ORGANIZATION MEETING JANEiARY 3, 1961
The Southold Town Board met at the office of Supervisor Lester M. Albert-=
son at Greenport, New York; on Tuesday, January 3, 1961. The meeting was
called to order at 1: 30 P.M. with the following present: Supervisor
'Albertson; Councilman Demarest; Justices Tuthill and Clark; Supt. of
Highways Price; Town Attorney Tasker and Town Clerk Richmrn d.

RESOLVED: That the minutes of the Special meeting of December 15, 1960, .
be and hereby are duly approved as read.
Vote of Town Board: Ayes-Supervisor Albertson; Councilman Demarest;

WHEREAS, It is required by Section 27, Subdivision 1 of the Town Law
that the Town Board fix the salaries of all Town elected officers at an
amount not in excess of the amounts respectfully specified in the notice
of hearing on the preliminary budget, published pursuant to. Section 113
of the Town Law, now therefore be it
RESOLVED: That the salaries of the following town elected officers be
and hereby are fixed at the following amounts:

WHEREAS, It is required by Section 67, .Subdivision 1, of the Social Wel-
fare Law that the Town Board shall appoint a Public Welfare Officer or
authorize the Supervisor of the Town to act as such official, now there-
fore be it RESOLVED: That Lester M. Albertson, Super visor, be and:he
hereby is authorized to act as Public Welfare Officer at the pleasure
of the Town Board, and be it further
RESOLVED: That Lester M. Albertson serve in such capacity without com-
pensation and be it further.
RESOLVED, That the Town Clerk be instructed to file such certificate
with the proper parties as is required by Section 30, Subdivision 3,
of the Town Law.

WHEREAS, It is required by Section 148 of the Education Law that a local
Historian shall be appointed by the Supervisor of a town, and
WHEREAS, the Supervisor has appointed Wayland Jefferson to act as Town
Historian, now, therefore, be it
RESOLVED: That Wayland Jefferson be compensated while acting in such
capacity in the amount of Five Hundred Dollars ($500.00) per year, pay-
able in regular monthly payments, and be it further
RESOLVED: That the expenses incurred per year be the Town Historian in
the performance of his duties be paid by the Town in an amount not to
exceed One Hundred Fifty Dollars ($150.00) per year, and be it further
RESOLVED: That the Town Clerk be instructed t6 file such certificate
with the proper parties as is required by Section 30, Subdivision 3, o
of the Town Law.

WHEREAS, It is required 'that an enforcement officer be appointed for
the Multiple Resident Law and a Building Inspector be appointed for the
enforcement of the Building Zone Ordinance df the Town of Southold, now
therefore be it
RESOLVED, That Howard M. Terry be and he hereby is appointed enforcement
officer for both Multiple.' Resident and the said Building Zone Ordinance
for a term of one year, commencing January 1, 1961 and expiring December
31, 196i and be it further
RESOLVED: That the total salary for both positions be and hereby is
fixed at the sum of Five Thousand eight hundred dollars ($5,800.00) per
yearn payable in regular monthly payments during said term, and be it
further Resolved; That the Town Clerk be instructed to file such certif-
icate with the proper parties as is required by Section 30, Subdivision

RESOLVED: That Howard M. Terry, enforcement officer for the Multiple
Resident Law and Building Zone Ordinance, be compensated for travel
expense necessarily and actually incurred in carrying out the duties
of his office and that he be further compensated for the use of his
own automobile when used to carry out the duties of his office at a
rate not exceeding eight cents ($ .08) per mile. Demarest;

and Sergeant, be effective as of January 1, 1961, and be it further
RESOLVED, that the Town Clerk be instructed to file such certificate
with the proper parties as is required by Section 30, Subdivision 3, of
;the Town Law.

WHEREAS, Section 22b of the Town Law allows the Town Board of any Town
having more than one assessor to establish the office of Chairman of
town Assessors, who in addition to his regular duties shall perform
such services in connection with assessment and taxation of property
for state, county and town purposes as the Town Board shall direct,
now hherefore be it
RESOLVED that Albert Martocchia be and hereby is d6signated .to' hold the
office of Chairman of the Town Board of Assessors until the first day
of January next succeeding such designation, all in accordance with
Section 22b of the Town Law, and be it further
RESOLVED, that compensation for such appointment be fixed at $1, 500.00
per year, payable in regular monthly payments.

