SAWICKI - - - - - - - SPECIAL MEETING FEBRUARY 14 , 1986 A Special Meeting of the Southold Town Board of Appeals was held on Thursday ; February 14 , 1986 at 5 :00 o ' clock p .m . at the Southold Town Hall , Main Road, Southold , New York 11971 . Present were : Gerard P . Goehringer , Chairman ; Charles Grigonis , Jr, and Joseph H . Sawicki , constituting a quorum of the members. Absent were : Robert J . Douglass and Serge Doyen (dud to illnesses ) . Also present were : Victor Lessard , Building- Department Administrator , and Linda Kowalski , .Z . B .A. Clerk and Secretary . The Chairman opened the meeting at 5 :00 p .m. and proceeded with Item I (a ) of the agenda , as follows : I (a ) . Appeal No . 3429 - PENDING DECISION : Application of H . NORMAN McCULLOUGH III and ANTONE E . BERKOSKI for a Variance to the Zoning r inance , rtic e III , Section 0 -3 or approval of insufficient depth of parcels in this pending three-lot minor subdi-vision , located at th.e corner of Oregon Road and Cox ' s Lane , Cutchogue , NY ; County Tax Map District 1000 , Section 83 , Block 3 , Lot 3 . Following deliberations , the board took the following action : WHEREAS , a public hearing was held and concluded on January 9, 19863 in the Matter of the Application of 'H . 'NORMAN McCULLOUGH III and ANTONE E . BERKOSKI under Appeal No . 3429 ; and WHEREAS , the board has considered all testimony and documentation 1 � Southold Town Board of Appeals -2- February 14 , 1986 Special Meeting (Appeal No . 3429 - McCULLOUGH AND BERKOSKI , decision , continued : ) entered into the record concerning this application , and it is noted that no public opposition has been received; and WHEREAS , the board members have personally viewed and are familiar with the premises in question as well as its surrounding area ; and WHEREAS , the board made the following findings of fact : 1 . The property in question contains a total area of 5 . 967 acres and is situated. at the southeast corner of Oregon Road and Cox ` s Lane , Cutc hog ue, identified on the Suffolk County Tax Maps as District 1000 , Section 83,_ 'Block 3., Lot 3 . 2 . By this application , appellants request a variance for insufficient lot depth of three ._parcels , proposed as follows : (a ) Parcel l . of an_ area._ of 85 ,600± sq . ft . in area , frontage [lot width] of 397 feet , and lot depth of 222_. 47 feet; (b) Parcel 2 of an area of 86, 600 sq . ft . , frontage ,[lot width] of 386 feet , and lot depth_ of 224± feet.; (c ) Parcel 3 of 86,600 _sq . ft . , frontage .[lot width] of 363 feet, and lot depth of an average of 227 . 50± feet , all as shown on sketch _planjsurvey_ prepared by Roderick .VanTuyl , P . C . October 26 , '1984:. 3. Proposed Parcel #1 is presently improved with a noncon- forming building depicted "cottage " on the October 26 , 1984 sketch plan/survey and which has been in delapidated condition for quite some time ; proposed Parcels #2 and #3 are vacant . 4. The board finds there is no other method feasible for the appellants to pursue other than the variance and therefore agree with _appellants ' reasoning. 5. For the record., it is noted that favorable comments have been received from the Southold Town Planning. Boa_rd by action taken December 2 , '1985 on the general layou_t_ of this minor subdivision . 6 . It is also noted for the record that Certificate of Occupancy #Z1296.1 was issued for the entire parcel of 5 . 967 acres on November 9, 1984 . In considering this application , the board has determined: (a ) the relief .requested _is unique ; (b ) the relief requested is not substantial_, being 10% of._ the requirements_; (c )_ there will be no substantial_ change_ in the character of this district ; (d ) _ the relief as requested is not substantial ; (e ) the public health , welfare , .and safety of the town will be served by upholding this t Southold. BERKOSKI as applied and .S.UBJECT 'TO 'THE FOLLOWING CONDITION: That the existing delapidated structure conform to the require- ments of the zoning and b_uildi'ng codes if converted to a residence as to livable floor area, setbacks , e.tc .._ (as well as meeting setback requirements of an accessory structure .if used as such ) . Application of NORTH-FORK 'C.OU.NTRY 'CLUB for a Special Exception to the Zoning Ordinance , Article III , Soctlon l 0=30(B) for permission to reestab- lish and rebuild country club building _whi_ch will_- include a restaurant, kitchen facilities ; bar., pro shop with sales and various support rooms such as locker rooms and lounges., existing 18-hole golf cour.se and exist- ing two tennis courts , at premises located at the corner of Main Road and Moore ' s. Lane , Cutchogue , NY; Suffolk County Tax Map District 1000 , Sec___ tion 109 , Block 4 , Lots 1 , 3 , 4 and 7 . ' Following deliberations , the board took the following action : WHEREAS, a public hearing was held and concluded on January 9 , 1986 , in the Matter of the Application of NORTH FORK COUNTRY CLUB under Appeal No . 