-SOUTHOLD TOWN BOARD
FEBRUARY 6, 1996
WORK SESSION
Present: Supervisor Jean W., Cochran, Councilwoman Alice' J. Hussie, Councilman

9:10 A.M. - Guy Sturniolo, agent for Bissett Nurseries, met with the Town Board
to request permission to put a watchman house trailer on the Bissett property on
Cox Neck Road, Mattituck. Mr. Sturniolo told the Board that over the past few
has. been substantial theft of plants from the property, resulting in a
years there
loss of money to the business. Mr. Sturniolo was asked if the police had been
called, and if so could he produce copies of the reports. Mr. Sturniolo returned
at 10:15 A.M. with. several police reports, which the Board reviewed and agreed
warranted the, placement of a watchman trailer (resolution 27) . Mr. Sturniolo was
advised the permit would be reviewed if there are any complaints about its use.
9:20 A.M. - Transportation Committee members Neb Brashich,
Victor Brown,
Margaret Brown, Mike Acebo,• Dwayne Early, and Barbara Michaelson met with the
Town Board to review the progress of that committee. Chairman Brashich updated
the Board on their programs, - Road • Run-Off Project, cenic Corridor
isorManagement
Plan, and Seaview Trails of the North Fork. Mr.
will be meeting with the New York Department of Transportation on February 29th
with regard• to these programs.
10:00 A.M. Joe Gold, Chairman of the Land Preservation Committee, met with the
Town Board to review two proposed parcels for acquisition under the Agricultural
Land Preservation Program: (1) the property of Marie D. Cassidy and Carole M.
Cassidy on Albertson Lane, Greenport, and (2) two parcels belonging t to Lieb Board
yards - one on Bridge Lane and the other on Oregon Road, g
set a public hearing (resolution 26) to consider the acquisition of the development
rights in these properties.

Raynor .met with the Town Board to discuss public Y
Raynor advised the Board that one of his full-time dispatchers will be going on
maternity leave for .18 months '.beginning in March and he will need a temporary full-
time replacement. A Civil Service list will be called for to fill that position for the
18 month period.. Secondly, Mr. Raynor advised the Board that he is in need of
a new permanent full-time PSD due to the amount of straight time and overtime being
put in by the part-time PSD's. Senior Accountant John Cushman will be asked to
gather the figures together. to determine whether a new full-time person is
warranted. In the .meantime the Town 'Board will seek a part-time PSD (resolution
32) .----Following this discussion, Chief Droskoski said he specifically came before
this Work Session to set the record straight due to items in the previous week's

discussion was the "Property Improvements in Southold Town, A Guide to Permit
Procedures" prepared by Robert Keith. The pamphlet is intended to guide the
public through the permit process when they decide to improve their property. The
pamphlet has been reviewed by various Town departments, and the Town Board
agreed it is now ready for distribution to the public.----Senior Accountant John
Cushman met with the Town Board to discuss the ' implementation of a Management
Safety Program. The goal of such a program is to provide every employee a place
of employment free. from recognized hazards which are a potential cause for serious
physical harm or health impairment. Upon review and approval of the Statement of
Management Safety Policy, a resolution (28) was placed on the agenda to adopt same.
Next the Board designated Senior Account. Cushman as the Safety/Injury Coordinator
and placed a resolution (29) on the agenda to put this in place. Lastly, the
creation of an Executive Safety Committee is necessary to the implementation of the
program, and a resolution (30) was placed on the agenda to create the committee
and appointment members.----Town Board discussed the Fishers Island Metal Dump
project. Senior Accountant Cushman advised them that there is only $9.13.07
remaining to pay for Ed Capobianco's supervision at the site, which is would be
enough , for about a week. It was agreed Justice Evans should put pressure on the
contractor to get the job done as soon as possible, and Mr. Cushman will find the
funds in the General Fund to fund whatever additional time is needed for Mr.
Capobianco.----Although Chief Droskoski had requested a full-time Clerk Typist to
fill a part-time vacancy at Police Headquarters, the Board agreed to advertise for
a part-time Data Entry Clerk (resolution 31) to fill that vacancy.----Town Board
reviewed with Senior Accountant Cushman and Town Attorney Dowd a summary of
outside legal fees and legal staff salaries from 1991 to 1995.----Senior Planner
Valerie Scopaz appeared before the Board to request permission to attend the
Association of Towns on February 20th (resolution 33) .
12:20 P.M. - Recess for lunch.
1 :40 P.M. - The work session reconvened and the Town Board agreed to place a
resolution on the agenda '(36) supporting the Long Island Pine Barrens Society's
proposed "Initiative E Referendum" to put on the ballot a proposition that would
require future use of the Suffolk County Pine Barrens Reserve Fund under the
"Clean Drinking Water Protection Program" to ' be used exclusively for land
acquisition in the Pine Barrens.----Town Board discussed a letter from C.A.S.T.
asking for designees to serve on the Board of Directors. Supervisor Cochran and
Councilwoman Oliva volunteered, and a resolution (37) was placed on the agenda to
make the recommendation.----Councilwoman Hussie brought to the Board a proposal
for a Yellow Bag vending machine pilot program for the collection center. She will
present complete details to the Board at a - future meeting.----The Town Board
reviewed the application for renewal of a trailer permit by Vincent Annabel. Certain
points were reviewed: (1) the Board received additional information showing that
the trailer was used for overnight stays, which raised concerns about the adequacy
of the existing septic system; (2) the original nonconforming trailer has been
replaced by a newer trailer; (3) the trailer is on wheels and can be moved to a
conforming site without great difficulty; (4) the trailer is used for pleasure
purposes, and the general aim of the Board is to issue trailer permits only for
reasons of necessity. Due to the foregoing reasons, Mr. Annabel, who was in
attendance at this time, was advised the permit would not be removed. He was
given until April 1st to remove the trailer.
2 :10 P.M. - Town Board reviewed the resolutions to be voted on at the 7 :30 P.M.
Regular Meeting.
2 :55 P.M. - The Town Board devoted the next hour to a review of the final report
of the Committee on Local Taxes. At the conclusion of the review it was agreed the
Board members would each prepare a list of those points they feel are possible to
implement, and this matter will be discussed again at a future meeting.

