SOUTHOLD TOWN BOARD
NOVEMBER 19, 1985
WORK SESSION
NOVEMBER 18, 1985, 3:00 P.M.
Present: Supervisor Francis J. Murphy, Councilman Joseph L. Townsend,
Jr. , Justice Raymond W. Edwards, Councilman Paul Stoutenburgh, Councilwoman

The Town Board met in a special Town Board Work Session at 3:00 P.M. , Monday,
November 18, 1985, for the purpose of discussing affordable housing definition,
guidelines, guarantees, and commitment by the Town of Southold. The Board agreed
that. the first step would be to study the possibility of establishing a Housing Author-
ity, which has been researched by Town Attorney Tasker, who stated that a. Housing
Authority is the only means of controlling prices or setting income or residence guide-
lines. The Board also agreed that they should review the Zoning Code to determine
what can be safely eliminated in the Highway- Specifications to shorten the time span
for permit approvals. Councilman Stoutenburgh felt the Board should meet with Board
of Health representatives to discuss their` regulations which would apply to smaller lots.
Supervisor Murphy said he would contact East Hampton Councilman Randall Parsons
and request he meet with the Board to discuss the plan he has implemented for the
purchase of lots to use for affordable housing. Councilwoman Cochran expressed he
feeling that affordable housing projects should be spread throughout the Town and
not concentrated in just one area. The question of central water and sewage treat-
ment facilities was discussed and Supervisor Murphy said that the proposed establish-
ments of water districts by the Town would make it possible to create central water
treatment facilities. Councilman Townsend and Supervisor Murphy discussed the
methods by which a housing authority could provide for reduced interest rate financ-
ing. and low mortgage payments, with perhaps second mortgages held by the Town.
Housing Advisory Committee Chairman_ Herbert Mandel was also present at this work
session and strongly advised the Town not to go into the building business, let a
builder do it; the Town would become ensnarled in regulations and projects would
take much longer to complete then if done privately.

9:00 A.M. - The Board met with Walter Krupski, Southold Town Promotion Committee
with respect to bills he has submitted for payment for printing brochures for the
Committee. The Board reviewed the bills and agreement that money has been allocated
for payment of $2, 810. 95.
9: 15 A.M. - Robert Webb, SEACOM, met with the Board to urge them to accept the
proposal of Wallace L. Duncan to prepare the legal feasibility study respecting the
formulation of a municipal electric utility by the Town and acquisition of the electric
distribution system of LILCO within portions` of the Town (see resolution No. 24) .
Mr. Webb volunteered to video tape .the next informational meeting relative to the
formation of a municipal electric utility for .airing on Cable TV.
9:30 A.M. - Bob Wojczak, Account Executive, AT&T Informations Systems, met with
the Board to discuss his proposal for the installation of the Merlin telephone system

in the Southold Town Hall. The approximate cost for the system, under the State
jContract, is $26,764. 00, and the Board authorized Town Attorney Tasker to prepare
a bond resolution for the next meeting, and authorized Mr. Wojczak to begin preparation
for the installation of the system after the first of the year.

