a consultant who would assist with the refinement and -
implementation. of , the Town's farmland preservation strategies, identify potential.
sellers of development rights, develop specific farmland conservation plans; and
generally . assist with preparation of applications for matching funds and related
farmland preservation assistance, negotiations and agreements, and structuring and
execution .of appraisals. The funds to accomplish this would be paid from ' the
farmland bond money. Mr. Gold and his committee will develop a list of consultants
and trusts, and submit a recommendation to the Town Board.
10:40 A.M. - Recreation Supervisor Kenneth Reeves, insurance agents John Stype
& Dan Brisotti, and . Dione Dekas and Dr. Karen Malcolmson of the North Fork Early
Learning Center, met with the Town Board to discuss. a proposed North Fork Summer
Camp to be presented through the cooperative efforts of the Southold Town
Recreation Department and . the North Fork Early Learning Center. A day long
summer program . for youth ages 6-12 is proposed; with planned activities, including
sports, arts and crafts, and field trips. The camp will be held at the Scouter's
Lodge at Bailie's Beach, Mattituck. The majority of the Town Board voiced their
support of the proposal, and Town Attorney Dowd was instructed to prepare a
written agreement detailing the scope of services for be provided by Ken Reeves.
12:05 P.M. - Town Trustee- President Albert Krupski, Jr. met with the Town Board:
to request their consideration in implementing a project for installing mooring piles off
shore at Narrow River Road, Orient, connected to on-shore stakes. He estimated
the cost at approximately. .$3,000, which the Trustees do not have in their budget.
After a discussion with Executive Assistant Jim McMahon, it was determined the
money would be available in the road end restoration projects budget.
12:20 P.M. - Merlon Wiggin, representing Mariculture Technologies, appeared before
the Town Board to discuss the lease of - Klipp Park from May 15-30 for the
assembly of net cages . for a mariculture project. (Councilman Moore recused himself
from this - discussion. ) Mr. Wiggin also requested the use of the launching area at
Beach Road, Greenport, during the first week of May for another phase of the same
project. The Board agreed to the proposal, and an agreement will be prepared for
a resolution on April 28th, along with the necessary insurance coverage. Mr. Wigggin
assured the Board they would use only a small portion of both areas Tor the wor3c.
12:30 P.M. - Recess for lunch.
1 :45 P.M. - The Work Session reconvened and the Board took up the following For
Discussion items: Proposed lot line change at Tasker Park with Albin Combs. The
Board now has a survey of the property which reflects the 5,682 sq. ft. gain for.
the Town in the area of the football field and a 5,682 sq. ft. change for Combs on
the west side of the Combs property. The Town Attorney will now move forward
with the necessary paperwork to accomplish the exchange.----Councilwoman Oliva
explained a letter from the NYS Department of State with regard to the availability
of Federal Emergency Management Agency (FEMA) funds to be used to move four
houses back from the shoreline at Kenney's Beach, Southold. The homeowners must
assume 250 of the cost,. the balance would paid by the FEMA funds. Councilwoman
Oliva was authorized to send letters to the homeowners to determine .their interest
in participating.----The Town Board again discussed the proposed amendment to the
Suffolk County. .Sanitary Code, Article 4 "Water Supply" for Fishers Island. Letters
from William Ridgway, Chairman of the Fishers Island Water Works Corporation, and .
Leslie Goss, President of the Fishers Island Civic Association, were reviewed. . As a
result of Mr. Ridgway's letter, the Department of Health Services : advised that
two of the proposed standards will be, revised to reflect his concerns. Justice Evans
will discuss the concerns of Ms. Goss with Town Senior Planner Valerie Scopaz to
see of her suggested changes can be incorporated. A public hearing is scheduled
for April . 22nd by the Health Department with regard to the proposed
amendments.----Justice Evans sought the Board's approval to replace the fence
around the tennis courts which the Town leases from the Fishers Island School
Di"strict. It was determined the money could be taken from the Park & Playground
fund, and a resolution (41) was placed on the agenda to accept the proposal of a
contractor to accomplish the work.----The Board reviewed a proposal submitted by
Solid Waste Coordinator Bunchuck for the purchase of a Yellow Garbage Bag Vending
Machine, and authorised the purchase by placing a resolution (40) on the agenda..

A Regular Meeting of the Southold Town Board was held on April 15,
1997, at the Southold. Town Hall, Main Road, Southold, New York.
Supervisor Cochran opened the meeting at 4:30 P.M. with the Pledge of
Allegiance to the Flag.

will be held at 7:30 P.M., Monday, April 28, 1997,at the Southold Town
Hall, Southold, New York.

