i 9:35 A.M. = James H. Redman, DEC Marine Resources Specialist III met with the
Board, to discuss his bacteriological water quality studies in Mattituck .Creek and
Arshamomaque Pond. Mr.. Redman advised the Board that he is recommending to
his superioors that all of those creeks. be designated as uncertified shellfish:lands
and should be closed by the end of September. He asked. the Board to send their
..comments to Peter. Van. Volkenburgh, Chief of the Bureau of Shellfisheries. Super-
visor Murphy said' he would schedule a meeting between Mr. 'Redman, Bay.-Constable
Dzenkowski, Paul Flagg and a Town Trustee.
•10:20 A.M. - Gary E. Loesch, P.E. , Holzmacher,• McLendon & Murrell; P.C. met
with- the Board.Ao..dis.cuss the .proposed Southold Scavenger Waste Pretreatment
Facility Scavenger Waste Ordinance. . : He will work with Town Attorney Tasker in
the preparation of an ordinance appropriate for the Town of Southold.
10: 45 A.M. Off-agenda items: Request of Burton Potter Post. No. 185, American
Legion, Greenport.for funds to improve their'building. N.Y.S. Dept. of State
Workshop on Local Waterfront Revitalization Program, Albany - to be attended by
Councilman' Stoutenburgh and Community Development Director McMahon. Request
of Executive Administrator Lessard• for vacation time to use his 'accumulated over-
time. Letter from Arthur W. Hughes, Ole Jule Lane, Mattituck relative to excessive
morrings in'James Creek - referred to the Trustees. Request of Institutional
Securities Corporation to supply tape, punch cards or. computer printout of appro-
priate tax bills to be sent to them.
11: 00:A.M::=. Community Development Director McMahon met with the Board to
update them on the 1984 Section 8 Existing Housing Program. There were 94
applications received for.the .35 'available. housing units. At the present time
. those applicants are being screened for. verification of income and other criteria.
11: 10 A.M. - The Board resumed reviewing off-agenda items.
11:35 X.M. - Trustee President Henry Smith met with- the Board to discuss the
proposed Local Law for standard bushel bags for commercial scallopers. There
was also discussion concerning the .10 bushel limit in'State waters and 5 bushel
limit in Town waters and the possibility of the State and Town reaching an agree-
ment on a mutually agreeable limit.
12:35 P.M. - Recess for lunch.
2:00 P.M. - The Board reconvened with hearings. on.violations-of-the Unsafe.
Building Ordinance by Bassford, Schmidt S Honnett, and. Nicholas Schick, Inc. -

REGULAR MEETING

A Regular Meeting of the Southold Town Board was held on Tuesday, September
11, 1984 at the Southold-Town Hall, Main Road', Southold, New York, Supervisor
Murphy opened the meeting at 7:30 P.M. with the Pledge of Allegiance to the Flag.

the.'audit'of today.
Moved by Councilman Stoutenburgh, seconded by Councilman Schondebare, it was
RESOLVED that the following audited bills be and hereby are approved for payment:
General Fund Whole Town bills in the amount of $28,332.37; General Fund _Part Town
bills in' the amount of $15,914.62; Highway Department bills in the amount of
$70,861.78;. Fishers. Island Ferry. District bills in the amount of $11,585.26; Federal
Revenue .Sharing bills. ins the amount of $200.'00; and Scavenger Wastewater Treatment
Plant-bills 'in: the-amount of $6,230.'63.

RESOLVED that the minutes of the August 28,' •1984 meeting of theSouthold Town
.Board be and hereby are approved.

establishment of a Housing Committee. Councilman Stoutenburgh read the.following
statement he made at a meeting of the DEC relative to Wetlands held in Riverhead on
August 29, .1984:
"My name 'is •Paul Stoutenburgh, Councilman from' Southold Town and represent-
ing the Southold-Town Board at.this meeting. Sometime ago our Planning Board asked