WHEREAS, It is required by Section 27, Subdivision 1, of the Town Law

That the salaries of the members of the Board of Appeals, Town of
Southold, be and hereby are . fixed at $750 .00 per year �iath the exception
of the Chairman of the Board of Appeals whose salary/he, lland hereby is
fixed at $800.00 per year, and be it further
RESOLVED, That the members of the Board of Appeals and the Chairman
of the Board of Appeals be paid these salaries for their respective
offices and that these salaries be paid in regular monthly payments,'
and be it further
RESOLVED, That the Town Clerk be instructed to file such certificates
with the proper parties as is required by Section 30 Subdivision 3
of the Town Law.

WHEREAS, It is required by Section 27, Subdivision 1, of, the Town Law
that the Town Board fix the salaries of all town appointed officers
or employees, now therefore be it
RESOLVED: That the salaries of the members of the Planning Board Town
of Southold, be and hereby are fixed at $500.00 per year, with the
exception of the Chairman of the Planning oard, whose salary shall be
and hereby is fixed at $600.00 per year, and be it further
RESOLVED, That the members of the Planning Board and the Chairman of
the Planning Board be paid these salaries for their respective offices,
and that these salaries be paid in regular monthly payments, and be it
further
RESOLVED, That the Town Clerk be instructed to file such certificate
with the proper parties as is required by Section 30, Subdivision 3
of the Town Law.

RESOLVED, That all of the foregoing salaries, except Police Patrolmen
(Constables) and Watchmen be effective as of January 1, 1961.

WHEREAS, Section 64 of the Town L w requires the Town Board to designate
-by resolution banks in this States in which the Supervisor or any other
officer of the Town shall deposit all monies coming into their hands
by virtue of their offices, and
WHEREAS, The Town Board may require any Bank so designated to deposit
with such Board the Bonds or certificates of the United States, of the
State of New York, or any Connty, Town, City, Village or School District
of the State of New York as security for such funds so deposited but
such bonds or certificates shall be subject to the approval of the` Town
Board and shall be deposited in such place and held under such conditions
as the Town Board may determine, now therefore be it
RESOLVED, That the following banks of the Town be and hereby are desig-
nated as depositaries for all monies of the Town, and be it further
RESOLVED, That the amount of security herein set forth for each res-
pective bank be and hereby is approved:-

WHEREAS, Section 62 of the Town Law requires that every Town Board shall
meet on or after the 28th day of December, but not later than the 31st
day of December, in each year, and
WHEREAS, There is no other time specified by law when meetings of the
Town Board. of a Second Class Town shall be held, now therefore be it
RESOLVED, That the Supervisor be and hereis, empowered to call all meet-
ings o_f the Town Board as may be required for the best interest of the
Town, and be it further
RESOLVED, That the Supervisor -designate Tuedday as the day of the week
for calling. such' meetings, and be it further
RESOLVED: That each member of the Town Board be given at least 2 days
notice in advance of such meeting,, notice to contaim the time and place
where such meeting is to be held.

RESOLVED: That the Assessors of the Town of Southold who use their own
automobiles in the performance of their duties for the Town will be
compensated for the use of such automobiles in the amount ndt to exceed
eight cents ($ .08) per mile.

RESOLVED: That the Suffolk Times, Greenport, N.Y.- be and hereby is,
effective as of February 1, 1961, designated as the official news-
paper of the Town of Southold. to publish the notice of the Receiver of
Taxes thate.he.-.is;-oin-�rece'ipt.-.:of such tax and assessment roll and warrants;
and that the taxes and assessments therein may be paid to the Receiver
of Taxes . at the times and with penalty other than his principal , office
when and where he will attend for the receipt of taxes and assessments
in accordance with Section 22 of the Suffolk County Tax Act, and all
other legal notices as may be necessary and required in accordance
with Section 64, Subdivision 11 of the Town Law.

RESOLVED: That the Town Board hereby approves the action of the Supt.
of Highways in increasing the pay of the employees of the Highway
Department ten cents per hour as of January 1, 1961.

RESOLVED: That the Southold Town Supt. of Highways be and he hereby is
authorized to purchase . for the use of the Town, equipment, tools, snow-
plows and other implements 6and devices, without prior approval of the
Town Board of the Town of outhold, in an amount not to exceed Five
Hundred ($500.00) Dollars during the period January 1, 1961 to December

RESOLVED: That Ralph P. Cox of Mattituck, New York, be and he hereby is
appointed' Dog Warden for the 'Town of Southold, .including the Village of
Greenport, to serve at the pleasure of the Town Board, unless otherwise
provided by law, and be it further
RESOLVED, That Ralph P. Cox be compensated for such service at the rate
of_ $3000.00 per year payable in regular monthly payments.

