10:00 A.M. - Francis 'J. Yakaboski, 'Special Attorney, met with the.Board to.
'.discuss
his '1984 billing for legal services, the per hour rate for which was set by a :1981
agreement, and his proposal for amending said' agreement •1985. This matter will
be discussed further by the Board at the January. 3, .1985 Organizational. Meeting.
EXECUTIVE SESSION
10: 15 A.M. - The Board discussed with Mr. Yakaboski' pending litigation: Wade
vs. Town of Southold,' Silverman/Cartnick vs. Town of Southold, Cron vs. Planning
Board and Hodor-Staller vs. Town of Southold.
.10:47 A.M. - The Work Session reconvened and the Board met with Town Trustees
Frank A. Kujawski; Jr., John L. Bednoski; 'Jr. and President Henry P. Smith to
discuss the need for a second Bay Constable, the subject of Resolution No. 13.
11:20 A.M. - The Board discussed off-agenda items: junk yards, Waterfront Re-
vitalization Grant application, as well as agenda resolutions.
12: 10 P.M. - Work Session adjourned.
REGULAR MEETING

A Regular Meeting of the Southold Town Board was held on Friday, December
28, •1984, at the Southold Town Hall, Main Road, Southold, New York. Supervisor
Murphy opened the meeting at 12: 15 P.M. with the Pledge of Allegiance to the Flag.

SUPERVISOR MURPHY: Thank you for being so patient. We're delayed today. We
had an attorney, come in and discuss some items that 'we really hadn't planned upon
and this was on his time, too. I'd .like a motion to approve the December 28th audit
of the bills.

Moved by Councilwoman Cochran, seconded by Councilman Stoutenburgh, it was
RESOLVED that the following audited bills be and hereby are ordered paid: General
Fund Whole Town bills in the amount of $50,,899.82; General Fund Part Town bills
in the amount of $18,448.62; Highway Department bills in' the amount of $8, 865.23;
Fishers Island Ferry District bills in the amount of $35,959.05; Federal Revenue
Sharing bills in the amount of $2,520'.00; and Southold Wastewater Treatment Plant
bills in'the amount of $578.00.

SUPERVISOR MURPHY : 1 look for a motion to approve the minutes of the Regular
Town Board Meeting of December 18th.
Moved by Councilwoman Cochran, seconded by Councilman Stoutenburgh, it was
RESOLVED that the minutes of the Regular Town Board Meeting of December 18,' '1984
be and hereby are approved.

SUPERVISOR MURPHY: Next, a resolution to set the next meeting dates. The
first one is 'January 3rd, '1985 an Organizational Meeting at 3:00 P.M. , Southold
Town Hall and the second is January 8tK, :1985* a Regular Meeting at 7:30 P.M.

COUNCILMAN STOUTENBURGH : Nothing, except that the Dredging Committee has
.,.met and that we are formulating a priority list right now and we'll have that for the
Board's .approval.

