Cochran, Councilman George L. Penny IV, Town Clerk Judith T. Terry, Town Attorney Robert W. Tasker, Superintendent of Highways Raymond L. Jacobs. .Councilman Schondebare (3:25 P.M.) , Absent: Justice Edwards. 9:00. A.M. = Jay Tanski, Sea Grant, met with the Board to review his outline of potential erosion control options for Kenneys Beach which deals with the benefits and disadvantages of relocation of affected structures landward, beach renourish- ment , shoreline hardening structures and process altering structures. Mr. Tanski suggests that additional information is needed through the services of a qualified engineer regarding beach profiles, wate climate, sediment transport, and specifications for a structure, all of which are extremely- costly. Copy of this outline is on file int he Town Clerk's .Office. 9:45 A.M. - Police Chief H. Daniel Winters met with the Board to discuss hiring of a school crossing guard for the Greenport School crossing, and his wish to hire two new police officers in anticipation of expected retirements in' 1987. 10:00 A.M. - Resolution No. 21 proposed for the regular meeting agenda, with respect to rescinding the Board's policy requiring new community water systems be dedicated to the Suffolk County Water Authority, was discussed. The resolution, proposed by Supervisor Murphy, states that the Board. failed to comply with SEQR. Town Planner David Emilita had advised the Supervisor that there is litigation in the Town of East Hampton with the Water Authority concerning the SEQR require- ments. Councilman Penny stated he had spoken to Mr. Emilita who advised him that he was under the impression the Town was giving the Water Authority a franchise, which they are not. They already have a francise from the State of New York. This matter will be further discussed with Mr. Emilita at the after- noon work session. 10:05 A.M. - Superintendent of Highways Raymond L. Jacobs discussed the Kenneys. erosion problem with the Board. He stated that the wind and waves during the past couple of days has exposed rods and concrete used to stabilize the beach. He said it will cost the Town about $900 to rent a machine to .push the cement back toward the parking lot. Don Stanton, a resident of the Kenneys Beach area, urged the Board to push back the cement so the beach will remain open. Councilwoman Cochran urged the Board to close the beach for the remaining six days of the season, but Councilmen Stoutenburgh and. Penny requested the cement be pushed back. Super- isor Murphy advised Mr. Jacobs that the concensus.of the Board would be to get the machine and move the cement back. 10:10 A.M. - A Public Informational Meeting with the Suffolk County Water Author- ity was discussed. Councilwoman Cochran suggested an educational-type meeting with the Water Authority present, as well as the County Health Department and Dr. Koppelman of the County Planning Department, to which Councilman Penny and Supervisor Murphy agreed. Councilman Stoutenburgh stated the residents of the Town have the right to hear from Riverhead Town and how they are handling their water district, as well as representatives from other water districts throughout the County. Councilwoman Cochran suggested 'a second meeting after the meeting with the Water Authority if the people have further concerns. Supervisor Murphy agreed that to have numerous representatives from other districts would be to much at one time, stating that a second meeting would be reasonable if necessary. The Board will discuss a possible date for this meeting when Councilman Schondebare and Justice Edwards are present.--Stanley Sledjeski, Nick Cyprus and Don Witscheben, residents with the Captain Kidd Water System, spoke about their prior request to ask the Suffolk County Water Authority to take over their system. Mr. Witscheben took exception to the Chairman of the Town Water Advisory Committee going before the Greenport Village Trustees to pursuade them to take over the Captain Kidd system after the Town. Board had agreed to support their request for the Suffolk Countv Water Authority. 13 O AUGUST 26, 1986 iu:su H.M. - Lori ,aimon, a resident of Horton Lane, 5outnold, appeared before the Board to protest the lack of action with respect to a building on the Millman property on Horton Lane. Mrs. Salmon described the building as an eyesore, and dangerous, as it appeares to be sitting only on cement blocks. - Other residents of the area have registered their protests over the past year with respect to this building. She produced a chronological list. dating back to October or early November .1984 with 'respect to the status of the building and her attempts to have .the situation corrected. Executive Administrator Lessard came- before the Board and assured them that the matter is in the hands of Special Attorney Lark for the declaration of an unsafe building and he will meet with Mr. , Lark the first of next week to move it forward. 10:45 A.M. - Discussion relative to Coastal Erosion Hazard Areas, as designated by the New York State Department of Environmental Conservation, will be discussi during the afternoon work session when Planner David Emilita is in attendance. Mr. Don Stanton, resident of the Kenneys Beach area, urged the Town Board to respond to this matter in a timely manner. 11 :10 A.M. - Abigail Wickham, Attorney, met with the Board to obtain their permission to amend the Farmland option of Simmons and Nicholas to reduce the right-of-way along the westerly property line from 50 ft. to 25 ft. A letter from the Farmland Committee indicates their full agreement to this amendment. The Town Board agreed and Town Attorney Tasker and Ms. Wickham will work out the amended option agreement. 