A Regular Meeting of the Southold . Town Board was held on
February 6, 1996, at the. Southold Town Hall, Main Road, Southold, New
York. Supervisor Cochran opened the meeting at 7:30 P.M. P.M. with

WHEREAS, the Town of Southold' wishes to recognize outstanding groups
and organizations who have rendered significant contributions for the
enhancement of the residents within our township; and
WHEREAS, the AMERICAN HEART ASSOCIATION is committed to
reducing death and disability from cardiovascular diseases and stroke
through research, training, educations programs and services; and
WHEREAS, the AMERICAN HEART ASSOCIATION makes a positive
impact on the health of Long Islanders through the support of their
volunteers and donors - their greatest strength; and
WHEREAS, the AMERICAN: HEART ASSOCIATION is reaching thousands
of Long Islanders in the workplace with their "Worksite Wellness"
Programs, and school children are benefiting from their Heart Healthy
Education Modules; and

proclaims the month of February, 1996 as NORTH FORK HEART MONTH

authorizes Lawrence Healthcare Administrative Services, Inc. to pay the
medical bills of Dylan Gibaldi, which bill was submitted by the
provider more than 90 days after service was provided; and be it
FURTHER RESOLVED THAT THE Town Board authorizes Lawrence
Healthcare Administrative Services, Inc. to pay the medical bills of
Patricia Conklin, which bill was submitted by the provider more than 90
days after service.

N.Y., from March 4 - 7, 1996, at a cost of $1,195.00, and paid through
the Central Data Processing Contractual Budget.

RESOLVED that the Town Board of the Town of Southold hereby
authorizes and directs Executive Assistant James McMahon to apply for the
permits necessary to construct a concrete boat ramp at. the end of King
Street, Orient, - and floating dock at the Town Board Ramp at the end of
Jackson Street, New Suffolk; said projects are in the 1996 Capital Budget.

appoints Patricia Carsik as a Secretary in the Supervisor's Office, for
the period of February 1 -& 2, 1996, at a salary of $100.00 per day.

RESOLVED that the Town Board of the Town of Southold hereby grants
permission to Building Inspectors Cary J . Fish and John M. Boufis to
attend the Finger Lake Building Officials Association Conference at
Rochester, New York, on March 25, 26, 27, 1996, and the necessary
expenses for meals, lodging, registration and transportation, using a Town
vehicle, shall be a legal charge to the Building Department's 1996 Budget.

permission to Detective Beth Dzenkowski to attend the 7th Annual New
York State D.A.R.E. Officers Association Conference, - at Syracuse, N.Y. ,
on March 28 - 31, 1996, and the actual expenses for registration
($145.00"), meals, lodging, and transportation shall be a legal charge to
the Police Department's 1996 Budget.

