Townsend, Jr. , Councilwoman Ruth D. Oliva, Justice Louisa P: Evans, Councilman William ` D. Moore, Town Clerk Judith T. Terry, Town Attorney Laury L. Dowd. 9:05 A.M. - Detective Beth Dzenkowski, D.A. R. E. Officer, met with the Board to explain the benefits of attending the National D.A. R. E. Officers Annual Training Conference, to be held this year in St. Louis, Missouri (see resolution 25) . 9:20 A.M. - Members of the Anti-Bias Task Force met with the Town Board to update them on the progress of the committee and sub-committees, and to present:. their recently completed brochure. Present: Reverend Marvin Dozier, Chairperson, Dorothy Wolf, Vice Chairperson, Reverend Lynda Clements, Barbara Summers, Viola Cross, Mark Gagen, Elaine Breese. Ms. Wolf spoke about the Anti-Bias Task Force . Mission Statement, to promote diversity, unity and understanding in Southold Town, and to organize education and group activities as well as legal and legislative efforts to eliminate all forms of bias and prejudice. She explained that the committee has created a Legislative Committee, chaired by Barbara Summers; Education Committee,. chaired by AI Falkowski (Mark Gagen spoke on behalf of that committee) ; and Social Inter-Action Committee, chaired by Lynda Clements, who spoke about that committee. 10:00 A.M. .- For Discussion Items : Town Board placed a resolution (26) on the agenda to enact A Local Law in Relation to Fire Equipment Access.----Placed a resolution (27) on the agenda to appoint Glynis Berry to the Transportation Committee; (28) to appoint Deborah Winsor to the Landmark Preservation Commission; (29) appoint Helen Varellas as a Contingent Permanent Clerk Typist; (30) authorize Town Clerk to readvertise for a member of the Board of Ethics; (31 ) appointed three Gate Attendants; (32) created two youth Conservation Advisory Council positions; (33) appointed a youth member, Christy Paliouras to the CAC.----Letter from the State Liquor Authority requesting. the Town's input concerning an application for, an on-premises liquor license by .Bay Watch at Club Wave Restaurant Corp. The Board has concerns due to zoning violations and the juxtaposition of ;liquor sales and watercraft rentals. Town Attorney will draft a response.----Reappointed three members of the Land Preservation Committee (resolution 34) .----Councilwoman Hussie submitted a proposal for additions and alterations to the Collection Center 6 Recycling Facility. She said it is nearing the time to send out for RFP's for the transfer station, and it will be necessary to have the expanded facility in place. The Board will meet at 9:00 A.M. , July 9th at the Disposal Area for a tour of the facility.----Councilman Townsend asked the Town Board to consider the appointment of a Police Commissioner who would deal on a day-to-day basis. with personnel, policy, management strategies, and procedures of the Police Department. Councilman. Moore said that those are the duties of the Police Committee which was appointed' in January by Supervisor Cochran (Councilman Moore, Chairperson, Councilman Townsend, Councilwoman Hussie) . Councilman Moore said lie has been actively working with the police since that time. He said he will call a meeting of the Police Committee to discuss and develop those areas Councilman Townsend would like to see undertaken.----Councilman Moore reviewed some proposed Code changes to determine whether the Town Board wished to pursue any of them. Noise Ordinance - difficult to enforce, no action. Jet Skis - Code Committee will look at that. Adult JUNE 11 , 1996 411 6 uses - Code Committee will look at. Accessory Apartments pre 1984 - no interest in changing. Alternative forms of security for subdivisions. Southampton allows land to be put up. Code Committee will look at it.----Councilman Moore brought to the Board's attention the need to engage the services of former Data Control Supervisor Jeanne Ruland to train the newly appointed Data Programming Specialist on the IBM AS400 computer system. Receiver of Taxes Marilyn Quintana met with the Board and explaibed the need to print the tax books by next week, as well as the unpaid notices. Board agreed to hire Ms. Ruland at a fee of $50 per hour, not to exceed $1 ,000.----The command structure of east end police departments, compiled by Councilman Moore, was circulated to the Board.----Supervisor Cochran presented a proposal from Attorney Patricia Moore, for the donation of property in the Angel Shores major' subdivision by her clients Mr. & Mrs. Theodore Laoudis. (Councilman Moore excused himself from the discussion as Mr. & Mrs. Laoudis are former clients. ) The offer is for four parcels described as Open Space in the subdivision, and consists of approximately 4G acres, which includes freshwater and tidal wetlands, bay front beach and open space. Councilman Townsend brought up questions of liability to .the Town should they accept the property, and do the property owners in the subdivision derive a tax break, from the transaction. The Town Attorney will research the question with the Planning Board, and Mr. Townsend will talk to the Open Space Committee to obtain their opinion.---- Councilman Moore set 8:30 A.M. , June 21st to interview an applicant for the CAC. 12:20 P.M. - Town Board reviewed the resolutions to be voted on at the 4.30 P.M. Regular Meeting. 12 :30 P.M. - Senior Building Inspector- Thomas Fisher met with the Town Board to ask for an additional clerical employee for the summer months to assist them in processing building permit applications, certificates of occupancy, and copies of certificates of occupancy. The Board agreed to the appointment of Stephanie Graseck a former seasonal employee with the Town (resolution 36) . EXECUTIVE SESSION 12 :50 P.M. - On motion of Justice Evans, seconded by Councilwoman Oliva, it was Resolved that the Town Board enter into Executive Session to discuss CSEA negotiations, litigation,- personnel. SUPERVISOR COCHRAN: As you can see we have public hearings listed today the first one at 5:00 o'clock, so wherever we are in our order of business we will stop at that time to deal with the public hearings. As you know the Town Board has a policy that prior to the passing of the resolutions, we ask you to address any of the resolutions at- that, if you have something to share with the Town Board. If not, there is time at the end of the business part of the meeting for anyone that would like to address the Town Board on any given topic. (No response. ) Hearing none, wJ will begin with the resolutions. 