Southold Town-Board of :Appeals -2- May 12, 1960 The -Chairman .opened the hearing ,by reading ,application for a •special exception, legal notice of hearing and affidavit attesting to its publication ,in..the official newspaper. The:Chairman ,also read letter of consent from the property owner. THE . CHAIRMAN: Is there anyone-present who wishes to speak . for- this, application? MRS. WILLIAM VICTORIA: (Stated she appeared for the application. ) THE CHAIRMAN: Has the sign been moved? MRS. VICTORIA: No, ; I am .waiting for permission. THE CHAIRMAN: Is there anyone present who wishes to- speak against this application? MR. ROSENBERG: How far back . is it being moved? MR. TERRY, Building, Inspector: It .is. entirely in the street now. You can see the property marker in the picture that :appears in the file. THE CHAIRMAN: This is an .enlargement .of the sign as I recall you said, is that right? MRS. VICTORIA: We were :adding . the crown to the sign .to make it more attractive and eye catching. We repainted it :a .different .color to attract the driver's attention. THE CHAIRMAN: The dimension is presently approximately 4 ft. by 6 ft. ? MRS. VICTORIA: No, it is 6.- ft. by 8 ft. The-. same as the one o n the Main Road. THE 'CHAIRMAN: The sign size permitted for this type of sign is 'actually 6 ft. 6 in. by 12 ft. 6 fn. MR. ROS.ENBERG: Providing .there is no advertising on it® THE 'CHAIRMAN: If no one wishes to say anything else in favor or in opposition to this ,-application I will. offer. a Resolution granting this application. Grigonis, ..and, carried, WHEREAS application .of 'William.-Victoria a/c Victoria.' s Cottages, , having„been considered at Public Hear ing .N.o. . 272 on. .May 12, 1960t and the Board finding that the pubs i c convenience .and .welfare and j,ustice. :will be served '..and the. legally established or-permitted use of neighborhood property will not be.-substantially or permanently, injured and. the.'spirit -:of :the -Ordinance, will be observed, therefore be it RESOLVED "that the application- be gr.anted .as :applied for . �with_'.the condition that this :sign, which is. the "reldcation of a non-conforming sign which. has been enlarged within the. permissible . limits, be relocated in. the_ same.,locationat least .five .(5.) feet from..any property line. Southold, -appeared before the Board of 'Appeal.s for aninformal ,di.scussion. Mr. Kronk stated that at .the Town Board meeting on .May 1Oth he .was advised that the - Town Board would have to. issue licenses to those junk -dealers in th..e Town who requested them. . He stated he is of the opinion the un- licensed junk deal-ers should be given..summonses .and fines for not operating -with .a..license for this length .of:time. Mr. Kronk said he is the only licensed Junk dealer in the Town -,and he has to keep records which .are inspected regularly. He feels it is, riot fair for the other. junk -dealers to operate .without -any restrictions at -all. The ;Chairman. ;advised :Mr. :Kronk that the Board of-.Appeals is " inspecting, junk. yards a few-at .a. time to .,see 'that -they are putting in. their planting .pf 'hedge or stockade- as approved and'- they intend to continue their program until .all junk yards are screened. The Chairman.:.also advised, Mr. Kronk :that .the licensing -of junk yards is not .a' matter of --concern-to the Board of :Appeals since it is a . State- law and the . Town 'Board issues the: licenses. The minutes of the meeting ,of:April 21, 1960, on motion of .'Mr. Gillispie, pfeconded by Mr._­Grigonis, and carried, ,were approved -.as submitted. Hoard of `Appeals -4- May 12, 1960 PUBLIC HEARINC3: Appeal -of `Thomas and Florence ,Jurzenia, a/c Silver ':Sands Motel, , No. 270, for a .special exception in accordanc.e .with ,Article III, Section 300, Subsection 11. This public hearing was reesssed `from :7:45 P.M. , . Thursday? April 21, 1960 at :the. request. of the applicants. Fee paid .