SUPERVISOR MURPHY: Any other questions on it?
COUNCILMAN TOWNSEND: I'd like, to amend that resolution, only to put Jim
McMahon and Dave Emilita on a one year basis;, primarily because the reason
they're on there is because it has to do with their 'employment with the Town
and that's subject to change on a year by year basis; so I think if you put
them on. for one year---
SUPERVISOR MURPHY: It has nothing to do with their employment. ' They volunteered.
This 'is not part of their 'job. They're not being paid' for this:
COUNCILMAN TOWNSEND: 1 understand, but Dave Emilita doesn't even live here
and if he doesn't work here next year, or if he doesn't .work here two years from
now---
SUPERVISOR MURPHY: That's .his problem, then he'd have to resign from the
Committee.
COUNCILMAN TOWNSEND: That's true.
SUPERVISOR MURPHY: If he doesn't make the meetings. Hopefully we'll .have our
housing problems solved in one year.
COUNCILWOMAN COCHRAN: Yes, 1 had him originally for a one year term.,, those
two, because of their positions with the Town, but they can resign from the Committee
if they do leave the area. Six'of one and half a dozen of the other, Joe.
COUNCILMAN TOWNSEND: Okay.
SUPERVISOR MURPHY: Any other questions?
COUNCILMAN SCHONDEBARE: Yes, we agreed, and when this 'came on once before,
that we weren't going to vote on it until we received a job description. We still
don't have the job description and yet we're going to vote on it 'and I'm going to
make it 'my policy not to vote on this; or any other committees, .and appoint anyone
to it if we don't have a job description of what it *is we're appointing these people
to do.
SUPERVISOR MURPHY: Jay, they did receive that when they applied.
COUNCILMAN SCHONDEBARE: What we want is rules and regulations for this
Committee. We don't have any rules and regulations or guidelines for this '
Committee. We set up nothing, yet we're appointing people to it.
TOWN CLERK TERRY: When you established the Committee you did have guidelines.
COUNCILMAN SCHONDEBARE: . No, . we don't.
TOWN CLERK TERRY: In the resolution.
COUNCILMAN SCHONDEBARE: We don't have them. We don't. have anything.
COUNCILWOMAN COCHRAN : Well, -actually, Jay, the purpose of this Committee we
all know and that's the goal of the Committee is to solve some of the housing
problems. The nitty gritty as far-as objectives of the goals will 'be developed
and that's being developed by Jim McMahon. Either way, you had twelve applicants
and you're filling twelve spots and I think they could go with. this "and your main
goal is to solve the problem of affordable housing, sb you do have a goal. It's
the workings of the Committee, and many. committees have the right to determine
some of their own workings, and guidelines are being developed with more: specifics,
but---either way you're going to. come up with the same twelve people.
COUNCILMAN SCHONDEBARE: My question and my position is not with regards to
these twelve people. My position is that before.we start appointing. to people to
the Committee we ought to have the specifications of what the Committee is going to-
do and what we want, and that should be approved by this Board.

RESOLVED that the Town Board of the Town of Southold hereby authorizes and
directs the Town Clerk to place a public notice in The Long Island Traveler and
The Suffolk Times notifying the public 'that the Town Board will. consider proposed
amendments to the Community Development Year X Program Budget at their Regular
Meeting to be held at 3:00 P.M. , Tuesday, January 22, 1985. as follows, and invites
interested citizens to attend this meeting and to comment on the proposed amendments:

and place for a rehearing of the petition of Harold Reese and Frederick Reese
for relief from the Bulk requirements of the Zoning Code. as provided in Local

going to hold, at the advice of Counsel, to discuss further. . I'll put it 'on the
agenda for the January 8th meeting.

was not complete the last time we met, which 1, could make -now---

5. COUNCILMAN -SCHONDEBARE: Where, a.proposed Local Law No. 10 .1984 was
introduced at a meeting of this 'Board held on the 4th day of December, •1984, and
WHEREAS, a public hearing was held there on by the Board on the 18th day of
December, -19840 at which time all interested persons were given an opportunity to
be heard thereon, now, therefore, be it

I. Subdivision A(2) (Residence parking_ permits) of Section 65-3 of Chapter 65
(Parking at Beaches) is 'hereby amended to read as follows:
(2) The Town Clerk or a person designated by [him] the Town Clerk
shall inspect such application to determine that the applicant is a
qualified resident of the town. Upon approval of the application,
a resident parking permit shall be issued and inscribed with the
vehicle license registration number. Such permit shall not .be trans-
ferred to any other vehicle. [Upon payment of the permit 'fee, a
resident shall be entitled to a permit for each vehicle owned by
him' if'such vehicle is registered to an address withih the Town of
Southold.]
II. ' This Local Law shall take-effect upon its filing with the Secretary of State.

SUPERVISOR MURPHY: Number 13 is :a ,provisional appointment as a Bay Constable.
13. Moved by Councilwoman Cochran, seconded by Supervisor Murphy, it was
RESOLVED that the Town Board of the Town of Southold hereby appoints Michael
Fingerle, provisionally pending a .Civil Service test, to the position of Bay Constable
for the Town of Southold, effective January 1, 1985, at an annual salary of $13,000.00.
SUPERVISOR MURPHY: Any questions?
COUNCILMAN TOWNSEND: I'd like to table the motion to discuss how we could
accomplish some of the goals that I discussed in the Work Session. I think that---
although I have nothing against Mr. Fingerle, I'm sure he's doing an excellent job,
and has done an excellent job, by all reports at any rate, but I feel that we can
reorganize at this 'point and might set a trend towards increasing the efficiency in
Town government by doing it. That's all I'd like to say. So I request that 'we
table the motion.
TOWN CLERK TERRY: Are you making a motion?