.the North Fork Environmental Council to do an inventory of the freshwater wetlands
in Southold Town. Under the leadership of Loraine Terry, a former president, the
survey was completed and presented to the Planning Board. . It is our understanding
that you now have these maps in your possession. It is 'the request of the Southold
Town Board that these designated wetlands, after review by your department, be
included in your official wetland map for the Town of Southold. The Board also
requests,that the Town of Southold be designated as a "sole source aquifer." . Verifica-
tion of this can be seen on examining any map and seeing that the town actually has
.three main eland'bodies
surrounded by salt water. The first runs from Deep Hole
Creek to. the south and Mattituck Inlet to the north and then on to the east to Mill
Creek to the south and Arshamomaque Pond to the north. The second land area
surrounded by salt water is 'the one running from the last mentioned waterways to
the Causeway that separates East Marion and Orient. The third being the Orient
area to the east. Between these landmasses there is only a few hundred fee to
a .few thousand feet separating Long Island Sound from the bays- to the south. We
have a limited water supply in Southold Town. and.this limitation.is the larges single
factor that controls the growth. and prosperity now and in the future of our town.
The Board sincerely hopes you will'consider recommending this sole source aquifer
classification for our Town."
Councilwoman Cochran reported on her attendance at the Commerce and Industry
Committee with the Chamber of Commerce, the Safety Belt Program and her -recent
trip to Canada and a visit to the Royal Mounted Police. Justice Edwards reported _
on the winding-down of the summer season on Fishers Island. Supervisor Murphy
reported on his attendance .at a meeting .of the. Nassau 'and Suffolk County Supervisors
concerning the Landfill Law. : - ..Supervisor M.urphy then:.extended best wishes to
Traveler-Watchman report Bill'James who is leaving that job to work in New York City.

III. COMMUNICATIONS.
SUPERVISOR MURPHY: The following communications are on file in the Town
Clerk's Office or the Supervisor's .Office for those wishing to review them.
1. The first one is from. Frank Hinderman to Mr. Dean, a .note of thanks
for his prompt attention to the problem at the end of Pierce Drive. at Eugene's
Creek, Cutchogue. His department has done a much more. extensive job and
hopefull erosion,problem has been taken care of. We hope so too.
2. From the Mattituck Fire Department, Chief John Harrison, thanking the
Police Department and the Town for their cooperation on thei r'tournament on
August 11th.
3. A petition of 84 signatures. concerning the Norman Klipp Memorial Park
and there are people here I know and I would like. to make some comments on it.
would like to thank you for bringing this to .the Board's attention. There is a.
meeting scheduled with Mr. Dean and the Parks. and Recreation Committee in .the
very near future. to address this: We weren't aware of the real seriousness of
the problem and I'd .like to.thank you people for taking the time out to bring it
to our attention and you could be rest assures that this 'problem will be taken
care of properly and that thiswill' not happen again next'year. . We had ,a man
who had been doing this -I:.don't want to make any excuses for anybody, and it
Just ,was not done the way it was done in the past and the Town Board, .I think, ..
as a whole is. very sorry that this did'take place and cause so many people to
be disturbed where you have to sign a petition and you have to come out here.
We will work with you. I would like -to meet personally with some members of
the group that signed this 'and arranged the- petition to see it- and then work
with Mr.- Dean and the Parks and Recreation Committee to make sure that this
does not happen again. It's .a brand new. committee--all members are new, so
that's .one.of the reason we really weren't aware of this potential problem and
again I'm.very sorry. Is there someone here would like to comment on a petition?
COUNCILMAN SCHONDEBARE: Frank,; before you begin; let me just say that
one the things I forgot to comment on when I was giving my report is that there
was a Parks and Beach Committee meeting--1 .think we did' it last--when did we do
it Paul? Paul Stoutenburgh was there. with me. Last week,: wasn't it?
COUNCILMAN' STOUTENBURGH: Yes.
COUNCILMAN SCHONDEBARE: Last Wednesday morning about 8:30 in' the morning.
It was the end of the season we asked, to set up the meeting to find 'out how did
go, and the information that we received from our representative at this meeting
at this meeting that everything was fine. . Some salary increases, but what was
contained in' your letter and what.we. heard at.this committee meeting was totally
two different things and we weren't even aware of it, so as the Supervisor says,
we're going to have to listen--we're setting up another meeting, hopefully some
time next week, and find out exactly what's going on.
SUPERVISOR MURPHY: Anyone like to add anything further? Yes, . sir?
MR. EDWARD TOBER, Inlet Lane, Gr.eenport: Mr. Murphy, when you said "it"
won't happen again, I hope you're aware that the "it" encompasses a number of
different things.
SUPERVISOR MURPHY: I see, yes.
MR. TOBER: You're using it as a general, condition.
SUPERVISOR MURPHY: Definitely, yes.
MR. TOBER: All right, thank you.
SUPERVISOR MURPHY: Any other comments on it? Okay, again we're sorry.
This should not happen to our beaches.
III..:COMMUNICATIONS. (Continued) :
4. New release from Dimension Cable Services of Long Island of.a new general
manager. I met the man, Michael Giampietro. He comes from Massachusetts. He
will be in charge of this whole area. He was a:,former general manager of the, Haverhill,
Massachusetts cable system and he has also worked as. an aide to the Governor of
Massachusetts before he went into ithat system. He's. very alert; very aware of our
biggest concern out here the attitude of cable T.V. to the people where the previous
manager really didn't think there was anything wrong with the system and that their
office staff and .everything was doing a very good job. We've tried to get the message
across that they really weren't..
SUPERVISOR MURPHY: We have about five minutes before.the first public hearing
scheduled for tonight is 'opened, so we'll move on to Number V, Resolutions.