RESOLVED that the Town Board of the Town of Southold hereby
authorizes and directs Supervisor Jean W. Cochran to execute the
Town's DBE (Disadvantaged Business. Enterprise) Coal Update, which is
required by the Federal Aviation Administration of federal funds
recipients, which regard, to Elizabeth Field Airport, Fishers Island, all
in accordance with the recommendation C&S Engineers, Inc., the Town's
airport consultants.

N.Y. (SCTM#1000-059-10-006.3)m 28.3 acres, at an appraisal fee of
$1,000.00

10 .-Moved by Councilman Townsend, seconded by Councilman Moore,
WHEREAS, Section 64 of the Town Law requires the Town , Board to
designate, by resolution, banks in the State in which the Supervisor or
other officers of the Town shall deposit all moneys coming into their
hands by virtue of their office; and
WHEREAS, the Town Board may require any bank, so designated, to
deposit with such Board bonds or certificates of the United State, of the
State of New York, or any county, town, city, village or school district
of the State of New York, such security for such funds so deposited,,, but
such bond or certificate shall be subject to the approval of the Town
Board and shall be deposited in such place and held under such conditions
as the Town Board may determine; now, therefore, be it
RESOLVED that the 'following bank is hereby designated for fiscal year
1996 as depository, with the following securities required as collateral
for such cash balances in said bank:
Bridgehampton National Bank $5,000,000.00

AND BE IT ' FURTHER RESOLVED that the $5,000,000.00 required of the
Suffolk County National Bank for the Tax Receiver's account be deleted;

FURTHER RESOLVED that the Receiver of Taxes is hereby authorized to
execute Collateral Agreements between the Town of Southold and
Bridgehampton National Bank and their Third Party Custodial
institutions, all in accordance with the approval of the Town Attorney;
and be it
FURTHER RESOLVED that the authorization for increase and decrease of
securities shall be subject to the approval of the Receiver of Taxes.
COUNCILMAN TOWNSEND: This is a decision that the Receiver of Taxes
made, because of ease of bookkeeping, and since is at her discretion, we
are passing this resolution authorizing the securities to be deposited in
that bank.

SUPERVISOR COCHRAN: Number 11 we are holding. It's a resolution on
purchasing computers for Town Hall. We're going to get more information
before we make any decision in this direction.

12.-SUPERVISOR'S APPOINTMENT
Supervisor Jean W. Cochran hereby rescinds her appointment of
Leander Glover, Jr. as , her Fire Coordinator for Disaster Preparedness
for the Town of Southold, and hereby appoints Norman A. Reilly as Fire
Coordinator, effective immediately through December 31, 1996.
SUPERVISOR COCHRAN: After the appointment of Mr. Glover we were
notified that he was not an' active fireman, so he has to be relieved of
the duty, and they have recommended Norm Reilly to do' the job.
13.-Moved by Councilman Moore, seconded by Councilwoman Oliva, it was
RESOLVED that the Town Board of the Town of Southold hereby
authorizes and directs Supervisor Jean W. Cochran to execute an
Archival Records grant application to The State Education Department. The
State Archives and Records Administration, under the Local Government
Records Management Improvement Fund . grant program, for the Town
Clerk's Records Management Program.

14.-Moved by Justice Evans, seconded by Councilwoman Hussie, it was
RESOLVED that the Town Board of the Town of Southold hereby
authorizes the Town Clerk to advertise for bids for the purchase of one
(1) new Ford LN8000 Swenson Model A.P.B. Combination Dump Body
Spreader' (or equal) for the Superintendent of Highways.

RESOLVED that the Town Board of the Town of Southold hereby accepts
the resignation of Marvin Knight, Home Health Aide for the Human
Resource Center, effective January 25, 1996.

