Townsend, Jr., Councilman Paul Stoutenburgh, Councilman James A. Schondebare, Councilwoman Jean W. Cochran, Town Clerk.;Judith ,T. Terry, Justice Raymond W.. Edwards (9:55 A.M.) Town Atts�r-ney Robert W. Tasker (.9:30 A.M.) , Superintendent of Highways Raymond Co Dean (10:25 A.M.) . The Board audited outstanding vouchers. 9:30 A.M. - Board ,of Appeals Chairman Gerard P. Goehringer met with the Board .to bring them tAp to date on Board of. Appeals' activities. He stated they have been meeting every two weeks and are now beginning to receive applications pertaining to the new waterfront setback requirements. Mrs. Strang is no longer with the Board for the public hearing portion of the minutes, but he feels they can handle the situation with their present employees. Mr. Goehringer, a Commissioner of the Mattituck Park District, stated the district is concerned about the tremendous activity at their beaches during the night and requested an increase in the police sector patrols to. cover the situation. He also said he has received two calls relative to the possibility of the Town acquiring the Dietz property on the Mattituck Inlet for use as a boat ramp, and there is concern from residents about increased traffic. Councilman Stoutenburgh expressed the need for access' to-Mattituck .Creek by all of the residents of the Town, which would be accomplished by the purchase of the Dietz property. Supervisor Murphy ::stated be does not feel. there would•be that much objection from the residents. 10:00. A.M. _ Account Clerk Betty W,ellsAnet with the Board at the request of the Supervisor to apprise, them of. the results of her research on cost for Automatic Data Processing to accomplish the employee deductions for the Deferred Compensation Plan. It has been determined that the first year cost'to the Town will be $2,944. 00, and second year cost $2, 544.00. It was the decision of the Board, whereas only two employees have availed themselves of this program, to rescind their authorization to (Resolution. No. 30) implement this plan with the hopes the two employees will seek a private plan to meet their- needs. 10:15 A.M. - Robert Webb, President of SEACOM, appeared before the Board to urge their support to call for a public.,referendum at the time of the General Election on November 5th, to establish a public power system in Southold Town, Town Attorney Tasker advised the Board that there is not sufficient time remaining by law for this to appear on the ballot at that time. In that event, Mr. Webb said he would like to see a Special Election held as soon as legally feasible, and in the interim some sort of public form whereby R. W. Beck and Associates could make 'a public presentation of the proposal to the community. Mr. Webb stated that SEACOM has had the Beck report analyzed by Jerry Bolger, William Wilhelm and Sidney Breese, and their report will be available to the Board very soon. The *Board advised Mr. Webb that they would like to see the comments on the Beck study. and meet again to review all aspects, as well as receiVing comments from PASNY.-and -.QtKers;:-,'-R.Orhaps after :that time a public informational meeting could- be scheduled. 11:35 A.M. - The Board reviewed the following For Discussion agenda items: (1) - Letter from Suffolk County Executive Cohalan opposing the closing of the Long Island Reginal Office of the New York State Division for Youth. A resolution of opposition directed to Governor Cuomo will be placed on the September 10th agenda. (2) Letter from the Planning Board requesting reimbursement of funds to. Ruth Enterprises for overpayment of a filing fee (see Resolution No. 29). (3) . Discussion relative to the SEQR process concerning the Costello petition for a change of zone. Town Board to .declare themselves lead agency (see Resolution No. 31) . (4) Request of East - End Community Services for start-up funds. Town Board to establish a new project line in the Community Development Year .11 Budget (see Resolution No. 33), and will consider amending CD Year 11 on September 10th (see Resolution No. 34). Councilman Schondebare, with the concurrence of the -other Board members, will prepare a statement to be read at the regular meeting stating the intent of the. Town Board that if additional moneys are requested f6r.1986, it would be the AUGUST 27, 1985 Board's position that such moneys would be contingent upon a firm commitment of funding from the County and State. (5) ,Application of Mike Jacobi