RESOLVED that the Town Board of the Town of Southold hereby authorizes and
directs Supervisor Francis J. Murphy 'to enter into an agreement with Sidney B.
Bowne E Son to conduct an engineering/survey of the Skunk-Lane, Cutchogue
flooding problem, at a cost not to exceed $3,000.00.

as time and place for a public hearing on the petition of Harold Reese and Frederick
Reese for relief from the Bulk requirements of-the Zoning Code of the Town of .
Southold as provided in Local Laiw..No. 17 1983,. with regard to major subdivision
known as Harbor Lights, Section V, .consisting of approximately 39 acres and located
on the north side of North Bayview Road, Southold, New York..

3. Moved by Justice Edwards, seconded by. Councilwoman Cochran, it was
RESOLVED .that the Town Board of the Town of Southold hereby authorizes the .
1984 CROP Walk for Hunger to be .held' on Sunday, October 21', 1984, beginning
at. 1 :00 P.M. , using the following Town roads in'Mattituck and Cutchogue: Maple
Avenue, . Cardinal Drive,' Blossom Bend', New Suffok Avenue, Moores Lane and
Reeve Avenue, provided they secure and maintain sufficient insurance to hold the
Town of Southold harmless.
SUPERVISOR MURPHY: Any. questions on this? (No response:) This is a joint
effort with the various churches and .groups in schools and groups, service clubs
and all, in'the Town, to make .people more aware and to try .to raise food and funds
for this program.

SUPERVISOR MURPHY: Number 6 is a proclamation relative to Minority Enterprise
Development Week in the Town of Southold.

WHEREAS, America's growth and prosperity depend on the full participation of
all its citizens. If we as a Nation are to remain the world's leader in innovation,
technology and productivity; we must. ensure that. all Americans are involved in .
our economic progress, and

WHEREAS, the fulfillment of this challenger has become more realistic today, because
of.the significant contributions of minority American entrepreneurs to our economy.
The--Nation's 600,000 minority-owned business reveal the true meaning of entrepren-
eurship. They have emerged as a dynamic force in' the market-place, bringing
innovative products and services to our economy,- and constituting the principal
source for jobs and training for thousands of American workers; and
WHEREAS, as we enter an era of greatly expanded opportunities in economic growth -
and evelopment,, it is appropriate that we encourage minority- business owners by
recognizing their tremendous contributions toward the continued economic development
of our Nation, now, therefore, be it ,
RESOLVED that the Town Board of the Town of Southold do hereby proclaim the week
of October 7 through October 13, .1984 asl MINORITY..ENTERPRISE DEVELOPMENT WEEK,
in the Town of Southold and urge all Town residents to. loin together with the minority
business enterprises of our Nation in appropriate .observances.

RESOLVED that the Town Board of the Town of Southold hereby authorizes and
directs the Town Clerk to place a public notice in The Long Island Traveler-
Watchman and The Suffolk Times notifying the public that the Town Board will
consider proposed amendments to the Community Development Year 9 Program
Budget at their Regular Meeting to be held at 7: 30 P.M. , . Tuesday, October 9,
1984 as follows and invites interested citizens to attend this meeting and to comment
on the proposed amendments:

that it come under the--or be part of a Town program, and since we have a Juvenile
Aid Bureau, this individual would act as a counselor doing family counseling and
individual informal. counseling as far as the Juvenile Aid' Bureau is concerned. It's
100 o reimbursable and should incur no expense, or will*not incur any expense to
the Town.
COUNCILMAN SCHONDEBARE: You're just- changing the labels from which the
funding comes from?
MR. McMAHON: Yes. It's no longer going to be funded to a non-profit, it will
be funded to the Town of Southold.

New York,. and the actual and necessary expenses for travel, meals and .lodging shall
be a legal charge against the Town of Southold.

