Councilman Stoutenburgh (conference in Albany) . 9: 30 A.M. - The Board discussed off-agenda items and then recessed to hold two hearings on Notice under the.Unsafe Building and Collapsed Structure Law of the Town of Southold - Marlake. Associates, and Rose Koroleski. 10:30 A.M. - Special Attorney Richard F. Lark, and Executive Administrator Victor G. Lessard discussed the Walters junk yard property, and the Wetland Violations of Harbor Lights Property Association .and Bayview Development Corp. 10: 45 A.M. - Board of Appeals Chairman Gerard Goehrin er met with the Board to discuss his request to hire a public stenographer for the verbatim testimony of the Board of Appeals meetings, which was approved, and a request to meet with the Town Board at another date. to discuss divisions of property. 11: 10 A.M. - Board of Assessors Chairman Charles Watts met with the Board to update them on the total amount of exemptions which will. be reflected on the .1984-85 tax rolls. Mr. Watts also explained the impact on the Town by the amend- ment to the Veterans' Real Property Tax Exemptions. EXECUTIVE SESSION 12:05 P.M. - Executive Administrator Lessard met with the Board to further discuss the Harbor Lights Property Association violation, as well as personnel procedures. 12: 45 - Recess for lunch. 2:10 P.M. - Work Session resumed and Board reviewed regular meeting agenda items. 3:00 P.M. - Work Session adjourned. REGULAR MEETING 3:00 P.M. A Regular Meeting of the Southold Town Board was held on Tuesday, September 25, 1984 at the Southold Town Hall, Main Road, Southold, New York. Supervisor Murphy opened the meeting .at 3:00 P.M. with the Pledge of Allegiance to the Flag. Present: Supervisor Francis J. Murphy Councilman Joseph L. Townsend, Jr. Justice Raymond W. SEPTEMBER 25, 1984 425 SUPERVISOR MURPHY: I'd like a resolution to approve the audit of the Fishers Island Ferry District bills today. Moved by Councilwoman Cochran, seconded by Justice Edwards, it was RESOLVED that" audited Fishers Island Ferry District bills in the amount of $1,304.31 be and hereby are approved.- . Vote of the Town Board: Ayes: Councilwoman Cochran, Councilman Schondebare, Justice Edwards, Councilman Townsend, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: I'd like, a resolution to approve the minutes of a regular meeting of September 11, 1984. Moved by Justice Edwards, seconded by Councilwoman Cochran, it was RESOLVED that the minutes of the regular Southold Town Board meeting held on September 11, 1984 be and hereby are approved. Vote of the Town Board: Ayes: Councilwoman Cochran, Councilman Schondebare, Justice Edwards, Councilman Townsend, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: And lastly I'd like a resolution'to set the next meeting date for October 9th, 1984, 7:30 P.M., Southold Town Hall. Moved by Councilwoman Cochran, seconded by Supervisor Murphy, it was RESOLVED that the next Regular Meeting of the Southold Town Board will be held at 7: 30 P.M., Tuesday, October 9, 1984 at.the Southold Town Hall, Main Road, Southold, New York. SUPERVISOR MURPHY: Moving on to the first item on the agenda, Reports. I. REPORTS. SUPERVISOR MURPHY: 1'd like to remind everybody that: these reports are on file in'the Town Clerk's Office for anyone who would like to read them. 1. Town Justice Tedeschi.- August 1984. 2. Southold Town Police Department - August 1984. 10. Councilmen's reports starting with Jay. Do you have anything, Jay? COUNCILMAN SCHONDEBARE: We attended the Parks and Beaches--Councilman Stoutenburgh and myself, and Ray Dean. We had a meeting just the three of us originally and that was on September 18th, mainly with regard to he Pond and problems at the Gull Pond beach down there. Then we had another meeting again, Parks and Beaches, two days later on the 20th. - At that time we invited people who .were making complaints with regards to that area. They came in and we had a long discussion at that time and hopefully we're on our way to solving the problem. also attended a Recreation meeting and I'll let Councilwoman Cochran discuss that one. SUPERVISOR MURPHY: Thank you, Jay. Joe? COUNCILMAN TOWNSEND: The Farmland Preservation Committee me on the same night as the Recreation, the aforementioned Recreation Committee met and they have decided on two appraisers to do the appraising of the parcels of property. Now that we've floated the bond they're in a hurry. They've got the bit in their teeth and they're in a hurry to- make some acquisitions. It's going to be a long 'process. We've got a lot of distinct personalities