for one of the two remaining vacancies on the Licensing Review Board (see Resolution: No. 35) . (6) Request of Chief Winters to accept the transfer of Mark Zaleski from the Town of Southampton as a Public Safety Dispatcher I, a civil ,service position (see- Resolution No. 36) . (7) Notification of a seminar, Groundwater Technology: Pollution and Trans- - - port, to be held September 18th 20th at City University Graduate Center, New York City. A resolution authorizing attendance will be placed on the September 10th agenda. The Board also discussed Resolution. No. 26 on the Regular Meeting Agenda, and at the request of Councilman.Schondebare, who wished to research this further, this resolution will be held until the September 10th meeting. Mr. Tasker will draft a resolution for the Board's September 10th meeting. Mr. Tasker also brought-to the Board's attention the recent decision of the Suffolk County Supreme Court setting aside the Town Board's determination denying relief to Harold Reese and Frederick Reese from the two-acre zoning. The Board will not appeal the decision. Lastly Mr. Tasker discussed a. the pending-- Vantage Petroleum Corp. certiorari ,proceeding which is being handled by Special Attorney Richard Cron. I j .12:45 P.M.---Recess for. lunch. 2:20 P.M. - Work Session reconvened and the Board met with Recreation Director i Susan Fossett to discuss the "Instructor" Agreements prepared by Town Attorney Tasker, which they approve (See Resolution No. 15) ; her proposals to enter into agreements for Instructors for Arts S Crafts, Youth Tennis, Adult Exercise, and Horseback Riding Lessons (for which Resolutions No. 16-19,, to execute the contracts- will not be needed, as the Board. under Resolution No. 15 authorizes the Supervisor to sign Instructor Agreements for those items within the budgetary appropriations therefor) . Mrs. F,ossett also explained her need to establish a checking account j for recreation activity fees and deposit program fees, make withdrawals for ticket purchases, equipment purchases and instructor salaries.. (see Resolution No. 20) . The Board agreed that such an account is necessary, rather than requiring vouchers for payment which is a lengthy process and would not be feasible under the Progra REGULAR` MEETING 3:00 P.M. A- Regular Meeting of the Southold Town Board was held on Tuesday, August 27, 1985, at the Southold-Town Hall, Main Road, Southold, New York. Supervisor Murphy opened the meeting at 3:00 P.M. with the Pledge of Allegiance to the Flag. Present: Supervisor Francis J. Murphy Councilman Joseph L. Townsend, Jr. Justice Raymond W. Tasker SUPERVISOR MURPHY : Thank you. The first order of business, I'd like a resolution to approve the audit of the bills of August 27th. Moved by Councilwoman Cochran, seconded by Councilman Stoutenburgh, it was RESOLVED .that the followingaudited bills be and herebyare ordered aid: General Fund Whole Town bills in the amount of 25,335.79; General Fund Part Town bills in the amount of $5,367.72; Highway Department bills in the amount of $13,483. 90; Fishers Island Ferry District bills in the amount of $9, 228. 17; Waterfront Revitalization Grant bills in the amount of $648. 00; Southold Wastewater Treatment Plant bills in the amount of $94,329.85. AUGUST 27, 1985 01, 3 SUPERVISOR MURPHY: Next, a resolution to approve the minutes of the August 13th, 1985 meeting. Moved by Councilwoman Cochran, seconded by Councilman Schondebare, it was RESOLVED that the minutes of the August 13, 1985 Regular Town ' Board Meetina be and hereby are approved. SUPERVISOR MURPHY : Next, I'd like a resolution setting the next meeting date at September 10th, 1985, 7:30 P.M., Southold Town Hall. Moved by Councilman Stoutenburah, seconded by Councilwoman Cochran. it was RESOLVED that the next Regular Meeting of the Southold Town Board will be held at 7:30 P.M.., Tuesday, September 10, 1985,, Southold Town Hall, Main Road, Southold, New York. SUPERVISOR _MURPHY: Moving on to the first item on the Agenda, our Reports. I'd like to state that all these reports are on file in the Town Clerk's Office for anyone who would like to read them-. 1. Town Justice Edwards =monthly report - July 1985. 2. Board of Town Trustees - monthly report -. July 1985. 3. Police Department - monthly report - July 1985. 