BE IT ENACTED. by the Town Board of the Town of Southold as follows:
Chapter 48 of the Code of the Town of Southold is hereby amended
as follows: (additions are indicated by underline; deletions by
[brackets] ) .
.I. The word "REFUSE" set forth in §48-1 thereof is hereby amended.
to read as follows:
REFUSE - Any human, [or] animal or vegetable refuse, offal,
swill, cesspool and/or septic waste, sewage, garbage, paper,
ashes, junk, trash, rubbish, waste, of whatever material
composed, discarded machinery or parts thereof, discarded
vehicles or parts thereof and an unlicensed motor vehicle
parked, stored or standing outside :an enclosed building in
an inoperative condition for more than thirty (30) days.
II. -- .The term "REFUSE DISPOSAL AREA" set_ forth . in' §48-1 thereof
is hereby amended to read as follows :
REFUSE DISPOSAL AREA - The sanitary landfill site owned and
operated by the Town of' Southold located north of County Route
48 at Cutchogue, New York, and any premises designated by
the Town Board as [the] a refuse disposal area of [this] the
town for the disposal of refuse by the residents of [thi8T
the town.
III. Subdivision C of §48-3 thereof is amended to read as follows:
C. No vehicle shall be permitted to transport refuse into
any refuse disposal area maintained by the Town of
Southold unless such vehicle displays a valid [parking]
permit and/or license issued pursuant to the provisions
of 1548-3 of the Code of the Town of Southold. ] this
chapter. ,
IV. -948-4 and §48-5 thereof are renumbered §48-5 and §48-6
respectively.
V. A new §48-4 is added thereto, to read as follows :
§48-4 Permit and License Fees.
A. The fees for .the issuance of permits and/or licenses
for vehicles transporting refuse into any refuse disposal
area maintained by the Town of Southold shall be as follows :
(1) Parking permit - For non-commercial vehicles of
less than one ton. capacity owned by a resident
and or taxpayer of the Town of Southold and
......transporting only household refuse, provided that
such vehicle displays a valid parking permit issued
pursuant to the provisions of §65-3 of the Code
of the Town of Southold.
(2) $ ,50 (fifty cent) Per Load Fee - For each non-
commercial vehicle of less than one ton capacity,
which possesses not permit.
(3) $15 . Per Load Fee - For each single axle truck which
does not possess a permit.
(4) $25 . Annual Fee - For each commercial vehicl e. -
transporting liquid septic waste, together with
an additional fee of $ .01 (one cent) for each gallon
of liquid waste discharged.
(5) $25 . Annual Fee - For each commercial contractor' s
vehicle of less than one ton maximum gross vehicle
weight.

B. Issuance and Duration of Permits and/or Licenses.
All permits and/or licenses provided for in this chapter
shall be issued by the Town Clerk . All annual permits
(including those previously issued) shall expire one
- -- year from the date of the issuance thereof.
C. Refund of Fees.
In the event that the Town Clerk has heretofore issued
permits for vehicles transporting refuse into the town
landsite at Cutchogue, and the fees paid therefor exceed
the fees provided for herein, the Town Clerk is hereby
authorized to- refund such excess fees' to the holders
of such permits. and or licenses.
D. Amendment of Fees.
Notwithstanding any of the provisions hereof, the Town
Board may, by resolution, change, modify or repeal any
of the fees set forth in §48-4 hereof.
VI. This local law shall take effect upon its filing with the
Secretary of State.

inspection of premises owned by F. Devoe Bassford, William K. Schmidt, Joyce-Alyce
Honnett, and shown and designated on Suffolk County Tax Map as: District 1000;
.Section 097.00 Block 02'00; Lot 010.00,` and thereafter prepared a written report
thereof and filed the same in his office, and
WHEREAS, it was determined by the -Building Inspector that the building or structure
on said premises is dangerous or unsafe to the public, and
WHEREAS, the Building Inspector promptly thereafter served a notice on the owner
or other persons having an interest in said property, 'pursuant to the provisions of
chapter 90 of the Southold Town code, and

knew--this is my first time sitting on the Board listening to the. requests for the
Community Development Funds. "Considering the time, I think should do a little
bit 'better on how we do our time on public hearings because we scheduled that
and there. were a whole bunch of people in here•. I think that was scheduled for
five minutes and doesn't make sense .to have all those people sitting here.all that
time--Harbor Lights people for I don't know how long.
SUPERVISOR MURPHY: Jay, sometimes there times when there were one.or two
people showed up.