1 .-Moved by Justice Evans, seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes an expenditure not to exceed $259.00 for expenses incurred by individuals from the New York State Department of Motor Vehicles to travel to Fishers Island to process the renewal of driver's licenses for Fishers. This resolution was duly .ADOPTED. 3.-Moved by Justice Evans, seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold hereby requests the New York State Department of Transportation to conduct a traffic survey on Stars. Road, East Marion, N.Y. , for the purpose of reducing the 40 miles per hour speed limit, all in accordance with the recommendation of Superintendent of Highways Jacobs. 3.-Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. 4.-Moved . by Councilwoman Hussie, seconded by Councilman Townsend, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes Executive Assistant James ' McMahon to submit a permit application, on behalf of the Southold Town Highway Department, to the New York State Department of Environmental Conservation and the Army Corps of Engineers, for the following projects: Removal of concrete rubble from the end of a right-of-way off at Bay Shore Road, Creenport. Dredge and clear material from the east and west side of the bridge (Marion Lake) on Bay Avenue, East Marion. 4'.- Vote of the Town . Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. 5.- Moved by Councilman Townsend, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold hereby rescinds authorization to the Fishers Island Ferry District Board of Commissioners for the appointment of Dan L. Clarke as a part-time Deckhand (resolution no. 17, May 28, 1996) . 5.- Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. JUNE 11 , 1996 415 6.- Moved by Justice Evans, seconded by Councilwoman Oliva, it was :. RESOLVED that the Town Board of the Town of Southold hereby accepts the proposal of Pirate's Cove Marine, Fishers Island, N.Y., in the amount of $1,650.00, for repair and placement of channel markers and instructional floats to be placed in both West Harbor and Hay Harbor, Fishers Island, As well as repairing and replacing, or returning missing markers that are lost during the season, at a rate of $30.00 per hour, under the supervision of part-time Bay Constable Thomas F. Doherty, Jr., buoys and floats to be prepared and laced by June 1, 1996, and removed and stored by October 15, 1996; forgoing all in accordance with the bid proposal; Pirate's Cove Marine to be paid 500 on June 1, 1996, and 500 on November 1, 1996. 6.- Vote., of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Oliva, Councilwoman I•lussie, Supervisor Cochran. This resolution was duly ADOPTED. 7.- Moved by Councilwoman Oliva, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Jean W. Cochran to execute a Letter of Agreement for Continuing Disclosure Undertaking between Munistat Services, Inc. and the Town of Southold, thereby designating Munistat Services, Inc. as the Town's designated dissemination agent for the purpose of preparing the Annual Information Statement and submitting,. to each of the Nationally Recognized Municipal Information Repositories and to the State Information Dispository; and the Town agrees to pay Munistat Services, Inc. the sum of $3,500.00, each year commencing with fiscal year beginning January 1, 1996; charge to be made to A.1310.4.500.100, Accounting & Finance, Bonding Fees and Bond Counsel. 7.- Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Supervisor Cochran. RESCINDED June 25 96„ by Resolution #20 8— Moved by Councilwoman Hussie, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby engages the services of Marion R. King, Certified Real Estate Appraiser, to conduct appraisals, for a fee of $100.00 per parcel, of the following properties, for possible purchase with open space funds: SCTM#1000-45-1-10, 8 acres, corner of Route 25 and Chapel Lane, Creenport, and SCTM#1000-53-1-4, 6.5 acres, corner of Route 25 and Pipes Neck Road, Creenport. 8.- Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. 9.- Moved by Councilman Moore, seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold . hereby authorizes and directs the Town Clerk to advertise for resumes for an EISEP Coordinator for 17-1/2 hours per week, at a salary of $7.00 per hour. 9.- Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. 10.- Moved by Councilman Townsend, seconded by Councilman Moore, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs the Town Clerk to advertise for resumes for a SNAP Cook for weekends, 10 hours per week, at a salary of $8.57 per hour. 10.- Vote of the Town Board: Ayes: Councilman Moore, Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Supervisor Cochran. This Local Law shall take effect upon fillny with the Secretary of State. * Additions in bold/under-linecl Deletions in overstrike JUNE 11 , 1996 421 COUNCILWOMAN HUSSIE: I'm voting, no, and I'd better make some explanation, because I'm the only one who disagrees with this.• I understand the purpose of trying to do something about this, because the fire departments in town who can not always get their equipment with ease to a place that needs it. However, what we have written here is something that 'I think is almost absolutely unenforceable in the first place, and in the second place, if it is enforceable it's going to mean that the person at the very end of one of these private roads winds up having to take care of clearing, this fifteen by fifteen foot space on the road for the entire road, whether it's one block, one city block, or a half a mile, or a mile. That's one problem. Also, I checked with an attorney. Some of the attorneys on the Town Board said, no, but my attorney said that by having this law in here would—my home would become non-conforming, because even though I have a C.O. , I was not fully in compliance with Town Code. That is enough to make me worry about beyond the problem of the enforcement. So, those are just two of the five reasons. I'm not going to take up more time. COUNCILWOMAN OLIVA: But, then, again, if you build a home. . l want to build a home at the end of say up at the Sound, and there's no road, you have to go to the ZBA for, what we call, a 288 excess, and the ZBA will make you build a road to certain specifications, and you have to pay the full burden of that road, if you are even a half a mile away from it, because it's your driveway to get to your house. TOWN ATTORNEY DOWD: And keep it up over the years. COUNCILWOMAN HUSSIE: You are expected to but those house that