SUPERVISOR COCHRAN: Today we have a very special presentation to
make. As I reported at the last meeting I served as a Judge for the
spelling bee in Mattituck. It was kind of a fun thing for me along with
Mayor Kapell, and Mr. Walter Krupski from the North Fork Bank. Today
we have with us the winner of the spelling bee, Lisa Crodski. I am
going to come down, and do a presentation.
Moved by Supervisor Cochran, seconded by the Entire Town Board,
WHEREAS, the Town Board of the Town of Southold, on behalf of ""the
residents of Southold Town, recognizes LISA GRODSKI sixth grader
attending Laurel School; and
WHEREAS, she - is looked upon by her teachers as an outstanding student
and by her classmates as being kind and considerate of others; and
WHEREAS, LISA GRODSKI as a member of• her sixth grade class, was
participant in the North Fork Spelling Bee held on March 25, 1997; and
WHEREAS, LISA CRODSKI was the remaining student who successfully
spelled the word "apathetic" to take first place in the Spelling Bee, now,
therefore be it
RESOLVED that the Town Board of the Town of Southold hereby
congratulates LISA GRODSKI on her . first place finish and wishes her
continued success in her education.

SUPERVISOR COCHRAN: We have a second proclamation to present.
don't know what happened to our Public Safety Dispatchers, but it is
proclamation recognizing the fact, that it's Public Safety Dispatchers
complimenting them on the job they do, and it is National
Telecommunications Week. So, I will see that it is presented to them in work
place.
Moved by Supervisor Cochran, seconded by the Entire Town Board,
WHEREAS, the Town Board of the Town of Southold wishes to
acknowledge our PUBLIC SAFETY DISPATCHERS, during NATIONAL
TELECOMMUNICATIONS WEEK, as indispensable individuals in the field of
communication between the police, fire, emergency medical services and
those in need of emergency assistance throughout this nation; and
WHEREAS, the skills of PUBLIC SAFETY DISPATCHERS involve quick
thinking,. common sense, proficiency in communications, a reassuring voice,
public relation and a certain level of diplomacy, which skills are often
exercised behind the scenes and too seldom receive the recognition they
deserve; and
WHEREAS, the Town of Southold is fortunate in having a highly skilled
and motivated corps of PUBLIC SAFETY DISPATCHERS, who are diligent
and dedicated in the performance of their duties to the citizenry of
Southold Town; now, therefore, be it
RESOLVED that the Town Board of the Town of Southold wishes to
publicly recognize, thank and express its appreciation to our PUBLIC
SAFETY DISPATCHERS by declaring the week of April 13th to April
19th, 1997, as NATIONAL TELECOMMUNICATIONS WEEK in the Town of
Southold. "

III . COMMUNICATIONS.
SUPERVISOR COCHRAN: We had a response from a letter from Governor
Pataki in relation to Neighborhood and Rural Preservation Programs. We,
also, had one from Congressman Forbes advising us that he received a final
report from the United State Department of Agriculture regarding the
problems that we are - having concerning a placement of telecommunications
tower in Greenport, and he enclosed a copy of the report, and as you can
see, an individual or firm interested in placing an antennae on Plum Island
should contact Mr. Carlos Santoyo, Assistant Center Director for
Management, Plum Island Disease, and they will be able to advise you as to
placement and so forth. So, I did send that letter on to the people in
Orient, that are concerned with towers located in their,community.
1 . Governor George E. Pataki, in regard to Neighborhood and Rural
Preservation Programs.
2. Congressman Michael P. Forbes concerning the placement of
telecommunication towers.
3. Ginger English, Eastern Land Island Reality Group Education
Committee with information' about Realtor Group Programs.
4. Vito Minei, Program Manager, Peconic Estuary Program, to
Assessor Scott Russell in appreciation of assistance.
5. Toby Wiles, Director of the Suffolk County Office of the Aging in
regard to funding for the Southold Adult Day Care Program.

SUPERVISOR COCHRAN: We have two hearings scheduled for today.
1 . 5:00 P.M., on the Acquisition of Development Rights of the
Agricultural Land of Lois Woodhull.
2. 5:02 P.M. on a proposed "Local Law in Relation to Light Industrial
(LI) and Light Industrial Office (LIO) Zone Uses".
V. RESOLUTIONS
SUPERVISOR COCHRAN: Also, you know that we have Town Board policy
that if you. would like to speak to any of the resolutions, that the Town
Board will be passing today, that we give you the opportunity now. You
will also have the opportunity at the end of the Board meeting to speak to
the Town Board on Town business on any other topic. At this point if
there is any information you would like, or any comment you would like to
make in relation any of the resolutions, now is the chance for you to have
an opportunity to do so. (No response.) If not, we will commence with
the reading of the resolutions.

RESOLVED that the Town Board of the Town of Southold hereby accepts
the bid of G.T. .Power Systems, Wainscott, New York, in the amount of
$33,840.00 for supplying and installing a diesel powered generator system
with automatic transfer switch at the Southold ' Town Human Resources
Center, Sound Avenue, Mattituck, New York; said bid all in accordance
with the bid specifications.

all bids for the construction of a Salt/Sand Storage Facility at the
Southold. Town Highway Department, Peconic Lane, Peconic, N.Y.

