Albertson is hereby authorized to give notice in the local paper and post signs at` the Town Dump regulating the tieing and/or packaging of papers deposited in the Town Dump, Cutchogue, L.I. ,N.Y. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; .Justices Tuthill and Clark. An invitation to bid on 62 acres of property at Fishers Island, N.Y. was received from General Administration. After discussion the Town Board and also E. Perry Edwards, Justice of the Peace of Fishers Island decided that the Town Board should not submit a bid on the property. A letter was received from Senator Barrett regarding land at New Suffolk, N.Y. . He informed the Board that he had not been in contact with the Attorney General' s Office in an effort to expedite a discussion on the property. Supervisor Albertson informed the Board that aerial photos were avail- able. through U. S. Department of Agriculture, Agricultural Stabiliz- ation and Conservation Service and the Board authorized Supervisor Albertson ro order necessary phmtographs to complete the area of the Town of Southold. The meeting was called to order by the Supervisor, Lester M. At 3:00 P.M. in accordance with the notice published, according to law, bids were opened for proposals fo furnish to the Town of Southold six (6) resuscitors for the police cars. Two bids were submitted: L. I. Fire Equipment Co. and Carl A. Hennicke. L. I. Fire Equipment Co.-6 Emerson Resuscitators Model FC without flexible connector -- $249.00 each. 6 Emerson Resuscitators same as above with flexible connectors --$259.00 each. Albertson be and hereby is authorized to transmit the following bill to Assemblyman Duryea and 'Senator Barrett for introduction in the New York State Legislature: AN ACT to authorize -the payment of travel expenses of officers and employees of the Town of Southold, in the County of Suffolk, who reside on Fishers Island in said Town. Section 1. Notwithholding the provisions of any general or special law, any officer or employee of the Town of Southold, in the County of Suffolk, whose duties as such an officer or employee require him to travel to any portion of said Town on Long Island for the purpose of attending any meet- ing of any board of which he may be a member or for the -purpose of perform- ing any of the duties of his office or employment, shall be paid all actual and necessary expenses of travel, meals and lodging Incurred by him in connection with attendance at such meetings or the performance of such duties.- Such- expenses shall be a charge agaimst the- Town ,of Southold and the amount thereof shall be audited, allowed and paid in the same manner as are other claims against the Town of Southold.' #2. Moved by Councilman Grathwohl; seconded by Justice Tuthill: WHEREAS, the Board of Commissioners of the Cutchogue-New Suffolk Park District duly petitioned this Town Board on October 13, 1961, pursuant to Chapter 763 of the Laws of 1960, to call a public hearing on the quest- ion of authorizing, on behalf of said District, the acquisition of the real property as described in said petition, and the original improvement and embellishment thereof for use as a bathing beach, including a building and appurtenant equipment, and WHEREAS,:, this Town Board duly adopted a resolution. on November 9, 1961, calling a public hearing on the aforesaid acquisition and improvement to be held at the Cutchogue School House,. Depot Lane, in Cutchogue, New York, on November 29, 1961, at. 7: 30 o' clock P.M. , eastern standard time, and WHEREAS, the notice of such hearing was duly published and posted in ttse manner prescribed by law and proof of such publications and posting has been presented to this Town Board, and WHEREAS; said hearing was:._.duly held at the time and place aforesaid at which time all persons interested in the subject thereof were duly heard, and - WFE REAS, this Board has duly considered the evidence given at said hearing, NOW, THEREFORE, BE IT RESOLVED: BY THE Town Board of the Town of Southold, Suffolk County, New York, as follows: SECTION 1. A RESOLUTION AUTHORIZING THE ISSUANCE OF $27, 350 SERIAL BONDS OF THE TOWN OF SOUTHOLD, SUFFOLK COUNTY, -NEW YORK, TO PAY THE COST) OF THE THE ACQUIS- ITI0N AND IMPROVEMENT OF CERTAIN REAL PROPERTY FOR THE CUTCHOGUE-NEW SUFFOLF PARK DISTRICT IN SAID TOWN. WHEREAS, by proceedings heretofore duly had and taken pursuant to Chapter 763 of the Laws of 1960, including particularly a resolution heretofore -adopted at this meeting, the Town Board of the Town of Southold, Suffolk County; New York, has determined it to be in the public interest to acquire and improve certain real property for