SOUTHOLD TOWN BOARD OF APPEALS
October 6# 1960
A regular meeting of the. Southold Town Board of Appeals
was held 7:30 P.M.,,- Thursday* October 6, 1960, at the Town
Clerk Office, Main Road, Southold, New York.
There were present: Messrs. Robert W_ Gillispie, Jr. ,
Chairman, Robert Bergen, and Herbert Rosenberg,
Absent: Messrs. Charles Grigonis, Jr.-, and Serge
Doyen, Jr.
PUBLIC HEARING:, Appeal No. 316 7:3 0 P.M. (E.D S,T.. ),
upon application of Fishers Island Farms, Inc., Oriental
Avenue, Fishers Island,. New York, a/c David R. Wilmerding,
Oceanic Avenue, Fishers Island, New York,f . for a variance in
accordance with the Zoning Ordinance, Article III, Section 300,
Subsection 74 for permission to erect an addition on private
garage with reduced setback. Location of property: north-
easterly side Oceanic Avenue, Fishers island,. New York,
bounded north by Paquette, east by Ocean is Avenue, south by
Gordon, and west by now or formerly of Williams. Fee paid
$15, 00.

THE CHAIRMANz This application should read as a special
exception as it is the expansion of a non-conforming use.
On motion of Mr_ Rosenberg, seconded by Mr. Bergen, and
carried, the application of Fishers Island Farms., Inc.., a/c
David R. Wilmerding was amended to read a Special ExceptionP
under Article X. Section 1007 (e)_
Vote of the Board: Ayes:-- Mr. Gillispie, Mr. Bergen,
and Mr. Rosenberg,
The Chairman read the notice of disapproval issued by the
Building Inspector, application, legal notice of hearing and
affidavit attesting to its publication in the official newspaper-

THE CHAIRMAN: We have pictures in the file of the existing
garage Mr. Wilmerding wishes to make an addition to this garage_
(The Board discussed the location of the proposed garage_ )
THE CHAIRMAN: Are there any other questions in connecticn
with the application?

Resolution was offered by Mr_ Bergen, seconded by Mr,
Rosenberg., and carried, WHEREAS application of Fishers Island
Farms,, Inc_ , a/c David Wilmerding, having been considered at
public Hearing No, 316 on October 6, 1960, and the Board finding
that the public convenience and welfare and justice will be served
and the legally established or permitted use of neighborhood
property and adjacent use districts would not be substantially
or permanently injured and the spirit of the Ordinance would be
observed, therefore be it

RESOLVED that this. special exception be granted permitting
Fishers Island Farms,. Inc. a/c David Wilmerding to erect addition
to non--conforming garage no closer than 13 ft. to the south
property line .on oceanic Avenue4 Fishers Islands New York.,
Vote of the Board: Ayes:- Mr- Gillispieo , Mr- Bergen, Mr.
Rosenberg
Mr. George Lind appeared before the Board of Appeals for, an
informal discussion relative to his father's property, Louis Lind
located on the south side of--Soundview Avenues near hortons Points.
Southold.. -Mr. Lind has an .irregularly shaped corner lot and wishes
to erect an addition. Howevery due to the angle of the lot line on
the street the addition would come closer to the lot line than the
existing house_ Since this is. a corner lot the setback should be
35 ft, on the street, however* the present house is only 24 ft.
2 in_ from the street at the closest point and the addition will
then come 21 ft. 5 in. Mr.. Lind stated that it would be impractical
to locate the addition in any other position because of the layout
of the rooms, in the existing house. Mr. Lind was advised by the
Board of Appeals that he would be justified in making an application
for a special exception.
Mrs. William Victoria# -Jamesport* appeared before the Hoard
of 'Appeals for an informal discussion. Mr. and Mrs. Victoria
have nonconforming cottages at Bayview* Southold and would like
to add motel--type ubits�. They have purchased a barge and would
like to float it ashore and remodel it into motel units. Mrs.
Victoria asked if the Board of Appeals would have any objections
to that type of project.
The Chairman advised Mrs,, Victoria that the erection of a
motel in her cottage colony would require a change of zone to
"M" Multiple Residence District which should be taken up with
the Town Board. As far 'as floating the barge ashore and breaking
the shoreline she would have to consult with the 'own Trustees..
Mrs. Wilma Zimmermann,. Cutchogueg. New YorkA appeared before
the Board of Appeals for an informal discussion. Mrs. Zimmermann
would lice to have a yarn shop in the back porch of her home.
The previous owner4 also a Zimmermann, had an upholstery shop in
his home which was less than two years ago. Mrs. Zimmermann was
advised that this yarn shop would come under the heaAing of home