are already built are not going to fall under that. SUPERVISOR COCHRAN: You can see this has been a very lively topic, not only in the Work Session, but also here at the Board session. I think what we're trying to keep in mind foremost is the health and safety of the people when •they call. There is one road in particular. This relates mostly to private roads, but there is one road in particularly that an emergency call had :to be made. An elderly gentleman was having a heart attack. Needless, to say when he came from the hospital he had all his neighbors get together and clear the road, because the fire vehicles, and safety, and ambulances do have to have access on these roads. The newer equipment, ambulance are wider and higher, so this law has been in affect,• but the way it read in the past was up to fifteen feet, which did not allow the Town Attorney leverage to enforce. Now, it does say specifically, at least fifty feet, so this is the major change. It's volley ball courts, and they're using it, and so he would like to get the lease signed and executed . They are very, very happy with it. They're going to be playing, I believe, Thursday and Friday nights. On Wednesday they are going to start a league. They're absolutely delighted. Henry Raynor owns the property. He leases part of it to Mr. Bacon for the Island, so it's down in New Suffolk. It's working very well, and they are delighted. It's interesting. Any of you here, some evening when they are playing volleyball you should take a ride down, because it really is a family kind of activity. They bring their wives and their- children. One of the greatest things is, there is absolutely no drinking 424 JUNE 11 , 1996 of alcoholic beverages. They play the sport of volleyball. Afterwards they may go and have refreshments, but while they are there it really is a family activity rather you watch it here, or you go over to the ocean in the summer, and watch it where they have six, seven different courts going at the beaches at the same time. I have gone over with my grandchildren. Can I fill in some time, and tell you where I went a couple of weeks ago? June 3rd I went up to Albany with a group of other people from the five East End towns to see what we could do about getting the bill to allow us to have an advisory referendum on the ballot in November for Peconic County, to establish Peconic County. This does not say, yes, there will be a Peconic County, but it does give us a feel of how the people feel about Peconic County, and the process is a little bit laborious, I think. We have to get permission from the State Legislature to put this on the ballot for.. us to vote on. The bill did pass the New York Senate forty-nine to nine, and it is presently being held up by Assemblyman Sheldon Silver, who has not put it on the floor of the House for a vote. So, a group of us went up there to lobby. The only thing we ask for was permission for you and me, and everybody else here on the five east end towns, to be able to vote on whether we even want to consider Peconic County. I don't know how well we did. It was a very interesting trip. It was very well organized by the Shelter Island Board, and we did not come up there empty handed, one thousand raw clams on the bus, and I don't know how many cases of local wine. . We were a hit. FRANK CARLIN : Frank Carlin. My subject. today is Southold Police. It's in three phases. I'm going to try to do two phases. If I think I'm taking too long, I'll sit down, and let sornebody else speak, and then come back for the third one. Now, that the way has been cleared after 16 months to hire police officers, how many does this Board have in mind you want to hire? SUPERVISOR COCHRAN: Would you like an answer now? Frank, there was five put in the budget, and then we had Officer Fiedler- retire, so that really could allow us the maximum of six, according to the funds we have. We've hired two from the preferred list, and we have Interviewed on the open list, no matter which way we go in hiring the next officers off the open list, they can not start the Academy until August 31st. So, at this point we have what we have on board, but we hope to go to the open list next. FRANK CARLIN: How many do you plan on hiring, the maximum? SUPERVISOR COCHRAN: The max would be the six counting the two we already hired, so that would be four more. 432 JUNE 11 , 1996 FRANK CARLIN: That would bring you from sixteen to twenty-two? COUNCILMAN MOORE: A few more back from disability. They are coming and going. Some are out. FRANK CARLIN:' Okay, now, we got $75,000. given to us from the Federal government for the COPS Program, Community Policemen. That's three cops right there at $23,000. You just hired two for $23,500, didn't you? What are trying to say, Joe? COUNCILMAN TOWNSEND: After five years . . . FRANK CARLIN: Let's not talk about five years, Joe. Let's talk where we go� now. • The problem with you, Joe, you're always worrying about what's going on down the road. Let's worry about what's going to happen today. We're short on cops. Greenport give us $240,000. (tape change. ) COUNCILMAN TOWNSEND: I can't tell you the exact figure, but probably with the benefits and so forth, and it could be. . I wouldn't want to guess, maybe $180,000, something like that. I would like to address you, when you are through, on this is, because money is a big issue. FRANK CARLIN: I'd like to address you, too, Joe, but I'll give you the benefit of the doubt of each $23,500. To me, this Board with the cost of taxpayers there ain't money too high right now. What's down the line five years, that's something else. Fifteen cops, at least, we should be able to hire in this Southold Town, and that won't even bring us up to 41 we had in 1990. You know, Joe, we had 41 police officers in 1990. Did our taxes ever go down? We have 16 now, did our taxes ever go down? COUNCILMAN TOWNSEND: No. FRANK CARLIN: That's my opinion. Sixteen, fifteen, at least, with causing the taxpayers any more money right now. You know what I'm saying? June 6th at 8:00 o'clock Southold Police Department received six brand new police cars. I know because I guided the trailer through the railroad bridge. - That's my every day duty anyway living there, guiding the tractor and trailers when they stop and can't make the bridge, usually go out with courtesy, and I ask them how high are you? They say thirteen six, because it's a State Law, and I say, go ahead because the bridge is over fourteen and a half. That's a freebie I do for the town. I'm always