was substantially constructed (renovated) according to the:
approved plans. We are also in receipt of the engineers
certlfxcatlo letter (dated July 6, 1993) lndlcat~ g that this
facility was constructed according to the approved plans, and the
U.L. Certificate for the electrical work perforated.
Having completed these requirements, it is th~ determination of
this office that the above referenced facility is approved.

Hay Harbor Club's wetland permit nu/nber 3807 has expired on
February 23, 1990 and will have to be extended by Board
Resolution prior to their commencing any activity on the site.
Our non-jurisdiction letter for the swimming pool and associated
equipment of June 25, 1992 refers only to that expansion. As
such they could be granted a permit for those activities.

This permit will expire two years from the date it is signed if
work has not commenced by said date. Fees must be paid, if
applicable, and permit issued within six months of the date of this
notification. Two inspections are required and the Trustees are to
be notified upon completion of said project.
Please return to the Building Department for a determination on
the need for any other, permits which may be required for thais project.
Please note this approval does not extend to bulkhead
replacement as this office never received any information on this.

The following action was taken by the Board of Town Trustees
during its regular meeting held on February 22, 1990 regarding the
above matter:
WHEREAS, Stephen Lupow on behalf of Hay Harbor Club applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated November
7, 1989 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on February 22, 1990 at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and 'documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT

with the ECL, all applicable regulations, the General Conditions specified (See Reverse Side) and any Special

9 That if future operation5 by the State of New York require an al-

if, in the opinion of the Department of Envkonmentai Conservation
it shall cause unreasonable obstruction to the free navigation of said
waters or flood flows or endanger the health, safety or welfare of
the people of the State, or cause loss or destruction of the natural

Any material dredged in the prosecution of the work herein permitted
shall be removed evenly, without leaving large refuse piles, ridges across
the bed of a waterway or floodplain or deep holes that may have a

herein authorized

SPECIALCONDITION$
1. A snow fence and staked hay bales must be placed at the seaward
edge of the existing building and along seaward edge of the
proposed pool deck complex upon commencement of the project and
remain, in place until project is completed.
24. Any debris or excess material from construction of this project
shall be completely removed from the adjacent area (upland) and
removed to an approved upland area for disposal. No debris is
permitted in tidal wetlands.
3. The storage of construction equipment and materials shall be
confined to within the project work site and/or upland areas
greater than 50 linear feet distant from the tidal wetland
boundary.
4. Prior to the ultimate expiration of this permit the permittee
will cause all fill and exposed faces to be vegetated to prevent
erosion.
5. Dry wells for pool filter backwash shall be located a minimum
of 100' landward o the tidal wetland boundary.
6. There will be no draining of swimming pool water directly or
indirectly into tidal wetlands.

without further approval of the Department.
8. There shall be no disturbance to vegetated tidal wetlands as a
result of the permitted activity.~
9. Equipment operation below mean high water is strictly
prohibited.
10. No fill is authorized for this project.
11. The sanitary system must be constructed a minimum of 2.5' above
seasonal high groundwater.
12. There shall be no disturbance to vegetation or topography
seaward of existing tennis courts and/or existing building.

SUPPLEMENTARY SPECIAL CONDITIONS
following conditions apply to all permits:
If any of the permit conditions are nnclear,the permJttee shall con-
tact the Division of Regulatory Affairs at the address and telephone
noted below.
A copy of this permit w[~h supplementary conditions and approved
plans shall be available at the project site whenever authorized
work is in progress.
The permit sign enclosed with the permit or a copy of letter of
approval shall be protected from the weather and posted in a con-
spicuous location at the work site until completion of authorized work.
At least 48 hours prior to commencement of the project, the permittee
shall complete and return the top portion of the enclosed receipt fort,
certifying that he is fully aware of and understands all provisions ned
conditions of this permit, within one week of completion of the
permitted work, the bottom portion of that form shall also be com-
pleted and returned.
For projects involving activities to be accomplished over a period of
more than one year, the permittee shall notify the Regional Permit
Administrator itl writing at least 48 hours prior to the co~]encement
of resumption of work each year.
If project design modifications take place after permit issuance, the
permittee shall submit the appropriate pIan changes for approval by
the Regional Permit Administrator prior to undertaking any such modi-
fications. The permittee is advised that substantial modification
may require submission of a new application for permit.
Ail necessary precautions shall be taken to preclude contamination of
any wetlands or waterway by suspended solids, sediment, fuels,
so].vents, lubricants, epoxy coatings, paints, concrete, leacbate or
any other environmentally deleterious materials associated with the
project work.
Any failure to comply precisely with all of the terms and conditions
of this permit, unless authorized itl writing, shall be treated as a
violation of the Environmental Conservation Law.
The permittee is advised to obtaie any permits or approvals that may
be required from the U.S. Department Of Army Corps of Engineers, NY
District, 26 Federal Plaza, New York, NY 10278, (Attention: Regulatory
Functions Branch), prior to commencement of work authorized herein.
The granting of this permit does not relieve the permittee of the
responsibility of obtaining a grant, easement, or other necessary
approval from the Division of Land Utilization, Office of General
Services, Tower Building, Empire State Plaza, Albany, NY 12242, which
may be required for any escroachment upou.State-owned lands underwater.