16.-Moved by Councilwoman Oliva, seconded by Councilman Moore, it was
RESOLVED that the Town Board of the Town of Southold hereby
increases from $15.00 to $20.00 the charge for a check which is returned
as unpaid or dishonored for insufficient funds, all in accordance with
Section 85 of the General Municipal 'Law.

part of the Boy_ Scout family for a long time. We wish you Happy

COUNCILMAN ',MOORE: Thank you. That uniform didn't fit when I made
my Eagle Code of Honor. The sleeves were short, and the pants were
snug, but, anyway, thank you.

recognizes today, Thursday, February 8, 1996, as SCOUTING
ANNIVERSARY DAY,in recognition of the establishment of the Boy Scouts
of America on this day in the year 1910.

arbitrators in police interest arbitrations strongly consider the local
government's ability to pay and the eventual impact said award would have
on local taxes. This type of alteration to the existing state labor law
would better balance the bargaining power of the respective parties to a
police/fire collective bargaining agreement and might result in more
equitable settlements.

It is our goal to provide every employee a place of employment free from
recognized hazards which are a potential cause for serious physical harm

Coordinator under the Southold Town Loss Control Program, and his

- report to the Town Board the extent of employee injuries and
progress on the loss control program;
- attend all executive safety committee meetings; prepare agendas
and maintain minutes;
- maintain records of injuries and milestones in the implementation
of the loss control program;
review reports provided by PERMA claims administration and
loss
control staff, meet with PERMA as needed; and
work with PERMA loss control staff to develop training programs
for supervisors and employees.
COUNCILMAN MOORE: I'll just explain what we're doing here. This
statement of policy, that we did before, and this resolution deals with an
ability to keep our insurance premiums down. By setting up an in house
loss control program of. assessing what our injuries are, and trying to
address them, and prevent them in the future, we can keep our insurance
premiums down by a third. We presently have the lowest we can possible
have, and by putting this in place we can keep them at that level. That's
what this is all about.
SUPERVISOR COCHRAN: Number 30 relates to it also. That's the
committee that will be functioning with John.

"Initiative E Referendum" to put on the ballot a proposition that would
require future use of the Suffolk County Pine Barrens Reserve Fund
under the "Clean Drinking Water Protection Program" to be used
exclusively for land acquisition in the Pine Barrens.
COUNCILMAN TOWNSEND': This . is in regard to the Suffolk County
Legislature using twenty-four plus million dollars of the Pine Barrens
acquisition fund for the balance of the budget amendment. We don't feel
that represents a good trend, or use of that money that voters voted in
for that purpose. Consequently, we put this resolution on.
SUPERVISOR COCHRAN: There's a loophole in the law, and with the
support, and this referendum being put through, it will close that
loophole, so that funds will be spent in the manner in which they were
allocated.

SUPERVISOR COCHRAN: That's the end of our resolutions for this
evening. You now have the opportunity to address the Board on any given
subject. Is there anyone who would like to address the Board on any
given subject? Is there anyone that would like to address the Board?
FRANK CARLIN: I have two I'd like to speak on. I'll speak on one,
and then I'll come back. Good evening, ladies and gentleman of the Board.
My name is Frank Carlin. I know this happened, Madame Supervisor, on
another watch, so I'm going to ask you these questions, but perhaps
somebody else on the Board can give u.s an answer. About six months ago
the First Baptist Church on Route 48 requested a little bit of property
from Southold Town, a quarter acre of land there. Can you tell me what
has been done, or what's going to be done to help these people out, so
that maybe they can have that piece of property, or what?
SUPERVISOR COCHRAN: Yes, the Town isn't giving the property away,
but we are giving them an easement across the property. I believe
they're paying $500.00 for it.
COUNCILWOMAN OLIVA: With an option to buy, I think, then later.
SUPERVISOR COCHRAN: They would have the first option to buy.
FRANK CARLIN: It's going to help them, right? I mean, they're going
to do what they want to. do, and start moving. That's what I want to
see. The Town Attorney and myself have sat with Reverend Fulford.
FRANK CARLIN: That's good, because it was already five months, and I
feel that should have been done way before now.
SUPERVISOR COCHRAN: Laury, do you want to clarify any of this?
TOWN ATTORNEY DOWD: We've had the papers ready for them to sign
for awhile, but Reverend Fulford is still working on his negotiations
with the other party, and he's held up signing the papers.
FRANK CARLIN: What other party?
TOWN ATTORNEY DOWD: The .other party, that's selling them the land
that the church is going to on.
VINCENT TIRELLI, JR. : My name is Vincent Tirelli, Jr., President
of Southold Town P.B.A. I notice, once again, we have no motion on
hiring. Two weeks ago I addressed you. The further we go, I got a
feeling we're not going to make that academy class, if you take anybody in
now. Sunday afternoon you all know we had a major incident in
Mattituck. A gentleman was shot four times by another gentleman, who
then left the area. I happened to be working that day. There were four
officers on duty, and a Sergeant,. as well as a Detective Sergeant.
Luckily, the Detective Sergeant was in the area, backed up the first
responding unit. I was the third or fourth. If that had turned into a more
major, if the subject barricaded himself, or if he decided he was going to
take a few shots at us, we didn't have a chance. The area was big to
cover. We were lucky, it was a Sunday afternoon. It was very cold.
People decided to stay home pretty much. We had a few rubber peckers
come out, and look. We don't have the manpower to handle a situation
like that. It is a typical argument against using seasonals, instead of
hiring full-time officers, because it was February. If it had happened in
the middle of the summer, okay, fine, you've got your seasonals there.
This happened in February. The seasonals would not even come into play.
The argument is, we never know- what's going to happen. We have to be
prepared for the worse at all times. Yeah, granted there are times, when
you're going to look out; you're going to see five officers on the road,
maybe six officers on the road. Hopefully, I'd like to see seven. Then
say, gee, there's a lot of cops out there. Yeah, there are, and it
prevents a lot of stuff 'from going on, just our presence. We were lucky
Sunday. Nobody got hurt, other than the people who were involved. None
of ours got hurt. I am very concerned that one of our people are going
to get hurt due to lack of backing, and I really, really can't stress
enough the fact that we need people out there, and it's getting worse,
and I don't know if you're going to make that March class if you go