RESOLVED that the Town Board of the Town Board of the Town of
Southold hereby authorizes and directs the Town Clerk to readvertise for
bids for the construction of a Salt/Sand. Storage Facility at the Southold
Town Highway Department, Peconic Lane, Peconic, N.Y.

with regret; the resignation of Clifford J. Benfield, Chairperson of the
Landmark Preservation Commission, effective April 8, 1997.

RESOLVED that the Town Board of the Town of Southold hereby
authorizes and directs the Town Clerk to advertise for resumes for a
member of the Landmark Preservation Commission to replace Clifford J.
Benfield, whose term expires on April 5, 1998.

7.-Moved by Councilwoman Hussie, seconded by Justice Evans, it was
RESOLVED that the Town Board of the Town of Southold hereby
authorizes and directs Supervisor Jean W. Cochran to execute an
Amendment to the Lease Agreement between 'the Town and the Southold
Town Promotion Committee, Inc. for the rental of the tourist information.
booth in Laurel, to reflect the change in the name of the Southold Town
Promotion Committee to North Fork Promotion Council, Inc.; all other terms
of the lease remain the same.

Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie,

8.- Moved by Justice Evans, seconded by Councilwoman Hussie, it was
RESOLVED that the Town Board of the Town of Southold hereby
authorizes and directs Supervisor Jean W. Cochran to execute a budget
modification to the Suffolk County Office for the Aging, . CSE Senior Day
Care Contract, which modification results in a zero net change.

Deed of Development Rights in Liber 11792 cp 233, hereby authorizes and.
directs Supervisor Jean W. Cochran to execute a consent to amend/modify
restrictive covenants . between Andres R. Cassidy, Carole Cassidy,
Herbert O. Cassidy, Thomas P. Cassidy, and Ellen Cassidy and the
Suffolk County Department of Health Services, all in accordance with the
approval of the Town Attorney.

13.-Moved by Councilwoman Hussie, seconded by Councilman Townsend, it was
RESOLVED that the Town Board of the Town of Southold hereby
authorizes the Transportation Committee to solicit proposals from qualified
consulting firms for the development of a Scenic Byway Corridor
Management Plan. The Plan will form one part of a multi-phase project
designed to preserve and enhance the scenic, historic, recreational,
cultural, and archaeological characteristics of the Town of Southold; - and be
it
FURTHER RESOLVED THAT THE Town Clerk be and she hereby is
authorized to issue the Request Form Proposals to perform the aforesaid
services to qualified consulting firms.

Section 1. PURPOSE
Wireless cornmunicalinn technology has created the demand for
structures on-which transmitting and/or receiving antennae are located. The
number of structures absent regrilation rmay be anticipated to increase as the
demand for cellular phone service correspondingly increases. The Town Board
is concerned that the impact of an unregulated increase in the number of such
structures,be examined at this time. Shared use, appropriate setbacks, visual

impact and the like would be appropriate subjects for study in detail beyond the
present provisions of Town Code Section 100-31(13)(6), which currently governs
public utility structures. This Local Law is intended to provide the Town Board an
opportunity to study the likely impacts of the Telecommunications Act of 1996
signed into law by President Clinton-on February 8, -1996, including most
particularly, appropriate and inappropriate locations for telecommunication
structures, the impact of an unregulated number of such structures and the likely
next stages of development of this technology.
Section 2. ENACTMENT OF TEMPORARY MORATORIUM
lJntil one hundred and twenty days (120 days) from the date of enactment
of this local law, after which this Local Law shall lapse and be without further
force and effect and subject to an other Local Law adopted by the Town Board
during that one hundred twenty day period, no agency, board officer or
employee of the Town of Southold, including by way of illustration, not limitation,
the Zoning Board of Appeals acting under its special exception use powers
under Town Code,Section 100-31(8), or the Planning Board acting under its site
plan approval powers under Town Code Section 100-250 et al., or the Building
Inspector issuing any building permit pursuant to any provision of the Town
Code, shall issue, cause to be issued or.allow to be issued any approval or
permit for any telecommunication tower, meaning a structure on which
transmitting and/or receiving antennae are located or any accessory facility
thereto, including a structure housing transmission equipment accessory to a
telecommunications tower.
Section 3. EXCLUSIONS.
This Local Law shall not apply to any person or entity who has, prior to
the effective date of this Local Law, obtained all permits required for construction
of a telecommunications tower pursuant to Town Code Section 100-31(B)(6),
including later applications to repair or alter (but not enlarge in height) any such
existing tower or structure.
Section 4. AUTHORITY TO SUPERSEDE.
To the extend any provisions of this Local Law are construed as
inconsistent with the provision of Town Law Section 267, 267-a, 267-b, 274-a
and 274-b, this-Local Law is intended pursuant to Municipal Home Rule Law .
Sections 10(1)(ii)(e)(3) and 22 to supersede any.said inconsistent authority.
Section 5. VARIANCES TO THIS MORATORIUM.
Any person or entity suffering unnecessary hardship as that term is used
and construed in Town Law Section 267-b(2)(b) by reason of the enactment and
continuance or this moratorium may apply to the Zoning Board of Appeals for a
variance excepting the person's or entity's premises or a portion thereof from, a
moratorium and allowing issuance of a permit under Town Code Section 100-
31(13)(6), all, in accordance with the applicable provisions of the Town Code

Sections 100-270 et al.
Section 6. SEVERABILITY
If any clause, sentence, paragraph, section or part of this Local Law shall
be adjudge by any court of competent jurisdiction to be invalid, the judgment
shall not affect, impair or invalidate the remainder of this Local Law.
Section 7. EFFECTIVE DATE.
This Local Law shall take effect upon filing. with the Secretary of
State.