RESOLVED, That the salary of Barbara Andrade, part time secretary to

RESOLVED, That Justice Ralph W. Tuthill be designated to represent the
Town of Southold at the annual meeting of the 'Association of Towns of
the State of New York to be held, in Buffalo, New. York, on Feb. 6, 7, 8,
1961 and to cast the vote of the aforesaid Town pursuant to Section 6 .
of Article' III of the Constitution and by-laws of said Association.

RESOLVED, That Supervisor Lester M. Albertson` be designated as Alternate
to cast the vote of said Town at. the annual meeting of the Association
of Towns 4f the State of New York to be held at Buffalo, New York, on
February 6, 7, 8, 1961 in the absence of Justice Ralph W. Tuthill .

RESOLVED: That the report of Ralph P. Cox, Dog Warden, for the month

WHEREAS, Southold Plannigg Board has prepared an official report and
recommendation upon the proposals to amend. the Building Zone Ordinance
of the Town of Southold, ' Suffolk County,, New York,
NOW, THEREFORE, BE IT RESOLVED, That a public hearing will be held by
the Southold Town Board at the Supervisor ' s Office, in Greenport, on
Tuesday, January 26, 1961, at 7:40 P.M. on the following proposed . ,
amendments to the Southold Town Building Zone Ordinance, including
the Building Zone Maps, to wit:
1. By amending Article I, Section 100, by adding thereto a new para-
graph, to be Paragraph 23B, to read as follows:
23B--TOURIST CAMP-- Any lot, piece or parcel of ground where
two or more tents, ,tent houses, camp cottages, house cars or house
trailers used as living or sleeping quarters are or may be located,
said camp being operated for or without compensation.
II. By amending Article IIIA, Section 350, by adding thereto a new
paragraph, to be Paragraph 4A, to read as follows:
4A. Tourist Camps, when approved as a .special exception by the
Board of Appeals as hereinafter provided.

WHEREAS, an application was heretofo;ce made by Rhoda S. Asch, et al,
to the Supreme Court of the State of New York, Suffolk County, to review
a decision of the Zoning Board of Appeals of the Town of Southold dated
August 8, 1960, granting a variance for the conversion of certain prem-
ises on State Street, Orient, New York, owned by Stephen Hornick, et ors,
to a two-family dwelling, said application having duly come on to be
heard on the 26th day of August', 1960, at Special Term, Part I, of said
Supreme Court at Riverbead•, County of. Suffolk, and said proceeding having
terminated in favor of Respondent Zoning Board of Appeals and the app-
lication of the petitioners having been denied and tl-e petition ,desmissed
by Order of Hon, L. Barron Hill, J. S.C. , dated November 4, 1960; and
WHEREAS, Petitioners Rhoda S. Asch, et al, have a.Epealed from said Order
to the Appellate -Division of the Supreme Court, S cond Judicial Depart-
ment, by notice of appeal dated November 26, .1960, and
WHEREAS, it is necessary that the Town Board authorize the Zoning Board
of Appeals to retain counsel for the purpose of representing- it upon
the aforesaid appeal,
NOW THEREFORE BE IT RESOLVED, That the Zoning Board of Appeals of the
Town .of Southold be and they hereby are authorized to retaim Josepli .J..
Snellenburg, II, Main Road, Southold,:. New York.;, as their attorney for' the
purpose of representing said Zoning Board of, Appeals upon the appeal
aforesaid, pursuant to Town Law, Section 65 .

WHEREAS, Southold Town Planning Board has prepared an official report
and recommendation upon the proposed change of zone from "A" Resident-
ial and Agricultural District to °B" Business District on- certain prop-
erty on Cox Neck Road and Middle Road, M�ttituck, New York,
NOW,, THEREFORE, BE IT RESOLVED: That a public hearing will be held by"'
the .Southold Town Board at the Supervisor' s Office, on Tuesday, Jan.
26, 1961, at 7:30 P.M. on the following proposed amendments to the
Building Zone Ordinance of the Town of Southold (including the Building
Zone Maps) to wit:-
By changing faom. "A" Residential and Agricultural District to "B
Business District the following described property:
ALL those certain bracts or parcels of-land, situate, lying and being
at Mattituck in the Town of Southold, County of. Suffolk and State of
New York, bounded and described as follows:
PARCEL I. Beginning at the intersection of the northerly. line of.
Sound Avenue with the westerly line of Cox Neck Road and running thence
westerly along the northerly line of Sound Avenue 450 feet; thence
Northerly at right angles to said line of Sound Avenue 350 feet, more

meeting shall be a legal charge against the Town.