beyond the
remainder of . what's on the Greenport list. I know there's a stumbling
block, and you're working to get around it. What I'm asking is the people
who are becoming the stumbling block to reconsider. I mean, you're not
going to get over that block. You have to go through it, or work around
it. You already know what you can, .or can't do, and you know, you can't
sit on this for three years until the list expires. That's ridiculous.

SUPERVISOR COCHRAN: Thank you,;. •Officer Tirelli. I will putting this
on for discussion ,at the next Board meeting, and hopefully a decision will
be made one way or the other. Thank you. Mr. Carlin?
FRANK CARLIN: . Once .again, Frank Carlin. On the November 14th
agenda, Town Board , meeting, resolution #6 was voted 'on to receive
$75,000 from C.O.,
P.S. towards the hiring of Police Officers. It was on the
agenda, resolution #6, accepting C.O.P.S., which is Community Orienting
Police Service. About $75,000 to . fund for one new police officer. It was
voted on, I believe, and was voted, yes, on. I understand, also, that in
this budget this was included to hire five new police officers in this
budget for this year. Now, since we took over Greenport Police
Department, we put the key in the door on 'November 17th at' 3:00 P.M. ,
at the Police Headquarters. We took that Police Department close to
fifteen, sixteen months now. The overtime went up to about. .even more,
but I'm going to give you the benefit of the doubt, of 12,500 hours of
overtime, that Southold Police had to work. I'm giving the benefit of the
doubt. I'm sure there's more. Figure that out at an average of $40.00 an
hour for time and a half. Maybe I'm a little bit high. Maybe I'm a little
bit low, but it comes in my school to a half a million dollars. Does it
make sense to pay that kind" of money out, rather than hire policeman?
It's been a proven fact, ladies and gentlemen of the Board, that an
employee that works over, eight hours a day loses his efficiency. There's
times when these police officers come home, and they sit down for supper,
two, or three hours, then zoom, you have to come back, because a man
called in sick. That isn't any way to work a Police Department. We're
going down, in of, going up: We have 24, in 1990, we had 42. Now,
we come-to 124, we're down to 17. We're going the opposite Way, that the
way we- should. be going. It just doesn't make sense. Now, what is the
problem? Well-, :We all know what the problem is, the Civil Service list for
one man. What are we going to do here? Before I continue on, I want to
say one thing to straighten it out. I'd like to say this before I get
started. I was accused last year, or recently, of being an effective
mouthpiece for the Republicans. Not so. I speak my mind, and I say the
facts the' way they are, and I call the shots the way I see them, and I
want that to understood right now.
SUPERVISOR COCHRAN: It's on the record.
FRANK CARLIN: This here, one man, and I mention his name, Eric
Heins, well,. if I was up on that Board, knowing their records, knowing
the history here, this would have been resolved a long time ago. I would
have solved the problem, and hired my cops. I would have hired the guy.
Last year the Town Board hired an attorney, which in turn hired an
investigator. You all know :his. To investigate this man, and he came up
with nothing but positive issues. . The Grand Jury found. nothing against
him, sealed the records.. The way I look at it, the man is innocent until
proven guilty, not like in England, where it's the opposite. What was the
big deal, we tie this thing up for fifteen months? The Police Department
is going down, and down, and down, because something in this machine
here doesn't want to work right. Take the pencil, get a resolution, vote
on it, hire the guy, and let's get on with it, and give the people proper
police protection, because I'll tell you what. If we do make the March
deadline, it takes six months. You won't see another cop here before next
September. We had the opportunity to hire certified police officers back
in '95 in February, but two of them went with Southampton. They're
working over in Southampton. We didn't even have to send any to the
academy, and spend the taxpayers' money. We had a chance to hire two of
them right there, and they went over there. They got hired over there.
Southampton is happy with them, and they're happy with their jobs over
there. It's awful. I want to tell you a story. I've lived in this town for
forty-two years. I can tell you a lot of stories about this town. I know