�15. 00. . On .Thursday, .April .21, 1960 the hearing .was '-opened .and the legal notice and application read.' 'THE .CHAIRMAN: Is there .anyone present Who wishes 'to. speak for this application? *Rr THOMAS JURZENIA r .Greenport, New York: ,: There- is no way we have. of advertising whose motel it is. We now have -only ".motel-" on the roof. As you .know we have a-bad situation -there- on .the -corner. We would like to establish ..a very definite identity. THE .CHAIRMAN: How big .-are-the letters 'that .are there now? MR. JURZENIA: The existing letters are 2 ft. THE CHAIRMAN: Hcw far -areyou.- from the_;idain Road? MR. JURZENIA: I .,would say about ,1000. to.- 1200 ft. About :400 yards. I 'have here, a .sketch_of the. proposed sign. MR.HOWARD TERRY: He is exactly 13.00 ft. . from the Main Road. -The sign. he -now has was.authorized as part of..the. original building plan. . MR. ROSENBERG.: This neW sign is over 50 sq. ft. MR. JURZENIA: I can .bring:that ,size :down to 50-sq. ft. That is. j ust a.:.rough- sketch. Resolution was offered byMr. Bergen, seconded by. Mr. Rosenberg and -carried, .WHEREAS application. of :Thomas and Florence ,J'urzenia, a/c Silver Sands Motel, having'been .considered at Public Hearing No. 270 on May 12, 19.60, and the' Board. finding, that, th.e public, .convenie nce -and 'welfare and justice.wil.l be served and the legally established or permitted -use' of neighborhood property will not.be .substantially. or permanently injured .and the. spirit of the Ordinance will be observed* therefore be it Southold ' Town Board of Appeals -5- May 12, 1960 RESOLVED that the application be granted as applied for with . the condition that -the. size of the- sign is not to exceed 50 sq. ft. , nor. 6 ft. 6 in. in height,, nor. 12 ft. 6 in. in width, consider- ing that the size of the sign,. when letters are mounted independently,, is predicated upon .straight lines drawn to intersect the high .and low points of the characters of the sign. Vote -of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg, and Mr. Grigonis. The minutes of .the meeting ,of May 5, 1960, - on motion of 'Mr. Bergen, seconded by Mr. Grigonis, and carried, were approved as submitted. Vote o-f the Board: Ayes: - Mr. Gillispie, Mr, Bergen, Mr. Rosenberg, and Mr. Grigonis. The minutes of the meeting , of May 9, 1960, on motion of Mr. Grigonis, seconded by Mr. Rosenberg,, and carried, were approved as submitted. Vote of the Board: Ayes: - Mr. Gillispie, Mr_. Bergen, , Mr. Rosenberg, and-.Mr. Grigonis. The Chairman advised that Mr. A. Straussner advised him by telephone. that -he had decided not to complete his applications. The next .meeting of the Southold Town Board of Appeals will be held 7: 3'0 P.M. , Thursday, May 19, 1960 .at .the Town..Clerk Office, Main Road, Southold, NeW'York. On motion of Mr. Bergen, seconded by. Mr. Grigonis and-carried, it was RESOLVED that the Board set 7: 30 'P.M. , Thursday, May 26, 1960 at .the Town -,Clerk Office, Main .Road, Southold, New York, as time and place for hearing upon application of Thomas Jurzenia, a/c Silver Sands Motel 'and Jack :Levin, a/c Sound Shore Motel,, Greenport, New York, . for a .special -exception. in. accordance with. Southold Town Board .of Appeals -6- May 12, 1960 the Zoning Ordinance, Article III, Section 300, Subsection 11, for permission .to replace an -existing directional sign with ,a two-panel directional sign. Location. of property: southeast corner of intersection of- North-Road -arid Chapel Lane, Greenport,' New York. Vote of the Board: Ayes: — Mr. Gillispie, Mr. Bergen, Mr. Rosenberg, and'Mr. Grigonis. On motion of Mr. Rosenberg, seconded by Mr. Bergen, and carried, it was RESOLVED that 7:45 -P.M. (E.D..S_T. ) , Thursday, May 26, 1960, Town- Clerk . Subsection ,11, for permission .to mplace an .existing directional sign with .a two-panel directional sign.