11 : 15 A.M. - _Ruth_ Oliva spoke to the Board to urge their endorsement of the establishment of a Bay Management Task Force to save the Peconic Bay Estuary from further deterioration. The Board agreed to this endorsement - see resolution No. 23. 11:20 A.M. - Garrett Strang, Architect, met with the Board to discuss the bids received on August 21, 1986 for the construction of a new Dog Pound building. The bids received were incomplete, lacking plumbing and heating, air .conditioning and ventilating bids. The three general. construction.bids ranged from $167,393.00 . to $223,929.00, and two electrical bids of $16,300.00 and $19,771.00. It .would appear that had all phases of construction be bid, the cost would have been twice the amount estimated of $110,000. Mr. Strang suggested rejecting the bids and rebidding thrl different ways: (1) general construction, (2) the administration building only, an (3) the kernel section only. The Board agreed - see resolutions no. 24 and 25. 11 :30 A.M. - For Discussion Items: (1) Consider the purchase of twelve more' Town Flaps as there is only one remaining flag, and that is being used as a "loaner", The Board authorized the Town Clerk to order twelve more flags, and charge them to Buildings and Grounds. (2) Letter from the League of Women Voters requesting support of the establishment of a Bay Management Task Force (see resolution No. 23) . (3) Letter from Attorney Richard J. Cron requesting a refund of the inspection fee with respect to the abandoned subdivision known as Greenbriar Acres, Mattituck (see resolution No. 29). (4) Letter from the Town Trustees requesting a meeting between the Town Board, Southold Park District, Town Attorney- Tasker, the Trustees and Mrs. Ruth Cooke to discuss a grant of land by Mrs. Cooke. A date will 'be arranged. (5) Letter from Sue Rauch -- with respect to a quit claim of a Town right-of-way at Gull Pond. Town Attorney Tasker informed the Board this has been an on-going matter for the past twenty years and all of the property owners concerned would foot agree to the quit claim. This matter will be referred to the Town Trustees. (6) Letter from the Suffolk County Office of Economic Development asking the Town if the wish to join Suffolk County in placing ads in the "Economic Resource Profile" magazine. The Board.- declined the invitation. (7) Letter from East.End Counseling Project asking for suggestions for obtaining Southampton Town approvals and identifying possible other funding sources for the capital start-up costs of a Residential. Treatment Program for Substance Abusers. The Board feels this is for local jurisdiction int he Town of Southampton. (8) Letter from Suffolk County Executive Cohalan informing the Board that Suffolk County recently approved a local law authorizing an increase in senior citizen exemptions from $10,500 to $12,025 as a result of a recent new State law permitting local governments to make this increase by the adoption of a local law. (9) Request of Capital Highway Materials, Inc. to be released from the bid for T Posts for snow fence. The Board agreed and will award to the second lowest bidder Chemung Supply Corporation - see resolution No. 26. (10) Request of Councilman Stoutenburgh to discuss Critical Environ- mental Areas - will be discussed when Town Planner Emilita is at the afternoon work session. (11) Memorandum from Paul Sabatino II, Counsel to the Suffolk County Legislature, transmitting a copy of a resolution of the Suffolk County Department of Parks, Recreation and Conservation Board of Trustees requesting the Town to carefully review and scrutinize all applications for land use activities involving zoning actions, special permits, variances or subdivision plats which affect Robins Island and Orient Point since they are proposed to be purchased by the County within the next three years. (12) Discussion with respect to projected 1987 fees for vehicle and shellfish permits. The Board members agreed AUGUST 26, 1986 131 the fees will not be increased. ' (13)_., Proposal of the Farmland Committee to enter into an agreement with Andrevi`=D Stype to-perfcrm four appraisals on recently offered property - see resolution No. 27 authorizing the execution of an agreement. (14) Discussion with respect to the amount to be deposited with the Town in lieu of land for park and playground in the major subdivision of Harbor. View at Mattituck - see resolution No. 28. 12:45 P.M. - Recess for lunch. 2:10 P.M. - Work Session reconvened and the Board met with Diane Carroll, Donald Bracken and their architect Charles Egosi who presented to the Board their proposal -for development of the Costello property, Route 48 and Moores Lane, Greenport, presently zoned "M" Light Multiple Residence District. . The proposal calls for 84 semi-attached units, on the easterly side of the property abutting Fleetfield, to-be sold .as moderately priced housing in the mid to upper $70,000 range. There are to be 96 clustered townhouse units on the westerly portion of the property, and an open space area separating the two concepts. If they secure approval from the Planning Board within the next few months the project should be underway by spring. . Mr. Bracken stated they would like to restrict the sale of the units to Southold Town residents for the first six months. They are presently in' negotiations with the Village of Greenport for water and sewer hook-ups; the Village being interested in .utilizing a well site on the property. ..The Board members all, agreed the proposal looks good and the low-cost housing is badly needed in the Town. The developers will now begin the approval process before the Planning Board. 