BASIS OF APPEAL: Notice of Disapproval issued by the Building Inspector dated November 7, 1996. "Under Article IIIA, Section 100-30A 4 (ref. 100-33) , proposed accessory garage will be located in a front yard rather than a required rear yard." CODE PROVISIONS APPEALED: Article IIIA, Section 100-30A.4 (100-33) RELIEF REQUESTED: Applicants are proposing to locate behind the existing dwelling a 24 ft. wide by 28 ft. deep accessory garage with the garage doors facing Youngs Avenue, setbacks proposed 6-8 ft. from the northerly property line. A yard area normally deemed to be the rear was determined by the Building Inspector to be another front yard, abutting a former "right-of-way" as shown in a 1959 town record. MOTION MADE BY G. REASONS/FINDINGS: The subject property is otherwise without a rear yard, and no other .alternative is available. The relief is minimal and meets all other zoning code requirements. Upon information received, the right-of-way is not in existence. Title searches show there is no current right-of-way easement of record. Based upon the information submitted, the yard area chosen is what is most commonly the "rear yard" under code requirements. Boufis) stopped by to review our 1959 file and was able to confirm that that split was for the same property for which he has now received a building permit (garage) application, second accessory building to an existing house. When leaving, John indicated that the 1959 file consisted of a survey showing a ROW along the rear property line, and John was concerned that if the ROW existed, that he may have to disapprove the building permit application due to a second front yard area. Apparently, Paul Caminiti was contacted by his client (DeMaggio or another party) to contact our ZBA office. Since then, after three different conversations, the applicant would like to show that the 1959 ROW does not exist. A copy of this memo is being sent to the Building Department in order to bring them up-to-date and ask the Building Department to contact Paul Caminiti, Esq. Mr. Caminiti said he was told that the ZBA office was concerned about the ROW - which is not true. The right-of-way from the 1959 survey was a concern raised by the Building Department - and proof as to whether it exists or not is not properly in the jurisdiction of the ZBA office - it must determined by a Building Inspector under the "building permit application" for the second accessory building. Paul Caminiti just left our office at 2:35, and said he will try to catch up with John since he can prove, he says, that the ROW does not exist. Como when they purchased the property located at 265 Youngs Avenue, Southold, New York 11971 on August 30, 1995. That at the time of purchase, a title search was ordered from Stewart Title Insurance Company as well as a new survey from Peconic Land Surveyors, dated August 16, 1995. Neither the title report nor the survey reflected any rights of way recorded or not. In fact a Certificate of Occupancy for the shed was required and an application for a building permit was filed in September, 1995 by the undesigned and a permit was issued for the shed together with a Certificate of Occupancy which reads in part "accessory storage shed in rear yard as applied for". Physical inspection by John Boufis at that time did not reveal a right of way. The right of way does not exist and if it was created in 1959 then it was only a "paper right of way" and was never used, since all the properties affected along the right of way abut on town maintained roads. The area in questions is totally overgrown with brush and there is absolutely no evidence of any right of way.