doing that. But, they stand there, and they stand there, they don't know if they want to go on. Anyway, six new police cars were delivered to the Southold Police Department at 8:00 o'clock. In fact, I drove down there, and I seen them being unloaded. The problem is let's put these cars to use. I think Southold Town has a tendency to put these behind the headquarters there, and leave them lay for awhile to cut costs. We've got police cars, some of them on the road now, Madame Supervisor, that are Itickets. They have 100,000 miles on them. SUPERVISOR COCHRAN: More than that. FRANK CARLIN : They should be taken down to the dump, and dumped in the metal pile there, plain speaking, because probably costs more money to maintain than to buy a new one. SUPERVISOR COCHRAN: Frank, when the police cars come in it does take a little bit to get them on the road, because they have to be striped, and an insignia goes on, and so forth. FRANK CARLIN: I'm not say that. As long as they don't go into moth balls someplace, which we have been known to do before. SUPERVISOR COCHRAN: I think some will be on the road shortly. FRANK CARLIN: And get rid of some of those clunkers over 100,000 miles. Let these boys ride in something half way decent, and let the taxpayers money go to work here for them. Can I finish up? It won't be too long. Police Chief, I have nothing against our retired Police Chief Stanley. He did a good job as a police chief, but the size of Southold Town, no $96,000 to no police chief. Come on. The New York City's JUNE 11 , 1996 433 Police Commissioner with 30,000 police, and I'm giving him a raise here, $125,000. Suffolk County Commissioner, 2,600 officers, $95,000, 2,600 officers, Nassau Commissioner, $95,280, Boston Commission, $85,000, FBI Director, $125,000. Southold last year what ever these people voted, you give the Police Cihief $91,000, and he got a raise since then to $96,000. It's too much for the size of this town, too much of the taxpayers money. That's my argument there. I can understand, you know, you look at 30,000 police officers that this Police Commissioner is responsible for, that's more people than we have in Southold Town. We're only down to sixteen, and some Sergeants I'm throwing in there, and some Detectives. I mean I have nothing against Stanley, but you got to use some logic here. $96,000, 1 make a statement here, in my opinion, I say the Police Chief in Southold should get no more than $65,000. 1 hope that when you decide on, I don't care if you choose. .it doesn't matter to me if you choose from in the ranks, or outside, that you keep this in consideration. COUNCILMAN MOORE: Frank, can 1 just respond quickly to your comments? The money is not out there in some huge pot to say that we're going to hire fifteen, or twenty, or you pick a number officer. One of the things we're looking at right now, and we just put into place this year was the ability of seasonal police officers, of which we were able to hire two for right now, who are certified, and put on the street. Those are the people who can fill in, and do certain tasks, in the summer season, which we all acknowledge is the busiest time of the year out here on the east end. One of things, when we get to the ,new police chief, we have to examine is just how to best meet the manpower needs of the town. Now, it's combination of seasonals and full-times, and some other things that can be done to maximize your manpower , in a way that you get most bang for the buck. As far as the Police chief goes, however we go on that we have to negotiate a contract. If you could find a way to help us negotiate a contract paying $65,000, I'd love to have your input on that, because you'll see a tier structure of employment that makes that rather difficult. But, I'd be happy to hear your comments on that. COUNCILMAN TOWNSEND: Just a comment, not to embarrass anybody, but you realize that if it was $65,000 he was probably making less than most of the mon �on the force, assuming all the officers, because we have officers that make almost $90,000 now. With overtime some patrolmen make well more than that, so it's difficult to put a Police Chief in who would be making less than a good percentage of the force. We discussed that. It is a concern in this town. That's one comment you hear all time. It's a concern for us. We're all very concerned about that level. It's a very interesting story how it got that way, but the fact is, there is a reality in that he is not the only one that is making that kind of money. Quite a few members of the police force are making that kind of money. FRANK CARLIN: Riverhead Police Chief ain't making that money. SUPERVISOR COCHRAN: I think Riverhead is, Frank, if you check, because he gets paid in different ways. I believe he gets a bulk salary. He get $15,000 for this, so much for that, so if you total it up. I think you have to look at the whole thing. COUNCILMAN TOWNSEND: In the County they're making over a hundred. FRANK CARLIN: You brought up a very important point, $90,000 in overtime. That was because we had no cops. They were working overtime, over 4,000 hours overtime. When you have enough police that they can all work forty hours, you wouldn't have hit that kind of salary. We've been paying $90,000. 1 can't believe that without overtime you're telling me we wouldn't make no $90,000 for a police officer. You're telling me $90,000 because for the last sixteen months you people couldn't make up your mind on this issue about hiring, and used the taxpayers' money to spend all this kind of overtime, and worked these fellows all kinds of hours overtime here, now, you're telling me it's $90,000. Sure, it's going to be $90,000. If you had enough police officers on there, then it won't be $90,000, because they'll work forty hours a week. How come in 1990 we had 41 police officers, and all of a sudden now we're worrying about only six. Tell me. Answer. 