2:45 P.M. - Town Planner David Emilita met with the Board to (1) discuss "Critical Environmental Areas" with respect to prope:rties,around Hallocks Bay, Orient. Councilman Stoutenburgh plans a� meeting with the land owners of that area, as well as .the Trustees, Conservation Advisory Council, Town Board, .Orient Association and representatives of the D.E.C. The meeting wa3 set for 7: 30 P.M., September 2nd at the Town Hall. (2) Coastal Erosion Hazard Areas.' Regulations have been been adopted by the D.E.C., but are in the process of being amended. Preliminary maps are available and within*six'months of the filing of the final maps all municipalities shall submit the commissioner an erosion hazard area ordinance or local law. Residents of the West Mattituck Beach Association and Kenneys Beach Association are protesting the hazard area lines established. by the D.E.C. as being arbitrary and the program has been poorly publicized; they-want the Town Board to review the map and make recommendations to the D.E.C. to revise the lines. Mr. Emilita submitted an outline of a Southampton Town "Community Consultation" meeting. Mr. Don Stanton, Kenney§ Beach, and Mr. Don Witscheben, West Mattituck Beach, urged the Board to meet with the D.E.C. and the residents. of the areas in contest to resolve the setback lines. (3) Master Plan Update. The Board agreed that they are satisfied with the proposed Zoning Code, however there are several changes that must be made on the proposed map: The Board specified the changes to Mr. Emilita who will see that the map is corrected and it is anticipated everything will be in place for the Board to move forward with the SEQR process, with respect to the updated Master Plan, at their September 9th meeting. 4:30 P.M. - The Board reviewed proposed resolutions for the Regular Meeting, and again discussed the proposed public informational meeting with the Suffolk County Water Authority, Suffolk County Department of Health Services, and the Suffolk County Department of Planning.---Don Stanton, Kenneys Beach, approached the Board to request that they take steps to set up a committee to study the erosion problem at Kenneys Beach. 5:35 P.M. Board audited outstanding vouchers. 5:55 P.M. - Work Session adjourned. 132 AUGUST 26, 1986 REGULAR MEETING 7:30 P.M. A Regular Meeting of the Southold Town Board was held on Tuesday, .August 26, 1986 at the Southold Town Hall,. Main Road, Southold, New York. Supervisor Murphy opened the meeting at 7: 30 P.M. with the Pledge of Allegiance to the Flag. Present: Supervisor Francis J. Murphy Councilman Paul Stoutenburgh Councilman James A. Edwards SUPERVISOR MURPHY: I would like to call the regular Town Board meeting to order. The first order of business is a resolution to approve the audited bills._._. .. of August 26, 1986. Moved by Councilwoman Cochran, seconded by. Councilman Penny, it was RESOLVED that the following audited bills be and hereby are ordered paid: Genera .. Fund Whole Town bills in the amount of $14,801.45; General Fund Part Town bills it the amount of $7,348. 69; Highway Department bills in the amount of $8,098. 85; FishL Island Ferry District bills in'the amount of $10, 102.76; Southold Wastewater Treatment District bills in the amount of $864.43. SUPERVISOR MURPHY: Next is the approval of the minutes of a regular meeting of August 12, 1986. Moved by Councilman Stoutenburgh, seconded by Councilwoman Cochran, it was RESOLVED that the minutes of the Regular Meeting of the Southold Town Board held on August 12, 1986, be and hereby are approved. SUPERVISOR MURPHY: Next is a resolution setting as September 9, 1986, 7:30 P.M. as the next regular meeting of the Southold Town Board here in Southold. Moved by Councilman Stoutenburgh, seconded by Councilman Penny, it was RESOLVED that the next Regular Meeting of the Southold Town Board will be held at 7: 30 P.M., Tuesday, September 9, 1986 at the Southold Town Hall, Main Road, Southold, New York. Vote of the Town Board: Ayes: Councilman Penny, Councilwoman Cochran, Counci - man Schondebare, Councilman Stoutenburgh, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: The next is a special resolution that it gives us great pleasure in presenting to a man who really has done a'-tremendous amount in his way for the school district and for the Town and it's for Teddy Doroski. I'd 'like to ask Teddy to come up. He has retired after many years of service to the school and the Town. Please come up, we have a special proclamation, and Councilman Paul Stoutenburgh asked to read it. He says he's known you for a good many years and I can't believe the numbers. COUNCILMAN STOUTENBURGH : We didn't say anything about the numbers, Ted. Ted, it really gives me great pleasure because I've seen you out there. I have a daughter in the school system who says you do a fine job with the young people, and I'm proud to read thic to vnii_ AUGUST 26, 1986 133 Moved by Councilman Stoutenburgh, seconded by the Entire Town Board, WHEREAS, THEODORE E. DOROSKI, a most valued employee of the Town of Southold, will retire from public service effective September 13, 1986; and WHEREAS, THEODORE E. DOROSKI, as a School Crossing Guard since December 5, 1968, has provided safe crossing and watched over the school children of this Town, and deserves the sincere gratitude of those with ;whom and for whom he has served; . now, therefore, be it RESOLVED that the Town Board of the Town of Southold hereby expresses their most sincere appreciation to THEODORE E. DOROSKI for hisi wholehearted cooperation and untiring efforts on behalf of this .Town, and extends their best wishes for continued good health and happiness in his 'retirement; and it further RESOLVED that this resolution shall hereby be made a part of the permanent records of the Town of Southold, and a copy be presented to Mr. Doroski. SUPERVISOR MURPHY: Okay, moving on to the first item on the agenda is Reports. These reports are on file with the Town Clerk for anyone who wants to read them. 1. Recreation Department, Director Susan Fossett, monthly report for July 1986. 