10:00 A.M. - Attorney Janet Geasa, and mason Joseph Crenshaw, met briefly with
the Board relative to their request for a waiver under Local Law No. 14 - 1985, with
respect to Mr. Crenshaw's proposal to construct an office and mason's contractor's
yard on the north side of Route 25, Mattituck. The Board had reviewed this property
during the undated zoning map review -on November 15th and agreed to grant Mr.
Crenshaw the waiver (see resolution No. 25) .
j10:05 A.M. - Executive Administrator Victor Lessard, and Maintenance Mechanic Alex
Stepnoski met with the Board with respect to the deterioration of the ceiling at the
Senior/Youth Center, which appears to be ready to collapse at any moment. Mr.
Lessard recommended removal of the ceiling to evaluate the conditions. Councilman-
Elect George Penny volunteered to work with Superintendent of Highways Dean and
Mr. Lessard to resolve the problem, and the Board immediately ordered the Center
closed, effective November 20th due to the hazardous conditions.
j 10:30 A.M. - William Pfeffer, President of the West Creek Estates Property Owners
Association appeared before the Board to discuss the procedure for forming a road
improvement district to improve the roads in West Creek Estates for acquisition by
the Town. Superintendent of Highways Dean advised the Board that the cost to
bring the roads to specifications would be approximately $12,000. Mr. Pfeffer was
advised the property owners association should hire a lawyer, who would work with
! Town Attorney Tasker in preparing the necessary documents and reports for the
formation of a district.
10:45 A.M. - For Discussion Items : (1) Letter. from George Gatta, Directcr, Town
of Islip Economic Development Division requesting the Town's support of the Heftel/
j Campbell proposed legislation for mortgage revenue bonds (see resolution No. 26) .
(4) Proposal of Holzmacher, McLendon & Murrell, P.C. to conduct the One-Year
Monitoring/Operation Assistance Program for the Southold Scavenger Waste Treatment
Facility (see resolution No. 27) . (6) Memorandum from Community Development Admin-
istrator McMahon relative to New York State Urban Development Corporation grants
for innovative aquaculture programs '(see resolution No. 38) . (7) Proposed agreement
between the Town of Shelter Island and Town of Southold for telephone communications
and receipt and dispatch of radio transmissions by the Southold Town Police Department
(see resolution No. 28) . (8) Letter. from County Legislator Gregory J. Blass asking
if the Town of Southold is stilling willing to join with the towns of Brookhaven, South-
ampton, Riverhead, East Hampton and Shelter Island to assume, on an equal-share
basis, the cost of maintenance for the National Weather Service Transmitter for Eastern
Long Island and its surrounding waters (see resolution No. 29) . (10) Request of
Richard J. Cantwell for a 90 day extension for submitting his Long Environmental
Assessment Form with respect to his Wetlands Application, which form is due on Dec-
ember 9, 1985. The Board agreed they do not wish to grant the extension. ( 11)
Request of Richard J. Cantwell for the refund of his $550 filing fee for a subdivision
application which has not been reviewed formally by the Planning Board. Board agreed
to refund (see resolution No. 30) . ( 12) Discussion relative to pending vacancies on
Housing Advisory Committee due to expiration of terms. Board decided to extend the
appointment of the three members in question for another year (see resolution No. 31) .
(17) Request of Sylvia K. Rouse, :Clerk-Typist in the Assessor's Office, for transfer
to the Accounting Department. Mrs. Rouse's request will be placed in her personnel
file for consideration should a vacancy occur in that department. (20) Proposed
Scenic and/or Conservation Easement submitted by John B. Tuthill was discussed.
The Board members feel the provisions for termination of this easement, which is
presently 30 days notice, should be extended fo.r a longer period of time--perhaps
eight years as is provided in the farmland agreements. Scenic and/or Conservation
Easements will be studied by the Board before moving forward with the one offered
by Mr. Tuthill. (21) Request of Barbara A. Rudder to transfer from her present
part-time position as a Clerk-Typist for the Board of Appeals to a permanent position
in the Assessor's Office to fill the vacancy of Mrs. Julia King who will retire December
31st and is presently on a leave of absence. Mrs. Rudder's request was granted (see
resolution No. 32) .
11 : 15 A.M. - Gladys Csajko, North Fork Animal Welfare League, Inc., met with the
Board to inquire how the new building for the Dog Pound is progressing. Super-
intendent of Highways Dean said he is working on the coordination and should begin
work shortly.--The Board again discussed with Mrs. Csajko and Town Clerk Judith
Terry the ongoing question of conducting a current dog enumeration throughout the
Town. Mrs. Csajko informed the Board that she does not have the staff to perform
this task, but will study the problem further.
11:30 A.M. - Mary Ann Fleishman, Youth Counselor for the Juvenile Aide Program,
appeared before the Board to determine where the Town will provide space .for her
to meet with her clients, which she presently does at the Senior/Youth Center, where-
as the Center is to be closed on November 20th. She was advised that space will be

�} Q made availabe in the Town Hall.--Ms. Fleishman also asked the Board to consider
providing her with benefits, which the Supervisor will research and report back to
the Board.
11 :35 A.M. - The Board dicussed the following For Discussion items: (18) Waiver
request of Merlon E. Wiggin, on behalf of Joseph and Linda Schoenstein, North
Fork Welding (see resolution No. 33) . (9) Waiver request of J. Parker Wickham
(see resolution No. 34) . (14) Waiver request of Charles R. Cuddy, on behalf of
Barbara D. Schriever (see resolution No. 35) . (20) Proposed scenic/conservation
easement by John B. Tuthill. Board members would like to review the termination
clause which has been standard for these easements, and have this redrafted by
Town Attorney Tasker.--The Board also discussed with Superintendent of Highways
Dean the request of Clement and Antonia Booth to relocate a drainage easement on
thbir property on the dorner of Soundview Avenue and Hortons Lane, Southold.

A Regular Meeting of the Southold Town Board was held on Tuesday, November
19, 1985, at the Southold Town Hall, Main Road, Southold, New York. Supervisor
Murphy opened the meeting at 3:00 P.M. with the Pledge of Allegiance to the Flag.

