Box 86 Orient, NY 11957 RE: 8070 NARROW RIVER ROAD, ORIENT SCTM# 18-6-18.1 Dear Mr. Tuthill: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wed., December 15, 2010: WHEREAS, SOUTH BROWN LLC applied to the Southold Town Trustees for an Amendment to Wetland Permit #3747 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated October 31, 2010, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure, as applied for, does not comply with the standards set forth in Chapter 275 of the Southold Town Code, 275-11 Construction and Operation Standards C.(2)(c)[1][b]Residential Docks. [b]If any of a residential dock structure includes a float or floating dock, the float or floating dock portion shall be designed so that, with the exception of the pilings:fi]It is no larger than six feet wide and 20 feet long except on 2 Fishers Island if the need is demonstrated, or of equal square footage as determined by the Trustees;(ii]No part of the floating dock will contact the bottomland during a normal low tide, and, WHEREAS, the Board has determined that the structure, as applied for, will have a detrimental effect upon the health, safety and general welfare of the people of the town, and, NOW THEREFORE BE IT, RESOLVED, that for the foregoing reasons, and based upon the application's failure to meet the standards contained in Chapter 275 of the Town Code, that the Board of Trustees deems the proposed project to be Inconsistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-6.3 of the Southold Town Code, based on the number of proposed floating docks and possible contact of the bottomland and marsh using floating docks for the proposed structure, and, BE IT FURTHER, RESOLVED, that the Southold Town Board of Trustees DENIES WITHOUT PREJUDICE the application of SOUTH BROWN LLC to Amend Wetland Permit#3747 to extend and expand the existing dock with a 4'x15' landward extension, a 6'x20' floating dock and two (2) 5'x30' finger floats, as applied for. Located: 8070 Narrow River Rd., Orient. SCTM#18-6-18.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the below Policy Standards and therefore is CONSISTENT with the LWRP provided that the following requirements area adequately addressed: ♦ `��I°" f Y .yam F�"4"1 x NIFIR ./'. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. It is recommended that the Board require that the applicant address the following dock standards pursuant to § 275-11. Construction and operation standards. (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water- dependant activities; [3] Whether the dock will unduly interfere with transit by the public along the public beaches or foreshore; [5] Whether the dock will cause degradation of surface water quality and natural resources; [6] Whether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife habitats; [7] Whether the dock will result in the destruction of or prevent the growth of vegetated wetlands, seagrasses including eelgrass (Zostera marina) and widgeon grass (Ruppia maritima) or shellfish; Eelgrass (Zostera marina) is known to occur in Hallock's Bay. Cornell Cooperative Extension scientists have been contacted to determine the presence or absence of the eelgrass at this location. It is recommended that the Board reserve a decision until a response is recieved. [10] Whether the dock will adversely affect views, viewsheds and vistas important to the community; [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design,. construction, and location of the dock will minimize cumulative impacts; and [12] Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service.