WHEREAS,, Southold Town Planning Board has prepared an official report
and recommendation upon the petition of A. John Gada for a change of
zone from "A" Residential and Agricultural District to "C" Industrial
District on certain property on Fishers Island,
NOW, THEREFORE, BE IT RESOLVED: That a publid hearing will be held by
the Southold Town Board at the American Legion Hall on Tuesday, Jan. 24,
1961, at 1 P.M. on following proposed amendment to the Building Zone
Ordinance of the Town of Southold (including the Building Zone. Maps)
to wit:-
ALL that certain tract or parcel of land situateda ' at Fishers Island
in the Town of Southold, Suffolk County, New York, and more particularly
bounded and desribed as follows:-
Beginning at a brass plate on the westerly side of the roadway extend-
ing northerly from Whistler Avenue, said point. being on the dividing
line between the herein conveyed tract and land of the United States
Coast Guard known as the family quarters, tract and thence running
along the westerly-line of said roadway North 37 -degrees 06' West 82.20
feet; thence along said road line North 16 degrees 14' West 80.11 feet;
the along said road line North l degree 29' East 125 .3 feet; thence
Neisterly along ,said road line to land of the United States Coast Guard
known as the communications antenna site; thence northwesterly in' a
straight line to the shore of Fishers Island Sound, abutting North-
easterly on said Coast Guard land; thence in a general Southwesterly
direction along said shore line about 450 feet to the entrance of Silver
Eel Cove; thence along said Cove line in a Southeasterly, Northeasterly
and Southeasterly direction about 700 feet to said land known as the

WHEREAS, Chapter 68 of the Laws of 1856 as amended by Chapter 374 of
the Laws of 1898 authorize six assessors for the Town of Southold,
easch to be elected for a term of two years, and
WHEREAS, IT IS DESIRED TO. AMEND SAID PROVISIONS OF Law to authorize
the Town Board of-. the Town of Southold, at least 150 days prior to
any biennial Town election, to adopt a resolution subject to a per-
missive referendum, to change the term of office of assessors from
two years to four years, and
whereas, the Town Attorney of the Town of Southold has been requested
to draft an amendment to said provisions of Law to effect said purpose
and the Town Attorney has presented such an amendment to the Town
Board, .
NOW, THEREFORE, BE IT RESOLVED, that the Town Attorney be and he here-
by is authorized and directed to transmit said proposed amendment to
Assemblyman Perry B. Duryea for introduction in the 1961 session of
the New York State Legislature.

Mr. Patrick F. Gorman sent a letter to the Town Board as a represent-
ative' of the Southold Town Democratic Committee asking that the follow-
ing resolution be brought before the Town Board meeting.

WHEREAS, this Board, in fmlling the vacancy caused by the tragic
death of Supervisor Henry H. Tuthill, felt compelled by the county-
wide interests to appoint a Republican, and
WHREAS, at the last election the voters expressed a desire to have
representation from the Democratic party on the Board and tlhere now
exists a vacancy in the office of councilman caused by the resig-nation
of Supervisor Albertson, and
WHEREAS, this Board feels a sense of duty to the electorate warrants
consideration of an enrolled Democrat to fill the vacancy, it is
RESOLVED that this Board requests the Southold Town Democratic Comm-
ittee to submit to it a list of persons felt to be qualified for the
office of councilman for consideration to fill the existing vacancy.

Gentlemen:
On behalf of the Democratic Committee of Southold Town, we
respectfully request the enclosed resolution be brought before town
board meeting being held Jan. 3, 1961 at Pillage Hall Greenport, N.Y.
We are of the opinion that since you did not see fit to appoint
a Democrat to fill the unexpired term of Supervisor Henry Tuthill, you
sholld in the interest of good Government at this time request the
Democratic Party of Southold to submit one of their party to fill
vacancy in the office of "Councilman" !
I am sorry I cannot be present to present this resolution in person
as I must be at work.

The Supervisor asked if the Town Board desired to take any action of
the above resolution. Councilman Demarest suggested that it might be
advisable for the Southold Democnatic Town Committee submit a list
of persons they believed qualified for the offiee of Councilman. There
being no further action taken, the Supervisor thereupon passed onto
the next order of business.