on the Committee, each one has his own point of view and nonetheless we seem to be able to reach a concensus at the end of every board meeting which is sometimes miraculous, and now they're going to be sending invitations out to the people that have submitted bids to bring in either sketch plans or surveys of their property to determine what portion .of their properties they're actually offering. On the basis of that they're going to go and look at the properties they consider the most desirable and authorize appraisals of those properties. There's a resolution on the agenda tonight authorizing an expenditure for these appraisals. That's all I have. SUPERVISOR MURPHY: Thank you, Joe. Jean? 426 SEPTEMBER 25, 1984 COUNCILWOMAN COCHRAN: Update on the Belt Safety Program. I received the "Buckle-Up" safety bumpers on Thursday last and to date 12,250 brochures have been distributed to local business and in addition some stickers in some places. Bumper stickers have been distributed to the Southold Town Police Department, and I believe they're already on the cars. To the Southold Town Highway Depart- ment and to all the departments in Town Hall. Also this morning each Town Board member received a bumper sticker and I hope that they'll put it on their back bumper to set an example and use their seat belt also. Solicitation of prizes have begun and we are beginning to receive. assorted prizes from our local businesses. Additional brochures, posters and stickers will' be distributed over the next few days. In relation to the Recreation meeting that was held on Thursday the 20th, the Recreatic Committee held a public meeting in relation to .the creation of a Town-wide Recreatior Program. We had a total of 28 persons attend,_ including members of the Town Boaru. The purpose of the meeting was to update those attending on the proposed budget submitted to the Supervisor by the Recreation Committee and for those attending to have the opportunity for input as to their. needs in the area of recreation. I felt that we had a good cross .section.of the community attending. We have had rep- resentation from schools,. the handicapped, interested parents, church groups, seniors, youth groups and service clubs. A summary of comments: lack of coordination, lack of activities during times of the year, lack of activities for pre-schoolers, lack of activities after school causing many latch-key children in the community, lack of activities for physically handicapped, such as weekends, Christmas and leisure time, lack of activities for children and young adults, lack of activities from eleven to twelve years old, lack of activities for nineteen and twenty. You can see that everyone attending saw many needs in--and of course they expressed themselves in relation to the needs that they sought within their particular group. I would .say the concensus, or what I heard after listening to the ind.ividuals that attended, ,was that they felt that the request for services was development of additional programming, developing of new programming and a great, great need for coordination. They also felt that there was a need for Town support and financial support. Some felt that there was not parity in the support that they were now receiving. . We also had representation from the Southold and Greenport Rotary and they offered theirsupport to the project. felt the meeting was both productive and positive. Thank you, Frank. SUPERVISOR MURPHY: Thank you, Jean. Ray? JUSTICE EDWARDS: Just that things are quiet on Fishers Island. Eighty percent of the people have left for the winter. The clamming has been good and I'm going on a vacation. Thank you, Frank.. SUPERVISOR MURPHY: Enjoy it. I'd just like to mention Paul Stoutenburgh is not here today. He and Jim McMahon are up at a Waterfront Revitalization Conference in Albany. They will be back tonight. We have good news that we are supposed, to be receiving our grant that we applied for, which is most necessary for us to start to. addressing the road run-off problem in the Town and as soon as we get this grant we would like to start working on it. I would like to also invite any of the press and arty people who are concerned, tomorrow to listen to talks on some innovative programs that can be done in landfills to reduce volume. It's going to be held down at Porky's Restaurant at 11 o'clock for the East End Super- visors and I would welcome anyone down to listen to the presentation. That's about it. We'll .move on to the second item on the agenda which is Public Notices. Il: PUBLIC NOTICES. SUPERVISOR