Edwards, Councilman Paul Stoutenburgh, Councilman James A. Schondebare, Councilwoman Jean W. Cochr Councilman George L. Penny IV', Town. Clerk Judith T. Terry, Acting Town Attorn Francis 'J. Yakaboski. ' 9:25 A.M. - The. Board met with Insurance Consultant William F. Mullen, Jr. Mr. Mullen advised that there will be three qualified bidders for the Town's 1988 Insurance Program. Further, he has been working with the Stype Agency since June and althougl- the report is still' not complete, the Town should be looking forward to a credit of about $87,000. for -1986, a 'substantial refund for 1987, and a small one for 1985.--Mr. Mullen. informed the Board he was recently in Aruba and .spent over six hours with people of that island on afforable housing, where they put up about 200 homes annually. He would be willing to prepare a presentation if:the Board is 'interested; which they are. Mr. Mullen was also present,__as:,was Planner :Valerie 'Scopaz, while the Board discussed Planning Board fees with Acting Town Attorney Yakaboski. The cost of engineering services have drastically increased due to the hiring of the, professional firm Sidney Bowne, and Mr. Yakaboski is 'researching the legality of charging the developer with. the actual cost of the engineering services. Ms. Scopaz stated the Planning Board is looking at the alternative of hiring .a staff engineer. 10:00 A.M. -. Officer hours for Town Hall Departments: Board of Appeals Chairman Gerard Goehringer stated his office is never closed. Justices Price and Tedeschi stated they had discussed this. with Board members who had agreed they should close their office as necessary to permit 4heir`.clerks to complete required paperwork. They, as elected officials, have determined that their office hours .shall be 1 : 00 P.M. to 4:00 P.M. Planner Valerie'Scopaz stated their office is closed from 9:00 A.M. to 10:00 M. and 4:00 to 5:00 P.M. to permit 'them to complete paperwork. They rarely close lunchtime. 10: 15 A.M. - Acting Town Attorney Yakaboski reported to the Board that he has investigated the complaint from the Terry Waters Association, which was discussed. at the October 6th Board meeting, and i ,appears a side door has been added to the Helen Rusch dwelling. He has suggested that the Building Department inspect and issue a violation, at which time they may be able to determine whether other portions of the home have been converted to create a two-family dwelling.--West Creek Estates - as discussed previously - the owners of the roads, Wilsberg;-cave agreed to redeem the property from the County, atid.:-the -property -owner's association has submitted :a certified check for the redemption. Hopefully the County .Legislature wily release the deed to Harold and Ernest Wilsberg, and then they will most likely give a deed to the association. Sisu Development, Inc. - Mr. Yakaboski wily arrange an on-site inspection with Rogers & Taylor, appraisers, and Sidney Bowne, engineers.-- Notice of Highway Defects. - Mr. Yakaboski agrees with the recommendation of Insurance Consultant Mullen that the. Code should be amended to be more encompassing, and wily prepare the. proposed local law.--Letters of Credit Mr. Yakaboski stated there is'a specific'provision in the Town Law that Planning Boards must accept performance bonds with respect to major. subdivisions; however, there is no provision with respect .to site plans, so they could ask for Letters of Credit; and he will will' work on putting that into the Code. 10:30 A.M. - Valerie Cardona met with the Board to submit the revised budget for the Southold Town Supported Work Project. Mrs. Cardona asked for a letter of support and commitment from the Town for; $5,220. 00 non-personnel funding for the project. The Board agreed (see resolution no. 21) . 10:45 A.M. - Planner David . Emilita and Acting Town Attorney Yakaboski met with the Board to discuss the Master Plan and proposed updated Zoning Code and Map. Councilman Penny stated that the way the proposed zoning ordinance now reads, due to the removal of the provision for a special exception by the ZBA, there would be 12,000 non-conforming parcels in the Town, and to make any exterior change to a building they would be required to go to the ZBA for a variance under.a hardship basis. Mr. Emilita does not agree with Mr. Penny's interpretation. Mr. Emilita and Mr. Yakaboski will' meet with the Planning Board to discuss the manner in which to correct the situation. 11 :40 A.M. - Mr. Yakaboski advised the Board that the has received a telephone call from a resident who lives in the area of Marion Lake complaining that a Mr. and Mrs. Eugene Parino are constructing a two story dwelling with two kitchen facilities; one each on the upper and lower floor, together with separate bedrooms, OCTOBER 20, 1987 3 6 9 bathrooms, etc. , appearing to be.;a,: twq=;;fam.ily.dwelli.ng.. He examined the plans on file with the. Building Department, upon which a building permit was issued, and the plans clearly show what appears to be a tw-family dwelling. He has directed the Building Department to issue a Stop: Work Order pending a complete review of the facts and circumstances s,urroundingi,this,'.matter, as there appears to be a serious discrepancy in' their interpretation of the zoning ordinance. 11:55 A.M. - For Discussion Items : (1) Planning Board fees and expenditures was discussed with Acting Town Attorney Yakaboski and Planner Valerie Scopaz earlier in'this 'w.ork session. (2) Letter from the .State of New York Parks, Recreation and Hisioric'Preservatioh informing the Board that a matching grant of $225,000. 