like. to mention is 'that the Housing Committee is being formed and we are getting
names and .asking them to serve. We are moving ahead there and 'then also :on Octob N
4th at 7:30 at night with the planning consultant RPPW, the Town Board and the
Town Planning. Board to further discuss this ''before. we .wrap up Phase II and move
into the completion of Phase III. 1 would like to ask anyone in the audience if they .
have anything to 'say or make. any comments? Mr. Mandel..
MR. HERBERT MANDEL, Inlet. Lane, Greenport: . Thank you. very.-much. I'm sure
you're all tired and ready to go home, I am too, . and I also sympathize as the .
previous speaker said with problems that .you have to overcome. 1. feel that the
problem that we have at. Inlet Lane .and the area around Klipp Marine Park .lends
itself to a great deal. more. importance than appears on the surface. I'd like to
address a couple of words relative to it. . You seem .to indicate when you spoke
about it 'that you had looked into it 'and you thought there was merit,and you were
going to do something about it. I hope that that occurs. Over the past six years
the problem has kept repeating. It's .gotten much worse in'the past year and a half
since the theory of not having to. p.ut::up the gate would .be of a help and the theory
came about because the kids with the cars, the seventeen, eighteen year olds .would
drive through the closed gate and the cost of replacing the gate got to be a nuisance,
headache, so the gate was not closed. Gate not closed means that two, three o'clock -
in the morning kids go through--I use the word "kids" advisedly, whether seventeen
or twenty--with their foot on the brake to hear .the squeal of the tires, which you get
oh, 1 would say, almost all the way through to the North Road from the park. , It's
horrendous, it keeps you awake at night, it wakes you .at night. There's nothing
you can do about it except call the police. The police respond. However, you're
very hesitant to do that because by the time the car--radio car will get.there the
perpetrator is gone in many instances. Also you're concerned with maybe the police-
man who comes may be needed for some more important thing elsewhere, so you hesitz
to call. They've had about nineteen or twenty calls this season. There must have b
at least four times that that didn't call. I know myself many times I feel like calling
and I say, well, it'll stop in another hour. It isn't only the cars, although they're
the most important thing because it's a hazard. They can not only hurt themselves,
they can hurt others. ' They use Manhanset Avenue near the park as a speedway.
I have suggested, and I still think it would be well worthwhile to consider, the
series of bumps with the appropriate hazard signs be installed in the roadbed so
that no car can go down Manhanset Avenue fifty, sixty miles an hour. And I think
that--I'm sure that that will alleviate that problem. The other problem is the radios
blasting at all hours of the early morning and late night and that I don't know how
to solve, excepting to keep the park closed the way .it's supposed to be and I do
hope that the few words I've had to say about it will not be looked upon as an attempt
to harrass the Board, which is not my intention, but I .would offer my services in any
way if I could be of help but I'm certain that the problem is 'a great deal more important
than it sounds. Thank you. ; .

COUNCILMAN STOUTENBURGH: Mr. Mandel, before Iyou go. Would you object to a
light on the gate?
MR. MANDEL: Absolutely not. There are lights at the park at night.
COUNCILMAN STOUTENBURGH: .1 realize that, but I mean a bright light on the
gate itself.
MR. MANDEL: No, I wouldn't object at all. I think, .though, that there has been
expressed an opinion that the cost of maintaining an individual'.at the park during
the daylight, because it isn't only at night that this happens, could easily be defrayed
by income generated from the trailers that come to launch boats and from other means
of that type and maybe not defrayed in it's .entirety, but also the maintenance of the
park could be substantially improved upon if there were personnel to do it. Not only
to collect income but to take care of it:

MR. MANDEL: I wouldn't have any objection to that at all.

In other words, we have a man
up real..early in the morning, goes down there and -he's .there when the people come
from Jersey or anywheres else. .He collects the .fee right then and.there 'as they
put their boat in morning, no matter how early they get there, well from five o'clock
on.
MR. MANDEL: Although I welcome the opportunity to .speak and to be here, this
was not generated out of:-my thinking. This came .about when I was presented with ..
a petition.and I wholeheartedly believe im the petition and that's .why I'm here. But
as I said; anything 1 could do .to alleviate it I'd .be more than glad to. And I don't
think anybody objects to any kind of. Hours. that are supervised. What they do object
to is the. unsupervised hours..
COUNCILMAN STOUTENBURGH: The reason I speak of the light is 'that 1 have in my
own family a• cousin' who was killed by going through a fence that was--a. gate that
was put up and he was in' a state park during the daytime and .in the evening he
decided to go down to the .park and it just so happened to be on a corner and as he
went around the corner someone had put the gate up and he ran into the gate and
was killed and there was a tremendous liability thrown on. And this is why I say,
would you mind :this being illuminated brightly in that area?
MR. MANDEL: Wouldn't object at all, but you know a light could go out, for example,
but the bumps on the road wouldn't disappear, and if somebody drives down a road
at fifteen or twenty miles an hour they'll .stop because.they'll see the gate. When
they go down sixty miles an hour, light or no light, they may not be able.to stop.
COUNCILMAN STOUTENBURGH: Bob, did*you speak about' these bumps at one time
.1 recall?
TOWN ATTORNEY TASKER: You might be creating.a liability, even if you put
a caution sign there, "bump."
MR. MANDEL: 1'm. sure it's a liability, but 1 do see it 'in other areas.
COUNCILMAN STOUTENBURGH: . I think we thought of this in another area at
one time and was discouraged against it.
MR. MANDEL: I haven't seen it 'in'Southold, but I've seen it 'in many other places.
COUNCILMAN STOUTENBURGH: I see it in private parkings and things like that.
SUPERVISOR ,MURPHY: I don't think you see it on public highways.
COUNCILMAN STOUTENBURGH: Private roads you see ,it. Cedar Beach has it. on
the road that