SUPERVISOR MURPHY: Thank you. At this time I'd like a resolution approving
the audit of bills of November 19th, 1985.
Moved by Councilwoman Cochran, seconded by Councilman Stoutenburgh, it was
RESOLVED that the following audited bills be and hereby are ordered paid : General
Fund whole Town bills in the amount of $27,531. 13; General Fund Part Town bills
in the amount of $23, 587.77; Highway Department bills in the amount of $56, 394. 19;
Fishers Island Ferry District bills in the amount of $8,675.29; Agricultural Land
-Development Rights Capital Account bills in,the amount of $960.73; Federal Revenue

JUSTICE EDWARDS : Nothing at this time, Frank, thank you..
SUPERVISOR MURPHY: Jean?-
COUNCILWOMAN COCHRAN : Well, I've attended several meetings in the past week
or so. We did meet again last week and finish the review of the Zoning Map. Also
we had a meeting yesterday in relation to affordable housing. Our next step will
be to met with the Health Department and Councilman Parsons from East Hampton
and also obtain some information from our Counsel in relation to a Housing Authority
and it is my hope that we are beginning to move in this direction to solve this
problem. That's it, Frank.
SUPERVISOR MURPHY : Thank you, Jean. Paul?
COUNCILMAN STOUTENBURGH : Yes, I was at the zoning map meeting, and also
the Code Meeting, which I'll leave to Jay. I also met informally trying to get some-
thing together on a shellfish grant, which I think is very, very important. We're
hoping to get between $45, 000 and $50,000 as a grant. Hopefully so that we can
start a seed program for scallops, and this will be a program in which we will have
nets that will be suspended in the water above predator problems and the seed will
be put in that. Hopefully these seeds will then attach to these nets and we'll be
able to raise them to what we call ,bug size and then let them go, and in that meeting
we had Peter Wentzel who I found to be a very knowledgable young man who is in
the Baymen's Association. He's president of it and is really doing a wonderful job
along with his secretary, Steve Latten and these two people, I think, should be given
a real pat-on the back for getting involved. Also the whole program is winding around
something else which I've been trying to get going here and that is the transplanting
of eel grass. As many of us know who lived on the bays way, way back when, there
used to be eel grass in our upper bays and this has been wiped out many years ago
and has never come back and this was, of course, one of the great things that the
scallops were in for the simple reason that when they got in here they got away from
predators also and this is why we have such a tremendous scallop seasons years ago.
Jim, I don't know if you would like to add anything to this, because you were involved
in it. I've just told them that we're going for about two million scallop seed, perhaps
with a $45,000 to $50,000 grant, which would buy the nets and the manpower and what
have you to run this and basically it will be completed when do we expect? Next
Friday?
COMMUNITY DEVELOPMENT DIRECTOR McMAHON :_ This Friday.
COUNCILMAN STOUTENBURGH : This Friday. Now, do we need a resolution to put
this grant---
COMMUNITY DEVELOPMENT DIRECTOR McMAHON : Submit an application to the UDC
for funding?
COUNCILMAN STOUTENBURGH : Yes. Do we need a resolution for that? The point
is this has to be in by the 29th and there won't be a meeting by that time again.
If so we can put that on the end. Okay?