4. Greenport Housing Alliance, Community Development Monitoring Report. S. Councilmen's reports. I'd like to ask the Councilmen if they have anything further to report, . starting on my left with Jean. COUNCILWOMAN COCHRAN: I did attend the Chamber of Commerce meeting, which the Chairman. Jay Schondebare, will be reporting on. Also I've been busy working with Councilman Stoutenburgh on the STOP Program and I'm sure Paul will be report on that. ' So that is all I have at this time. SUPREVISOR MURPHY: Thank 'you, Jean. Paul? COUNCILMAN STOUTENBURGH : Well, just to bring people'up to date. We are rolling Very well with our STOP Program. We' have our insurances, we have our flyer which has just been finished, we have posters on the way. --Our big push is going to be the next two weeks, or I should say from probably the first of the new month coming up on to the 14th. We..will have a program open to the public between 9:00 and 3:00 in the afternoon. ' We're finding many interesting things coming about. We think we're probably going to have one of the best STOP Programs in Suffolk. I think we're going to make Islip Town's look 'very small from what I see the input. Jean, can you add anything to it? _ COUNCILWOMAN. COCHRAN : . No, I just think everythings in place. If there is any organization or service group that would. like a 15 minute showing of the slide presentation-that we're working on to help--this is more of an educational thing to help spread the word throughout the community as far as. STOP is concerned:,.- We'd like a little:.coverage in the paper, if possible, so anyone can contact the committee and we'd be very happy. to come in and talk to-them to encourage their attending. SUPERVISOR MURPHY : Okay. Thank you, Paul. Joe? COUNCILMAN TOWNSEND : Last week, or after the Town Board meeting I had a chance to return to my youth and go up to Toronto and compete with a bunch of other old foggies in World Masters Rowing Team. That was fun and relaxing in many ways. As you know, Frank, we both spoke to the Orient Association on Friday night and got informed as to `what concerns them. Last night 1 spoke to the New Suffolk Civic Association about concerns that they had. I also sat. in on the Commerce and Industry Committee meeting briefly, which Jay chaired and I'll defer to him to make a report of that meeting. That's all I have, Frank. SUPERVISOR MURPHY: Thank you, Joe. Jay? COUNCILMAN SCHONDEBARE: No comment. It was a very good meeting. The outcome basically is that we have a resolution on for today to establish an Economic Advisory Committee. The purpose of that.is to gather information as to the present economy in the Town of Southold, what contributes to it. The future of that present economy, that is what industries are viable and what is not, and also to search and look for additional firms that we can bring in to. the Town for the purposes of expand- ing the Town's tax base. To increase our taxes by increasing assessment I don't feel is-the way to go. So we're hoping that perhaps we can. bring some firms in here and we can get additional taxes and jobs. That's it. AUGUST 27, 1985 04 SUPERVISOR- MURPHY : Thank you, sir. Okay, I would just like to report that some time in the middle of September there is going to be a housing seminar for Towns down in Philadelphia, 1 believe and the information should be coming very shortly and hopefully at the next meeting we'll have authorization to have several Town Board members to attend, as well as there is going to be another solid waste seminar in Philadelphia .in the middle -to the end of September which I will be attend- ing, in fact 1 ve been asked to speak at it'on volume reduction, which is a program that we're doing in our Landfill and we're doing quite well with it. I would ask everybody to cooperate with Paul and Jean's Committee on the STOP Program. It's most important. It's .a way to get rid of hazardous waste, chemicals that are around the house that you might have stored and that if they were ever brought into the Landfill or dumped in your own backyard accidentially or whatever, could cause quite a major problem for the aquifer underneath you and so it's very important and I'm sure we're going to have an excellent program. here as both,_Paul and Jean mentioned. 11. PUBLIC. NOTICES'. SUPERVISOR MURPHY: Moving on to the second .item on the agenda is Public.' Notices. 1. _Corps of. Engineers, General Permit to authorize the construction of timber piers, decks, mooring .piles for non-commercial use in Nassau and Suffolk Counties. 