SUPERVISOR MURPHY: Thank you for your, comments.' Sir?, .
MR. TOBER: I'd .certainly like to confirm. Mr. Mandel's .description of the noise,
it's amplitude, it's frequency and 11m. about a block from the other side of where
it happens, so I hear it 'and I share .his irritation and probably anger. There are
many things--and I just want to concentrate on one thing. Not only ought you have
the gate closed at night and the gate open early so that the fishermen get served,
but at the same time if they pay their'dues .to get into it, I'm of. the opinion, 1
don't know whether. I'm . right or not, it's .an opinion, that the revenue gained thereby
would more than cover the cost of the guardian of the off-hours, let's say from 5 A.M.
to.9:A.M..,. or. whenever the beach opens, but beyond that I. would testify by my own
witnessing repeatedly this 'summer--probably the week before last, on a weekend,
leaving the beach--we were about fifty feet away from the gate and saw a succession
of at least five and probably seven cars, or. vans, in. a .row, speeding right past the
entrance where the very tender young girl, sunning in the sun, was ignored. Now
can tell you that on weekends, particularly, 'but even during the week, there's some
very tough characters that come down there; very intimidating and I don't think we've
had the right kind of personnel since the late Mr.. Cook had it. . The Town is losing
a lot of money in' revenues. It encourages a lot of lawless behavior that perhaps a
more authoritarian kind of guardian would, by his appearance and occasional actions,
could .prevent. That's all I want to say myself. I'm sure the others have other things
they want to emphasize, but a sign saying "all cars must stop" seems to me was there.
The bumps may expose the Town a liability, - but on the other hand we all of us in the
area can certainly tell you that' there's an accident waiting to happen with the frequency
of the cars. speeding down Manhanset Avenue at literally fifty miles an hour, I think
is a conservative estimate,. very often, going right into the parking lot. So I think
you might consider the liability from that side too and what would offset the other 1
leave it to you gentlemen and ladies to decide, but it's a bad situation there. Now
I've used up my time, but thank you very much.
SUPERVISOR MURPHY: Thank you. Yes, mam?
MRS. LILLIAN MORRIS, Inlet Lane:. . The only thing I'd like to add is i object to
the gates being open. Cars: drive down on the beach- all night long. Some nights
there's three or four and they race down. and they have no business to be on the
beach. So .the gate should .be closed. Who has the authority to--Dean doesn't
have the authority to close the gates.
SUPERVISOR MURPHY: Bob, who has the authority?
TOWN ATTORNEY TASKER: To close the gate to the entrance?
MRS. MORRIS: Yes.
TOWN ATTORNEY TASKER: The Superintendent of Highways.
MRS. MORRIS: . Thank you.
TOWN ATTORNEY TASKER: Who is 'also in charge of the Public Works .Department.
SUPERVISOR MURPHY: He's Commissioner of Public Works.
MR. LARRY LAVEGLIA, Wood Lane: In regards to who was closing the gates, prior
to this 'year the Southold Police were closing it and.they were opening it at six in
the morning, but. then. all of a isudden they. decided they weren't going to open it
and the cars would be all lined up with the boats waiting to.get in and that- problem
was never solved and they just stopped opening it 'and they just kept the, gates open
night and day. That's one of the more serious problems. , . There are so many others
that I personally feel that a committee should be established to look into the enormous
amount of problems that we have. -It isn't justiAhe gate, the dirt on the beach, the
people who throw garbage in' the .cans and the Town of Southold has gone into the
garbage collecting business. You can go there any given morning and you'll find
every garbage can is 'overflowing with household garbage, not beach garbage and
the Town of Southold has got this 'beautiful truck--l...think they're going in competitic
with the garbage removal people--and they pick up everybody's garbage. I'm going
to start putting it there myself. Why pay the -garbage removal if I've got the Town
to do it.' So as I say 1 think that they're so many items to be considered that -it
would be good to have a, committee set up by some of the .residents in the immediate
area and somebody on the Board, or whoever you people feel you should set the
committee with to discuss the situation and to see what. could be done to solve most
of the problems anyway, because year by year it!s getting worse and worse. I think
that the Town .is :giving out too many passes. I've seen people that I know haven't
got homes in' the area with passes on their car.
COUNCILMAN STOUTENBURGH: You remember that this area is originally money
went in' from the State and I believe., Bob you can correct me if I'm wrong, anyone
in New York State can use that particular area.