2. Justice Frederick Tedeschi, monthly report for July 1986. 3. Southold Town Dog Shelter, monthly report for July 1986. 4. At this time I'd .like the Councilmen to give any special reports that they have, starting on my left with Councilwoman Cochran. COUNCILWOMAN COCHRAN : On August 20th I attended the Highway Committee meeting, where we are working---if 'you had .started on the other end, Frank--- - I don't want to take---George, will you be reporting on Highway? COUNCILMAN PENNY: Yces,M11 was, Jean. COUNCILWOMAN COCHRAN: Jay, will 'you be reporting on Chamber of Commerce? COUNCILMAN SCHONDEBARE: Jean, you can take care of that. Go ahead. Other- wise you don't have anything to report on. COUNCILWOMAN COCHRAN: And Paul's going to report on Beaches. COUNCILMAN .SCHONDEBARE: Does that leave you with anything, Jean? COUNCILWOMAN COCHRAN: No, they're all meetings I attended,, but it doesn't leave me with reporting on them. COUNCILMAN .SCHONDEBARE: Do Commerce and Industry. COUNCILMAN PENNY: You can do Highway if you want to, Jean. COUNCILWOMAN COCHRAN : The Chamber did report to us. We met with them on August 20th, and they did report to us that from June 16th in the Mattituck booth-- from June 16th to August 19th, which was about nine weeks time, they had 2,800 visitors to the booth, with a total of 5,125 cars. The Greenport Chamber--Southold- Greenport Chamber also reported that they kept track of their visitors, but they did not register cars, and they've had 3, 950 visitors. So we've gone well over 6,000 visitors that have stopped to our two Chamber of Commerce booths this season. Also, Frank---and we didn't get into this today, and I don't think it really has to be an item for discussion at a Town Board meeting---they wanted permission to place a rock down on the Greenport property in memorial to two of their past members. Would the Board have any problem with that? SUPERVISOR MURPHY: I don't see any. COUNCILWOMAN COCHRAN: The other thing that they requested of us is that they'd like to have the water tested in Mattituck because it seems to have an odor and a distinct unpleasant taste, and where we do post at our Town Beaches to please do not drink the water, we may have to test up there to see if it's drinkable. 134 AUGUST 26, 1986 SUPERVISOR MURPHY : I'm sure there is a test made already on it in the new well. We'll check it and see why. It could be just a new system. That should be some of the best water in the Town. COUNCILWOMAN COCHRAN: That's supposed to be, yes. Supposed to be. SUPERVISOR MURPHY: You never know. COUNCILWOMAN COCHRAN: So they can go ahead with their memorial rock? (The Board agreed.) Okayl Also they feel that gutters have to be put on the front of the building. Greenport also reported that they did put a new roof on their building and they tore out their old shrubbery and they have added new lighting on the sid Okay, the rest of the meetings I attended was the Highway, which George will be reporting on. Parks and Beaches - we did a .tour of our beaches, which Paul will reporting on. Thank 'you. SUPERVISOR MURPHY Paul? COUNCILMAN STOUTENBURGH: All right, I will report on that Parks and Beaches meeting. We've had some problems with the Health Department. As you know, regulations become more and more difficult for any place where there's a public gathering, and on beaches with bathrooms and showers and what have you, and so to clear up the problem we asked one of the Health Department people to come travel with us, and we traveled to every one of our beaches, had a check list and checked off some of the items that they had said we were in violation, and said well, really, when it comes right down to it you don't have to do this. So there are two or three little items in each area that will be cleared up for next year, and to make sure we start off with a clean slate next year, we're going to start with an inspection of the beaches with one of their people. So we'll .start off with a clean slate. I think we've got a good handle on it and it was really a productive meeting I think. I also want to report again on our STOP Program, and Ruth, would you just pass out one of those flyers just to make sure everybody gets one? We have a good volunteer group, of which Jean is one of them, and each person right from Orient to Mattituck, right to Laurel school will be covered. We are planning on next Thursday to get together with packets of material to give to every school child. Hopefully that the material will get home to--get back to every home. The idea being we want to make sure people understand the 6th of September is the day when household pollutants, pesticides, whatever you have in your garage, will be accepted at the Town Landfill at the cost of this Town of approximately between $7,000 and $10,000 for haulers, and I hope you'll .all take advantage of it. If wherever you see this -sign (poster) as