434 JUNE 11 , 1996 SUPERVISOR COCHRAN: That's what money allows right now, Frank. FRANK CARLIN: And the traffic is getting worse, and we took over Creenport yet. So, that means with that town we need more police officers to cover 9reenport. No logic there. Sorry. SUPERVISOR COCHRAN: Thank you, Frank. Mr. VanBourgondien? PHIL VANBOURCONDIEN: Phil VanBourgondien, Southold. What read in the paper about the Police Chief situation is that, and correct me if I'm wrong, if it were proven that the majority of the people in town wanted you to go outside of the town for a police chief, that's allowed, according to the way the paper stated it. If you show that enough people wanted, you to go outside of town. That's what both papers had in last week COUNCILMAN MOORE: Let me just comment on that. I don't know that would characterize it that way. I think the fellow from Civil Service explained to us the criteria. It has nothing to do with .a popular vote of the community saying, we want you to do this, we want you to do that, and somehow the majority vote would say, go hire from outside. Civil Service Law, and the Town Attorney can step in here with the language specifically, gives the criteria which suggests. . [ don't think I am speaking out of turn characterizing what Mr. Schneider said, that promotional exams appoint many departments within it's police department, or your Highway Department, or your Scavenger Waste or Solid Waste, are geared toward and foster promotion. That seems to be the frame of the Civil Service Law written in New York State. It requires, and I don't want . to quote inaccurately from that Law. , It's not a popular vote, and it's not just because we want to do it. It has be in the public interest to do it. TOWN ATTORNEY DOWD: Impractical or against the public interest, or against the public interest. COUNCILMAN MOOR:E: Well, impracticable, and in the public interest to go outside, sw it's a burden that the Board will have to meet, and having Mr. Schneider here I think the Board is working through the information that he provided, and what conclusions are drawing upon them. We agreed kind of to reach that on our own, as a Board proponent, that's what we're going to do. PHIL VANBOURCONDIEN: It's shame that it was presented the way it was in the press, because you get the impression there's enough people that didn't want promotion from within, you would be free to go outside, which of course, I advocate doing, as you know from the last meeting. COUNCILMAN MOORE: His meeting with us was very informative. Those who actually sat there, and heard him directly it was most helpful. It was open to the public, and those who were there, I think, heard it directly from him, and kind of form their own opinion based on what they heard from him, and not characterized by someone else, whether it's by me or by anybody else analyzing what he said. PHIL VANBOURCONDIEN: Thank you. A friend of mine came to me the other day, and made a statement that worried me. He said that he inquired of the North Fork Bank about renting a part of the white, elephant up on Youngs Avenue, that the bank is stuck with. Their answer was, no, we're not interested in renting any part of it, because we're in negotiations with the Town of Southold, and they're looking into buying it. As you know, a month or so ago I told you that I thought this was the biggest mistake in the world. It's an ugly looking building. It's far too big for us. Councilwoman Hussie, of course, said, well, we can rent part of it out. Politicians never rent anything out. They fill it with more employees: That is the way it always works, and then what do you do with this building? This building sits empty and try to find people to fill this building when you have rentable buildings all over the Town of Southold at the present time. Office space all over the place. I can't impress you enough with how much I feel that spending two and a half million dollars is a compete waste of money, when you can purchase property right around this building, which ' is an attractive looking JUNE 11 , 1996 4 building on the main street in the middle of a beautiful town. If you were to take that people would say, look, look at that ugly brick building. That's where they are stuck away. You can expand with an architect, and you can purchase property around this building. You can lay out and add on to it what you need for far less that two and a half million dollars, I'm sure. My third topic today is, two weeks ago Ed Siegmann made a statement, or asked a question of the Board if they had ever done anything about looking into the report of the Tax Committee, that was instituted several years ago? The answer was, well, we're thinking about it, or we're looking at it, or whatever. I personally doubt that anybody with the exception of maybe Alice has even read the first report or the second, or maybe Ruth very possibly. Otherwise I doubt that any of the rest of the Board has read either of the reports through. I'm not patting myself., on. the back. I happen to be on that committee, and I felt that we did a big job, and we came up with a lot of conclusions on how taxes could be reduced. Unfortunately, politicians are politicians, and something started by another politician is never looked on very well by the next guy, who takes over, and I suspect that, that's the reason why it has not been looked at, but there is a lot of good information in there. I urge you to look at it, because as time goes on, and costs escalate you are going to hear more and more discontent from the people, and I think you ought to look into ways and means of trying to reduce government, and government expense. SUPERVISOR COCHRAN: Thank you. If I may I'll start backwards. I'll start with your remarks in relation to the tax report. It has been brought to the Board on two occasions, and there has been no action taken. Number two, in relation to the building, we are not in negotiations with North Fork Bank, or anyone else. We are looking at the feasibility of purchasing the bank. We don't even know if that will be the selling price. I have doubts that it will be. We felt that if we had options in relation to perhaps adding on to this facility, perhaps recycling a building, that has been sitting there empty for five or six years, or perhaps building elsewhere. The Board has to begin to look at this. We have four departments in the basement, in the cellar, and someday OSHA is going to knock on our door, and say, you people do not belong down there. It is ' not healthy. It is not safe. It is unfortunate, Mr. VanBourgondien, that have such lack of confidence in your elected officials. You seem to find that politicians, that it is a nasty word. I don't believe it is. These are _neighbors and people, that are elected to do the job for the community. I also believe in relation to taxes, that it is the responsibility of this Town Board at the time they develop a budget to look at downsizing, or rightsizing, or whatever term is in vogue that day. But, it is our responsibility to look at a budget, to plan it, to keep the taxes down as best we can, and yet give the service we are