3435 for a Special Exception ; -and - _ WHEREAS , the board has considered all testimony and documentation entered into the record concerning this application ; and it is noted that there has been no public opposition ; and WHEREAS , the board members have personally viewed and are familiar with the premises in question , its present zoning , and the surrounding area ; and WHEREAS, the board members have also considered Items (a ) through ( 1 ) of Article XII, Section 100-.121 (c ) [2] of the Zoning Code in making this determination ; and WHEREAS , the board made the following findings of fact : 1 Southold Town Board of Appeals -4- February 14 , 1986 Special Meeting I . The property in question is identified on the Suffolk County Tax Maps as District 1000 , Section 109 , Block 4 , Lots 1 , 3 , 4 and 7 , consisting of a total acreage of approximately 34. 5 acres , fronting along by east side of Moore ' s Lane (a/k/a Linden Avenue ) approximately 695 feet along the northerly end , and fronting along the south side of the Main Road ( State Route 25 ) 708± feet . 2 . By this application , applicant requests a Special Exception to the Zoning Ordinance , Article III , Section 100-30 ( B) for permission to reestablish and rebuild country club which will include : (a ) a restaurant., ( b ) kitche_n facilities , (c ) bar,__ (d) pro shop , with sales, (e ) various support rooms , such as locker rooms and lounges_ , and to continue it_s existing 18-hole golf course and two tennis courts [see site plan dated November 14 , .1985 prepared by Donald A. Denis, A. I .A. ,_ _P . C .] . The dining room is proposed to seat a maximum of 180 persons (for a total of 1 ,200 sq . ft. ) . Also proposed are a b.a1.1 room of 1 ., 794 sq . ft. , service bar-136 square feet , chair storage-80 sq ._ ft. , coat room -108 sq . ft . , janitor ' s closet-70 sq . ft. , bath rooms 2422 sq . ft . ,__ office-240 sq . ft . , kitchen-1 , 3'00±- sq . ft. , foyerJlounge 954 sq . .f_t. , bar-1 ,050± sq . ft. ,_ grill -836 sq . ft.. , pro shop and storage 1 , 300± sq . ft. , for a total square footage on the main floor of 1.3,020± sq . ft . The second. floor will be., used for air-c_onditio_ning and other equipment , e.xhaust _c.onduits , air handlers; and storage . 3. It is noted that in rebuilding and reestablishing the above uses , the original clubhouse structure and foundation (which consisted of.. 9,837 _sq . ft.. on the main floor ) will be demolished and removed from the premises . .. 4 . It . is also noted for the record that 97 parking spaces will be provided , which includes the existing 70 spaces ) , as well as an "overflow" parki. ng ' area located just east of the exist- ing concrete-block garage . 5 . Reference is made herewith to a conditional variance granted simultaneously herewith under Appeal No . 3434 to allow for the 1 ocatlon =of i.fte parking facilities within 100 ' of the street line and varying the number of parking spaces to 97 , to which the Planning Board , 'by resolution of December 16 , 1985 , has stated is adequate and therefore have no objection . 6 . The premises in question is located in the "A-80" Residential and Agricultural Zoning District . Properties to the east- and south are also located in the Residential__ an_d Agricultural Zoning District . Properties on the north side of the Main Road , opposite the subject premises , are located in the Residential Zoning District . 7 . For the record , it is noted that prior to a fire in June of 1985 , the premises was occupied by a preexisting , nonconforming country clubhouse and restaurant since prior to 1957 . In considering this application., the board has determined : (1 ) the uses proposed will__ _not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use dis- tricts ; _ (2 ) the safety , health,,.. welfare , comfort, convenience and order of the town will not be adversely affected; (3) the use is in harmony with and will promote the general purposes and intent of zoning. Accordingly, 'on motion by Mr . Goehringer , seconded by Mr . Sawicki ., .it was RESOLVED,. Board of Appeals -6- February 14 , 1986 Special Meeting PENDING DECISION : Appeal No . 3434-V : Application of NORTH FORK COUNTRY CLUB for a Variance to the Zoning Ordinance : (a ) Article III , Section 100-30 (B ) [a] to establish and con- tinue existing and new parking area within 100 feet of street line , ( b ) Article XI , Section 100- 112 (A) to vary number of parking spaces to less than that required by parking schedule . Location of Property : Corner of Main Road and Moore ' s Lane , Cutchogue , NY ; Suffolk County Tax Map District 1000 , Section 109 , Block 4., Lots 1 , 3 , 4 and 7 . NO.RTH FORK COUNTRY CLUB under Appeal No . 3434 for a ,Variance_;__ and WHEREAS, the board has considered all testimony and documentation entered into the record concerning this application ; and it is noted that there has been no public opposition ; .and WHEREAS, the board members have personally viewed and are familiar with the premises in question , 'its present zoning , and the surrounding area; and WHEREAS, a conditional Special Exception was approved under same date hereof .concerning Application No . 