THEREOF IS $400,000; APPROPRIATING SAID AMOUNT
THEREFOR AND AUTHORIZING THE ISSUANCE OF
$400,000 SERIAL BONDS OF SAID TOWN TO FINANCE
SAID APPROPRIATION.
Section 1. The Town of: Southold, in the County of
Suffolk, New York (herein called "Town") , is hereby authorized to
acquire and install computer equipment, including, but not

limited to software and. training facilities, in order to upgrade
the existing computer system of the Town in the several Town
offices. The estimated maximum cost -thereof, including
preliminary costs and costs incidental thereto and to the
financing `thereof, is $400, 000 and the said amount is hereby
appropriated therefor. The plan of financing includes the
issuance of $400, 000 serial bonds of the Town to .finance said
appropriation, and the levy and collection of taxes on all the
taxable real property in the Town to pay the principal of said
bonds and the interest thereon as the same shall become due and
payable.
Section 2 . Serial bonds of the Town in the principal
amount of .$400, 000 are hereby authorized to be issued pursuant to
the provisions of the Local Finance Law, constituting Chapter 33-
a of .the Consolidated Laws of the State of New York (herein
called "Law") , 'to finance said appropriation.
section 3 . The following additional matters are hereby
determined and declared:

specific object or purpose for which said serial bonds authorized

of the sale of said bonds shall contain the recital of validity

obligations of the Town, payable as to both principal and
interest by general tax upon all the taxable real property within
the Town without limitation of rate or amount. The faith and
credit of the Town are hereby irrevocably pl.edged to the punctual
payment of -the principal of and interest on said bonds and any
notes issued in anticipation of the sale of said bonds and
provision shall be made annually in the budget of the Town by
appropriation for (a) the amortization and redemption of the
bonds and any notes in anticipation thereof to mature in such
year and (b) the payment of interest to be due and payable in
such year.
Section 5. Subject to the provisions of this resolution
and of the Law and pursuant to the provisions of Section 21. 00
relative to the authorization of the issuance of bonds with
substantially level or declining annual debt service, Section
30. 00 relative to the authorization of the issuance of bond

60. 00 of the Law, the powers and duties of the Town Board
relative to authorizing bond anticipation notes and prescribing

hereafter authorized, and of any bond anticipation notes issued
in anticipation of said bonds, and the renewals of said bond

Section 6. The validity of the bonds authorized by this
resolution and of any notes issued in anticipation of the sale of
said bonds may be contested only if:
(a) such obligations are authorized for an object or
purpose for which the Town is not authorized to
expend money, or
(b) the provisions of law which should be complied with
at the date of the publication of such resolution
are not substantially complied with,
and an action, suit or proceeding contesting such validity is
commenced within twenty days after the date of such publication,

(c) such obligations are authorized in violation of the
provisions of the constitution.
Section 7 . This bond resolution shall take effect

JUSTICE EVANS: On the scope the bond amount is for $400,000, and we
are basically/ revamping our computer system, because it is very out
and it does not allow a lot of our departments to connect in with each
other. So, the person who runs the Data Processing Department has gone
through in trying to give us the best value for our money, and give us a
more up-to-date system, that can serve the public better, because the .
people in Town Hall will be able to communicate with each other better, and
produce better work.
COUNCILMAN TOWNSEND: I think we had a study done a couple of years
ago, and at that - point we put it on hold. I think the new administration
came, evaluated it, and we hired somebody in-house, and he has
reformatted that study, and this is a result of that.
TOWN ATTORNEY DOWD: You might add that it includes, not only
computers, but software, and training for the next three years.

