We, the undersigned, being members. of the .Town Board of the Town of South-
old, Suffolk county, New York, do hereby severally waive notice of the time,
place and purpose of the.meeting of the Town Board to be held at Southold,
in the Town of Southold, New York, on Wednesday, ,August 16, - 1961, .
hereby 'conseni that . the same behold on said date for-.the transaction of
.any business which may properly come before said meeting.

A special meeting. of the Southold Town "Board was held at the Town Clerk
Office, Southold, N.Y. on Wednesday, August 16, 1961, the members . of the
Board having waived notice of the time, place and purpose-'of the meeting.
The meeting was called to order by the, Supervisor, Lester M. Albertson,
at 10:30 P.M. with the following present: - Supervisor Albertson; Councilmen
Demarest and Grathwohl; Justice 'Tuthill; Town Attorney Tasker and Town.
Clerk Richmond; ' Supt. of Highways Price.
Moved by Councilman Demarest; ; seconded by Justice Tuthill: . .
WHEREAS, the Southold American Legion, Griswold-Terry-Glover Post #803 has
applied to the Town Clerk -of the Town of Southold, for a Bingo License, and
WHEREAS, the Town Board has examined, the application and after investigat-
ing 'the matter, duly made findings and determinations as required bylaw,
NOW, THEREFORE, BE IT .RESOLVED: That the Supervisor be and he hereby is
aq,thorized and directed to execute on behalf of this' Board the findings ,
and determinations required by law, .and. it is further
RESOLVED: That the Town Clerk be and he hereby is directed to issue a
Bingo License to the Southold American Legion, Griswold-Terry-Glover Post
#803 .
Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and
Grathwohl; Justice Tuthill.
Moved by Justice Tuthill; seconded by Councilman Grathwohl;
RESOLVED: That the next regular monthly meeting of the Town Board will be• ,
held at the office of the Supervisor, Lester M. Albertson, at 16 South
Street, Greenport, N.Y. on Tuesday, August 29, 1961, at 3: 00 P.M: --
Vote of- Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and
Grathwohl; Justice Tuthill.
Moved by Justice Tuthill; seconded by Councilman Demarest:
WHEREAS, Guido Ciacia, Greenport, N.Y. by petition verified the 26th day
of June, 1961, petitioned the Town Board for a change of zone of certain
real property described in said petition from "A" Residential and Agric-
ultural District to "B" Business District, and
WHEREAS, the said petition was referred to the Planning Board for its
official recommendation and report, and
WHEREAS, the Town Board pursuant to due notice thereof held a hearing
thereon on August 8, 1961 at which time all interested persons were given
an opportunity to be heard, minutes of which were. recorded by Judith Boken,
NOW, THEREFORE, BE IT 'RESOLVED: That the Southold Town Building Zone Y
Ordinance including the Building Zorie Maps be amended by changing from
"A" Residential and Agricultural District to , "B" Business District the -
following described property:
ALL that certain tract or parcel of land situated at Greenport, in the
Town of Southold, Suffolk County; New York, and more particularly bounded
and described as follows:
BEGINNING at a point formed by the intersection of the northerly line of
Kerwin Boulevard and the easterly line of the Main (State) Road, running
thence N. 300 24' 20" E. along said easterly line of Main Road 50 feet to
land now or formerly of Mann, thence easterly along said land now- or
formerly of Mann S. 590 35- 40." E. 125 feet to a point; thence northerly
along said land now or formerly of Mann N. . 300 24' 20" E. 25 feet to a
point; thence easterly along said land now or formerly of Mann S. 590
35 ' 40." E. 62.50 feet to a point; 'thence northerly along said land now

or formerly of Mann N. 300 24- 201, E. 75 .00 feet to a point; thence easter-
ly along said land now or formerly of_Mann S. . 590 35 ' 40" E. 62 .50 feet
. to the westerly line of a private road, "Lawrence Lane"; thence southerly

ly line of the Main Road at the point or place of beginning.
BE IT FURTHER RESOLVED: That the Townb Clerk be and he hereby is authorized
and directed to cause notice of said amendment to be posted and published
pursuant to law.

WHEREAS, THE Town Board on its own motion proposed to amend -the Building
Zone Ordinance of the Town of Southold, Suffolk .County, New York,. and
WHEREAS, the said, resolution was referred to the Planning Board--for its..
official recommendation and report, and
WHEREAS, the Town Board pursuant to due notice thereof .held a hearing
'thereon on August. 8, 1961, at which time all ,interested persons...were
given an opportunity to be .heard, j
NOW, THEREFORE, BE IT RESOLVED: That"-the Building
-Zone Ordinance, of .the
Town,- of Southold, Suffolk County, New York, be, amended as. . follows: .to wit:
1. By amending Article III Section 300 of said ordinance by inserting
therein a new .paragraph to be paragraph 6B to 'read as follows:
116B - Cemeteries and the necessary incidental structures when ,authorized
as a special exception by the Board of Appeals as hereinafter .provided. "

BE IT FURTHER RESOLVED:_That the Town Clerk be and he hereby i•s ,authorized
and directed to cause notice of said amendment to be posted• and published_
pursuant to- laig.

.WHEREAS, Southold Development Corporation and GeorgeJW. . Smith & ;Son, Inc.
by petition verified on the 20th day of April,, 1961,. petitioned the Town
Board for a change of zone of certain real property described in said
petition from "A" Residential. and Agricultural District .to, "M" Multiple ,
Residence District, and
WHEREAS, the said petition was referred .to the-.Planning Board„for .its.
official recommendation and report, and .
WHEREAS, the Planning Board has filed its official report with the Town ,
Board, and
WHEREAS, the,-Town Board pursuant to .due notice tbereof,, beld-, a .hearing on
said petition on August 8, 1961, at which time all interested- persons,
' were given an opportunity to be heard, . .
NOW,, THEREFORE, BE ,.IT RESOLVED: That, the. relief demanded .in said petition
of Southold Development Corp. and George W.. Smith &. Sons, ,Inc. be and
same is-..in all respects..denied. .