2. . Department of 1-ransp6rtation, State of New York, concerning dredging of temporary channel to allow a barge to deliver heavy stone fill to Route 25 revetment at East Marion. There is a job coming out fairly soon with the NOT .to rebuild: the stone wall .there "in -East Marion. _ 3. . New York State. Department of Environmental Conservation, Notice of Complete Application of Philip J. .Ofrias, Jr. to subdivide an 1, ± acre parcel into four lots in Long Creek Drive, Long Creek and Arshamomaque Pond, Southold. Comments by September-13,. 1985. III. COMMUNICATIONS. SUPERVISOR:.MURPHY: The next item is Communications:. 1. From Congressman William Carney stating that he's sorry he couldn't make the, Fishers Island meeting, but as usual :he is very interested and very concerned about not only Southold Town, but also Fishers Island. 2. Letter from Senator=Alfonse D'Amato. We had sent him a letter asking him to support our request for a grant on the small water systems to the EPA, our individual filter program, and hopefully with his effort and Senator Moynihan's and Bill. Carney's efforts, this will .come about. 3. From Suffolk County Legislator Gregory Blass asking help from the Town in establishing a Sing e' Parent Residence-whiiah will e, hopefully, s( et up import. IV. PUBLIC HEARINGS. SUPERVISOR MURPHY: There is a public .hearing scheduled for a little later (3:30 P.M. Thomas E. Samuels, Wetland Application), so we'll move on to item No. V, Resolutions. V. RESOLUTIONS. SUPERVISOR MURPHY: The first resolution concerns our STOP Program and maybe Paul would like to read it. 1. Moved by Councilman Stoutenburgh, seconded by Councilwoman Cochran, it was RESOLVED that pursuant to Article -8 of the Environmental Conservation Law State Environmental Quality Review and -6NYCRR Part 617, Section 617. 10, and Chapter 44 of the Code of the Town of Southold, notice is hereby given that the Southold Town Board, as lead agency for the action described below, has determined that the project, which is unlisted, will not have a significant effect on the environment Description of Action:. . Southold Town (STOP) Stop Throwing Out Pollutants Program to be held on September 44, .1985 at the Southold Town Landfill Site, Cutchogue, New York. The project has been determined not to have a significant effect on the environ- ment because an environmental assessment has been submitted which indicated that no significant adverse effect to the environment are likely to occur should the project be implemented as planned and because there has been no response in the allotted time' from the New York State Department of Environmental Conservation it is assumed that there are no objections' nor comments from that agency. There is governmental support at both- the state and local level for this project. Only. benefifical impacts are expected due to the reduced risk of environmental contam- ination from storage of hazardous materials in the home 1 -Vote of the Town Board: Ayes: Councilwoman Cochran, Councilman Schondebare, Councilman Stoutenburgh, Councilman Townsend, Supervisor Murphy. Councilman Schondebare, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the following amendments to the Community Development Year 11 Program Budget, as follows, to wit. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 4 is to execute an agreement on a Grant Amendment/ Increase in our Scavenger Waste Pretreatment Facility. - 4. Moved by Councilwoman Cochran, seconded by Supervisor Murphy, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs- Supervisor Francis. J. Murphy to execute a Grant Amendment/Increase in the amount of $742, 950. 00 with respect to the construction of the Scavenger Waste Pretreatment Facility (C361120-02-1) ; said amendment is for an increase due- to the construction bids received on Contracts 1, 2, 3, and 4. SUPERVISOR MURPHY: The construction is coming along pretty well. We hope by the end of September to be pretty much .complete on most all of the- construction L. aspects of it. There might be a few parts missing of some modifications of motors in- particular, and might cause a little delay. Hopefully not. But we hope to be able to start up the biological feeding of the di.gestor by that time. 4.-Vote of the Town Board: Ayes-: Councilwoman Cochran, Councilman Schondebare, Councilman Stoutenburgh, Councilman Townsend, Supervisor Murphy. This resolution was declared. duly ADOPTED. SUPERVISOR MURPHY: Number 5 is a decision on- the relief petition of Hodor-Staller. 