The permitted site or fpcility, including ~elevant i'ecords, is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Depa?tment) tO deterr~lne whether the permittee is complying with this permit and.the ECL. Such representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection by the DepArtment at all times at the project site. The Department reserves the right to modify, Suspend or revoke this permit when: a) the scope of the!permitted activity is exceeded.or a violation of any condition of the permit or provisions of the ECL and pertinent regulations is found; b) the permit was qbtained by misrepresentation or failure to disclose relevant facts; c) new material information is discovered; or . ' d) environmental c?nditions, relevant technology, or applicable law or regulation have materiallY changed since the permit was issued. 3. The permittee must su }mit a separate written application to the Department for renewal, modifica- tion or transfer of this )ermit. Such application must include any forms, fees or supplemental Infor- mation the Departmen requires. Any renewal, modification or transfer granted by the Department must be in writing. 4. The permittee must s ,bruit a renewal application at least: a) 180 days before E xplration of permits for State Polluta.nt Discharge Elimination System (SPDES) Hazardous Wast,? Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste Managem ~nt Facilities (SWMF); and b) 30 days before expiration Of all other permit types. 5. Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any order o~ determination previously issued by the Department or any of the terms, con- ditions or requiremen!s contained in such order or determination. Other Legal Obligations ofi Permlttee 6. The permittee has acc6pted expressly, by the execution of the application, the full legal responsibili- ty fo[_.a!l damages, direct or indirect, of whatever nature and by whomever suffered~arlsing out of the pro~ect described {n this permit and has agreed to indemnify and save harmless the State from suits, actions, damages and costs of every name and description resulting from this project. 7. This permit does not qonvey to the permlttee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the Impair- ment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit, i ' 8. The permittee is respohsible for obtaining any other permits, approvals, lands, easements and rights- of-way that may be required for this project. That if future operations by the State of New York require an feratlon in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation 13. it shall cause unreasonable obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the Department to remove or alter the structural work, obstructions, or hazards caused 14. thereby without expense to the State, and if, upon the expirabon or revocation of this permit, the structure, fill excavation, or other 15 modification of the watercourse hereby authorized shall not be com- pleted, the owners, shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove ali or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse, No claim shall be made against the State of New York on account of any such removal or alteration. 16. q0 That the State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage. 11 Granting of this permit does not relieve the applicant of the responsi- bility of obtaining any other permission, consent or approval from 18 the U S. Any material dredged in the prosecution of the work herein permitted shall be removed evenly, without leaving large refuse piles, ridges across the bed of ~ waterway or floodplain or deep holes that may have a tendency to cause damage to navigable channels or to the banks of a waterway. There shall be no unreasonable interference w~th navigation by the work herein authorized. If upon the expiration or revocaUon of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove ali or any porUon of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. If granted under 6 NYCRR Part 608, the NYS Department of Environ- mental Conservation hereby certifies that the subject proJect will not contravene effluent limitations or other limitations or standards under Sections 301,302, 303, 306 and 307 of the Clean Water Act of 1977 (PL 95-217) provided that all of the conditions listed hereto are met All activities authorized by this permit must be in strict conformance with the approved plans submitted bV the applicant or his agent as part of the permit application. Such approved plans were prepared ,by Land Oge Co. 4/]/91, NYSDEC approved on3/3/92 . SPECIAL CONDITIONS 1. Any debris or excess material from construction of this project shall be completely removed from the adjacent area (upland) and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands or protected buffer area. 2. The storage of construction equipment and materials shall be confined to within the project work site landward of the approved retaining wall. 3. Prior to the ultimate expiration of this permit the permittee will cause all fill and exposed faces to be vegetated to prevent erosion. 4. A row of staked haybales shall be placed directly seaward of the approved retaining wall location. 5. Driveway and parking areas shall be constructed of pervious material. 6. Roof runoff shall be directed to drywells a minimum of 40 feet landward of the retaining wall. Tidal Wetlands 7. Ail fill shall consist of "clean" gravel and soil (not asphalt, slag, flyash, broken concrete or demolitsion debris). 8. There shall be no disturbance to vegetated tidal wetlands as a result of the permitted activity. 9. Ail repairs to existing structures shall be confined to replacement of existing structural elements with no change in design, dimension, or materials, unless specifica!!y authorized herein. 10. To protect the values of the tidal wetland, a pe'r'manent vegetative buffer area must be established in the area between the approved retaining wall and the tidal wetland line as shown on the approved plan. There shall be no disturbance to topography in this area and no fill shall be placed seaward of the approved retaining wall. This area may be planted with Bayberry (Myrica pensylvanica), Beech Plum (Prunus maritima) and Rugosa Rose (Rosa ru~osa) on 6 foot centers. Once plantings are installed there shall be no mowing or other disturbance to vegetation in this area or use of fertilizers or irrigation equipment. 11. Vegetation planted within the area 30 feet landward of the approved retaining wall must be drought resistant species of grasses or shrubs which do not require use of fertilizers. No use of fertilizers or irrigation equipment is permitted in this area. 12. Construction of the retaining wall must be completed prior to placement of fill behind it. 13. The permittee may construct one 4 foot wide wooden stairway down the face of the retaining wall, and maintain one 4 foot wide path for access to the existing pier. The A. following conditions apply to all permits: If any of the permit conditions are unclear,the permittee shall con- tact the Division of Regulatory Affairs at the address and telephone noted below. A copy of this permit with supplementary conditions and approved plans shall be available at the project site whenever authorized work is in progress. The permit sign enclosed with the permit or a copy of letter of approval shall be protected from the weather and posted in a con- spicuous location at the work site until completion of authorized work. At least 48 hours prior, to commencement of the project, the permittee shall complete and return the top portion of the enclosed receipt form certifying that he is fully aware of and understands all p~ovisions and conditions of this permit. Within one week of completion of the permitted work, the bottom portion of that form shall also be com- pleted and returned. For projects involving activities to be accomplished over a period of more than one year, the permittee shall notify the Regional Permit Administrator in writing at least 48 hours prior to the commencement of resumption of work each year. If project design modifications take place after permit issuance, the permittee shall submit the appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such modi- fications. The permittee is advised that substantial modification may require submission of a new application for permit. Ail necessary precautions shall be taken to preclude contamination of any wetlands or waterway by suspended solids, sediment, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project work. Any failure to comply precisely with all of the terms and conditions of this permit, unless authorized in writing, shall be treated as a violation of the Environmental Conservation Law. The permittee is advised to obtain any permits or approvals that may be required from the U.S. Department of Army Corps of Engineers, NY District, 26 Federal Plaza, New York, NY 10278, (Attention: Regulatory Functions Branch), prior to commencement of work authorized herein.