A' Local Law in Relation to Farm Stand Permits
BE IT ENACTED, by the Town Board of the Town of Southold as follows:
I. Chapter 47 (Farm Stand Permits) is hereby added as follows:
1. Section 47-1 ' Legislative Intent. Farm stands are an important
part of the towns agricultural character. Regulation is necessary
to ensure that farm stands remain an adjunct to agricultural uses
and do not become significant commercial operations in rural and
residential areas.
2. Section 47-2 Permit Required It shall be unlawful for any person
to erect place or sell from a farm stand or stands in excess of a
total of twenty (20) square feet in area unless the structure has
been issued a farm stand permit by the Building Department. A
farm stand is defined in the Zoning chapter of this code. '
3. Section'47.3. Standards for Issuance of Permit. No farm stand
permit shall be issued unless the structure and operation meet
the following requirements. All farm stand permits shall be subiect
to revocation if the farm stand fails to operate in compliance with
the standards set forth below.

a No farm stand may be in excess of one thousand (1.000)
square feet in floor area. Farmstands in excess of one thousand
(1,000) square feet are permitted only with site plan approval
from the Planning Board and with special exception approval
from the Zoning Board of Appeals and in accordance with
Chapter 100 Articles 25 and 26 of the Southold Town Code.
b. The farm stand must be located on a lot containing at least five
tillable acres of land (excluding any house or agricultural buildings)
owned or leased by the owner of the farm stand. Alternatively, the
farm stand may be located on a lot at least two acres in size
excluding any house or agricultural buildings) if the farm stand_
owner can establish ownershio or lease of at least five tillable
acres of land in the Town of Southold.
c The farm stand shall sell only produce plant stock or products
cooked pressed or dried from produce grown on farming
operations within the five East End towns. At least eighty percent
(80%) of the produce plant stock or products must come from the
owner or tenant farmer's own farming operations. A farm stand
shall not sell or manufactured products.
d A farm stand may be operated with an accessory greenhouse,
so long as the combined area of both structures does not exceed
1000 square feet All greenhouse operations are subiect to the
restrictions listed herein.
e The topsoil which lies under the farm stand or accessory
greenhouse must be retained permanently on the site.
f. The farm stand and greenhouse shall be set back a minimum of
fifty (50) feet from the adjoining public road in order to allow cars
to maneuver on the farm stand site without creating traffic safety
problems on the road.
g. The site shall provide one parking space for every 100 square
feet of stand and greenhouse area in a location approved by the
Planninq Board.
4. Section 47.4. Fee for Permit The fee for a farm stand permit shall ;
be in an amount set )y the Town Board b resolution, as amended
from time to time.
5. Section 47 5 Nonconforming Farm Stands A farm stand existing
on the date of adoption of th

6. Section 47 6 Penalties For Offenses Any violation of this Chapter
shall be grounds for revocation of the farm stand permit.
Furthermore any violator of this Chapter shall upon conviction be
guilty of a violation punishable by a fine not exceeding five

hundred dollars ($500) or imprisonment for a period not to exceed_
fifteen (15) days or both. Each day on which such violation shall
occur shall constitute a separate, additional offense. For a
second and subsequent conviction within eighteen (18) months

by a fine not exceeding one thousand five hundred dollars
($1 .500) or imprisonment for a period not to exceed fifteen (15)
days or both such fine and imprisonment.

BE IT 'ENACTED, by the Town Board of the Town of Southold as follows:
I. Chapter 100 ( Zoning) of the Code of the Town of Southold is hereby
amended as follows:
1. Article XXII is hereby added and shall be entitled Farmland Bill of
Rights
2. Section 100-220 (The Right to Farm in Southold) is added as follows:
The Town Board of the Town of Southold finds that farming is an
essential activity within the Town of Southold. Farmers provide
fresh food clean air, economic diversity, and aesthetic open
spaces to all the citizens of our town. In addition, land
in agricultural uses regures less tax dollars for services .than does
land with residential or commercial development. Accordingly,
farmers shall have the Right to Farm in Southold without undue
interference from adjacent landowners or users. For the purpose
of reducing future conflicts between people residing on tracts
adjacent to farmlands and farmers -it is necessary to establish
and give notice of-the nature of the farming activities to future
neighbors of farmland and farming activities.
Agricultural activities conducted on farmland, undertaken in
compliance with applicable federal state county and town laws,
rules and regulations are presumed to be good agricultural
practices and presumed not to adversely affect the public health
safety and welfare. We find that whatever nuisance may be caused
to others by such uses and activities so conducted, is more than
offset by the benefits from farming to the community. Therefore,
all such activities shall be Protected Farm Practices within the
Town of Southold.