COUNCILMAN TOWNSEND : Paul, is that going to be a Town application?
COUNCILMAN STOUTENBURGH : Yes.
COMMUNITY DEVELOPMENT'.DIRECTOR McMAHON : In conjunction with Sea Grant.
COUNCILMAN STOUTENBURGH*: Yes. Who do we have there from Sea Grant?
COMMUNITY DEVELOPMENT DIRECTOR McMAHON : Herb Smith and John Scotti.
COUNCILMAN STOUTENBURGH : Yes. So we're working with good people who are
guiding us, I think, in the .right direction and if we can get this this might be one
of the- salvations for our---
COMMUNITY DEVELOPMENT DIRECTOR McMAHON :. Sea _Grant will provide the
personnel to administer the program.
COUNCILMAN STOUTENBURGH : And the other meeting I 'attended, which I think was
probably the most productive meeting I've ever been to in the Water Advisory Committee
for the simple reason that I know Jay has been concerned what's going on there. We've
had some awful good reports handed in and these reports will be coming to you people
after the first of the year. Probably as a. meeting with this organization the middle
of January I believe that's when we decided to have a meeting with the Town Board.
In the meantime they have gone forth and put a whole collection of reports together .
and it will show you how they're starting to get some of the things which you people
have been interested in. One of the things they have done is contacted a group of
manufacturers who have filters and they put these filters now in twelve homes. They
have nine more to go, so they'll have twenty-one filters working in our community.
Each one on a different problem in a different situation. What we're hoping to do is
find out which one of these filters work best and the cost of it and there's much to
be done on this. And then there's a testing. Once you put the filter in then the
water has to be tested before and -after,':'a'nd after a couple of times, and I have group
of twelve of these homes and you can see it's quite a complicated list of materials that
they're testing for. Each one of these tests, and they are one, two, three, four,
five, six, and the cost for each one is $300, and there are going to be twenty-one
of them and your Health Department is doing this. So this gives you an indication
of what -your Health Department is going for you, and Marty Trent is backing this
whole thing and keeping an eye on it. So Marty Trent, who is a member of the
Water Advisory Committee is doing it. The next outline which we had is ERM, whic
we have hired as a consultant, and they now have an outline of the point of use suN�}iy
treatment systems. That would be these filters and how they would be administered,
how they'd be put on, the whole .thing. So they have now gotten the outline. Their
final report will be in December 15th, so we should have that to work with. On top
of that, you know we're talking about satellite water districts, or not water districts,
but water supplies in the community, and perhaps the Town someday taking these over.
Valerie Scopaz, who is one of the planners in Smithtown's Planning Department has
drawn' up an outline, and here is the whole complete outline, which -again needs a
little fine tuning, but we have finished the outline and this will be then presented
to you people in the middle of January when we meet again. In the mean time we
have Jim Monsell, who is as you know in Greenport, head of their water district, on
this Water iAdvisory Committee and he has given us a contract that he is asking all
their people to sign that are taking water from their district and this is the idea of
the $2,500 hook-up, and this is the whole program right here. He is sharing the
information as they go along in Greenport with the Water Advisory Committee so
hopefully we will have a real solid proposal for you people by the middle of January.
Frank Bear, sitting out there, who is Chairman of it, do you have anything to say,
Frank, on that?
MR. FRANK BEAR: No, I think that-the fact that we have on that committee people
who are not only competent and know what they're doing, but also devoted--Valerie
Scopaz, I don't know how much time of preparing this list of how to establish and
how to maintain these water districts, and as Paul said,.-we have to fine tune it, bu
it's still come a long way. We are getting to the place where ERM is going to have
something for us to work with. We've been waiting for that for quite a while. I th... ..
we've made some progress and I hope we can, .as Paul said, have something for you
by the middle of January or thereabouts.
COUNCILMAN STOUTENBURGH : I hope you'll approve our taking a little lengthy time
but I think this is probably the culmination 'of what we've been working for for two
years really.
SUPERVISOR MURPHY: Paul, 1'd like to just add a little bit more to that on the trip
that I went down with Joe Behr to the Washington to the EPA on the proposed grant.
We had put an application in for a grant and it was basically for water filters, to buy
"X" number of filters. Well, the EPA is interested in supplying filters around the
country and they know how filters work and all. They're very interested in our
Water Advisory Committee and the work that Suffolk County and Southold Town has

done and they want us to revise the grant application and Joe. Behr, from the Health
Department, is doing this right now, to include the management and to make recommenda
tions, possible funding, for how to properly manage one of these districts. This will
be one of the first in the country that will be set up here in Southold Town and they're
very interested in a Town or 'community of this size to participate in it. So it looks ver,
good that we will get a grant to operate this. It's being written up now and will be
resubmitted down to EPA and we can't guarantee anything, but according to the talks
we had with the people it looks very good. So we're making very good progress. Paul,
anything further?
COUNCILMAN STOUTENBURGH : No, nothing further.
SUPERVISOR MURPHY: Joe?
COUNCILMAN TOWNSEND: Y(es, along with what Paul was talking about -on the grant .
for inno ativ; techrol;,yy i;� production of shellfish, I've been working a little bit with
a couple of marine biologists, Steve Malinowski from Fishers Island and Scott Sedell from
Stony Brook and because of the time limits on this thing I'm not sure we're going to be
able to get anything together, but we're trying to put together a proposal which would
also go in from the Town to develop a system by which we could determine what size
seed would grow best and basically it would be a grant for monitoring various different
kinds--different sizes of scallop bug to determine what size these things have to be
grown to in the lantern bag. The problem is that we don't have anybody with a
sufficient technical background locally to undertake the monitoring and I'm working
with Walter Smith now to see if he can find a graduate student or somebody locally
to do that. If we can get that_ done by the 29th then I'll submit that as either an
addendum or a separate application with the proposals that Paul was talking about.
I attended the same meetings on the map and on the town codes that Paul and Jay
d have and since Jay's the Chairman of the Coe Committee I'll let him report on that.

COUNCILMAN SCHONDEBARE: Thank you. We did have a .Code Committee meeting
and we discussed the two areas that have presented a problem from the past. One
of them is the variances that are required for the 75 foot setback from the wetlands
and the 100 feet from the bluffs. There was a misinterpretation or probably a lack
of communication between the Building. Department and the ZBA and I think with
everyone there that day we got that straightened out. Very simple, if you're going
to build anything within those setback areas it. should be denied by the Building
Department and- you have to go to the ZBA for approval.. We also discussed the
survey which is required after -a foundation is laid. It's in our Code. We've had
problems evidentially in the past with this and what we decided to do is we discussed
whether or not it should be in the Code to begin with, the ramifications, and we
decided to leave it in the Code and everyone's on notice that we will strictly enforce
it, whether it's for a business parcel or a residential parcel, the foundation survey
is required and will be required. That's it, Frank, thank you.
SUPERVISOR MURPHY: Thank you, Jay. The only other thing that 1 have to report--
you can see that the Town Board has been very busy. It's just that we will have a
very important Landfill meeting where hopefully the DEC will give us their final official
determination of what the Landfill Law is.

