Remodeling and Restoration pursuant to building permit#23889Z issued to B. D. Remodeling/A. C. Owen. I believe that the proposed addition violates the Suffolk Town building code and would require that a variance be granted for its construction to be permitted. I am not aware of a variance having been granted and therefore ask that you revoke your building permit and issue a stop work order until such variance is obtained. The proposed addition violates the building code for at least three reasons: 1. The structure is in excess of 2 and 1/2 stories. The lower level of the existing home is a basement as defined in the building code and counts as one of the�allowabie 2 and 1/2 stories of the home. The existing basement has full windows along the back side (not shown in rendering) and full windows and door on the front side (as shown in the rendering). A significant portion of the existing basement is at grade with the driveway as shown in the rendering. Most importantly, more than one-half(1/2) of the height, measured from floor to ceiling, is above the established grade of the land immediately adjacent to the building. 2. The height of the building measured from the average elevation of the existing natural grade adjacent to the building before any alteration or fill to the mean height between the eves and ridge exceeds 35 feet.