a reminder, and you'll see them up throughout your Town. They're going to be posted and you'll .have; about 50 of them throughout your Town. So do cooperate and pass the word if You would. I also attended meetin�s.of the Farmland Preserva- tion Committee in which we are hopefully getting three new farms. We had one farmer who backed out, and we interviewed them. They all look good and hopefully they'll all come in. And. I also attended the Highway meeting, and the only thing I'd like to add is that I. asked that we would go ahead and make a recommendation to the Building Department, or the Planning Department, rather, that when underground lines are put in--and this is for electrical--that they put in Cablevision. I know of one particular one in Cutchogue with a mile long run, with houses on both sides--there must be probably 40 houses in there--that have to put antennas on their roofs, and you know the reception and the problems of it because they didn't put in a cable. .And hopefully this recommendation will be put in and people will be assured of television. Okay. SUPERVISOR MURPHY:' Thank you, Paul. Jay? COUNCILMAN SCHONDEBARE: No, Jean took them all. SUPERVISOR MURPHY: You were left in good hands. COUNCILMAN SCHONDEBARE: She did'a nice job. SUPERVISOR MURPHY:, Yes. George? COUNCILMAN PENNY; Yes, on 8/13 1 attended a Parks and Beaches meeting, which Paul has already reported on. On the 19th Jean and I and Frank stopped in. We had a discussion with the Payroll Department. They're working out some problems with the new payroll system which we've taken on. We're using North Fork Bank rather than ADP, and we were down here for about an hour and were reassured that our exasperations were going to be corrected. It's just a matter of getting together and working out a new system. On the 20th Paul partially reported about the Highway_ Committee. We recommended approval of Uhl Lane at Orient-By-The-Sea for take over by the Town. We reviewed the specifications for roads for minor sub- divisions and again, as Paul reported, recommend the Planning Board to require developers of a major subdivision and some minors to include Cablevision in under- . AUGUST 26, 1986 5 ground services. On the 22nd the Highway Committee met again and we interviewed three applicants for the job of Town Road Inspector, and we have our recommendation has been--I don't like to pre-empt the resolution, but we have an excellent recommenda- tion coming. He's a retired DOT employee that has done exactly this: for the Depart- ment of Transportation. On the 23rd I met with the Kenneys Beach Association. They're greatly. concerned about some things going on in this Town. Number one, . the road runoff which seems to be being diverted into Great Pond, and. the way . - that the Town is handling that. There will be more follow-up communications from them on that. They're very concerned about the Town Beach deterioration and as a result of some discussions today I believe we're going to set up a committee to look into this. Their last, and probably their far greatest concern, is the effects of the Coastal Erosion Management Program on communities and property owners like themselves that have shorefront property. We're going to get into further discussion on that and bring some of the -members of the D.E.C. down here hopefully around the 15th of the month and actually have some on-site discussions with them and then follow it up so we both have a better understanding of what we're dealing with. The Peconic Center is under way. I've had several meetings with. the architect and. with the super. on the job ironing out some of the small kinks in it, but there is a man on the job. Hopefully they'll be more men shortly. The materials are pretty much there and progress should proceed. So we're maybe a little behind schedule, but it's going along. The Dog Pound we had a bit of a problem with our initial bids, but we're going to go out an re id it and make a possible revision to the specifica- tions so that the least we can do is accommodate for the emergency--to preclude an emergency situation this winter and we'll just--if we can't do the whole thing, we'll just do a part of it.- One further thing is is the Town Board did discuss today, though informally, a public informational meeting with the Suffolk County Water Authority, the Suffolk County Department of Planning, and`the Suffolk County Department of Health Services being available here at the Town Hall at some time in the future so that people that do have any questions regarding the policy that the Town Board has in place, that hopefully all of their concerns will be alleviated by a.discussion directly with these people. That will be at some-time in the very near future and the date should' be announced at our next Town Board meeting. Thank you. SUPERVISOR MURPHY: Thank you, George. . 