It's always nice to hear these and receive these letters. This is what we expect of
our employees and it's nice to hear that they are doing that.

SUPERVISOR MURPHY: The first one is a very important one and l think we'll ask
Jean Cochran to offer it.

1. Moved by Councilwoman Cochran, seconded by _Supervisor Murphy, it was
RESOLVED that the Town Board of the Town of Southold hereby declares Thursday,
November 21, 1985 as NATIONAL GREAT AMERICAN SMOKEOUT DAY in the Town of
Southold and urges all cigarette smokers in the community to demonstrate to themselves
and their friends they can ;quit if they wish.
1.-Vote of the Town Board : Ayes :. Councilwoman Cochran, Councilman Schondebare,
Councilman Stoutenburgh, Justice Edwards; Councilman Townsend, Supervisor Murphy.
This resolution was declared duly ADOPTED.
SUPERVISOR MURPHY: Number 2 is to support legislation on the two-payment tax
system.
2. Moved by Councilman Townsend, seconded by Councilman Schondebare,
WHEREAS, State Assembly Bill No. 8140, adopted June 27, 1985, and made retro-
actively effective to June 6; 1985, amended the Real Property Tax Law, sections 902
and' 904, and such Act was; to be controlling in all jurisdictions, notwithstanding an;,
conflicting special, general ;or local law; and
WHEREAS, the Suffolk County Tax Act, a special act of the State Legislature which
has controlled real property tax procedures in Suffolk County since 1920, was super-
seded by the 1985 amendment which changed the lien date from December 1 to January
1, and, more importantly, requires that taxes be paid at one time on April 1, rather
than the two payments on January 10 and May 31 as permitted by the Suffolk County
Tax Act; and
WHEREAS, the Town Boardlof the Town of Southold is concerned about the problems
and burdens that a one-time payment of all taxes will create for the 17, 000 taxpayers
of Southold who have long fashioned their financial planning and savings procedures
to comply with the two payment procedure under the Suffolk County Tax Act; and
WHEREAS, in addition to the burden imposed upon the taxpayers by requiring one
payment of all taxes, the Town Board of the Town of Southold also perceives that it
is impossible for the 'towns of Suffolk County to comply with the dictates of this amend-
ment for the 1986 tax year because all tax bills are printed and procedures under the
Suffolk County Tax Act are in place.
NOW, . THEREFORE, BE IT RESOLVED that, by this Resolution, the Town Board of the
Town of Southold hereby requests the New York State Legislature and the Suffolk
County Legislature to take all steps possible to retain the two-payment procedure-as
mandated by the Suffolk County Tax Act and to change the date of compliance in other
matters, as required by this amendment to a future date; and be it
FURTHER RESOLVED that upon its adoption, a copy of this Resolution be forwarded by
the Town Clerk to both houses of the New York State Legislature and to the Suffolk
County Legislature.

RESOLVED that pursuant to- Article 8 of the Environmental Conservation Law State
Environmental Quality Review and 6NYCRR Part 617, Section 617. 10 and Chapter 44
of the code of the Town of Southold, -notice is hereby given that the Southold Town
Board, as lead agency for the action described below, has determined that the project,
which is unlisted, will not have a significant effect on the environment.

Description of Action: Proposed Local Law entitled, "A Local Law in relation to
Accessory Apartments in existing dewellings."
The proposal has been determined not to have a significant effect on the environ-
ment because an environmental assessment has been completed which indicated that no
significant adverse effect to the environment is likely to occur should the project be
implemented as planned, and because then ehas been no response in the allotted time
from the New York State Department of Environmental Conservation, therefore, it is
assumed that there are no objections nor comments from those agencies.
SUPERVISOR MURPHY: Any questions?
COUNCILMAN TOWNSEND : 1 have some comments. We have received in our mail a
letter from the Department of Health opposing this amendment to the Town Code
because it might affect sewage disposal and water supply facilities and conditions in
different areas. Taking that into consideration I don't think that I can vote for a
resolution of non-significance on the environment as it relates to this proposed Local
Law, so I intend to vote against it.