SUPERVISOR MURPHY: Would someone like to second Joe's motion to table?
COUNCILMAN SCHONDEBARE: Let me ask a question. The last time this came
on l voted against it. I assume that the three of you down at the other end of
the table on the dais will vote for it, Joe' s against it. I don't agree with Joe
on the Police Department enforcing this ordinance. I don't see that working and
don't see that as a viable alternative to hiring someone. I was persuaded, by
the Trustees and their, comments today and .likewise by yourself, Mr. Townsend.
How long do you .want to table this 'thing, if 'we went along with tabling it?
COUNCILMAN TOWNSEND: Until the Police Committee has a chance to meet.
Until we discuss specific goals, what exactly the Police would do and how it
would work within!their existing grounds. Possible creation of a Marine--like
they have a Youth Officer, perhaps we could create a couple of officers to have
that duty that would be something that they would take into consideration ,when
the were assigned their 'tours of duty. You .know, we could :discuss the possibilities
of the various ways we could accomplish---, .

location of a public project, to consist of the acquisition of 2.796 acres of real
property located on the northerly side of Lower Road, at Southold, Suffolk County,
New York, and the construction thereon of a Recharge Basin, to alleviate highway
flooding conditions. The public project will be located on real property described
as follows: All that certain'plot, piece or parcel of land situate, lying and being

property, it's a two and a half acre piece that the Town is going to take through

you're going to lose the funds and you've got $5,000 in next years.
SUPERVISOR MURPHY: Right, and it's :not enough. We have to have a bill or
a proposal.
COUNCILMAN SCHONDEBARE: We can take money out of some unallocated part
next year and put it in if we wanted to, to go along with this budget. Obviously
we can, we've been moving money around back and forth all day long.
COUNCILMAN TOWNSEND: Could we just say that we would vote to--leave out the
section or at a total. cost of $12,600 for the Town of Southold if Riverhead does not
participate. Can we encumber the funds on .that basis; if we leave out that--that's
your question, right?
COUNCILMAN SCHONDEBARE: Yes.
COUNCILMAN TOWNSEND : Leave out that sentence and still encumber the funds?

participate. We -accept thisproposal with a. contingency. Can you accept a
proposal--can you still encumber on that basis, Bob?
TOWN ATTORNEY TASKER: Well, the letter of contract that you have has it both
ways. It says $12,.600 if 'you participate alone. If Riverhead participates the
amount is '$19,000.'. It's already in the agreement.
SUPERVISOR MURPHY: Why do you want to eliminate this---
COUNCILMAN SCHONDEBARE: Well, I might not go along with it if 'we do it by
ourselves, that's what I'm saying. I . might not be willing to spend $12,600.*
SUPERVISOR MURPHY: We haven't signed the agreement.
COUNCILMAN SCHONDEBARE: I know. I hope not.
SUPERVISOR MURPHY: We're authorizing us to.
,COUNCILMAN SCHONDEBARE: . That's .exactly what we're doing. If we go it alone
we'll pay $12, 600..
SUPERVISOR MURPHY: Now, we have the money budgeted. We have $8,500 'and
$5,'000 budgeted next year for this: .

would vote for that, but if it's .going to be a problem I would go along with
pulling that out until--if -it's going to be a problem in getting Jay's vote or some-
body elses vote. I would pull .it out. So we've got to decide would we be willing
to do this by ourselves if 'Riverhead doesn't go along. Are you willing to do that?
COUNCILMAN SCHONDEBARE: No.
COUNCILMAN TOWNSEND : Are you willing to do that?
COUNCILWOMAN COCHRAN : Yes.
SUPERVISOR MURPHY: 1 am.

COUNCILMAN TOWNSEND: I guess I would too, so---
COUNCILMAN SCHONDEBARE: Anyone who tells me he doesn't know what the
final--this is going to. cost us, if'we go it 'alone, $12,•600,' right? When we had
that meeting I asked the fellow from ERM, when he gets done with the final
product, how much is 'it going to cost the Town? He has no idea. Give me a
ball park. Are we talking a project of $10,•000 or over $100,000, and this fellow
still 'couldn't even give me that information.