3. Section 100-221 Definitions is added as follows:
When used in this chapter crops, livestock and livestock products
shall include but are not limited to the following:
a. Field crops, including corn, wheat. oats. rye, barley, hay,
potatoes, and dry beans.
b Fruits including apples peaches grapes, cherries and berries.
c. Vegetables. including tomatoes. snap beans, cauliflower,
pumpkins cabbage carrots beets and onions.
d Horticultural specialties including nursery stock, ornamental
shrubs ornamental trees and flowers.
e. Livestock and livestock products including cattle, sheep, hops,
goats horses. poultry. fur bearing animals. milk eggs and furs.
f. Maple syrup.
g Christmas trees derived from a managed "Christmas" tree
operation whether dug for transplanting or cut from the stump.
h "Farm woodland" means land used for the production for
sale of woodland products including but not limited to lops,
lumber, posts and firewood._
i Horse boarding operations.
i. Bees/honey.
4. Section 100-222 The Right to Undertake Protected Farm Practices is
added as follows:
Farmers shall have the right to undertake protected farm
practices in the active pursuit of agricultural operations,
including but not limited to: clearing grading plowing, aerial
and ground spraying, the use of legal agricultural chemicals
(including herbicides pesticides and fertilizers), raising
horses poultry, small livestock and cattle. orocessing and
marketing produce installing water and soil conservation
facilities utilizing farm crop protection devices, designing
and constructing and using farm structures. including barns,
stables, paddocks. fences greenhouses and pump houses,
using water. pumping spraying pruning and harvesting
disposing of organic wastes on the farm. extensive use of
farm laborers training and others in the use and'care of
farm equipment animals traveling local roads in properly
marked vehicles and providing local farm produce markets .
near farming areas.
These activities can and do generate dust. smoke, noise,
vibration and odor. These activities may occur on holidays,
Sundays and weekends at night and in the day. Such
activities are presumed to be reasonable do not constitute a
nuisance unless the activity has a substantial adverse effect
on the public health safety and welfare.

5 Section 100 223 The Right to Notice Provided by Town Agencies is
added as follows:
The Town Planning Board the Town Board and the Zoning
Board of Appeals shall require as part of any approval of anv
development immediately adjacent to or within five hundred
(500) feet of any parcel of at least five (5) acres in size which. at
the time of such approval is in active agricultural use, that a
Notice of Protected Farm Practices be given to all purchasers
of such developed property.
The Notice of Protected Farm Practices shall be included in
per anent covenants and restrictions which shall run with the
land on each parcel when such parcel is subdivided or
developed.
If in any.development it is the intent to make the "common"
or"green space" available for agriculture. the Notice of
Protected Farm Practices shall be included in permanent
covenants and restrictions_
6t ection 100-224 The Right to Notice by Brokers and Agents is added
as follows:
All persons dealing in real estate in the Town of Southold
as brokers representatives or agents of the owners,
or any parcel of land adjacent to any parcel of land of at least five
(5) acres in size cu[L@Dtly in agricultural use shall provide to every
purchaser or such parcel an original and one copy of the Notice of
Protected Farm Practices at the time of a potential purchaser's
consideration and inspection of the parcel The person dealing in
real estate shall have such purchaser sign and date the duplicate
copy of the notice. The Notice of Protected Farm Practices form
shall be available to all persons required to provide such notices
free of charge from the Town Clerk's office.
7. Section 100-225 Enforcement is added as follows:
Failure to comply with any provision of this chapter shall constitute
a violation.
8 Section 100-226 Severability is added as follows:
If any part or provision of this law or the application thereof
to any person entity, or circumstances be adjudged invalid
by any court of competent jurisdiction such judgment shall
shall be confined in its operation and enforcement to the part
of or such provision of or application directly involved in the
controversy in which such judgment shall have been rendered
and shall not affect or impair the validity of the remainder of.
this law or the application thereof to other persons entities or
circumstances.

that the Bank holds the funds subject to a collateral hold in favor of the
Town, together with Mr. Smith's letter of instruction to the North Fork
Bank directing the Bank to pay to the Town the funds upon the

of the Town Attorney.

share with you *a little bit one of the things I have done the last couple of
weeks. I did attend the conference on the Brown Tide over in
Westhampton the other day. You had to be in Westhampton by eight
o'clock in .the morning, and I didn't leave until 4:30. 1 know a gentleman
in the audience left about 12:30. Tim Kelly was also over there covering
the event for the newspaper, and I think we both felt pretty good about
being dedicated, and being there at 8:00 o'clock in the morning on a

Saturday, but they did serve us breakfast. It was a very interesting
conference, and I would. like to share some remarks with you at the end of
the meeting. One of things that amazed me is back in '77, 1 believe, they
showed the map of where these blooms are taking place. Up in Rhode
Island, up in Maine, there were several blooms in that area, and they show
a map of today, and you have blooms, Florida, Puerto Rico, Hawaii, Golf of
Mexico, along the entire west coast. Now, along the entire east coast,
Alaska, Japan, .there is an alarming increase to these blooms throughout the
world, and most of it is along the shore where you have nooks, and
crannies, and bays going in, and so forth. There was some interesting
theories in relation to the groundwater entering the bays in the area, and
there were two different research teams, that we are going to be looking
more at this, but I felt they had obtained a great deal of information that
they shared with us, and I think' it is helping to put these different
research teams in a direction of investigation that hadn't been done before.
It was very interesting and I am going to stop at this point. It is five
o'clock. We have to go into a hearing. The Town Board will be sharing
other things with you at the end of the scheduled meeting. May I have a

development rights in the aforesaid agricultural lands owned by Lois
Woodhull, comprising 28 acres minus setoff for house and wooded lot, at a
sale price of $6,500.00 per acre; said property located at 2485 Elijah's

FURTHER RESOLVED that the Supervisor be and hereby is authorized
and directs to execute any and all required documents for the acquisition of