COUNCILMAN STOUTENBURGH: Then they have to pay for it, let me make sure
you say they have to pay for it.
MR. LAVEGLIA: Excuse me, when I go down for a car pass they ask me if I live
in the area and I have to show my license to show my address is in .Greenport.
The people that I'm. referring to don't live no wheres here. .They live in Jersey,
they live in Connecticut, they live in' New York City. .
TOWN CLERK TERRY: Sir; everyone has to prove that.they own property or have
a local registration and we do not give them out unless their'name is on the tax
roll.
MR. LAVEGLIA: I'm going. to give you the license plates of all these cars that
1 see that I know do not live in this area.
TOWN CLERK TERRY: They're not getting them in this office.
SUPERVISOR MURPHY: They're not getting them here.
TOWN CLERK TERRY: 1 guarantee you they are not.
MR. LAVEGLIA: They're getting .them some place. What are they getting at the
beaches?
TOWN ATTORNEY TASKER: I think the answer to it 'is that a non-resident, without
the beach sticker, can purchase a permit ;at the gate to go in with his trailer for a
boat.
MR. LAVEGLIA: He doesn't .get a sticker.
TOWN ATTORNEY TASKER: No, he doesn't .get a sticker.
MR. LAVEGLIA: These people I see have stickers. 1 know they definitely don't
live here.
TOWN CLERK TERRY: They're not getting them in this building, 1 guarantee you
that. We are very careful and have an awful lot of arguments as a result of it.
MR. LAVEGLIA: It's .my fault, I should have taken the license numbers and submitted
them to the Board. The next time 1 will'do it.*
SUPERVISOR MURPHY: Call my office anytime and we'll..check some registrations.
MR. LAVEGLIA: I sincerely go along with setting up a committee to try to iron this
out one way or the other.
SUPERVISOR MURPHY: Sir;. 1..appreciate everyone's .comments, but I'd- like to say
that before Jay said'that he and Paul and the man in:charge of the beaches had a
committee meeting about two weeks ago and we were told that everything was fine
in'all of these beaches.
MRS. THERESA HARTMAN; Greenport: I called your office the early part of July
about the situation on that beach and your secretary told me that she would talk 'to
you about it 'and that she would talk to guy on the roads there, whatever his name--
SUPERVISOR MURPHY: Mr. Dean.
MRS. HARTMAN: Mr. Dean. .And I also questioned the work, the duties of the
lifeguards were,, because I had a lifeguard tell me that Southold Town pays. him 'to
keep people off the ropes and to rescue anybody who was drowning and anything
else that went on on that: beach was not his 'business. . There's beer drinking on
the beach, which there's a sign says "no drinking." There are dogs on the beach,
no animals allowed. And those lifeguards never come down out of their stands unless
they have to take a little swim. -
SUPERVISOR MURPHY: Mrs. Hogan, after you did. call, Mrs. Hogan did speak to
Mr. Muir and Mr.. Dean and Mr. Jacobs on that. And if 'we. don't hear, as we're
hearing tonight on the severity of the problem, we couldn't do much. You can be
guaranteed something will be done.
MRS. HARTMAN: I know people who have called.
SUPERVISOR MURPHY: You will be guaranteed that something will be done.
MRS. HARTMAN: I hope so, I really do, because the beach this year was absolutely
disgusting disgrace.

MRS. HARTMAN: There must have been that much seaweed piled up -from the
tides. l mean, you had to tromp through it to get to the water.
COUNCILMAN STOUTENBURGH: That is part of a lifeguard's job, is to remove
that seaweed.
MRS. HARTMAN: No, sir, all his job is--.he says his job is to sit up there. and
keep people off the ropes and rescue anybody who's drowning.
SUPERVISOR MURPHY: 1 will meet with some people and we- will ask some residents
who signed that petition to come in and meet with the Parks and Beaches.
COUNCILMAN STOUTENBURGH: For the people who view this across the way, Mr.
Mandel, I believe, how often do you see a police car down in there?
MR. MANDEL: Only when they're called.
COUNCILMAN STOUTENBURGH: Only when they're called?
MR. TOBER: That's .a little unfair: During the .day they're there, but"-during
the day, yes.
MRS. HARTMAN: You know, up until the last two years we had good lifeguards on
that beach and they took• care of things.
MR. TOBER: As a matter--I' .like a point of information. . Up to this year, was it
true that we only had one lifeguard on duty at any time?
MRS. HARTMAN: Yes.
MR. TOBER: This year we had two of them, so that's -twice as. much.doing nothing.
MRS. HARTMAN: 1 have a witness to what was said"to me that day, but--
COUNCILMAN. STOUTENBURGH: I don't think we doubt .your' word.: 1 think these
things are revelations to some extent to us because we-sat with a person who was
in' charge and said' that his 'lifeguards take care of the beach and that was what
they were being paid' for and--- "