SUPERVISOR MURPHY: Certainly, Jay, he couldn't. First of all, Jay, we haven't
decided, through looking at the specifics, exactly how you want to go. Do you
want to make this a mandatory type of thing? Do you want to do it on education
alone? There's very many aspects of it that has to be and you need a professional
to analyze it:
COUNCILMAN SCHONDEBARE: And he has no idea where he's headed. He has no
idea where he's going.
SUPERVISOR MURPHY : Sure we do.
COUNCILMAN SCHONDEBARE: He can't. He couldn't .give me a price tag or $10,000
or $1100,.000. That tells me a fellow who has no idea.
SUPERVISOR MURPHY: We've been working with the County for two years on this.
COUNCILMAN SCHONDEBARE: I know what you've been doing on it and I've been
following ,italong and that's .why I expected him' to come up with something that he
could give me, but he couldn't give me anything.
SUPERVISOR MURPHY: Absolutely not.
COUNCILMAN SCHONDEBARE: I don't buy it.' I think this qualifies for Senator
Proxmires Golden Fleece Award. I don't buy it: I don't see it.'

SUPERVISOR MURPHY: Okay, that's .the end of the prepared agenda. Is' there
any Town Board member like to have any other comments?
COUNCILMAN TOWNSEND: Just for the public: The issue you brought up on the
police school and so forth, I think it's a good issue and has broad implications,
because if you look at the ones you are appointing, they generally tend to be the
children of active Policemen and that's not saying there's any active discrimination
process going against anyone else, but that just says that they're the ones that
are informed because they happen to be the children of Police Officers, so F think
that it's a good point, Paul, and I think what we should do is develop a procedure.
COUNCILMAN STOUTENBURGH: I just think it 'doesn't look good to continually
have this and I think it really hurts the person who you have applying, a son
of somebody, because everyone is saying, "Oh, yeah, he knows somebody that
he can get in," and it's not fair to him by golly.
COUNCILMAN TOWNSEND: So we'll bring it 'up as a matter for the Police
Committee.
SUPERVISOR MURPHY: A policy where you advertise for this, right.
COUNCILMAN STOUTENBURGH: From now on.

COUNCILMAN SCHONDEBARE: Frank, if I just may, I would request that we
have a meeting of the Police Committee sometime next week, preferably 8:00 o'clock
in the morning, if 'you. want to do that, at which time we'll discuss what Joe just
brought up and likewise bring up about the Bay Constable, let me get the Chief s
opinion, because I'd be receptive to another resolution later on if this doesn't pan
out in the Police Committee.
SUPERVISOR MURPHY: Because we also have to discuss rules and regulations.
COUNCILMAN SCHONDEBARE: I have a. copy of that. I've gone over them.
SUPERVISOR MURPHY: Okay, no problem.
COUNCILMAN STOUTENBURGH : And I would just like to--when you have that
Police Committee thing, there is that concern of some people about a Review Board--
not Review Board--what would you call it? Police Grievance Board. If they would
feel this 'is an objectionable thing or necessary or what have you. I'd like an official
kind of feeling from the--
COUNCILMAN SCHONDEBARE.: When you say Police Grievance, is 'this the police
grieving or the.civilians grieving about the police?
SUPERVISOR MURPHY : Civilians.
COUNCILMAN STOUTENBURGH: Other towns have them and 1 think it's something,
if 'even if it's .never used, you've at least gone---
.SUPERVISOR MURPHY: Paul, 1 think this 'will 'start to be addressed by the rules
and regulations that we're looking to adopt.
COUNCILMAN STOUTENBURGH: Okay, it will be taken care of some place, but I
want it taken care of.

COUNCILWOMAN COCHRAN : I'd just like to wish every one a healthyand prosperous

RUTH OLIVA, North Fork Environmental Council:' 1'd just like to put the NFEC's
pitch in' for another Bay Constable. 1 don't see how you. can take the work load
of the Wetlands Applications off your shoulders and dump it on to the Trustees
without giving them some added help in'enforcement. And I don't see the Policemen
that are joining the Police Force, then to be turned over to a Marine Unit: If they
wanted to do that they would apply for the Bay Constable job and not just for a
Police job. And number two, 1, can see in the wintertime, if Dzenkowski is off,
people are still' clamming, you. could go .up to Hallocks every day and you see a few
boats out. Who's. checking on their 'permits? Do they have them or don't they have
them? We have laws, then we have to be willing to enforce them and have people
there to do it.' So, I think it's extremely important that we have another Bay
Constable. And second of all, I wish you a very healthy and prosperous New
Year,too. Thank you.