here to provide. I really feel badly that you feel that we lack the knowledge, or we lack the ability to properly house people in the Town Hall. I can not even begin to comprehend that because you have the space you fill it up. This is not so. This is not so. We work as best we can with the people we have in this Town Hall, and I think they're doing a good job. But, we also owe to them a healthy working environment. So, we will continue to look at the options before us, and then the Board will make a decision yes or no. At this point no decisions have been made. Also, it is being considered what can happen to this building. This building does not have any historical value. I remember when it was built. It's not like it's been here since 18112. It's a building that was built, and it no longer meets the needs for good planning, and good execution of Town business. I thank you for- your concerns as I always do, and thank you for sharing with us. PHIL VANBOURCONDIEN : If I may say something . I have never intimated in any way that this building, as it stands today, is sufficient. I agree with everybody completely. It's a horror having people in the basement. I say with the money that you will spend with architects that you can add on to this building in various ways, You can purchase property right next door. You can purchase property in the back. You can do anything you want. Then add on to this building so that you get everybody out of the basement, and have sufficient room for everybody. Don't get the impression that I ever said that what we have is fine, because I agree with you. The people in the basement should not be, but 436 JUNE 11 , 1996 we should look at what we have here. When you say, well, it has no historic value. Has that white elephant got any historic value? COUNCILWOMAN HUSSIE: No, it doesn't. I think it's a horrible looking building. I SUPERVISOR COCHRAN: I think there are things that can be done. People make a building many times, also. Thank you for your clarification. I'm glad you see tKe fact that we do need added space, and this report hopefully will give us some of those options. In the past the Town Board has from time to time investigated the sale of the property on the corner, or the sale from Mr. Stankewicz. Year ago we had engineers going, and check it, and I don't think it was anything that the Town ' would like to purchase, and those records are on file. We will be looking at it in total. No one, myself included, has made a decision, or has made anything in their mind. We are going to look with an open mind, with growth to the future, and just try to make the best wisest decision that we can. Thank you. Anna? ANNA COSOMONO: My name is Anna Cosomono, and I'm a resident of Southold. I'm here tonight on behalf of the ad hoc Animal Rescue Committee. This may very well be our last time here, as July is right around the corner. Our petition for the new Board of Directors has been sent to, and received registered mail by the shelter. As you all know by now July is the month the shelter has their annual meetings, their elections for the Board of Directors open to the members of the League. As of now we don't know the date, but when we do we will let all the people know through the Suffolk Times, and Traveler-Watchman. Hopefully, you people will be there to cast your vote. We wish to thank all people who have helped us with this campaign all these months, and to you, the Town Board, for all your help. As you all know, how and why this fight with the shelter first started, I would like the public to be aware of this inexcusable, untimely death of a dog named Yana, and to make sure this sort of thing never happens to anyone ever again. personally have to be thankful to the people who have helped me in time, to be able to have a private cremation for Yana, and the crematorium where her remains were being held. The North Fork Animal Welfare League put a stop to it. This is all I have left of Yana. Yana may have died alone, but her ashes will be with me always, where she should have been in the first place. I hope in July everything is resolved, and we can finally do something good for the shelter. Thank you very much. SUPERVISOR COCHRAN: Thank you, Anna. Is there anyone else? MILDRED BOYCE: My name is Mildred Boyce. I live in Southold. just wanted say that apparently the turmoil on the Board of Directors of the North Fork Animal Welfare League continues. Last week the secretary resigned, and that brings a total of eight people, eight directors,, who have resigned from the North Fork Welfare League in the past year, and they are now down to six members on their present board. I just wanted to make everybody aware of those facts. Thank you. SUPERVISOR COCHRAN: Office Tirelli? VINCENT TIRELLI, JR. : Vincent Tirelli, Jr. , Southold PBA. First I'd like to say this past week I became a reluctant member of a club Ms. Hussie, and Mr. Carlin belong to, and that's the anonymous hate mail club. I have received letters in the past that people had the intestinal fortitude to sign. This one was a personal attack on my personal life, as well as my professional career. As Mr. Carlin said a few weeks ago, the letter is not worth the paper it's written on, if you don't have the guts to sign it, but maybe we should start a club. I don't know. I noticed under the discussions that you discussed the possibility of a police commissioner. Is that in lieu of a chief, or on top of a chief? JUSTICE EVANS: State Law requires that we have a chief. VINCENT TIRELLI, JR. : I realize that. SUPERVISOR COCHRAN: Mr. Townsend would you like to respond to .