00 has been reserved for the acqui si•tion.of a Mattituck Inlet Park (Carey tank property) . Councilman Penny informed the. Board that the people in that area don't want a State Park, and especially a boat ramp which would be open to the general public. Later in the afternoon Community Development Administator James McMahon advised the _ Board that the grant is•based upon Environmental Quality Bond Act moneys. He assured the Board there are ways to mitigate. the objections of the neighbors with . regard to launching ramps.. He discussed the possible acquisition of the property which would be at least $375,00.0 for 1. 3 acres. Board members authorized the application for the •funding, but did' not see the- grant application before it 'was submitted and stated in.k the. ;futcure..they want.to see all grant applications before submission. • '(3) Interviews 'for Ordinance Inspector: begnning at 5:00 P.M. , Tuesday, October 27th. (4) Letter from Under Sheriff Alan. J. Croce for input with respect to his 'feasibility study of establishing a Marine.Unit 'within' the Sheriff's Department.: Board discussed this 'with. Chief Winters.and Bay Constable Dzenkowski and agreed such a unit would not be needed. in Southold Town, however, if there are any grants available the Town would like the. County to share them. '(5•)' Receipt of Requests for. Qualifications for Solid Waste Compostingare being referred to Profession Epstein•of E. E A Environmental' Consultants, Inca and the H2M Group for review:" (6) -Request for the purchase of a :sub-compact- car for the. Building Department, was put on hold. 12:20 A.M. -: Board audited outstanding' vouchers to be paid' at the regular meeting. EXECUTIVE--SESSION 12':35 P.M. -. You might note it's Thursday instead of Tuesday. Okay, we don't have a very 1'arge agenda tonight, but we have a very special one. We have three proclamations that it's our real honor to present. One is to a man, Jack Sherwood, and Jack, .please come up, who's going to retire from Southold Town. I really don't know how Southold Town is 'going to get along without him. COUNCILWOMAN COCHRAN: You phone's going to be ringing once you leave. We'll still' look for you, Jack. Moved by Supervisor Murphy, seconded by the Entire Town Board, WHEREAS, JOHN S. (JACK) SHERWOOD, a most valued employee of the Town of Southold will retire from public service on November 1, .1987; and WHEREAS, JACK SHERWOOD has given generously of his time and expertise in his fauthful service too the Town of Southold and its residents as a member of the Assessor's. Office since September 16, 1977; and WHEREAS, his record of fine service to the Town of Southold and its people deserves the sincere gratitude of those with .whom and for whom he has served; now, therefore, be it RESOLVED that the Town Board of the Town of Southold hereby expresses their most sincere appreciation to JACK SHERWOOD for his 'unselfish and wholehearted cooperation and untiring efforts on behalf of the Town, and extends their best wishes for his retirement years ahead; and be it 'further RESOLVED that this •resolution shall be made a part of the permanent records .of the Town of Southold and a copy be presented .to Mr. Sherwood.. SUPERVISOR MURPHY: Okay, this year was the celebration of the Bicentennial of the Constitution, and we really had a tremendous program, I think, in Southold Town. The first resolution or proclamation I would like to present is to Peg Murray. Peg OCTOBER 20, 1987 3 7 1 is `here with the two producers, 'Iody ' -evin"andShar6n Corrigan. These three people really presented a play that was one of the best plays I .think that I've ever seen. I .think you people did a really great job. Moved by Supervisor Murphy, seconded by the Entire Town Board, WHEREAS, PEG MURRAY has unselfishly given of her time and talent in'order to commemorate the Bicentennial' of the United States Constitution by researching and writing the musical play, CONSTITUTION. NOW;.. and WHEREAS, the presentation of Peg Murray's play,. CONSTITUTION NOW, stimulated Town-wide interest in'our Constitution and deepened understanding of that- unique document;. and WHEREAS, the subject matter of CONSTITUTION NOW and the manner in' which it was presented by its talented cast made us conscious of the freedoms guaranteed by the Constitution and the civic'responsibiilities .necessary to its preservation and vitality; and . WHEREAS, PEG MURRAY has thus provided the community not only with superb enter- tainment, but also with a meaningful history and civics lesson, now, therefore, be it RESOLVED that the Town Board of the Town of Southold hereby expresses their most sincere appreciation to PEG MURRAY for her untiring efforts and extends their sincere congratulations for presenting such a magnificent and memorable production for the enjoyment of the residents of. I just wanted to say as excited as I got when 1 started working on that material, I mean this Country, I just fell in love. all over again. But I'd. like to say tonight .that I also love Southold m so much and I' so happy that";I,'m a-part,of Southold. Thank- you. SUPERVISOR MURPHY: Peg, I think it 'was. fantastic.' Thank you.. This is.'really a night of good proclamations here. We have one other and this 'is also concerning the Bicentennial, and it's going to be presented to John Harrison-for his .efforts on behalf of the celebration, the great parade we-,had and the events leading up to. it: I think Southold Town really again' out.'did.'iitself, and John, I want to .thank: you and your entire committee for, I think, doing a fantattic'job. I also would Like to thank the people of Southold; because without them there surely wouldn't have been much