WHEREAS, the Town Board of the Town of Southold has met at the time-and place
specified in the notice of public hearings on the preliminary budget and intended
use of federal revenue sharing funds for the fiscal year beginning on January 1,
1986, and heard all persons desiring to be heard thereon, now, therefore, be it
RESOLVED that the Town Board of the Town of Southold does hereby .adopt such
Preliminary Budget as the Annual Budget of- this Town for the fiscal year beginning
on the 1st day of January, 1986, and that such budget as so adopted by this Board
be entered in detail in the minutes of the proceedings of this Town Board, 'and be it
further
RESOLVED that the Town Clerk of the Town of Southold .shall prepare and certify,
in duplicate, copies of said Annual Budget as adopted by the Town Board of the
Town of SOuthold, together with the estimates, if any, -adopted pursuant to Section
202a, Subdivision 4 of the Town Law, and deliver two copies thereof to the Supervisor
of this Town to be presented by him to the County Legislature of the County of
Suffolk.

with respect to the "Consolidated Report", Phases I and II, Airport Site Selection/
Master Plan Study for the Town of Southold.

SUPERVISOR .MURPHY: For a point of information for anyone who wasn't here
before, we can't have it on this date for various reasons. The State is not ready
yet. to; met with us. They've had several changes of personnel and we have yet
to hear from the FAA or the Consultant and also our ceiling in the Rec Center is
falling down and we have to..rIeplace that. So hopefully in two weeks we'll have a
scheduled time for the meeting.--Moving on to Resolution No. 7 is to authorize the
attendance at a Planning Commission seminar.

the Town of Southold.

JUSTICE EDWARDS : I'd just like to make a comment on this one,. Frank. This
Operator, Eugene M. Henson from Fitchville. Just about a year and a half ago--
I've known Gene for about ten or fifteen years because he works for the telephone
company in Southern New England in the Hartford area. He decided to do a little
studying and he went right through the books and went down and took his exam
on the first shot down in .New York and passed it and then he's been riding shot-
gun on the ferry all summer and he got his time in just about two weeks ago. So
now they've given him a full-time/part-time job. Very lucky because he lives about
a half a mile away from Mark Easter the prime contractor, the head man on the district.
SUPERVISOR MURPHY: Good. Okay, Number 15 is concerning Fishers Island Ferry
District again and it's to amend their enabling legislation.

WHEREAS— the the Board of Commissioners of the Fishers Island Ferry District, in
response to concerns voiced by the 'electors of the Ferry District and property
owners situate within the Ferry District concerning possible future use of land
acquired 'for or purchased for the use of the Fishers Island Ferry District, title
to which is vested in the Town of Southold, wishes to provide some protection
against said future use which might be contrary to the desires of said electors
and property owners, and
WHEREAS, the Board of Commissioners is of the opinion that this purpose can best
be accomplished by an amendment to the act creating the Fishers Island -Ferry District.
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Southold
hereby authorizes the following proposed legislation to be forwarded to the New Yor,
State Legislature for its consideration in the 1986 Legislative Session which convenes
in January 1986:
AN ACT to amend chapter six hundred ninety-nine of the laws of
nineteen hundred forty-seven, relating to authorizing the creation of
Fishers Island ferry district in the town of Southold, Suffolk county
and providing for the election of its officers and management of its
affairs in relation to the sale or conveyance of real property in said
district
The People of the State of New York, represented in Senate and
Assembly, do enact as follows :
NOVEMBER 19, 1985 .
Section 1. Chapter six hundred ninety-nine of the laws of nineteen
hundred. forty-seven, relating to authorizing the creation of Fishers
Islasid ferry district in the town of Southold, Suffolk county and
providing for the election of its officers and management of its affairs is
hereby amended -by adding thereto a new section, to be section sixteen,
to read as follows:
Section 16. Notwithstanding the provisions of this chapter, or the
provisions of any other general;: or special .law, the town board of the
town of Southold shall not sell or convey any of the real property or
interest in real property, located within the boundaries of the Fishers
Island ferry district at Fishers Island, in the' town of Southold, Suffolk
county, . and acquired, used or intended to be used for any of the
purposes of the Fishers Island ferry district unless, 0) such sale or
conveyance shall have been approved in.. writing by a majority of the
commissioners of the Fishers Island ferry district, and (2) such sale .or
conveyance shall have been approved .by a majority vote of the electors of
the ferry district and the owners of real property situate within the ferry
district - assessed upon the last preceding . town assessment roll voting
upon a proposition therefor to be submitted at a special or annual meeting
of the ferry district. At least thirty days before any. special or annual
meeting to vote upon such a proposition, the ferry district commissioners
shall adopt a resolution which shall designate the date and place of such
meeting; the hours of opening and closing of the polls, which shall be not
less than four (4) consecutive hours between eight o'clock 'in , the forenoon
and eight :o'clock in the evening. The commissioners shall give notice of
such meeting by the publication of a notice in a newspaper or newspapers
having general circulation in the district, specifying the time when and
the place where such meeting will be held, the hours during which the
polls will remain open for the purpose of receiving ballots and setting
forth in full all propositions to be voted upon. The first publication of
such notice shall be at least twenty.-days prior to the time of such meeting.
.In addition, the commissioners shall post, or cause to be posted, a copy
of such notice in five public places in .the district at least ten days prior
to the time of such meeting. In all other respects the meeting to vote on
such proposition or propositions shall be conducted in the same manner as
provided herein for voting at annual district meetings.
`Section 2. This act shall take effect immediately.

