A regular meeting of the Southold Town Board of Appeals
was held 700 P.M.0 Thursday} October 20, 1960 at the Town
Clerk Office, Main Road, Southold, New York.
There were presents Messrs. Robert W. Gillispie,�- Jr.#

PUBLIC HEARING:s Appeal No. 315 - 700 P_M. (E.D.S.T. ),
upon application of aeon L. .Munle r+ 50 Sutton Place South;;_ .
New .York 22, New York, for a variance in accordance with the
Zoning Ordinance, Article III*. Section. 307, for permission to
reduce westerly Side yard on property located on the south
side Peconic Bay Boulevard, Mattituck, New Yorac, Property
bounded north by Peconic Bay Boulevard, east by Alex Boag*.
Jr-, and Clark, - south ly Peconic Bay, and west by F. A.Sealey.
Fee paid $15.00.

" The Chairman opendd the hearing by reading notice of dis-
approval issued by the Building Inspector, application for a
variance, legal notice of hearing .and affidavit attesting to
its publication in the official newspaper,
THE CHAIRMAN: Is there anyone present who wishes to speak
for this application?
MR- LEON MUNIERO 50 Sutton Place Southo New York 22* New
York: I- have a survey that was made when we purchased the
property.
THE cHAIRMAN: There are two pictures in the file indicathg
the situation.
MR. MUNIERs The lot is only 82 ft, wide where the house
is built, however I have 100 ft. on Peconic Bay Boulevard and
100 ft. on the Bay,_ the house is built parallel to the line-
There is approximately 8 ft. from the front of the house to the
beach. There are 30 steps down to the beach.,
THE CHAIRMAN; What is the distance to the line on the
other side of the house, that is the east side of the house?
MR_MUNIER: Approximately 25 ft. to 30 ft.
THE CHAIRMAN; It is the Board's opinion that it would be
smarter to add the room to the house at the. point you desire
rather than the front because of the embankment . At the point
of the addition only one corner of the proposed room violates
the 10 ft, setback requirements 4 ft. 6 in, of the corner of
the proposed addition.
MR, MUNIERs That is correct. The house is built at an
angle parallel with the lot line on the Bay.
THE CHAIRMAN: is there anyone else present who wishes to
speak for this application?
(There was no response.)
THE CHAIRMAN: Is there anyone present who wishes to speak
against this application?

Resolution was offered by Mr. Bergen, seconded by Mr.
Grigonis, and carried« WHEREAS application of Leon L,. Munier
having been considered at Public Hearing No, 315 on October
20, 1960, and the Board finding that strict application of the
Ordinance would produce practical difficulties or unnecessary
hardship because applicant must build addition at location
indicated because of the existence of a window and chimney.
The hardship created is unique and would not be shared by all
properties alike in th=_ immediate vicinity of this property
arl in the same us e district because many neighboring houses
are now built closer than 10 ft. to the side lot line. The
variance does observe the spirit of the Ordinance and would
not change the character of the district because the proposed
addition would be residential in keeping with the neighborhood,
therefore be it
RESOLVED that Leon L. Munier be granted permission to
erect addition to existing one family dwelling, the corner
of which addition will be no closer than 5 ft. 6 in. to the
westerly property line,.
Vote of the Board: Ayes;- Mr. Gillispie, Mr_ Bergen,
Mr. Rosenberg, and Mr. Grigonis.
Mr.. Robert Ketcham, Jr_, Bay Lake Park, East Marion_, New
York, appeared before the Board of Appeals and presented an
application for a special exception a/c The Booth House,
Greenport, New York. Location of the proposed sign to be
Route 25, Southold, near Bay Home Road„ on the property of
Fismer Estate..
PUBLIC HEARING: Appeal No. 317 - 8: 00 P.M. (tE`.D.S.T. ) ,
upon application of Edward J. Schuellein, Vanston Woad, Cutchogue,
New York4 for a variance in accordance with the Zoning Ordinance,
Article III, Section 307, for permission to reduce southerly
side yard on Lot No. 3134 Map of Nassau Point Club Properties,
Vanston Road, Cutchogue, New York. Fee paid $15.00.