occupations in the "A" Residential and Agricultural District
and. she may conduct a .yarn ,shop providing there is no display
of goods publicly and no advertisement shown ;other than a sign
not larger than 2 sq, ft. bearing the name of the practitioner
and the occupation in words only.
Mr. John E, McNulty, Jr-, Laurel,. N.Y. accompanied by his
father John P. McNulty� .Sr* , and Mrs. Clarence Diller, Peconict.
sister of Mr, McNultyt Sr.+ appeared before the Board for further
discussion relative to .their property on Long Island Sound at
Laurel, On September 22nd the McNultys met with the Board of
Appeals and stated that they have a piece of property on Long
island Sound in Laurel which is 140 ft_ wide and has approx-
imately 400 ft. in depth_ They have a prospective purchaser
for 100 ft, and would like to keep 40 ft, which would be used
as a right-•of--way 'to the water .for. future purchasers of their
property to the south_ The Board had advised Mr. ,McNulty that
they could not grant a variance leaving 40 ft, They suggested
however that a deed be made including the ,40, ft. to-the- purchaser
of -the -100 ft. parcel making it. specific in the deed that the
right-yof-way be kept as a permanent right--of--way for the use
of the property owners to the south.
The McNultyAs again repeated their proposal of selling
100 ft. and keeping the 40 ft. and the Board again advised
that`as far as they can see they cannot grant a variance,
however they would behappy to have Mr., McNulty take the matter
up with the Town .Attorney to determine if there is any other
possible solution.
The minutes of the meeting of September 22# 1960*, on motion
of Mr. Gillispiev, seconded by `,Mr. Bergen, and carried, were
approved as submitted,

Because Mr. Leon L. Munier 'will be unable- to be present
at the public hearing upon his application for a variance on
October 13thw-the Board of 'Appeals reset this hearing for Mr.
Munierfs, convenience, On motion of Mr.. Gillispiep seconded by
Mr.. Rosenberg.,. .and carried, the Board of Appeals set 700 P.M.

westerly side yard on property located on the south side
Peconic Bay Boulevard,_ Mattituck, New York. Property bounded
north by Peconic Bay Boulevard, east by Alex BoagA' Jr. , and
Clark, south by Peconic Bay, and west by F. A. Sealey*
Vote, of the Board: Ayes:- Mr. Gillispie, Mr. Bergen,and
Mr. Rosenberg.
Resolution was offered by Mr_ Rosenbergt. seconded by Mr.
.Bergen, and carried, setting 8: 00 P.M_ (E.D.S.T_ ) K Thursday,
October 20, 1960, Town Clerk Office, Main Road, Southold,, New
York as time and place for hearing upon application of Edward J.
Schuellein, Vanston Road, Cutchogue, New York, for a variance
in accordance with the Zoning Ordinance# Article IIIr: Section
3071, for permission to reduce southerly side yard on Lot No. 313p
Map of Nassau Point Club Propertiesi Vanston Road, Cutchogue,
New York.
Vote of the Board: Ayes:- Mr. Gillipie, Mr. Bergen, Mr.
Rosenberg.
The next meeting of the 'Southold Town Board of Appeals
will be held 7: 30 P.M., Thursdays_ October 20,t 1960 at the
Town Clerk Office,, Main Road, Southold, New York.