TOWN ATTORNEY TASKER : The Fishers Island Ferry District is governed by a
special act of the legislature which sets forth all of its powers and rights. One
of the provisions of the act is that all of .the...lands which are needed for Ferry
District purposes are to be acquired for the Ferry District by the Town of Southold,
and so therefore all the land of the Ferry District is in the name of the Town of
Southold. In recent months .there appeared to be some concern on the part of some
of the people on Fishers Island that the Town of Southold may divest them of their
property, which they apparently are very much opposed to and they would like to
see the property preserved in its present condition. I met with the Commissioners
last month to discuss this and :suggested that maybe a possible good solution would
be to amend the special act to provide that none of the land which is used for Ferr,
_District purposes, which is in fact owned in the name of the Town of Southold, may
be conveyed by the Town .Board without first getting the approval of the majority 0

the Ferry District Commissioners and also a majority vote of all of the residents and
property owners within the Fishers Island Ferry District, and they suggested that I
draw legislation and I did and this is what you have before you, and it basically
says, as I just said, that before you can dispose of any of their property or any
interest in their property on Fishers Island; it has to be approved by the majority
of the Ferry District Commissioners and submitted to a mandatory referendum of the
property_owners and residents of the District.

from the Village of Greenport, which 'they `received from Cablevision on the signing
of their lease for their tower in the Village, that they gave to the Nutrition Program.
Southold Town will just about match the same amount and buy them a new Van that's
much needed. It's a very nice way to do things.
Number 20 is to authorize the Recreation Director for a play.

Fossett, Recreation Director, to engage the services of Encore, Inc. (a not-for-

from the 1986 Budget Line A7320. 4. Performance is to be held during the week of
February 17 - February 23, 1986 at an area high school. No admission cost will
be incurred by Town residents and the entire expense will be vouchered under the
Division for Youth Grant for Recreation.
COUNCILWOMAN COCHRAN: I would just like to say that it's a very reputable
performance group and it gives a nice cultural experience to young people within
the community. It looks good.

which they're getting this step is under the existing contract which expired last
December. So I would wait until you get a new contract and then make it retroactive.

and the acquisition of the electric distribution system of Long Island Lighting Company
within portions of the Town,.. at a cost not to exceed $15,000, plus out-of-pocket costs
not to exceed $2,000. 00, unless Firm personnel is required to make more than two trips
to Long Island to present and discuss the legal feasibility study and final report; all
in accordance with the proposal submitted by Wallace L. Duncan, dated October -17, 1985.
SUPERVISOR MURPHY: Comments?
COUNCILMAN TOWNSEND: I'm not happy about incurring these expenses for this
purpose, although I intend to vote for it. I feel that it is going to be money that
could be used for much better purposes within the Town. At this point, though,
there has been so much concern expressed by the public and so much interest in
this project I intend to. vote for it. It will generate enough information to bring us
to the point where we can have.a -referendum and have a fuller airing of the issue in
the debates preceeding the referendum. ' That's all I have to say.

all telephone comunications and receive and dispatch radio transmissions to and
from the Shelter Island Town Police vehicles and the Town of Southold will keep
a proper record of all such radio transmissions, for the period January 1, 1986
through December 31, 1990, at the annual sum of $15,000, to be paid on or before
the 15th day of June of each year during the term of this Agreement. '

waters, which maintenance costs have been financed by the County of Suffolk since

the crystal then for that station, because we cannot get Riverhead.

MR. PHIL BARTH, Southold: I want to ask Paul a question on the Scallop Revitalization
Program. At a North Fork Environmental Council dinner we had a speaker there that
could not tell us whether or not this brown, tide will come back again next year. Now
if we have this program, what will happen if the brown tide comes back again next
year? What will happen -to all these seed scallops?
COUNCILMAN STOUTENBURGH : It will wipe them out. That happens every thirty
years, they think. It's a cyclic type thing. It's worth the chance.
MR. BARTH : Well, you're taking a chance, because--

COUNCILMAN STOUTENBURGH : Absolutely. Nothing's certain in this world.
MR. BARTH : Because according to the young fellow that gave the lecture, it
wasn't a question of a thirty year recycling thing because they really don't know.
COUNCILWOMAN COCHRAN : No one knows. It could or it couldn't.
COUNCILMAN TOWNSEND: It is unique in history. That particular thing is unique
to this time in history and .1 agree with you, we don't know whether it's going to come
back or not next year. It may well, but we're taking a risk which could help the
entire scallop season come back about two. or three years earlier, or more. So that's
why it's important to do this. I think it would mean thousands and thousands of
dollars to the community. But it is a risk, you're right.
COUNCILMAN STOUTENBURGH : And it is a grant, remember that.
MR. BARTH: It's still our money.
COUNCILMAN STOUTENBURGH : The point is somebody else will grab it if we didn't.