The Chairman opened .the hearing by reading notice of dis-

THE.CHAIRMAN: As I understand the situation,4 the only.
level area on this lot is the tennis court and there is a
very substantial valley to the north of the tennis court,
There is a considerable slope in back of the proposed house
going to the east and there is also an additional slope going
down to- the Bay to the west and the height is substantial above
the Bay. The trees surrounding the tennis court are probably
20 in. in diameters so that is a prelude to the application_
Is there anyone present who wishes to speak for this
appl icat ion?
MR. EDWARD J_ SCHUELLEIN, Vanston Road, Cutchoguer New
York: (Mr. Schuelbin had a model of his proposed house for
the Board to examine. ) My driveway will come in from Vanston
Road and from Vanston Road to the proposed house. is 150 ft.
if I move the house over 10 ft. from the line it will be over
the slope and there will be a chimney on the side of the house
where the slope is making it necessary to bring in a great deal
of fill,
THE CHAIRMAN: What is the area of the house?
MR. SCHUELLEIN: The tennis court is 50 ft. by 100 ft.
and the square footage of the house will be 1028 sq. ft_
THE CHAIRMAN: Is there anyone else present who wishes to
speak for this application?

THE C,HAIRMAN2 Is there anyone present who wishes to speak
against this application?
(There was no response.)
Resolution was offered by Mr. Bergen, seconded by Mr„
Grigonis, and carried, WHEREAS application of Edward J.
Schuellein, having been considered at Public Hearing No. 317

on October 20, 19604 and the Board finding that strict appli-,
cation of the Ordinance would produce practical difficulties
or .unnecessary hardship because applicant wishes to erect
proposed house on existing tennis court which is only level
area, of lot,#: in doing this one corner of the proposed house
would be closer than 10 ft, to the side property line. The
situation is unique and would not be shared by all properties
alike in the immediate use district because this is one of
the few lots with such unusual topography. The variance does
observe the spirit of the Ordinance and would not change the
character of the district because applicant intends to build
a new dwelling in keeping with the residential character of
the neighborhood, therefore be it
RESOLVED that Edward J.• Schuellein is granted permission
to erect new one family dwelling on existing tennis court no
closer than 5 feet to the southerly property line.
Vote of the Boards Ayes:- Mr. Gillispie, Mr. Bergen, Mr;
Rosenberg, and Mr. Grigonis.

carried,,. .the Board of Appeals set 7:30 F.M. (E.S,T. ) upon appli-
cation of Robert Ketcham$, Jr_, Bay Lake Park* East Marion,, a/c
Booth House,. Sterling Avenue,, Greenport, New Yorks for a special
exception in accordance with the, Zoning Ordinance, Article 111,
Section 300.,K. Subsection 11; for permission to erect and maintain
a directional sign on the property of A. W. Fismer Estate, south
side Main Road,#_ ,Southolds New York* bounded north by Main Road
east by Meadow & Booth, southby Bay and west by Bay Home Avenue.
Date- of hearing to be November 3* 1960 at Town Clerk Office;, Main
Road, Southold, New York,

On motion of Mr. Rosenberg* seconded by Mr. Bergen, and
carried,, it was
RESOLVED that legal notice of hearing be published in the
official newspaper under date. of October 27; 1960.

On motion of Mr.. Rosenberg, seconded by Mr, Bergen, and
carried, the minutes of the Meeting of October 6, 1960 were
approved as submitted.
Vote of the Board: Ayes:- Mr. Gillis_pie, Mr. Bergen, Mr.
Rosenberg, and Mr_ Grigonis.
The minutes of the meeting of October 17s 1960, on motion
of Mr. Rosenberg, seconded by Mr. Grigonis, and carried, were
approved as submitted.
Vote of the Board: Ayes:- Mr. Gillispie, Mr_ Bergen,.. Mr.
Rosenberg* and Mr. Grigonis.
The Board of Appeals received a letter from Mr. Joseph P.
Plonski,, Chairman, zoning Board of Appeals of Huntington stating
that the Zoning Convention is to be held this year on Saturdays
December 10, 1960 at the International Brotherhood of Electrical
Workers Building on Pinelawn Road_ Huntington. Mr. Plonski
asked to be advised in advance of the number of members who
would be attending this convention.
A letter was forwarded to Mr.. Plonski listing the members
of the Southold Town Board of Appeals and advising that a check
covering the members who plan to attend would be forwarded
directly to him by the Town Board.
A letter was also forwarded to the Town Board requesting
authorization to attend this convention and stating that if
this authorization is granted the Board would submit a voucher
on November loth for the exact number of members to attend.
The next meeting of the Southold Town Board of Appeals
will be held 7z30 P.M. ,t Thursdays October 27, 1960 at the
Town Clerk Offices Main Roads Southold, New York.
Meeting adjourned at 9: 05 P.M.