MURPHY: The first one is a U. S. Corps of Engineers notice of an application by Tosca Holding and Realty Corp. to construct a timber groin in East Marion. Written comments to the Corps by October 6, 1984. COUNCILWOMAN COCHRAN: Suffolk County Department of Works, designation of restricted highway on Oaklawn Avenue, Town of Southold, between Pine Neck Road and Wells Avenue/Jockey Creek Road. JUSTICE EDWARDS: Number 3 is a Notice of Complete Application by David Rosenberg to construct a one family dwelling approximately 43 ft. from tidal wetlands with associasted sanitary system a minimum of 100 ft. from tidal wetlands. A variance of 32 ft. is requested to the tidal wetlands Land Use Regulastions. The project is located at the weternmost portion of Mattituck Creek, on Cove Neck Road, Mattituck.. Comments to Dennis W. Cole, NYS-DEC, Stony Brook by October 3, 1984. SUPERVISOR MURPHY: Number 4 is an application of-James Bitses . to the DEC to construct 250 ft. of bulkhead in the intertidal and high mars area of the applicant's property and install an 8 ft. by 24 ft. .floating dock and comments to New York State DEC, Karen Chytalo in Stony Brook by October 6, 1984. I would like to remind everybody that these are posted on the Town Clerk's Bulletin Board. Joe. SEPTEMBER 25, 1984 427 COUNCILMAN TOWNSEND: Number 5 is another notice of complete application before the Department of Environmental. Conservation for Bernard O. and Eleanore I. Monson for a timber bulkhead located on the northerly end of Budd's Pond, Southold, New York. Contact person is David DeRidder, NYSDEC, Building 40, SUNY, Room 219, Stony Brook, New York. All comments are to be sent in prior to October 5, 1984. COUNCILMAN SCHONDEBARE: Number ..6 is a New York State Department of Environmental Conservation-.notice to the Baymen on the temporary closure of shellfish lands in Flanders Bay, September 8 through and including September 29, 1984. COUNCILMAN TOWNSEND: Number 7 is .another notice of complete application for DEC by John R. Dempsey to construct a one family dwelling in' accordance with 43 ft. apparent average seback and a timber retaining wall. That's located on the west side of Goldsmith's Inlet, Peconic. Contact person at the DEC is Robert N. Thurber, at the aforementioned location in Stony Brook.. Comments are to be in before October 12, .1984. SUPERVISOR MURPHY: Thank you,. Joe. Moving on to the third item on our agenda,..correspondence. 111. COMMUNICATIONS. SUPERVISOR MURPHY: The first is a very nice letter thanking the Town Board for their kind expressions of sympathy from Mrs. Ken Godfrey and her daughter. Again I'd like to publicly thank the Godfrey family for all that Ken has done for the Town. 2. A very nice letter from Adelaide Silkworth praising the Nutrition Center and the work that's done down there and we sent copies to Vee McKeighan and to our cook who has been doing a tremendous job. 3. From the Suffolk County Department of Public Works. notifying us that the contract was awarded for the Oaklawn Avenue Bridge. SUPERVISOR MURPHY: Number IV we had two public hearings on unsafe buildings this morning (Marlake Associates-and Rose Koroleski), and we'll move on to Number V, Resolutions. V. RESOLUTIONS. 1. Moved by Justice Edwards, seconded by Councilman Townsend, it 'was RESOLVED that the application of Sophie T. Saunders, for renewal of her single family house trailer located on the north side of Main Road, Laurel, New York, which permit expires on October 7, :1984, be and hereby is 'granted for a period of six (6)� months. SUPERVISOR MURPHY: Any questions? (No response.) I.-Vote of the Town Board: Ayes: Councilwoman Cochran, .Councilman Schondebare, Justice Edwards, Councilman .Townsend, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 2 is another trailer permit renewal. 2. Moved by Councilwoman Cochran, seconded by Justice Edwards, it was RESOLVED that the application of Martin Sidor, for renewal of his single family house trailer for housing of trainees under the Agricultural Program - National 4-H, located on the south side of Oregon Road, Mattituck, New York, which expires on September 23, 1984, be and hereby is 'granted for a period of six (6) months. SUPERVISOR MURPHY: Any questions? (No response.) 2.-Vote of the Town Board: Ayes: Councilwoman Cochran, Councilman Schondebare, Justice Edwards, Councilman Townsend, Supervisor Murphy. This resolution was declared .duly ADOPTED. SUPERVISOR MURPHY: Number 3 we're going to hold (decision on Harbor Lights Property Association Wetland Application.) Moving on to 4 is in support of OCS Revenue sharing legislation. 