SAWICKI M I N U T E S SPECIAL MEETING JULY 25 , 1985 A Special Meeting of the Southold Town Board of Appeals was held on Thursday , July 25 , 1985 at 7 : 30 p .m. at the Southold Town Hall , Main Road , Southold , New York. Present were : Gerard P. Goehringer , Chairman ; Serge Doyen , Jr. ; Robert J . Douglass . Absent were : Charles Grigonis , Jr. and Joseph H. Sawicki . Also present was Robert W. Tasker , Esq . The board members were requested to meet tonight to discuss several areas of the Master Plan revisions as proposed . The board members expressed their concerns about the importance of retaining Special Exceptions with the Zoning Board of Appeals , and the Planning Board reviewing the same project under the "Site Plan" regulations . Other areas of the Master Plan were discussed . The Town Attorney advised the board that the Zoning and Planning Boards. shoul.d have been invited to each of the _Master Plan review sessions , which have been held on Tuesdays and Thursdays , from 2 - 5 p .m. PENDING COMPLIANCE: Appeal No . 3184 - PETER AND PATRICIA LENZ. The subject variance was conditionally granted on - April 19 , 1984 , and .to date , no compliance has been made or any attempts in good faith. In researching . this matter , it was found that on September 30 , 1983 , an application was made to the Building Department for a Pre-C/O by E. Wallace Roth- Southold Town Board of Appeals -2- July 25 , 1985 Special Meeting (Appeal No .' 31'84, continued:. ) mayer . On October 25, 1983 an application wa.s made for a pre- CJ0 to the Building Departme.nt "by Lu.nds_tedt' & Foy regarding the_ premi ses . . Dur.i ng..October 1983, a ' No.ti ce -o f _Di sappro.va . wa.s issued by the Building Department indicating that the proposed subdivision required Planning Board approval and Z . B..A. approval on the insuffi - ci ent 1 of . width, and for _280-A access approval_.,. It has recently___. been found that a Pre-CJO was issued -by__the B.uldi-ng Department on December 23, 1983 -under' #Z1.21591 how.e.ver, the Z ..B.A. application was pending at this time, _and- a condi.tion,al approval was-later rendered on April. 19., -1984� On :motion .by Mr. Goehri.nger_, seconded by Messrs . Douglass and Doyen, It was RESOLVED., that the followi..ng letter be sent to the appl i cants,._., Mr . and Mrs Peter, Lenz,:_,wi th a copy sent to their attorney , Abigail A. ' Wickham_, Es.q . . . . Dear Mr. and Mrs . Lenz : This is in response to your letter dated July 23, 1985 . I wrote - to you on, July 18 ,- 1985 asking that you -gi_v_e the matter with the conditions imposed on the grant of the variance and approval of access to your property immediate attention and also advised you that if you do not intend to comply , the board will have no other alternative but to set this matter down for a new hearing to revoke the variance and access previously granted . I am advised by our town attorney that he discussed this matter with your attorney, Abigail Wickham, and that he also discussed this matter with you on__ the telephone , and that you indicated to him that you had no intention_ with not complying with the conditions imposed. I again ask you to advise thi�s:. board within the next 10 days whether or not you intent to comply with the conditions . If no response is received from you within- said period , the board- will proceed to set this matter down for a new hearing to consider the question os revoking the variance and approval of access previously granted. . . , Vote of the Board : Ayes : Messrs . P ; L .q Y Southold Town Board of Appeals -3- July ' 25 , 1985 Regular Meeting INCOMPLETE VARIANCE : In reviewing the application and \ forms left with. the Building Department _recently_, it was noted that several items were missing and the documents as submitted could not be accepted for filing . The Chair.manyindicated that a letter would be sent to Dr... Damianos requesting the following additionally : (a ) the three copies of .the application has not been notarized ; (b) the original. Notice to. Adjacent Property Owners form has not been com,pleted,___ signed and. notarized.. on_ the__ reverse sides for three _adj.oini:ng _property owners ; (c ) the adjacent `own.er to the north has not been notified as required by Section 100-725 11000•-.86-01 -01 ; (d) four copies of a survey or site ,plan showing the area of the festival in ,-question together with a -.-showing of the entire parcel ,_ 'and showing any proposed fences, egress, ingress , parking ._areas_, tents, sanitary facilities available to the .public , and all information concerning __personne7 for the affair ; (e ) $75 . 00 filing fee payable to the Southold Town Clerk . . The Chairman also indicated that if the Damianos papers were filed and complete by August 8, 1985, there was a great possibility this matter would be placed on our August 22nd .calendar f_or public hearing.. .