5.. Moved by Councilman Townsend, seconded by Councilman Stoutenburgh,. WHEREAS, Louis Hodor and Max Staffer, by petition dated October 24, 1983, applied to the Southold Town Board for relief from the bulk requirements of the Town Zoning Code requiring two acres for a residential subdivision rather than one acre, on certain property containing 25. 100 acres on the west side of Rocky Point Road, East Marion, known as "East Marion Woods, Section 1", all pursuant to Local Law No. 11-1983; and WHEREAS, a public hearing was held by the Southold Town Board on said petition on the 13th day of March, 1984, after which the Board adopted a resolution denying the relief requested and determining that the petitioners did not diligently prosecute their application for a major subdivision; and WHEREAS, an Article 78 proceeding was brought against the Town of Southold, Suffolk County, New York, and the Planning Board of the Town of Southold by Louis Hodor and Max Staffer, seeking to set aside the Board's decision; and WHEREAS, Supreme Court Justice Morton 1. Willen, by order dated and filed November 21, 1984, declared the decision of the Town Board annulled and remitted the matter to the Town Board for reconsideration de novo and the making of findings; and WHEREAS, the Town Board has, on the 2nd day of July, 1985, held a- re-hearing on the aforesaid petition, at which time all interested persons were given an opportunity to be heard, OAUGUST 27, 1985 06 NOW, THEREFORE, based upon the testimony given on the 2nd day of July, 1985; based upon all of the materials and exhibits heretofore submitted to this Board; and based'upon the personal knowledge of the members of this Town Board, this Board finds that: . The applicants herein are in the business of developing residential and commercial real estate in the Town of Southold and in other townships within the County of Suffolk. That real estate development in the County of Suffolk and in the Town of Southold is regulated to some degree by the Suffolk County Department of Health Services, which department would oversee and insure compliance with the provisions of. Article 6 "Realty Subdivisions and Development". The above-referenced Article; for purposes of this determination essentially deals with the, provision of potable .water and adequate sewage disposal systems for residential and commercial real estate developments in the County of Suffolk: Petitioners engaged counsel to process their application for a major realty sub- . Van Tuyl, .P.C., land surveyor and professional engineer, to prepare the necessary maps and drawings in connection therewith. , Max Staller Associates, a company either wholly-owned or controlled' by one or both of the petitioners, was also involved in deal- ing with the Suffolk County Department of Health .Services. Statements by petitioners' counsel indicate that petitioners were delayed in obtaining Health Department approval by a change in the manner of the administration of the provisions of Article 6. This Board disagrees with such contention. The applicants are charged with knowledge of the provisions of Article...6 of the Suffolk County Health Code and the manner of its .administration. In. October 1982, petitioners were made aware by letter of the fact that the County would be adhering strictly to the fact that approval under the provisions of Article 6 would be required prior to an approval of a subdivision map, not after. No application for approval by the County was submitted until July of 1983, which approval was granted by the County within about one month. Petitioners claim that they were -delayed between October of 1982 and April- or May of. 1983, because of the County`s failure.'to send certain data. requested by their professional engineer and attorney. We find that this contention is totally lacking in credibility. . This is especially so since the information sought would be public informa- tion and, undoubtedly; could have been obtained within a single day or two at the outside if this matter had been diligently pursued. The petitioner-applicants herein, realizing that Article 6 would have to be complied with, simply did not promptly pursue necessary-.information or required approvals. Petitioners also contend that another reason for their inability to obtain map approval:was the fact that Mr. Van Tuyl took a sabbatical• in September of 1982, and di not return to his practice until May of 1983. It is alleged that Mr. Van Tuy's absence made it impossible to prepare and file necessary