quite a bit of what goes on. I didn't just move out here from the city,
and want everything my way. I lived in this town for forty-two years,
and I know a lot of things, and I've been to Board meetings here for
about fifteen years. Back in 1970, there was a police officer, Southold
police officer, I'm not going to mention his name, was called to a dispute
on Cox Neck Lane. At the time they had a labor camp down at the north
end of it. He was called to respond. This is a true story. He responded
to that. When he got there, they ganged up on him. He was in trouble,
but luck would have it,' that before he arrived he called for backup. At
that time, we had sufficient amount of ,police. Two or three cops, and he
survived, because it's a proven fact. I come from a family of police
officers, about eight of . them, so I hear all kind of stories. If you call
on a dispute, if they see one cop, they get brave, but if they see more
than one cop coming, they start backing off. See what I'm talking about,
the averages, how it works here. This is a true story. This man could
have been injured, he could have been killed, but he had his backup, and
he called before he got there, and they arrived, and they saved him. I
mentioned that once before. That's a true story. I won't mention the man's
name. I have reasons for that. So, ladies and gentlemen of the Board,
ask you, what are we going to do here? It's been fifteen months. We're
playing with Russian roulette. Like Vinnie said, if somebody gets hurt
from no backup, and I hope it never happens, will our conscious be right?
Will we say to ourselves, well, maybe, we should have acted before now?
As far as I'm concerned, I'll say again, innocent until proven guilty,
hire this man, put a resolution up' there. Let's get on with it, at least
vote for it, and hire the rest of the police officers. We've got enough
for five. Let's get on with it. Fifteen month, my Cod. Riverhead has got
about 83 police officers almost, I believe, and we've got from 24 down to
17, and probably next year, if I stand here this Board will be down to 10
the rate we're going. I respect all the fire departments in Southold. I'm
not running for no office, because nobody wants a guy like me in there,
that says what he wants to say, but I praise all the fire departments in
Southold town, and I praise the Police Department in Southold town, and
again, I'm not looking for no Brownie points here, because you know
why? I'll tell you, we all just keep this in our minds, that when we're
in trouble, all of you, all of us, all 20,000 of us in Southold Town, we
know how to call 911, and they're there. My scanner goes off at home, the
whistle blows the Mattituck Fire Department, I hear those sirens blowing I
don't think it's a minute, I hear sirens blowing on the road, So,
respect both, the Police Department, and the Fire Department, but again,
I say, fifteen months, how long can this thing go on for just one man,
that stands in the way here for no reason at all, in my opinion? Maybe
I'm wrong, but I review facts, and I .come to the conclusion that there is
no reason why we can't hire this man, and get it over with. Maybe some
of us don't want to admit they might be wrong.
SUPERVISOR COCHRAN: Frank, I'd like to thank you for your words,
and as I said earlier I will be putting it on the agenda for next Board
meeting, and the Work Session. As the saying goes, paint or get off the
ladder, and I think it time that the Town Board move on this issue one
way or another. Let's clean it up. Anyone else like, to address the Board?