-that? l ) JUNE 11 , 1996 437 COUNCILMAN TOWNSEND: We discussed that we wouldn't be discussing it. We agreed not to discuss it. We just discussed the concept. I don't want to get in great detail, because we're looking at several options to perhaps achieve some of the changes that. or enhancements that some of the people up h9re had spoken about. Councilman Moore mentioned a few, and we hope to have a decision very soon on this. VINCENT TIRELLI, JR. : As Justice Evans . said, Civil Service Law does requires a chief in a department this size. I was just wondering if there was an attempt to circumvent the issue. Thank you. SUPERVISOR COCHRAN: Is there anyone who would like to address the Board? MARY RAKAUSKAS: I'm Mary Rakauskas from Southold, and did you get a response by any chance to the point in which a light will be installed at the intersection of Horton's Road? SUPERVISOR COCHRAN: I had the occasion to speak with the engineer from the Department of Public Works last; night. I had been invited over to Shelter Island. The Suffolk County Highway Superintendents Association was having their conference. I was invited, and lie happened to be there, so the first thing I said was, where's my light? He said they have had some difficulty. You'll see it, blue on the road, and the blue flags, and so on, and so forth. They're waiting for LILCO right now, and said, is there anything that my office can do in pushing LILCO along a little faster? He said, no, he thought it was under control, and that they should be solving the LILCO problem with the lines, and so forth. If you look up there, you'll see that the lines cross the road at an angle, and it just doesn't make sense how any of these wires go. So, that's what they're working on, and he assured me that it would be as quickly as possible. MARY RAKAUKAS: That's funny, because in one of more realistic fantasies I thought perhaps you could install speed bumps on Horton's Lane. It has been becoming a drag strip. SUPERVISOR COCHRAN: On Horton's? MARY RAKAUKAS: Yes. Another thing that has me puzzled is in respect to the salary of the clerk-typist versus that of one of the gentlemen that works at the dump. SUPERVISOR COCHRAN: The gate attendant. MARY RAKAUKAS: Is there a vast difference? SUPERVISOR COCHRAN: Fifteen cents. It's just that the gate attendant is earning more than the clerk-typist, that must know the computer, and must file, and must type, all these different duties. MARY RAKAUKAS: I was under the impression that a gate attendant earns something on the order of about $12.00 an hour. SUPERVISOR COCHRAN: No. TOWN CLERK TERRY: We just hired three. It's $ 6.96. SUPERVISOR COCHRAN: My comment was that the Town Board should really take a look at it. There's a little inequity here. Mr. Carlin? FRANK CARLIN: I got a suggestion, if you ever want to build a new town hall, how to get rid of this here building here. Try to sell it to the YMCA. Police Chief, we went out of town years ago. We hired a police chief from Suffolk County. For what reason lie resigned, but we already had one in the town. As far as politicians go, not all of them, but this is my opinion, not all of them, but some of them have a tendency to create problems, and then campaign against them. That's what I think. 4.38 JUNE 11 , 1996 SUPERVISOR COCHRAN: Thank you, Frank. Is there anyone else that would like to address the Town' Board? (No response. ) First I would like to apologize to the Board because we were so hard at work today, that all of sudden someone said something, we were almost done with what we had to do, and I looked at the clock, and it, was twenty of two, and they hadn't eveh had lunch yet. So, I thank you for being so patient today, and not saying, hey, I'm hungry. Let's close this down. But, would like to call if any Board 'members would like to report anything. Joe? COUNCILMAN TOWNSEND: No, not at this time. SUPERVISOR COCHRAN: Ruth? COUNCILWOMAN OLIVA: Yes. Two things, first of all, I was asked by Jean to go to the Peconic Estuary Conference last Wednesday and Thursday, and 1 went down, and they had some very, very interesting data, and presentations. I was especially pleased, because I was one of a small group people eleven years, this coming summer that met over with the group for-the South Fork to start this whole process, because we were worried about the Brown Tide. That it has evolved, thanks to so many people's participation in the Peconic Estuary System's program. It's really, I think, something wonderful. Hopefully, there will be some basic research just to find out what causes this Brown Tide, because we really do need an answer. One of the questionnaires on the public relations question that they asked, which towns used the Peconics the most? It was Southold Town with 75% of the people that were surveyed, and Southold Town used the Peconics extensively for recreation, for economic reasons, and what have you, so it really is important. Second of all, we have received a $20,000 grant from the Department of State to study the problem at Goldsmith Inlet, to study the accretion on the west side, and the erosion on the east side. We are going to hold a workshop here on Wednesday the 19th, and Thursday, the 20th. We will be walking the beach Wednesday afternoon the 19th, and the evening of the 19th at 7:30 right here in Town Hall we hope to have as many people that can possibly come out, from both the east and the west side of the inlet to give us their, perceptions, to give us any information . that they have that we may have had, so that these experts that the Department of State are bringing in from all over the country to study this ' problem can come to some various conclusions on .the morning of the 19th. So, any that out there from around Goldsmith Inlet, or anybody else that wants to come, we'd be delighted to see you at 7:30 here at Town Hall on Wednesday the 19th of June. Thank you. SUPERVISOR COCHRAN: Councilman Moore? COUNCILMAN MOORE: Ruth, I'm glad you picked up on the little lighter note there. We got pretty heavy. I didn't bring any pompoms, or megaphones, but I'm going to continue to roll the thing over to the cheerleader here. I want to thank the Arts of Southold Town. A week ago Saturday they brought out and presented Judy .Carmichael, who is a terrific stride jazz piano player. She ,is a tremendous entertainer, great program. I'm so happy that that group of people are sponsoring these kind of programs. We've .got jazz throughout the summer, classical music coming this fall, along with the music on the green on Wednesday will be starting up not too far from now. So, I think it's great to do that. also want to pitch a product of the Southold Town promotional Committee, which is now, out and available, called 1996 North Fork Directory, and this thing is super. This thing lists all the bed and breakfast, the hotels, the motels, the restaurants, you name it. It's a fantastic publication, and hard working Promotional Committee, which consists of our local Chambers, and Bed and Breakfast Associations, and charter captains, and a whole group of people were involved in this. It's a terrific brochure. COUNCILMAN TOWNSEND: There's racy picture of my daughter in there. JUNE 11 , 1996 439 COUNCILMAN MOORE: Is there? A racy picture, this must be at the beach then. The cover is a handcolored photograph by artist Daniel Jones, and. it was the bases of a poster that has been used before, and it's going to become a theme