COUNCILMAN TOWNSEND: Not too much. I'm interested to see that we
finally go the LI and LIO use changes on the hearing. I am surprised
there is not more interest on this, because these can substantially effect
the way the Town is developed. There is a fair amount of property zoned
in those uses, and up until this time there has really not been that much .
opportunity to use it for what our industry is, which is recreation in
general, and that's our biggest and fastest growing industry, I would
guess, and I think we provided an opportunity for that. So, I am happy
to see that you have gotten this far. I would like to have seen people here
that own the property, and comment on it.
COUNCILWOMAN OLIVA: We were able to finally get an appointment with
one of the representatives of the DEC, and Jim McMahon, and I, and a
representative from the the DEC went out to look at two parcels in Orient
right on Narrow River Road. One has access to Hallock's Bay in which
we own a fifty foot right-of-way, and then the DEC owns property on both
sides. We wanted to work out something so that we can make a nice path if
they don't destroy the little dune area that is there, and perhaps get some
parking, so that it is a blue stone, and make it an accommodation for
access to Hallock's, and yet by permit only for the Town, and also, for .
the DEC, you have to .obtain a permit for them, as access permit, to go
over their property, at least to clean it up, and make it more attractive,
because the kayakers really do like that area. We, also, went down to the
other end of Narrow River Road on Orient Harbor, where again we own a
piece of property that is parking by permit only, and right next door to it
is a piece of property that is owned by the DEC. What happens is people
don't part in our parking lot, but they go over and park in the DEC
parking lot, and it does look pretty shabby, so, again, we are looking at
ways of improving the looks of this place to make it more user friendly,
and yet- you still will need a permit to do this. Also, I have been working
with the Department of State to get some FEMA Funds for properties east
of Kenny's Beach. There are about four properties east of Kenny's Beach
that really are on the brink of disaster if we have another nor'easter,
and they are right on the beach. Working with the people from the
Department -of State to see if there were any FEMA Funds available for
these people .to to move their properties back, we, have received word from the
Department .of State, that there are monies available, that they could
receive a 750 grant of the cost of moving their houses back. The property
owners, themselves, will have to pay 250, but the Town will help these
people with the application. to FEMA to see if it could be approved, so
know the people east of Kenny's Beach have asked for this, and I'm very
pleased', because the Department of State has worked very hard on this to
bring .this to these people. Thank you, Joan.
SUPERVISOR COCHRAN: Thank you. Councilman Moore?
COUNCILMAN MOORE: Very briefly, the Code Committee has been busy
and we are going to meet again next week to discuss two items, which we
won't even contemplate getting done that night. One is assisting the
Planning Board in coming up with guidelines on Site Plan waivers from the
Planning Board, deciding whether or not an existing business has to go
through a full Site Plan process, or if there is a modified, or reduced Site
Plan process, or a waiver from the requirements. We are going to look into
that, and formalize that process, so that there is some serious guidelines
put in place they can operate under. The second one we are going to look
at for a little bit of time is the Merger Law. There continue to be issues,
and problems that pop up with it, now that it has been on the books for a
year and a half, or so. The last thing, we had a resolution on tonight
that set a public hearing on a telecommunication tower moratorium. In spite
of, or not withstanding, that public hearing, which is set for May 13th,
the Code Committee is going to get right to work starting next week on the
telecommunication tower issue, and start hashing that out. So, that is going
to be a big piece next Wednesday evening. So, that is it.