1'd just like to add a couple more. The methane survey for the Landfill and the piping diagrams and all, are being sent down, supposedly, from the consultant out here so that we could hopefully get this system in place. I also met with the Director of Catholic Charities for out here. He wanted to meet with the Supervisor to tell us that even though they were moving from Laurel down into Riverhead--the Laurel property was sold--that we will have the same services available to .the people. They do an awful lot in many fields. Also met the same day with Dr. Harris of the Health Department, Helen Proud, . the Health Department representative, Judy Hope, Tony Bullock, myself, and Greg Blass, on a proposal--very important proposal--a grant that's being presented to the State. Hope- fully we'll _get funded. There is a resolution of support on here and I think Helen will say something further. But it's one 'that's very important on the East End here where we are getting a much older population. Each year our percentage keeps going up, and it's something I think we've been doing very well with. I'm very proud of our Nutrition Program, the whole program that we have down there, and this is just another step to improve it and hopefully this grant will come, and to cover our bases both Judy Hope and-myself requested of the County Executive to include the money in his 'budget in case the grant was not approved, so that we would be able to get started in this next fiscal year on this program. It's going to be down in Greenport Hospital and over in Southampton Hospital. It's an extension of the clinic from Riverhead. Make- it much easier for residents on the East End to avail themselves of these services. Also I was able to make it up to Albany on Monday in spite of the hurricane. We got the plan that was going to fly some of the people up--some of the Town Board members up and Harold Berger, had to cancel unfortunately, but we had a very productive and a very good meeting up there. And that's about all have to report, except it's certainly very good to see our Ex-Supervisor, who's finally, come around here. • I thought he moved away on us. PELL, III : Soundly. 11. PUBLIC NOTICES. SUPERVISOR MURPHY: Okay, moving on to the second item on the agenda, Public Notices. . There is only one and it's concerning the New York State Department of Transportation who is going to have a plan set out at our Tourist Information building in Laurel on September 10th from 1:00 to 8:00 P.M., for any residents around, to see the plans of exactly the type of construction that's going on. They are going to, hopefully, by the end of the year the contract will be let for the 13 AUGUST 26, 1986 straightening of that road. We've had many, many serious accidents there and this will be another step in making the roads a lot safer in Southold Town. Anyone who's interested in the; plan you,could stop down and see them on that day and they'll explain what's going on. (Improvement of Route 25 from Aldrich Lane to the Long Island .Rail Road bridge in Laurel.) Just to give you an idea, the road is going to be brought a little closer to the booth, not by much, but the elevation on the edge of the road in front of the booth is going to be raised 18 inches, and so it's quite an involved job and a lot of clearing further to the west, so if you're interested, stop in and take a look. III. COMMUNICATIONS: SUPERVISOR MURPHY: We have three or four. communications. 1. From Mrs. Frances Glander who is thanking the Town and the Nutrition Program, Senior Day Care Center in particular, for the excellent job they're doing. I can't say enough about the program. It really is fantastic, and it's always good to hear good comments. Most of the time you hear the negative comments and it's nice when you know a program. is really reaching somebody and doing some good. 2. From the North Fork Peace Group thanking us for our, cooperation in behalf of their efforts (silent vigil against nuclear weapons on August 6) . 3. From the Assistant Director of the Leukemia Society giving us a .report and sending a picture down; of a fundraiser that some of us participated in. If you could believe a Town Board member actually paid $20.00 to put a cream pie in my face. We . had a very good time. COUNCILWOMAN COCHRAN : It was all done in good fun and good spirit; and it. was for a worthy cause, Frank. i SUPERVISOR MURPHY: And almost $5,000 was raised for the Leukemia Society, and it was a great afternoon and I thank everybody who participated and a little campaign literature the next time;Jean runs, we're saving these pictures of her in her costume. Anyone who would like to see them come up after. COUNCILMAN PENNY: I think you ought to hang them on the bulletin board. The public's interested in that, Frank. COUNCILWOMAN COCHRAN: It. was a nice break from all the seriousness we have. SUPERVISOR MURPHY: Letter Number 4: is from Mr. and Mrs. Theodore Kudlinski on Champlin Place in Greenport thanking the Town Board -for installing the four-way stop signs and finally grave the. residents down there a nice of peace is what" they said. Correspondence was good this week. It was mostly positive and it's always nice. IV. PUBLIC HEARINGS. SUPERVISOR MURPHY:J 'There is a public hearing scheduled at 8:00 P.M. V. RESOLUTIONS. SUPERVISOR MURPHY: We'll start on resolutions. I would like to just state the policy of the Town Board concerning resolutions. We do allow anyone in the audience to address the Town Board before resolutions are voted upon, and to address only concerning a proposed resolution if you want .to make a statement on it. After the regular Town Board meeting, after the resolutions and all, we will have a period of time where anyone in the audience could say whatever they want to address the Town Board. So I would ask at this time is there anyone here who would like to comment on one of the resolutions? Yes, Helen. HELEN PROUD: I think mine is the easy one. It's Resolution 16 and it's in support of our -request grant application for satellite services. We have applied to the New York State Department of Health for practically $300, 000, and with this money we will hire a physician, a couple of public health nurses, clerical people, a social worker, and a neighborhood aide and then begin to provide medical and adult