A regular meeting of the Southold Town Board of Appeals
was held 7:30 P.M.,- Thursday April 70, 1960 at the Town Clerk
Office,,. Main Road,.,. Southold New York.
There were present: - Messrs. Robert W,, Gillispie* Jr..,k
Chairman$, Robert Bergenk and Herbert Rosenberg.
Absent: Messrs, Charles Grigonis� Jr.,,,. Serge Doyen,_ Jr.,
and Howard M. Terry," Building Inspector.
PUBLIC HEARING: 7:3 0 P.M.. (E.S.T. ) ,,., Appeal No. 267 *- Upon
application of Eugene Mazzaferxo�, A/c catholic War Veterans*
Post #730* Greenport{ New York, for a variance in accordance
with the Zoning .Ordinance,#, Article I1.# Section 202 for permission
to operate a temporary amusement enterprise in an "A" Residential
and Agricultural District. Location of property: east side
Moore'ls__Lane, Greenportx. New Yorkt .bounded north by Village of
Greenport, east by A. Herzog*, Sr, and Leo S1edj eski,, south by
H., L.. Kalin and A. Herzog, -Jx.. .and west by Moore#s Lane, No
fee required.
The Chairman opened the hearing by reading notice of dis—
approval- issued by the Building Inspector-4 application for a

variance, legal notice of hearing and affidavit attesting to its
publication in the official newspaper.
THE CFURMAN= Is there anyone present who wishes to. speak
for this application?
MR. EUGENE MaZZAFERRO,, Gre-enport., New Yorkx I have nothing
further to say*, I think the application covers it.
TBE CHA IUW: I think it is pretty well covered and we are
all familiar with what you said when you were here before.
Is there anyone present who wishes to speak agains this
application?' Are there any questions members of the Board might
like to ask?
MR. BERGENz If this is granted,_ do we have a right to
stipula,te that they keep the papers from blowing around?
MR_ MAZZAFERRoz The owner of the property has already
stipulated that. We will erect a fence for Lloyd Kalin so the
people will not be running through the area and papers will
not blow around_
MR. ROSENBERGz Did you speak to the police?
MR. MAZZAFERROz .I spoke to Chief Anrig and he said he would
contact Mr. Gillispie stating that the traffic will be taken care
of.
THE CHAIRMANz Will there be any problem of cleaning up?
MR.. MAZZAFERROz That is part of our contract,#. that we will
clean up and put the land back in shape.
THE CHAIRMAN, We are not permitted to cause undue burden
on any of the branches of the Town government and the only other
burden we would cause would be on the police,. but since it has
been done before you might say that it is in the ordinary course
of events.

Public Hearing No. 267 on April 7e, 19604 and the. Board finding

that the strict application of the Ordinance would produceundue
hardship because without approval of the Board applicant would be.
unable to conduct this temporary amusement enterprise which has
been conducted for many years on the opposite side: of the street.
The situation is unique and would not be shared by all properties
alike in the immediate vicinity because this lo.t is situated next
to the municipal light plant where utilities are available and
parking will. be provided on a municipal lot. The public con-
venience and welfare and justice will ,be served and the legally
established or permitted use of neighborhood property and adjacent
use districts uv uld not be substantially or permanently injured
and the spirit of the ordinance would be observed because this
lot is located adjacent to the municipal light plantA across the
street from the base ball fields;_ near a business area and part.
of the property is used for a florist shop business*. therefore:

RESOLVED that the application be granted for permission to
operate a temporary amusement enterprise on the condition that
the 'Catholic War Veterans Post #730 be responsible for restoring
the property to its original condition*

THE CHAIRMAN.- Is there anyone present who wishes to speak
against this application? Are there any questions anyone would
like to ask?
(There was no response- )
Resolution was offered by Mr.. Bergen,,. seconded by Mr: Rosenberg
and carried, WHEREAS application of Richard Powell having been con-
sidered at Public Hearing No. 268 on April 74 1960,, and the Board
finding that the public convenience and welfare and justice will
be served, and the legally established or permitted use of neigh-
borhood property will not be substantially or permanently injured
and the spirit of the ordinance will be observed.,, therefore be it
RESOLVED that the application be granted as applied for-

Mr. Joseph Droskoski, Orient,. .New York,#, came before the
Board of Appeals for an informal. discussion. Mr# Droskoski had
purchased two cottages and wished to place them on a piece of his
property at Orient 172 ft. by 150 ft.. After looking at the layout .
of the property it was determined that Mr. Droskoski could enlarge
the lot to 200 ft„ by 150 ft, thus making two 100 ft, lots in
conformance with .the requirements of the Ordinance-
Mr. Peter Karas, East Marion# New Yorkj_ came before the Board
of Appeals for an informal discussion relative to erecting a third
sign on his "B" Business property at west Greenport. Mr., Karas had
been granted a special exception on June 41 1959. giving him permission
to erect a roof sign on the Greenport Snack Bar., however,_ it was
stipulated that this roof sign was to take the place of the customary
standing signs, since he would then have* in effect, two wall signs.
Mr. Kara.s now agreed that he would take down the wall sign on the
west side of the Snack Bar if he is granted permission to have a
standing sign. The Board of Appeals stated that that would be
satisfactory as long as the wall sign is taken down first.

The Board of Appeals next spoke informally to Mr. Steve Hornick
of Elmhurst,. New York, Mr. Hornick has purchased the. former Reybine
house on Skippers Lane.* Orient. New Yorkt and would like to convert
It into a three family dwelling. At the time he purchased it the
real estate agent assured him it could easily be made into a three
family dwelling as it is surrounded by two and three family dwellings
and tourist houses.. Mr. Hornick was advised that the house is
located in the "A" Residential and Agricultural Districts. where 'only
one"family dwellings are permitted. He was further advised that his
problem would be solved if he applied for and was granted a change of
Zone from "A" To "M" Multiple Residence District; It was pointed out
that the change might be looked upon favorably if some of the neigh—
bors were to joint with him in the application for a change to "M",