3434 ; and WHEREAS,, the board made the following findings of fact : 1 . ' The property in question is identified on the Suffolk County . Tax Maps as District 1000., *Section, 109;. Block 4 , Lots 1 , 3 , 4 and 7 , consisting of a total acreage of approximately 34.. 5 acres , fronting along by _east side of Moore ' s. Also proposed are a ball room of 1 , 794 sq . ft. , service bar-136 square feet , chair storage-80 sq . ft . , coat room -108 sq . ft. , janitor ' s closet-70 sq . ft . , bath rooms 242± sq . ft. , office-240 sq . ft . , kitchen- 1 ,300± sq . ft. , foyer/lounge 954 sq . ft. , bar-1 ,050± sq . ft . , grill -836 sq . ft . , pro shop and storage 1 ,300± sq . ft. , for a total square footage on the main floor of 13 ,020± sq . ft . The second floor will be used for air-conditioning and other equipment , exhaust conduits , air handlers , and storage . 4 . The distance of the proposed parking area as shown on the November 14 , 1985 Site Plan indicates a setback of 14 ' from its nearest p.oint. from the Main Road at the most northwesterly corner and widening to a setback of 46 feet from the Main Road at the most northeasterly corner . The setback of the proposed parking area from Moores_ Lane (Linden Avenue) is 28 fe.et , with the ingress and egress located approximately 80 feet south of the Main Road . 5 . The distance of the existing parking area as shown on the November 14 , 1985 Site Plan indicates a setback of 4 ' from Moore ' s Lane (and 71 from the ed..ge of the existing hedges_ alon.g Moore ' s Lane ) . 6 . The November 20 , 1985 Notice of Disapproval prepared by the Building Inspector indicates a total amount of 180 parking spaces .is required pursuant to Article XI , Section 100-112 (A) based on a total membership of 360 , including regular and house members , which would be the greatest use of the premises . 7 . Appellant propose 97 parking spaces , which includes 70 existing and 27 new , as well as an "overflow" parking area , all as shown on the November 14 , 1985 Site Plan submitted with the application . 8. For the record, it is noted that prior to a fire in June of 1985 , the premises was occupied by a preexisting , nonconforming country clubhouse and restaurant since prior to 1957 . Also., in rebuilding and reestablishing these uses , the original clubhouse structure and foundation (which consisted of 9 ,837 sq . ft . on the main floor ) will be demolished and removed from the premises . The newly constructed clubhouse and restaurant structure will be set back 125 from Moore ' s Lane (Linden Avenue ) and 188 feet from its front property line along the Main Road . 9. The premises in question is located in the "A-80 " Residential and Agricultural Zoning District. Properties on the west side of Moore ' s Lane are zoned Residential and others "B-l " General Business . Properties on the north side of the Main Road , opposite the subject premises , are located in the Residential Zoning District . In considering this application , the board has determined : (a ) the relief requested is unique ; (b ) the relief requested is not substantial ; (c ) there will be no substantial adverse change to the character of this district; (d) the public health , welfare , comfort , 'convenience and safety of the town will be served by upholding this application ; (e) the spirit of the zoning ordinance will best be served by allowing .the variances , as conditionally noted below. Accordingly , on motion by Mr . Goehringer , seconded by Mr . Sawicki , it was RESOLVED , that the relief requested under Appeal No . 3434 of the NORTH FORK COUNTRY CLUB for permission : (a ) to establish and continue existing and new parking area within 100 feet of street line , and ( b ) to vary the number of parking spaces to 97 spaces plus the additional overlow parking area as shown by site plan dated November 14 , 1985 , BE AND HEREBY IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS : 1 . N/s Sound View Avenue , Southold ; 1000-68-1 -14 and 15 . 1 . This pending application was updated and noted as follows : (1 ) N .Y . S . D. E . Variance to the Zoning. Ordinance , Article III , __Section 100-_30 .and Article XI , Section 1007118 , for permission to utilize premises located in this A-Residential and Agricultural Zoning District for two B-Light Business uses in addition to two dwelling uses .. Location of Property : 27475 Main Road , Cutchogue , NY ; 1000-102-01 -13 . The public hearing on this matter was held on February 6 , 1986 and recessed until March 13 , 1986 . The Chairman indicated that a letter to the Town Board would be referred requesting the changes anticipated by the Town Board in light of the fact that this property appears to have been occupied as a retail store ( Peaches ) nonconforming since prior to 1957 and continuously up until about 1982 , as evidence at the February 6th public hearing and Certificate of Occupancy #Z10644 . The property lost its nonconformity as a "shoe store . " There being no other business properly coming before the board at this time , the Chairman declared the meeting adjourned. The meeting was adjourned at 5 : 40 o ' clock p .m.
