Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is EXEMPT from LWRP review pursuant to: § 268-3. This material consists of a mixture of clay and spoil resulting from a permit issued by the Trustees to repair an existing bulkhead. Your office expressed disbelief and stated the property would be inspected promptly. The permit provided for 15 cubic yards of such material ! During the earlier period of heavy rains,your office was informed that the mound of material was eroding into the wetlands and cove. Purportedly the site was inspected. In any event the Trustee's usual panacea of hay bails was installed . This is the equivalent of the proverbial thumb in the dike. If the site was inspected, and the inspector had an even rudimentary knowledge of solid geometry, he would have realized that 15 cubic yards would cover 135 square feet to a depth of one foot. Stated otherwise, a pile 10 feet by 10 feet would be less than 1 1/2 feet high. Contrast this with the monstrous pile he did, or should have,seen. As of today's date,your office is uncertain as to whether the property was ever inspected . Also, as of today's date,heavy equipment is still beeing employed to spread this material. Am I expected to believe that, even by today's standards, it takes three days for heavy equipment to spread 15 cubic yards of material ? The result of this operation is that questionable fill has been placed in the wetlands area and the topography and drainage of the subject property substantially altered. I don't know what it will take to see to it that the Trustees do not issue permits in a casual manner and subsequently abdicate any responsibility to inspect and supervise the permits they issue for conformity to the terms of the permit and the requrements of the Town Code. MTCHAEL DI LEONE; applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold., application dated June 14, 1997 . and; WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recomnmendations, and WHEREAS. a Public Hearing was held by the Town Trustees with -respect to said application on July 30, 1997 , at which time all interested persons' were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code, WHEREAS, the Board has determined that the project as. proposed. will not affect the health, safety and general. wel€are of the people of the town, } " NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approves the application of MICHAEL DI LEONE to replace 1- 16' section of bulkhead inkind/inplace and 1- 40' section, add. a 4' X 6' platform attached to bulkhead, a 4' X 16' hinged. ramp and 2- 5' X 20' floats and dredge an area approx. 4' X 35' to a depth of 4' below ALW, yielding approx. 15 cy. of spoil and a 10' non-turf buffer landward of bulkhead along length of bulkhead: Located: 940 Tarpon Drive, Southold- BE IT FURTHER RESOLVED. that this .determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar. project. Permit to construct and complete project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this. notification. New York 11971 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL The following recommendation was passed by the Southold Town Conservation Advisory Council at its July 28, 1997 meeting: No. 1472 Moved by Bruce Loucka, seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Board of .Trustees APPROVAL WITH PROVISIONS of the Wetland Application of MICHAEL DiLEONE 57-1-10 to replace one 16' section of bulkhead in-kind/in-place and one 40' section of bulkhead in-kind/in-place; add 4' x 6' platform attached to bulkhead, 4' x 16' hinged ramp and two 5' x 20' floats secured alongside the bulkhead; dredge area approximately 4' x 35' next to bulkhead to depth of 4' below ordinary low water, yielding approximately 15 c.y. of spoil. 940 Tarpon Drive, Southold The Council recommends approval provided that need is shown for the full length requested, otherwise, applicant should reduce to proportions to meet needs; and recommendation of approval be pending an approved disposal site for dredge spoil.