JUSTICE EVANS: I am just pleased that the Suffolk County Health
Department, and the' Suffolk County Planning Board, and the Town
Planning Board, and people from Fishers Island, and the Town Board has
all worked together, and we have coming for public hearing a proposed
amendment to Article IV, the Suffolk County Sanitary Code, which are
watershed protection standards for Fishers Island. I am happy to see that
go through, and hope some day you will have something similar for the rest
of the town. It's nice to see that come to fruition, because people have
been working on it for a long time.
SUPERVISOR COCHRAN: And you are getting your tennis court fixed?
JUSTICE EVANS: Yes, we are: Thank you.
SUPERVISOR COCHRAN: Councilwoman Hussie7
COUNCILWOMAN HUSSIE: I would like to just expand a bit on resolution
#40, ' which says, that the Town is buying a bag vending machine. Those
of you who have been up to the Landfill, the Collection Center, know that
we have presently a bag vending machine, but it is one that we have been
renting, a.nd rather than continue to rent, we are going to buy. The other
thing is, my interest in electricity, and the lowering of the price thereof,
. have been attending many, many meeting of LIPA, and other
organizations concerned with the joining of LILCO and LIPA. Right
now the way things stand, LIPA is trying to go into negotiation to take
over the transmission and delivery section of the LILCO organization.
They would continue to do the billing and also, have the generation part of
it. There have been lots of articles that talk about tempting refunds, that
we are going to get. The Governor has announced that there is going to
be a 20% rate reduction over five years,• which when you get down to it
then it' only comes down to about 40, 5% a year. Little is mentioned about
the fund, that LIPA intends to set up with $32,000,000. It is going to a
bond, which you know who will pay for, in order that they will be able to
do good works, and do environmental stuff. Never do they mention the
$5,000,000,000 Shoreham debt, that is still out there. I don't sound very
hopeful about this whole thing, and I really haven't made up my mind
completely, but I do warn everybody, and urge you to listen to, and read
everything that you can possibly find out about this. There is a desire on
the part of LILCO to be able to get an agreement with LIPA by June
2nd, in order that LILCO, and this is very appropriate for today, be
exempted from $2,000,000,000 worth of capital gains on the Shoreham
operation. So, just keep your eyes open., and your ears, and keep looking
and reading about that whole deal that is going on.
SUPERVISOR COCHRAN: I agree with Alice. I attended the Ten Towns
Supervisors Meeting, maybe a week and a half ago, and all of the ten
towns, that were in attendance do have a concern, and we are all watching
it very carefully, so your advise is well taken. I would like to report to
you some of the things that have kept me busy in addition to answering
phone calls, and letters, and having people come in for interviews, and so
forth. I did. attend the Heart Association Ball, and served on the honorary
committee, :and that. was honoring Thomas Duell, he was President of
Peconic Corporation Health, which is • the three hospitals, Doctor Dan
Damianos, who is not only a doctor but owns Pindar, and they were
honored that night. It was a lovely affair. On the eighth, I did attend
the Eastern Long Island Round Table. They held an Economic Conference
in Riverhead. In started .first thing in the morning, and went most of the
morning, in fact, up until lunch. 1 was interested in going, because we
will be holding a Economic Conference here in Southold for our businesses
to review the results of the surveys we have done, and show them support
services, that come from both County, State, and Federal, and this will be
held on May 6th. So, I did have some good input. I grabbed some good
people , and 1 , think that will help us also. Also, I attended a fashion
show in Mattituck, the P.T.A. It was a lot of fun, because not only did
they have females, but they also had males parading around, and
strutting, and doing their stuff in their fancy new clothes. It was kind of
fun. We had a Safety Committee this week, and John Cushman, our
Finance• Director, heads that committee, and we are looking as a Town
Board to find as many ways as we can to insure the safety of .our
employees throughout our different facilities. We will be doing

walk-throughs, and some other things, just to improve, or correct any
situations that are now presently there, so that. we can bring as much
safety as possible to our employers. We, also, had a Labor Management
Committee meeting with the Union. This is the Committee of myself, and
Councilman Moore, and Ray Jacobs, Superintendent of Highways, and the
Union also has representatives, and we try to discuss different points and
issues before they become problems, so we review things, and bring them
to the Board, and it works .quite well. It helps to cut down on some of the
problems. As I mentioned earlier, I went to the Brown Tide meeting in
Westhampton. I found it very interesting, knowing different things about .
the Brown Tide from the time it began, and bits and pieces here. It was
kind of good to sit and hear what had be accomplished by this group up to
this point. So many times groups put together, and they don't always
produce, but I thought this was very successful, and I thought that they
had produced. What they did was now set themselves in a direction to
begin to investigate other things, and a lot of what they felt was true is
true. I don't know how extensive the article in The Suffolk Times will be,
but hopefully, Tim picked up the good facts, because I certainly will keep
up on this. I felt I gained a great deal from it, and it helps us keep an
eye on the problem. I attended the Southold Promotion Committee,
Shipwreck Soiree, which they had on the weekend, and they did a fantastic
job in decorating, and costumes, so it was another fun evening. I would
like to thank them for bringing this kind of affair to the public. Hopefully
they will do some more of this same type of fund raising, because they are
a worthwhile group. They .do promote the tourism, and what we have to
offer on the North Fork. We call it the North Fork because membership does
extend to Jamesport and Aqueboque, which I think is very important,
because that is our buffer to all the growth that is happening to the west.
Another thing I attended, the wet-down. For those of you that are not
firematic families, a wetdown is when a fire department buys a new truck,
and all. the other departments from the area come with the sirens, and the
hoses, and they wet down the new truck. So, there was a wetdown in
East Marion over the weekend, and they, were very pleased that the
community of East Marion did support them in purchasing the trucks: They
have a new brush truck, I think, which is rehab, and they have a new
heavy duty rescue truck, which has- just about everything on it, that you
need in case of an unfortunate bad accident, where they have to cut people
out of a car, and those kind of things. They now have all this equipment,
and it certainly benefits all of us, because most departments here on the
North Fork if one department has some of the equipment, and another one
doesn't, they do a common sharing back and forth, and be it during a fire,
an emergency, they do have a, what is the term used for it, Bill? Mutual
aid, they have mutual aid, so this is good. That is about all I have.
It's been a busy two weeks. The Board had a busy day all day today. We
started at nine, and finished up just before 4:30. That took care of a lot
of Town business. We ,thank you for joining us. Please, join us again,