SUPERVISOR MURPHY: All right, is there any more on this one item? Let's stick
with the one item first, Frank..
MRS. ISABEL BIDDULPH, Inlet Lane: Who would take care of replacing the gate
and replacing the attendant's .shack when it ':was destroyed last year and the tables,
everything--
SUPERVISOR MURPHY: The Department of Public Works.
COUNCILMAN STOUTENBURGH: Mr. Dean.
MRS. BIDDULPH: Doesn't he know.that things are, going wrong down there? You-.day.
you're not aware, but somebody has to see that the tables--.everything's .missing down
there.
SUPERVISOR MURPHY: . We are very much aware..that 'quite a bit 'of things Were. stolen
from there. and we are. very aware of the garbage problem, not only in that beach; it'S
in every container you..put around and it 'is 'a problem.
MRS. BIDDULPH: If the containers. were moved down the beach further where the
people would have to walk down.
SUPERVISOR MURPHY.- : Maybe:`we could work 'something like that. We'll .work with
you.
MRS. BIDDULPH: It's disgusting. It's a memorial beach and you're not keeping it
as a memorial beach. Everything's destroyed.
SUPERVISOR MURPHY: . We will work with you. Yes?
MR. TOBER: Mr. Murphy, 1. just want to say that up to last year it was tolerable,
but there really was'a very._very severe degradation of this beach.

SUPERVISOR MURPHY: Okay, this w' ill reverse itself. Frank?..
MR. FRANK CARLIN, Laurel: Well, .I guess 11m. the last one. I'm. going to keep mine
a little short. Now that the summer's over 1 have some spare time on my hands so
my research committee for a year and a half told" me that it's about time that you debate
Mr. Ray Dean. I want to debate him' face to face. Plenty of .questions that must be
answered and we have planned to start the first Tuesday of every Town Board meeting
to keep it 'at one to two debates so that it 'will be kept short and not drawn out. The .
length of time it 'will'continue is unknown because there's so much to be discussed.
This 'is 'something different. . It has never been done,. I .-don't think,. before by a tax- .
payer to challenge a public official and my research department of a year and a half
now we think we have enough for me to debate him and I'm. sure that I do and maybe
this 'gentleman's question might be answered, this 'gentleman's. question might be. brought
up too, who knows. Maybe we'll 'get some good out of this 'thing. If I can't make the
debate I' will notify Mr. Dean's _office and I hope that he'll do the same to me. But it
will' be the first Tuesday Town Board meeting, two debates at the most at a time. We
have so much to discuss. And how long, like I. say, I don't know. I think it's time
that Mr. Dean and I. come face to face because I don't like talking, like I did the last .
time with you,. Frank, that you had to speak for him. I'd rather have the man here
in front of me and I'd like -to present my case to him: They're not alone mine. They're.
other people's too. Thank God people come to me all the time and they say to me,
Frank, they're beach buggies down at Mattituck beach there, what can we-do? Don't
tell me,. call Mr. Dean or call the Police Department. You can't walk--I'm not Mr.
Dean, I'm just a taxpayer, but. I feel as a taxpayer after hearing all this=-and then
we decided really when we had. the problem with the bridge and the curve and we
decided to research Mr., Dean for a year and a half and believe me done it. It's
going to be interesting, I'll tell you. It's not. been done before. Going to be
quite interesting. I Will' say..one .thing, Mr. .Dean. better come prepared. and
hope that you will' relay that message back to him" and being that he never makes
the Town Board meetings I. can't tell him myself. Thank you.
SUPERVISOR MURPHY': . Thank you, Frank. Is there anyone else in' the audience

SUPERVISOR MURPHY: You certainly may.
MR. GOEHRINGER: I Would .just. like to be put on the Work Session for the next
meeting, .if you-wouldn't mind.
SUPERVISOR MURPHY.: You don't have to go through the Board, . we'll .put you on.
MR. GOEHRINGER: Okay. It will be concerning these agendas. You can pass them