and pediatric services in the two forks for about two and a half days each. One in the red building in Greenport, and the other two and a half days in the Shake building in Southampton, and as Frank said, we've gotten a lot of support for it • so far, and with County approval when the grant application finally goes in, it would be very beneficial, to us to have a. Town resolution .of support along with that. SUPERVISOR MURPHY: Thank you, Helen. We do appreciate your department's efforts, really. Okay, 'anyone else like to address the Board? Bill. BILL BEHR: Thank you very much. I would like to address resolution No. 1. would like to address it as a member of the Economic Advisory Committee for the Town of Southold, also as a member of the Board of Directors of the Chamber of AUGUST 26, 1986 137 Commerce. This particulae resolution is turning A *e world backwards. Let me tell you very simply that we really need affordable housing in the Town of Southold. I can say that as an individual, as a member 'of all these organizations, I can particularly tell you as far as the Economic Advisory Committee is concerned, the people we've interviewed, who are the people that help our Town to grow and main- tain their stability. They're the principal owners of/and people involved with the areas of agriculture, the fishing industry, and the area of tourism. We need affordable housing here. Last week I had the pleasure of listening to Lee Koppelman, who addressed the Chamber of Commerce here recently. If you don't know Dr. Lee Koppelman, he's a very hard thinking man. I consider him like the Robert Moses of our County. He said unless you have affordable housing you cannot stabilize, and further you cannot grow. These are very important to us. It's very interesting that the very nice plan that was presented to the work session today, and I'm not a builder, but tried to accomplish all the things the Town wanted. It's very disturb- ing to me, and to people I'm associated with, that they have not been able to get a meeting with the Town Planners. I was here two weeks ago and they were sure they'd have a meeting last Friday. They were never granted that meeting. Now that's very disturbing, and would have to be disturbing to this Town Council--Town a. Bo rd, as why someone with a plan cannot get a hearing. The hearing. wouldn't be with the Town Board, but with the Planners. What's wrong with the Planners? I'd like to jump to another subject. We have the Coastal Erosion Hazard Area. Apparently there was a' meeting. I was not here two years ago in which a lot of things were voiced. However, a number of people who appeared' today--the Kenneys Beach Association, the Captain Kidds group--and by the way I would 'Say they represent pretty much the people along the Sound. I don't live there, but I live on the water. I feel very sympathetic to them as a citizen. , I don't know why we . can't get the DEC here--by the way we pay for their 's6lariels--why' don't you set a date and insist that they be here and let's have an open hearing, which I think is being arranged. In the summer of 1985, when I applied for the I'M" Zone, the intention was to provide some affordable--moderate income housing--affordable housing, whatever you want, in Southold Town. That's still, the intention. There's never been any other intention. I think we've made a step in the right direction from presenting a concept plan this afternoon. It's easier when you see something. When you see something being headed towards a goal and I hope it continues to head that direction. Thank you. No owner , lessee, licensee or other person having any right to or interest in'any real property within'the jurisdiction of the Town of Southold;shall license, rent, lease or otherwise permit the use of such real property or any part thereof for public assembly purposes, other than in established theatres, auditoriums or other places licensed or permitted for public'assembly purposes as limited by law, except pursuant!, to a permit authorized by the Town Board as hereinafter provided!. ,D. Application The Town Board may issue a permit to use premises for public assembly purposes; upon the written application made by the person who proposes to maintain, conduct, promote or operate such public assembly use or participate therein, together with the owner, lessor or licensor who proposeslto rent, lease, license or otherwise permit the use of premises for such ',use, all hereinafter designated as applicant. E. Application Procedure (1) The applicant shall- file a verified application with the town clerk at least thirty (30) days prior to the date or dates upon which such public assembly use is 'to.take place, together with the permit fee in the sum of ten ($10.) dollars. (2) The Application shall state: (a) The names and addresses of all of the applicants (b) The location, size and facilities located on the property. intended to be used for the public 'assembly event. . (c) The number of persons expected to attend such event. (d) The date or dates .and hours during which the event will Pe held. (e) The means of accommodating the• persons attending such event with respect to: i(i) ' Food (H)'• Shelter (iii)' Facilities for toilet and other personal sanitary needs for men and women. NO Provision for public safety, guards or special police to assist in the control of traffic and the supervision of persons attending the event. F. Issuance of Permit The Town Board, after considering the application and after causing due investigation and report to.it,'.:and after considering the facts-and 0 circumstances