4. Moved by Councilman Townsend, seconded by Justice Edwards, it 'was RESOLVED that the Town Board of the Town of Southold hereby goes on record in support of the Outer Continental Shelf. (OCS) Revenue Sharing legislation which is now before Congress, and directs that the Town Clerk transmit a letter to Congressman William Carney conveying their support for this legislation and request- ing his favorable vote for this measure when it reaches the floor of the House. 4.2 8 SEPTEMBER 25, 1984 SUPERVISOR MURPHY: Any questions on it? COUNCILMAN TOWNSEND: Maybe you ought to explain what this does. SUPERVISOR MURPHY: We're really not sure exactly what it does, but it's Revenue Sharing that the oil drilling companies have to pay to the State and the State has to then spend this money on waterfront communities. This is where we expect this money to be coming and in the future quite large sums of it. This first is just money that we're talking about before on Jim" and Paul are up for, is just on the planning and when the money comes from the offshore. drilling this is where it will be spent on this waterfront revitalization, various programs like ,this. We should be very much in support of it. COUNCILMAN SCHONDEBARE: In accordance with my past practice, if I don't have the legislation in front of me, what we think it might do and what it might do, I'll abstain on voting on this issue. Not because I have any interest in offshore oil leasing, but I want the legislation. -COUNCILMAN TOWNSEND: We have an encapsulated version here, it says, "proposed legislation will establish a grant program which will enable the State and its coastal communities to continue their coastal managment activites, including waterfront revital- ization, natural resource protection and commercial fisheries development. The measure will provide local governments with a major opportunity to carry out waterfront research, designs and preconstruction activities needed to rejuvenate our waterfront. Legislation will also. provide construction,funds for small scale projects leading to the redevelopment of deteriorated. waterfronts, stabilization of eroded shorelines and the acquisition of lands to preserve sensitive areas. In addition, the measure will assure us of a continuing opportunity to protect our coastal resources such as Camp Hero property at Montauk Air Force Station through the consistency provisions of the Coastal Management Program. This measure will also assure that oil 'and gas production on the outer continental shelf will proceed in an environmentally sound manner." And on the basis of that I'm going to vote for it, because we have a -lot of activities. COUNCILMAN SCHONDEBARE: I'm:sure the person who wrote that knew what they were talking about. On the last paragraph they say, and this is addressed to Town Supervisor Francis J. :Murphy, "As Supervisor of the Town of Huntington, you may wish to convey your support for this OCS resolution and legislation to Congressman William Carney." . So on the basis of that I think I'll pass on this one. SUPERVISOR MURPHY: Typographical error. COUNCILMAN SCHONDEBARE: Typographical error. SUPERVISOR MURPHY: You should see. some of the letters I get. Okay, any other questions? (No response.) 4.-Vote of the Town Board: Ayes: Councilwoman Cochran, Justice Edwards, Councilman Townsend, Supervisor, Murphy. Abstain: Councilman Schondebare. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY; Number 5 we're going to hold, not act upon. (Request for contribution toward the cost .of dredging the inlet to the pond at Wunneweta Pond, Nassau Point, Cutchogue.) Number 6 is to extend the appointment of the Temporary Fire Inspector. : 6. Moved by Councilman Schondebare, seconded by Councilwoman Cochran, it was RESOLVED that the Town Board of the Town of Southold hereby extends the appointment of Temporary Fire Inspector Robert A. Fisher, which expired on September 15, 1984, to June 30, 1985, not to exceed 80 hours per month, at his present salary of $8..00 per hour. SUPERVISOR MURPHY: Any questions? (No response.) 6.-Vote of the Town Board:. Ayes: Councilwoman Cochran, Councilman Schondebare, Justice Edwards, Councilman Townsend, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY; Number 7 is to appoint a Traffic Warden. 7: Moved by Justice Edwards, seconded by Councilman Townsend, it was _RESOLVED that the Town Board of the Town of Southold hereby appoints Peter Grattan, Sr. as a Traffic Warden, effective immediately, at a salary of $4.50 per hour. 7.