The meeting was called to order at 3: 00 P.M. with the following present: Supervisor Albertson; Supt. of Highways Price; Justice Clark; Councilmen Demarest and Grathwhohl; Town Attorney Tasker and Town Clerk Richmond. Moved by Justice Clark; . seconded by Councilman Demarest; RESOLVED: That the minutes of the meeting of Sept. 26, 1961, be and they . hereby are duly approved. Grathwohl; WHEREAS, a petition was received from Kenneth G. Brown, President of K. G. Brown Mfg. Co. , Inc. requesting a change of zone of certain property situ- ated in Mattituck and more .fully. described in .said petition from "A" Resid- ential and Asriculural District to "B" Business District, NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of Southold be and he hereby is directed to transmit said petition to the Planning Board in .accordance with Section .901, of Article IX of the Building Zone Ordinance of the Town of Southold, Suffolk County, New York. Moved by Councilman Grathwohl; seconded by Councilman Demarest; RESOLVED: .That the Town Clerk be and he hereby is directed to request the Long Island Lighting Company to install one (1) 100 cp aerial street light on LILCO poles#3 on Mary' s Road, Mattituck, in -the Mattituck Light 'Dist. #1. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwbhl; Justice dark. Moved by Justice Clark; seconded by Councilman Grathwohl; WHERAS, the annual budget for the current fiscal year includes an approp- riation in the amount of $7500.00 for Parks, Beaches-other expense #44-30, and WHEREAS, of such sum appropriation $1624.68 remains unexpended to date, and WHEREAS, after due allowance for outstanding claims and further expend- itures chargeable against such appropriation or accou-ht there is an un- expended balance in said appropriation or account, of $1624.68, NOW, THEREFORE, BE IT RESOLVED: That $194.75 of said_. unexpended balance be and the same hereby is transferred to Parks, Beaches-personal services #44-10 and that .the amount heretofore appropriated for said purpose be and the same hereby is increased in the amount of $194.75 . Moved by Justice Clark;, seconded by Councilman Grathwohl; WHEREAS, the Burton Potter Post #185 American Legion -has applied to the Town Clerk for a Bingo License and WHEREAS, the Town Board has examined the application and after investig- ating the matter duly made findings and determinations as required by law, NOW, THEREFORE, BE IT RESOLVED: That the Supervisor be and hereby is authorized and directed to execute on behalf of the Board the findings and determinations required by law and be it further RESOLVED: That bhe Town Clerk be and he hereby is directed to issue a Bingo License to the Burton Potter Post #185 American Legion. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; Justice Clark. Moved by Justice Clark; seconded by Councilman Grathwohl; RESOLVED: That General Bills in the amount of $2390.27; Lighting District Bills in the amount of $2, 186.35; and Fishers Island Ferry District Bills in the amount of $12, 513 .46 be and the same are hereby ordered paid. Moved by Justice Clark; seconded by Councilman Grathwohl; RESOLVED: That the meeting of the Town Board be and the same hereby is recedssed at 3:40 P.M. to inspect trailer application sites. Vote of Town Board: Ayes-Supervisor Albertson;. Founcilmen Demarest and Grathwohl; Justice Clark. The Town Board reconvened at 8:30 P.M. at the Supervisor ' s Office, Greenport. Moved by Councilman Demarest; seconded by Justice Clark; WHEREAS, Edward Donahue, Raymond W. Donahue, Reginald S. Donahue, Clement B. Donahue and Edward •Meyer, Southold, N.Y.by petition verified the 24th day of August, 1961, petitioned the Town Board for a change of zone of certain real property described in said petition from "A" Residential and Agricultural District to "B" Business District, and WHEREAS, the Town Board pursuant to due notice thereof held a hearing thereon on Oct. 10, 1961, at which time all interested persond were given an opportunity to be heard, 'minutes of which were recorded by Judith .Boken, NOW, THEREFORE, BE IT RESOLVED: That the Southold Town Building Zone Ordinance including the Building Zone Maps be amended by changing from "A" Residential and Agricultural District to "B" Business District the following described property: ALL that certain tract or parcel of land situated at Southold in the Town of Southold Suffolk County, New York, and more fully bounded and des- cribed as follows: BEGINNING at a point marked by a granite monument set at the point of intersection of the northwesterly line of Middle Road with the northeasterly line of Kenny' s Road; running thence along said line of Kenny' s Road, North 41057150" West a distance of 220.62 feet to an iron -pipe; thence on a line at right angles .to said line of Kenny' s Road, �North 48002110" East a distanee of 131.30 feet to an iron pipe; thence along land of the party of the first part and along land of Edward Doaahue, South 42005' 50" East a distance of 200.0 feet to an :iron pipe set on said northwesterly line of Middle Road; thence along said lin :eof:.-Middle Road, South 39008'40" West a distance of 133 .38 feet to the point -of- beginning. Moved by Councilman Demarest; seconded by Justice Clark; RESOLVED: That the application of Minnie and Carl Frelex for a permit to locate a single trailer on property of Herman Hubbard, Mattituck, N.Y. be and hereby is denied on grounds that proposed location is insufficient inn area, and BE IT RESOLVED:. That the fee of $5 .00 which accompanied the application be returned/ Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; Jusice Clark. A letter was receivdd from John W. Mackey in reference to lease of certain property in New Suffolk. This matter will be considered and acted upon at a future date. A letter was receivedt;from residents on Mary' s Road, Mattituck, requesting a light on Pole #3, Mattituck. This request was granted. Supervisor Albertson repomted to the Board that a survey of street lighting on Bailey Ave . , Greenport, and Bray Ave. , Mattituck had been received and a copy of same has been forwarded to the representatives of their area for .consideration. A letter was received from Fred. W. Baker concerning erosion on Peconic Bay' in the Mattituck area.. This matter will be brought .to the attention of the Dept. of Public Works, County of Suffolk. Moved by Councilman Demarest; seconded. by Justice Clark; RESOLUTION OF TOWN BOARD APPROVING PRELIMINARY .. BUDGET AND CALLING PUBLIC HEARING THEREON RESOLVED:,,-.-,,That this Town Board does hereby prepare and approve as the pre- liminary budget of this. Town for the fiscal year beginning on- the.- 1-st day of January, 1962 the itemized statement of estimated revenues and expendit- ures hereto attached and made a part of this resolution, and be it FURTHER RESOLVED: That such preliminary budget shall be filed in the office of the Town Clerk where it shall be available for inspection by any interest- ed person at all .reasonable hours, and be it further resolved; That this board shall meet at 3:30 o' clock P.M. on the .9th day of November, 1961, for the purpose of holding a public hearing upon such preliminary budget, and be it FURTHER RESOLVED: That the Town Clerk give notice of such hearing in the manner provided in Section 113 of the Towh`,Law, and that such notice be published in substantially the following form:- NOTICE OF HEARING UPON PRELIMINARY BUDGET Notice is hereby given that the preliminary. budget of the Town of Southold, Suffolk county, New York, for the fiscal year beginning January lst', 1962, has been completed and filed in the office of the Town Clerk at Southold, New York, where it is available for inspection by any interested person at all .reasonable hours.