maps with the Plan- ning Department, the County of Suffolk and the Town Highway Superintendent. This contention is disputed by the very testimony of Mr. Van Tuyl at the Hearing. This Board finds that the petitioners must be held responsible for the lack of attention or failure to proceed of their agents or employees, professional or otherwise. The petitioners do not contend that they were unaware of Mr. Van Tuyl's absence. The fact that Mr. Van Tuyl had left his practice was a matter of common knowledge and petitioners were not diligent in taking the necessary steps to assure the continuation of the work on their subdivision map. ' There, is testimony that Mr. Van Tuyl, or his associates, engaged a different firm of professional surveyors and engineers to work on on-going matters in his absence, but there is absolutely no testimony given to .indicate whether this firm was engaged by Mr.. Van Tuyl to work on the matter at hand and there is no testmony from the petitioners, themselves, concerning their efforts to make certain that work continued on their subdivision map. In fact, neither of the petitioners testified at the Hearing on July 2, 1985. A further reason for the failure of the petitioners to timely file their map is the fact that they failed to diligently prepare and file amended maps between the period of September 15, 1981 and April 29, 1982, a period of slightly in excess of seven months. Accordingly; this Board `finds that the petitioners did not efficiently and promptly obtain the necessary approvals from the Suffolk County Department of Health Services and did not expeditiously process their application for major subdiv_ ision approval be113 the Planning Board. This Board will not speculate on what petitioners could have done or should ha., done to have caused their map to have been timely filed, but, based upon the record before us,' we find that the petitioners did not diligently prosecute their subdivision application and that the lack of final approval was not due.to circumstances beyond petitioners' control and, thus, their application for relief, pursuant to Local Law No. 11-1983, is hereby denied. SUPERVISOR MURPHY: The decision is five pages long (double spaced) and it is on file with the Town Clerk. We just. received it today, this afternoon, from the special attorney that drew up the answer. Mr. Zaleski .currently has Suffolk.-County. Civil Service status-as a Public Safety Dispatcher I with the Town of Southampton, and upon receipt of the required authorizations, will transfer to the Town of. Recently--today, as a matter of fact,- at lunch I read. an article where Governor Cuomo was applauding the Nuclear Regulatory Commission's turning down of Shoreham's lack of a-plan--Emergency Evacuation Plan, and it has made me think about another letter that appeared in our mail regarding the ash dump, which in some ways is a similar situation. As you know, the Governor authorized the. Long Island Regional Ashfill Board to find a site for an ash dump, which there has been some indication it may well be in part of Southold Town, on the western border. In our mail was a letter from a Riverhead Town Councilman and a member of their Industrial Development Agency in opposition to an ash dump AUGUST 27, 1985 13 in their town and I think it would be incumbent upon us to also express our opposition to siting of an ash dump =in''our town. Certainly just because we have less population and more open space is no reason to choose our area for the of the western towns on Long Island, especially considering the delicateness of our water table. I know that they would take precautions to protect that, however, that much ash coming in with heavy metals and God knows what else, is not something I think we want in our town and I want to go on record in opposition. I'd like to send a letter to the Governor. I'd like to have you, on behalf of the Town Board, - send a letter to the Governor. If anybody would like to make that--- SUPERVISOR MURPHY: I think we should have a resolution next time, next meeting. COUNCILMAN TOWNSEND : All right. The draft and it's more of a scoping to take in the whole concept. No site has been picked yet. COUNCILMAN TOWNSEND No, but we know that there has been contact made with LILCO on that. SUPERVISOR MURPHY: The environmental part of it might knock it out from even any consideration. COUNCILMAN TOWNSEND: I think it wouldn't harm us to be on record. SUPERVISOR MURPHY: . No, sir.