-Vote of the Town Board: Ayes: Councilwoman Cochran, Councilman Schondebare, Justice Edwards, Councilman Townsend, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 8 is to authorize a name for a path in the Town of Southold. 429 SEPTEMBER 25, 1984 8. Moved by Councilwoman Cochran, seconded by Councilman Townsend, it was RESOLVED that the Town Board of the Town of Southold has no objection to the establishment and maintenance of the name OLD WOOD PATH for a certain presently unnamed private road, which road proceeds in a general southerasterly direction from South Harbor Road in the hamlet of.Southold, all in accordance with the request by petition of all of the property owners whose properties abut the road in question. JUSTICE EDWARDS: Question. Does that mean the Town of Southold is going to maintain the road? TOWN CLERK TERRY: No, they just want to.maintain the name. 8.-Vote of the Town Board: Ayes: Councilwoman Cochran, Councilman Schondebare, Justice Edwards, Councilman Townsend, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 9 is 'authorize Curt Horton to attend a conference. 9. Moved by Justice Edwards, seconded by Councilman Townsend, it 'was RESOLVED that the Town Board of the Town of Southold .hereby authorizes Code Enforcement Officer Curtis W. Horton to attend the State Education Department orkshop on Fire Prevention and Building Code Enforcement to be held on November 8, 1984 at Howard Johnson's Motel, Lake Placid, New York, and the registration fee for same shall be a legal charge against the Building Department Contractual Account. SUPERVISOR MURPHY: On the question. He's going up to the one--there is one being given down in'Suffolk County later on "in' the month and the other two members of the Building Department will be going. Curt's going to be on vacation up there and. he's going to take a day of his vacation, go back to work, and then go back on vacation again. He's not being paid travel expenses or anything, just his necessary expense for that day. _ 9.-Vote of the Town Board: Ayes: Councilwoman Cochran, Councilman Schondebare, Justice Edwards, Councilman Townsend, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 10 is to authorize attendance at a conference. 10. Moved by Councilman Townsend, seconded by Councilwoman Cochran, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes all Town Board Members and all Water Advisory Committee Members to attend the Long Island Groundwater Quality - Today and Tomorrow Conference sponsored by Cooperative Extension Nassau County, at the Plainview Holiday Inn, Plainview, New York on Tuesday, October 16, 1984, and the $20.'00 per person registration fee, as well as necessary expenses for travel .shall be a legal charge against the Town of Southold. SUPERVISOR MURPHY: Any questions? (No response.) 10.-Vote of the Town Board: Ayes: Councilwoman Cochran, Councilman Schondebare, Justice Edwards, Councilman Townsend, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 11 we're going to hold. (Transfer within Refuse- & Garbage A8160, and payment to Morbark Industries, Inc.) Number 12 is to authorize Judge .Edwards to attend a conference. 12. Moved by Councilwoman Cochran, seconded by Supervisor Murphy, it was RESOLVED that the Town .Board of the Town of Southold hereby authorizes Town Justice Raymond W. Edwards to attend the Town Justice Advanced Train- ing Course at Ellenville, New .York on October 8, 9 and - 10, 1984, and the necessary and actual expenses for travel, meals and lodging shall be a legal charge against the Town of Southold. Contractual Account. 12.-Vote of the Town Board: Ayes: Councilwoman Cochran, Councilman Schondebare, Justice Edwards, Councilman Townsend, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 13 is to accept a proposal for auditing. 13. Moved by Councilman Schondebare, seconded by Councilwoman Cochran, it was RESOLVED that the Town Board of the Town of Southold hereby accepts the proposal of Elaine F. Kaldor, C.P.A. , P.C.; and authorizes the Supervisor to sign same, for the audit of the books and records of the Town of Southold and its grant programs for the year ended December 31, 1984 for the following fees: 1) Financial & Internal Control Audits: Town Audit $3,800. 00 Grants Audits 1,550.00 2) Compliance Audit 'of FRS Funds 500. 00 Total - . $5,850.00 430 SEPTEMBER 25, 1984 SUPERVISOR MURPHY: Any questions? This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 14 is a proclamation we could make now and there are some members of clubs coming in at 4 o'clock that we could give them their proclamation at that time, but we could put it on record. 