in*the matter, may authorize the Town Clerk to issue a permit upon such terms.and conditions as it deems necessary and proper to ensure the public health., safety and welfare. COUNCILMAN PENNY: Just that I'm very happy to see that Resolution 1, which has been a recurring resolution here wasn't acted on tonight. We had a very 14 �` AUGUST 26, 1986 `� excellent meeting with the purchasers of the Costello property and they have some pretty good ideas. It's not exactly our law, but then we can't always have every- thing our own ways. It's a realistic approach to solve the ultimate problem which is paramount out here in this area. As we were meeting this morning a builder walked in, who I'm very familiar with, and met with Jean and I and just told. us, not in defense of a Local Law or promoting a Local Law, but just told us how he had just lost another employee who moved into Connecticut and was able to purchase a two-story house in Connecticut for around $75,000 to $80,000, and there's plenty. of jobs up there, so the man is ultimately gone. So that's what we're faced with on a regular basis. Being a Town employer and hearing from so many other employers in Town. The young fellow that worked on my boat this summer for Mills is gone. -. He's leaving. He's been one of Mills' main men for years and he's leaving the area. He can't afford to live here, and he can have a chance to get a business going of his own and a place to live at a reasonable price elsewhere. This is the problem that we're dealing -with. Not whether or not a developer is going to make a couple of bucks, but what is the ultimate result. Will we get affordable housing for the young people in Southold who really need it, and I'm glad to see, like I said, that the Town Board did not move on Resolution No. 1 again; and I hope that it stays that way. COUNCILMAN SCHONDEBARE: Since I haven't had a chance to make the Work Session today, and I missed the presentation by the people with regards Resolution No. 1, 1 didn't feel it was pertinent or 1 didn't. feel..I should introduce Resolution No. 1 again until I've had an opportunity to review the plan, review the "M" Zone requirements and sit down with the Town Attorney to see if it can be done. Resolutic No., 1, is not dead, it's just on hold. SUPERVISOR MURPHY: Thank you. Paul? COUNCILMAN STOUTENBURGH: Yes. I listened to the presentation and I don't there's anyone who knows the problem as well as I do for the simple reason I've worked with young people all my life. I have three young people who had difficuties finding homes. My only concern is water supply in this area and one of our top people in the Health Department gives me a warning that this is going to possibly create problems down the line. I think we should be very, very careful in adding more load on to the water problems of the Greenport Water System, and 1 asked c of the principals that are in this development to talk to Marty Trent, who .1 refer to just previously, and hopefully he will get some idea of my concern, and basicu:_, that's- my real concern. I surely think we do need housing. I'm not against any housingithat's for sure. The problem is; is it at the correct place? SUPERVISOR MURPHY: Thank you, Paul. Jean? COUNCILWOMAN COCHRAN: Yes, as Chairman of the Town Board Housing Advisory Committee I would just like to say that I'm gratified that we have gotten this far and I hope that through communication and cooperation from all those involved that we will obtain our goal of affordable housing. On a lighter note, I. would just like to express a thank you to Susan Fossett and Pete Grattan, who was responsible for patrolling our beaches this summer, for the job they did. The Committee has worked very hard--the Beaches and Parks Committee, and I think we've made a dent and we've begun. We have some way to go, but I think things functioned and I think Paul will agree, a lot better this year then .they have in the past. SUPERVISOR MURPHY: Thank you, Jean. I have to agree with you because the calls in to my office certainly were almost nothing compared to other years. The problems really were handled much better. I would like to ask the Town Board to meet, just for about ten minutes, right after this meeting in Executive Session on a possible hiring. And I would like to just mention also to our Ex-Supervisor that our Town Clerk doesn't have sore feet or legs any more from being kicked. Somebody controlls themself. PHIL BARTH, Southold: I'd just like to address the Town Board in relation to a policy of the Work Session. I'm looking over the agenda for the Work Session and although there's Coastal Erosion Hazard Areas on here, there's no one scheduled to talk on that., Yet there were people here that took up hours of the time of the Work Session with their presentation. Now I'm not opposed to people expressing themselves, but I think that if it's going to be done, then it should be done the same way as we have a policy for the public meetings and we should have a policy for the Work Session, and that way at least the thing would be in an orderly fashion, otherwise whoever feels like--they want to come down .here and express themselves in a Work Session, comes down and expresses themself and our Work Session drags on interminably. So I think if you're going to have a policy where you want the public to be able to speak on a certain subject, do the same thing that you do on the public session. Give five, ten minutes, whatever, at the beginning of the Work Session to discuss any of the things that are going to be taken up at the Work Session.