WHEREAS, the Town Board deems it in the public interest that the Town
of Southold acquire the development rights in the agricultural lands
set forth in said option agreement with John Simicich, Jr. and Catherine
Simicich, now, therefore, be it
RESOLVED that the Town Board hereby elects to exercise the option to
purchase the development rights in the aforesaid agr—le—ulturai iands

WHEREAS , the Town Board entered into an option agreement with Charles
P. Simmons and A. E. Nicholas for the purchase of deveiopmentrig s
in agricultural lands , and
WHEREAS, the Town Board held a hearing with respect to said option on
the 7th day of November , 1985 pursuant to the provisions of Section 25-4
of the Southold Town Code, and
WHEREAS , the Town Board deems it in the public interest that the Town
of Southold acquire the development rights in the agricultural lands
set forth in said option agreement with Charles P. Simmons and A. E.
Nicholas , now, therefore, be it
RESOLVED that the Town Board hereby elects to exercise the option to
_purchase the agricultural rights in the aforesaid agricultural lands
owned by Charles P. Simmons and A. E . Nicholas , and
BE IT FURTHER RESOLVED that the Town Clerk be and she hereby is author-
ized and directed to give notice of such acceptance to Charles P. S'immons

SUPERVISOR MURPHY: Okay, do we need a resolution authorizing Bob to do the
title search?
TOWN ATTORNEY TASKER: You could put a resolution on to authorize me to order
required title search..and surveys required for all acquisition of agricultural rights..
COUNCILMAN STOUTENBURGH : Wasn't their property surveyed before they---
TOWN ATTORNEY TASKER : No. A lot of those farms have never been surveyed.
COUNCILMAN STOUTENBURGH : . 1 thought that, was part of the--
COUNCILMAN SCHONDEBARE: Yes, I agree with Paul. I thought that was part of
the thing.
TOWN ATTORNEY TASKER: No, that comes afterwards. The option agreement
provides for a price of so much per acre. Depending upon the survey, an accurate
survey that will be made, after the option agreement, and the price will be adjusted.
In other words, if you're saying it's 34 acres and we have it surveyed and it's 32,
that's what we pay for.
COUNCILMAN TOWNSEND: Now, what we've done--we took surveys and put points
on surveys.
TOWN ATTORNEY TASKER : We didn't want to go through with all of the expense
of having all of these farms surveyed and then you're only going to pick ten out
thirty.
COUNCILMAN SCHONDEBARE : Right. I remember that. You're right.
SUPERVISOR MURPHY: Okay, I offer that resolution.
41. Moved by Supervisor Murphy, seconded by Councilwoman Cochran, it was
RESOLVED that the Town Board of the Town of Southold hereby authorizes and
directs Town Attorney Tasker to proceed to order surveys and conduct title
searches of the lands which are the subject of the option agreements entered into
between the Town of Southold and the following optioners who have offered the
sale of the development rights in their agricultural lands as set forth in the option
agreements: Latham Farms, Inc. , Albert J. Krupski, Jr., John C. Tuthill, David
and Frank Cichanowicz III, John Nierodzik, John Simicich, Jr. and Catherine Simicich,
Charles P. Simmons and A. E. Nicholas.

Councilman Stoutenburgh, Justice Edwards, Councilman Townsend, Supervisor Murphy.
This resolution was declared duly ADOPTED.
SUPERVISOR MURPHY: All right, Bob, do we have to do anything further on this
now?
TOWN ATTORNEY TASKER: No. I'll order the surveys and title searches.
SUPERVISOR MURPHY : Does anyone have anything further to come before the Town
Board?
MR. BARTH : What's the total acreage? Does anyone know?
COUNCILMAN TOWNSEND : I think that this is about 230 acres we just authorized.
There's another: hundred acres coming up, something like that.
COUNCILMAN STOUTENBURGH : Going to be over 300.
SUPERVISOR MURPHY: Okay, I look ,for a resolution to adjourn.
Moved by Councilwoman Cochran, seconded by Councilman Stoutenburgh, it was
RESOLVED that this Town Board meeting be and hereby is adjourned at 4:38 P.M.
