Thursday4 May 54 1960 at the Town.Clerk Office.- Main Road*, Southold*' New York. There were present: Messrs. Robert W. Gillispie# .Jr,.,, Chairman,, Robert Bergen,. Herbert Rosenberg,- and Charles Grigonis,_ Jr. Absent: Mr. Serge Doyen,, j r. Also present: Mr. Howard M. Terry, Building 'Inspector PUBLIC DARING: 7 z 3 0 P.M. (E.D*S,.T. ),, Appeal No, 271 -- Upon application of L'oseph Gutierrez,,- Jr.*_ 615 South llth Street,- New Hyde Park. New York,,:. for a variance in accordance with. the Zoning ordinance# Article III, Section 300,# Subsection 7,#: for permission to locate private garage with reduced setback, Location of property: west side private road on south side Bayview. Road#- Southold, New Yorkp,. bounded north by Elaine Axien.. east by Gertrude Kuck and right-Hof-sway,,, south by Corey Creek,- and west by dredged canal. Fee paid $15,00. Southold Town Board of Appeals --2- May 5., 1960 The Chairman opened the hearing by reading notice of disapproval issued by the Building Inspector, application for a variance# legal notice of hearing and affidavit attesting to its publication in the official newspaper. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? Mr. and Mrs. Joseph Gutierrez,, Jr. were present, and spoke for the application. Mr-. Gutierrez located the present cesspools on the map and stated he intended at some future date to locate his cesspools in the general area where he would place the garage if he located it 50 ft. from the road*_ other suitable locations would interfere with his lawn and flower beds_ Mr. Nelson Axien informed the Board of Appeals* through Mr. Rosenberg by telephone._ thathe would not appear because he felt whatever the Board decided would be all right with him- It made no difference where the garage would be placed as far as he is concerned. THE CHAIRMANz Is there anyone present who wishes to speak against this application? (There was no response..) Resolution, was offered by Mr. Gillispie,,_ seconded by Mr. Bergen and carried, WHEREAS application of Joseph Gutierrez., Jr, having bedn considered at Public Hearing No. 271 on May 5, 1960, and the Board finding that strict application of the Ordinance$ woul�./produce undue hardship because there was no hardship shown*, as the only reason the applicant gave for not placing his garage within the boundaries permitted by the Ordinance was at some future date he might wish to place his cesspool in that location and in other parts of his lot where there was ample room to place the garage he did not wish to disturb his lawn and flower beds.. The situation is not unique and would be shared by all properties alike in the immediate vicinity,. because the applicant did not claim any unique situation- The public convenience and welfare and justice will not be served and the legally established or permitted use of neighborhood property and adjacent use districts would be substantially or permaneiztly injured and the v Southold Town Board of Appeals -3- May 50 1960 the spirit of the Ordinance would not be observed because there are no garages or other out buildings in the neighborhood close to the road* therefore*. be it RESOLVED... that the application be denied. Vote of the Board: Ayes:- Mr. Gillispie, Mr, Bergen# Mr.. Rosenberg. and Mr. Grigonis. Mr, and Mrs. Russell Goodwin appeared before the Board for an informal discussion, Mr. Goodwin has a junk yard on Depot , Lane* Cutchogue,r He stated that he has started a planting and intend, to continue same, Mr. Caponi who .owns the scrap metal on the property has been ill and absent for three months,, con" sequently the metal has accumulated_ On motion of Mr. Grigoniso, seconded by Mr. Bergen, and carrie,d.�. it was RESOLVED that the Board of Appeals set 7:30 P.M.4 Thursday, May 19, 1960* Town Clerk. Office,# Main Road* Southold, New York 'as time and place for hearing upon application of Frank W. ,Abrams,, Jr.* for a special exception in accordance with the Zoning Ordinance,K Article. IV41 Section 408 for permission to erect and maintain two (2) additional advertising signs on the premises located on the south side of Middle Road and west side Youngs 'Avenue, South(Ild,,. New York. Vote of the Board: Ayes:- Mr. Gillispie,,� Mr., Bergen,# Mr, Rosenberg,,. and Mr. Grigonis. Resolution was offered by Mr. Rosenberg, seconded by Mr. Grigonis and carried,. setting 7:45 P.M. .. Thursdays May 19.# 1960,, Town Clerk Office, Main Road* Southold, New York as time and place for hearing upon application of Charles. Corniburt-# a/c Island's End Golf and Country Club,, Inc. ,, for a special exception in accordance with the Zoning Ordinances Article 111.1. Section 300, Subsection 11#. for permission to erect and maintain an advertising sign on the premises on north side Main Road (Route 25)4greenport4_ New York leased by applicante, bounded north by lands of applicant#. east by Browns Cabins4_ south by Main Road,, and west by land of W. Critchlow and applicant. Vote of the Board= Ayes.-- Mr. Gillispie;, Mr. Bergen,. Mr. Rosenberg* and Mr. Grigonis.. Southold Town Board of Appeals -4� May 54 1960 It was further RESOLVED that legal notice of heaxl.ngs be published in, the official newspaper under date of May 12,. 1960, Vote of the Board: Ayes:-- Mr.. GillispieR. Mr. Bergenx Mr.. Rosenbergk, and Mr. Grigonis, The Board discussed the proposal of Thomas Jurzenia and .Jack Levin to- establish a ,joint venture directional sign. It was the Board's decision that a formal application would have to be made for each location and the applications should be joint applications with signatures of all persons who will have space on that particular location,_ together with a letter of amnsent from the property owner where it is to be- located and an application for sign permits with the exact wording,, etc. and the order of the motels to be listed- from the town town,, probably not more than :bur panels to one set of posts.,. but another set of posts alongside if necessary to accomodate all_ The next meeting of the Southold.