for the Promotional Committee. I'm sure Gayle Marriner-Smith had a lot to do with it. I don't know who else she worked with in' the layout. She's the Executive Director of the Promotional Committee, and she does a great job, and this is a tremendous brochure. The last thing, we built a place to put this brochure in a tourist information booth this past weekend, and I have really soft hands. I'm not a carpenter, and I don't know the first thing about carpentry, but was happy to participate Saturday in the construction of a new tourist information booth, that is going to go up at the Town Beach in Southold. I figured out which end of the hammer to hold, so another place to put these great brochures. Thanks. SUPERVISOR COCHRAN: Justice Evans? Councilwoman Hussie? COUNCILWOMAN HUSSIE: No, thank you. SUPERVISOR COCHRAN: I have several things I would like to support, but first I would like to offer my congratulations to the many, many students in Southold Town that just completed the DARE Program. For those of you who do not know what the DARE Program is, it is a program that works with one of our police officers, Detective Dzenkoski and the schools. We go into the schools and we teach these young people about drugs. We teach them about self-awareness, respecting themselves. We try to give them some skills, so that when they get to an age where drugs are offered to them they know how to say, no. . It's an excellent program. We had three, four, five different graduations "this week. They have all been televised. They are all showing on Channel 27, and the young people kind of get a kick out of seeing themselves on TV, but it might behoove you to watch at least one of them, and you will realize what this program has. It's worth every penny that is spent on it. I, also, had the opportunity to speak to some of the grades, Greenport, Southold, and so forth, down at Founders, Landing. Part of their history program is called, Landing to Lighthouse, and they learn about the beginning times in Southold Town, and I had the opportunity to share with them big billowy white clouds of sail coming up the bay to land at Founders. So, that was a nice opportunity for myself, and fo.r the children also. I attended the North Fork Housing Alliance open house and dedication. They have just completed an educational center, and that was dedicated plus one of the homes that were just renovated was also dedicated. It was exciting. We did a tour, one of them. I went to the first one, and then I disappeared, and the tour went to the other three homes. Joe was a part of that also, and presented a proclamation for the town. Also, I attended a meeting with County Executive Gaffney. All ten Supervisor, and they meet once a year to take action on funds from the quarter percent sales tax, and we did receive some funding for testing and capping of the landfill, a small amount. We don't generate that much in quarter percent sales tax. Bill spoke briefly about the booth that was raised. He said a Chamber booth. It's not a Chamber booth. What it is, is a regular booth, that the beach attendants use up at Town Beach to sell the stickers, and checking the people as they come in. Since the one that was there was ready to fall apart, we figured if we replaced it, but at the same time we enlarged this, that it would give us the opportunity to place tourist information in the booth in addition to being an attendants' booth. So, we checked the prices up here on the North Road, and so forth, and I said, heck, why can't we do an old-fashioned booth raising rather than a barn raising. We had some of these people together, and they were from the Chamber and Gail Marriner-Smith, that did this brochure, she was there. The women's role, we made the coffee, and served the bagels. I don't think they trusted us with a hammer. They did build it. They're up to putting the roof on tonight, but I have to tell you, Councilman Moore has never had the opportunity to build anything. His dad is a minister, and so is his grandfather, and they just didn't do carpentry. So, we decided we'd take the chance and give Bill a hammer. So, Bill did get a hammer, and after they first told him how to hold it, you did beautifully, Bill. You really did. At one point he is up on the ladder helping my husband, who's up on the peak of the roof, and he's banging this board, and Pep finally said, Bill, I don't know how to say this. I don't want to hurt your feelings, but would you please get off the ladder, 440 JUNE 11 , 1996 and let Jimmy King come up? So, Bill, thank you very much, and he left. But, he did learn his first lesson in construction, worked hard, as the fellows did, and we have our booth just about completed. So, government is work, but you can have fun, too, to get these things done. Also, I would like to congratulate Eagle Scout Todd Giordano in Mattituck. I attended his Eagle Scout award, and it was nicely done, and we offer him congratulations once again. In the same vein, I would like to offer congratulations to Ken Hagerman, and Midge Flynn Hagerman, who celebrated their Fiftieth Anniversary over the weekend, and were honored by friends, and neighbors. Then in the evening I -had the opportunity to go Polish Hall in Riverhead, and I served as a Judge for the Polish Hall Queen, which they use for their Polish Town Fair. It was a busy weekend, believe me. In a, weak moment one of the church groups from Mattituck, it's a youth group, and they're going to have a dunking booth, and they 'asked if I would cooperate by being dunked. For kids, darn it, I said, yes. I think I'm going to be auctioned, and my husband sits their with a big grin on his face. (tape change. ) Hull strawberries, and if any other member of the Board would like to join us, or you can go up, and fix the strawberries, and put the whipped cream on, but they certainly can use all the hands they can get for the Lion's Strawberry Festival in Mattituck. To finish my report, hopefully you noticed the display in the front hall. This was done in conjunction with one of the grades in Mattituck School in the Planning Board. They broke into groups, and they determined what kind of a building that would house certain activity that they see as missing, and I think you'll find it very interesting as to what they see as their needs. So, if you would take a moment on your way out, just look at the work these young people have done. I think it's worthwhile. I think that's all I have at this point, if no one has anything else, I'll call for a motion to adjourn.