14. Moved by Councilwoman Cochran, seconded by Councilman Townsend, WHEREAS, the 4-H program of Cooperative Extension since its beginning 63 years ago has contributed much to the health and welfare. of .the Nation and has encourage many young people to choose careers which help improve family and community living; and WHEREAS, during this .week .4-H members, leaders and families will'observe National 4-H Week with the theme: "4-H - Building on Experience," and WHEREAS, 4-H members put'into. practice the skills and science they learn as they develop their talents through 4-H projects and strive to "learn for living;" and WHEREAS, in these changing times young people, who are citizens of tomorrow, must discover and acquire the virtues of responsibility, thoughtfulness, morality and understanding; and WHEREAS, the more than 500 volunteer adult 4-H leaders are organizaing their 4-H Clubs for the •1984=85 year, many others are organizing clubs for the first time; and WHEREAS, the more than 130,000 boys and girls participating in 4-H programs throughout Suffolk County soon will be taking their places in society by establish- . ing homes of their own and joining the ranks of community leaders, now, therefore, . be it RESOLVED that the Town Board of the Town of Southold, in recognition of the fine achievements of 4-H members and their families do hereby proclaim the week of October 7 - 13, 1984 as NATIONAL 4-H WEEK in the Town of Southold. This resolution was declared duly ADOPTED. . SUPERVISOR MURPHY: Number 15 is a pending decision on a relief petition. 15. Moved by Councilman Townsend, seconded by Councilman Schondebare, WHEREAS, Anna Fiore, Michael. Longo, Larry Stein, Christian Christake, J. Evangelista and S. Evangelista, by petition dated April 3,. 1984, applied to the Southold Town Board for relief from the Bulk requirements of the Zoning Code with regard to major subdivision entitled "Subdivision of Richmond Creek . Farms," consisting of 49. 9 acres and located on the south side of Main (State Route 25). Moved by Supervisor Murphy, seconded by Justice Edwards, WHEREAS, the Town of Southold has a varied coastline of rocky shores, sandy beaches, productive estuaries and .salt marches, urban ports and small harbors, tidal flats and dozens of islands; .and WHEREAS, the coast has provided us with a rich scenic, cultural and historic heritage; and WHEREAS, the natural resources of the coastal zone are among our most important . economic resources; and WHEREAS, the marine environment is 'one of the most valuable resources supporting an active fishing industry; and WHEREAS, coastal landforms, especially barrier beaches, provide sufficient protection from coastal storms, flooding and erosion; and WHEREAS, we are strongly committed to the wise management of the coastline to ensure for all the residents that the environmental and economic value of the coastal zone will be sustained, and WHEREAS, the coastline is also receiving nation-wide recognition during the week of October 7 - :14, 1984:as a valuable but threatened resource, now, therefore, it is hereby PROCLAIMED by the Town. Board of the Town of Southold that the week of October 7 - 14, 1984 shall be COASTWEEK in the Town of Southold, and urge all citizens to take cognizance of this event and .to participate fittingly in its observance. Building.--.Inspector _of .the_.Town.. of Southold has.,made .a. formal inspection of premises owned by Marlake Associates, and shown and"designated on Suffolk County Tax Map as: District 1000, Section 85. 00, ,Block 001. 00; Lot 005. 00, and thereafter prepared a written report thereof and filed the same in his office, and WHEREAS, it was determined by the Building Inspector that the building or structure on said premises is dangerous or unsafe to the public, an WHEREAS, the Building Inspector promptly thereafter served a notice on the owner or other persons having an interested in' said property, pursuant to the provisions of Chapter 90 of the Southold Town Code, and WHEREAS, said notice required that the owner of said premises secure or remove the buildino or structure, securing or removal to commence within ten days from t e date of the service of said' notice and that the same be completed within thirty days thereafter, and WHEREAS, the owners of said premises has neglected or refused to comply with the provisions of said notice within the time specified therein, an WHEREAS, a public hearing on said:matter was held by this Board on the 25th day of September, 1984.