the Cutchogue-New Suffolk Park Distric in said Town, and WHEREAS, it' is now desired to proceed with the financing thereof, now, therefore be it RESOLVED: by the Town Board of the -Town of Southold, Suffolk County, N.Y. as Follows: 2 SECTION 1 . The specific objects or purposes for which the serial bonds hereinafter authorized are to be issued areas follows; a) The acquisition for the Cutchogue=New. Suffolk Park District in the Town of of Southold, Suffolk County, New York, of the real property as described in the proceedings referred to in the preambles hereof, at a maximum estimated cost of $17, 550, and b) The original improvement and embellishment of said real property for such District for use as a bathing beach, including a building and app- urtenant equipment, at a maximum estimated cost of $9, 800. SECTION 2 . The total estimated cost of the aforesaid specific objects . or purposes is $27, 350 and the plan for the financing thereof is by the issuance of $27, 350 and ,the plan for the financing thereof is by the issuance of $27, 350 serial bonds of said Town hereby authorized to .be issued pursuant to the Local Finance Law. SECTION 3 . It is hereby determined as follows: a) That Subdivision 21 (a) of paragraph a of Section 11.00 of the Local Finance Law applies to the acquisition of said real property and that the period of probable usefulness thereof is . thirty years: b) That subdivision 19 of said paragraph and Section applies to: the original improvement and embellishment of said real property and that the period oft probable usefulness thereof is ten years, „ and c) That the maximum maturity of the serial bonds herein authorize.d. will exceed five years. SECTION 4. The faith and credit of said Town of Southold, Suffolk County, ,New York, are hereby irrovocably pledged for the payment of the principal of and interest on such bonds as the same become due and payable. There shall be annually assessed upon all the taxable real property in .said Cutchogue-New Suffolk Park District, at ,the same time and in the same . manner as other town charges, an amount sufficient to pay said principal and interest as the same become due and payable, but if not paid from such source, all the taxable real property within said Town shall- be,. , subject to the levy of ad valorem taxes without limitations as to rate or amount, sufficient to pay the principal of and interest on said. bond,s. SECTION 5 . Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein author- ized, including renewals of such notes, is hereby delegated to the. Super- visor, the chief fiscal officer, Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Supervisor, consistant with the provisions of the Local Finance- Law. SECTION 6 .. The validity of such bonds may be contested only if: - 1) - Such bonds are authorized for an object or purpose for which s&id Town is not authorized to expend -money, or 2) .The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or 3) Such bonds are . authorized in violation of the provisions of the Constitution. SECTION 7. This resolution, which takes effect immediately, shall be ,. published in full in the Suffolk Times, the official newspaper of the Town, together with a notice-of the Town Clerk in substantially the form provided in Section .81 .00 of the Local Finance Law. "An .Act to create . the Board of Trustees of the ,Town .of Southold and empower said Board to manage and .dispose of the common lands under water, belonging to said town" in relation to the compensation of members of such Board. 48 Section 1. Section_ 4 of Chapter 615 of the Laws of 18.93, as last amended by Chapter 404 of the laws. ,of 1952, is hereby .amended to read as follows: Section,A. .The Town Board of the. Town .of Southold shall fix, from time to time, the salaries of the members of the Board of Trustees -and determine when the same may be -payable. Section 2 . The Southold Town Planning Board wishes to report that they have held 1. 15 meetings this year, 1961..- We,. have met with the Town Board and Boards. : of Appeals on three occasions. The Planning Board held five public hearings .on the question: of approval of ;subdivision plats and all five were approved. The Board has held approximately 50 informal discussions and action was taken in all cases. The Planning Board has investigated and made recommendations to the .Town Board on• 16 change of zone applications. The. Building Inspector collected and turned over.. to the Supervisor $375 .00 in connection with these applic- ations for change of zone. One .change of zone was made on the Town-: Board' s own motion, therefore no fee was required.