COUNCILWOMAN OLIVA: Yes. We're having an Anti-B`ias Task Force
meeting next Thursday at 10:00 o'clock. I believe that's the 15th. I
would urge anybody that would like to get involved with this committee to,
please, come and join us. We have some exciting things planned for our
Education and Social Interaction Committee, and anybody that would care
to join us, and aid us, we would be most happy to have you. So, it's next
Thursday at 10:00 A.M. We would be pleased to see all of you. Thank you.
SUPERVISOR COCHRAN: Councilman .Townsend?
COUNCILMAN TOWNSEND: Yes, I have a couple of things. We had a
Planning and Zoning Committee meeting, and we are trying to bring
everybody up to speed, :and we're going to be meeting next week to
continue that process over some, changes to the Code, business uses in
various commercial districts.
SUPERVISOR COCHRAN: Do you have a date for that meeting?
COUNCILMAN TOWNSEND: Yes, I think it's next Tuesday at 3:30.
Second, I'd like to address some of the comments that were made tonight.
I understand that the Town needs policemen. We wouldn't have put five
people in the budget if we didn't, and I'm concerned that we haven't been
able to do that. But, I'd like to point out that we had no way of knowing
that the hearing we requested on the officer, that people have referred to
would be delayed to this degree. As it stands now, there will be a
decision coming at the end of this month. There were some serious
allegations made in the press. I'll' emphasis ' that they are allegations.
Nothing has ever been proven. However, I feel that we have to reserve
control, and we should have a hearing on this issue. Civil Service has
said, that they will have' a hearing, and that's where it stands now.
We're still waiting . to have the hearing. If it is their decision that he
is to remain on the list, then we will all vote to hire him. If it's a
decision, he'll be removed, then we won't, we'll go to the next person on
the preferred list. It's a two way street. We haven't discussed it in
great detail, but the proposed officer in question could allow us to
reserve a place on the list for him, and let us hire. Civil Service has
told us that, and I for one, would certainly be willing to reserve a
place, and reserve back pay for this officer, if he would do that. It
would be a service to the town. But, since that has not been the case we
have not been able to hire. So, there are other things that can be done,
and I hope to discuss it next week in Executive Session. It's not as
simple as been said. We do need police, but we also have to have control
over personnel. That's all I have to say.
SUPERVISOR COCHRAN: Once again, I would like to congratulate the Boy
Scouts on their anniversary. I had the pleasure to attend a Blue and Cold
Dinner for Pack 39, Mattituck on Sunday, and they were honoring Russell
Nine, who has been involved in scouting for 45 years, and he has served
as a District Commissioner, and Unit Commissioner, and Cub Master, and
Scout Master, and he's pretty known as Mr. Boy Scout in Mattituck Town,
and he deserved the honor one hundred times over. He was very emotional
about it, and it was long overdue. Also, our Peconic County meeting, we
had a good turnout. We had about 170 people attend. It's being shown on
the TV. There is a three page summary, which would be important for
everybody to read, so that you can make an informed decision, when it
comes time to vote on it. That can be picked up in my office here in Town
Hall for anyone that would like a synopsis of information, rather than
reading the 200 page book. Frank, before we close, I see your hand up
in the air once more, and you'll notice, .Frank, that I haven't said you
only have five minutes.
FRANK CARLIN: I was just going to say that. You haven't used the
timer, and I respect you for that very much.
SUPERVISOR COCHRAN: I always believed that if someone had something
to say, they should be allowed to say it, and if we sit here a half of
hour, we sit here a half hour, because I don't want to see any resident of
Southold Town 'leave a Town Board meeting with still burning questions,
or burning complaints in their head, and in their heart, so don't take
advantage of it, Frank, but you're more than welcome to. .

FRANK CARLIN: I won't take advantage of ' it. I'll try and keep it as
short as I can, but try to get my point across sometimes it takes longer.
I'd like to say about Russell Nine. I've known him a long time. He did
very well for the Boy Scout. One thing here, I agree with what you're
saying, Joe, but it's been now fifteen months. This should have all been
taken care of before. (Tape change.)
VINCENT TIRELLI, SR. : The only thing I wanted to say is, most of
the people in town think like I do. If the only thing against this guy
would be adultery. .whichever, which is bad enough: They're all thinking
this is a joke. But, there seems to be a lot of other things, that the
reason people are so against this guy, and that's why we're all confused.
If it's only that issue, and that's the only issue we hear is this
incident with the desk, that we all laugh at, because if you hold
everybody to that standard, we're in trouble. So, there must be other
things, and everybody is guessing, and that's why so, you know, you say
we're waiting fifteen months just because this guy did what he did, and a
lot of us feel there has to be something else. That's why everything is
being held up. So, if you get any flack from the people, it's because they
only know that one thing, and they're going by that, and that's why
we're getting impatient. That's all. Thank you.