of a parade and they surely turned out in force. Peg and her group, and all the people that showed up that day for the parade was really great. And of course my committee, which worked fantastically. Thank you very much, all of you. Councilmen's Reports. At this 'time I'd like the Councilmen .to make any special reports, and I'll start on my left with Judge Edwards. . JUSTICE EDWARDS : . Nothing at this time, Frank. Thank you. SUPERVISOR MURPHY: Jean? COUNCILWOMAN COCHRAN: Yes, just several. things. I did meet with Ray Jacobs and Ken Reeves, I believe it.'was on Friday, to follow through on some of the recommend tions of the Recreation Advisory. Committee. We went up to the Peconic Center and made decisions as far as location of our bocci court and our pitching horseshoes andl shuffleboard inside, so that looks. like it's .progressing nicely. All of us have been busy with the budget. This evening, though, I did' attend the Green Meeting for the Southold Town Green .located here in' the hamlet of Southold, and they're coming up with a very good support type program..which is '"sell a brick". On November 14th WLNG, Paul Sidney will have his 'containment there, and they'll be broadcasting all day long from the site, and we're encouraging through publicity you will see, asking people to come down and buy some bricks to help complete the site as far as the walks are concerned. Also, if 'you are in' a generous mood you will have the opportunity to donate or buy a lamp post:,or a bench or something on. a larger scope. It looks like a:fund day. The Kiwanis 'will' be there with refreshments. The gazebo at that time should be, 90% completed. They're working. very had on that. If you go past you may see that it doesn't seem like anything's moving, but all fo thisis being done off-site, the cutting of all the timbers and so forth that go around the gazebo. So try to remember on the 14th, it's a Saturday, come down to the Village Green and by your support buy a few bricks. It's going to be a fun .day.- Thank you, Frank.. SUPERVISOR MURPHY: Thanks, Jean. I'm sure it will be. Paul? ---- GOUNC.ILMAN STOUTENBURGH: Yes, Frank, I met with our. Beach Committee,which Jean is a part of, 'this week,. to go over the year's trials and tribulations of summer beaches, and we`made :out pretty well we think. 1 think we did very well as a matter of fact. Only a few hitches here and there. . We'-re a little concerned that some of our young attendants might not have proved as worthwhile as we thought, but we think that perhaps maybe we might try using adults next year. This is something we're hashing around. We haven't made up our mind, because it's such a wonderful opportunity_ for young people, but it's a difficult one for them with their activities and connections, it's .hard to stay in''business with just young people I'm afraid. We also talked about our fees, our out-of-town residents. Perhaps we might have to raise those. Some of the: problems. with parking. It was a sort of give and take, the whole program. We had the Police. Chief there who gave us a run down on his operation,--and by the way, they have done a wonderful job patrolling and taking care of our beaches, and I think that has helped us tremendously to see that there is 'a patrol person continually traveling .from beach to beach. That's his entire job . all summer. long. And Peter Grattan did' a fine job on .that. So basically we've put our ideas together, we written them all down. We're going to put them together into a recommendation so that whoever takes .over the.following year will have some- thing to go,_by. . And,. of course,., I was at the Green Committee with Jean, and it looks like this. November 14th"should be a fund. day and I hope you'll all participate. And, of course, we had-.-budget meetings, and we'll be having more of those. That's about it, Frank. SUPERVISOR MURPHY: Thanks, Paul. Jay? COUNCILMAN 'SCHONDEBARE: Yes, thank you, Frank. We had a Police Committee meeting this morning, which we really can't get into and discuss. And we did the budget. And that's it. SUPERVISOR MURPHY: George? COUNCILMAN PENNY: Just a budget meeting last week and a Police Committee this morning. Nothing much more exciting then that. Thank you. SUPERVISOR MURPHY: Thank you. It has been a. very busy time with the budget mainly, and with the work, and it 'really is amazing, going back to Paul and Jean's reports on the beaches and that. It changes. every year and the problem that we had three years ago. is no longer a problem, but now we have athers. So it's an ongoing problem, but it's a good service. I think that we offer to the Town. 1l : PUBLIC, NOTICES. SUPERVISOR MURPHY: Under Public.' Notices, there's a 3:00 P.M. and an 8: 00 P.M. public hearing at Southold Town Hall on Thursday,. November 5th, 1987 on the Southold Town proposed Budget for .1988. OCTOBER 20, 1987 373 III. ' COMMUNICATIONS. SUPERVISOR MURPHY: There .was one Communication only from a Mr. Dugan in East Marion thanking the Town Board really for their efforts in' trying to help solve the air canons problem, and he had some good suggestions and he'was appreciative of our efforts, because it 'is *a real problems,. and the way the grape growers real.ly are trying to address it.' IV. PUBLIC HEARINGS. (None.) V. RESOLUTIONS. SUPERVISOR MURPHY: We'll move on to Resolutions, and I would just like to remind everybody of the policy of the Southold Town Board. If you would like to discuss or make a comment on any ,resolutions: you may do so now. There will be a time after the resolutions and the final Counci Imen's :reports for anyone to make any comments to the Town. Board. We w.au.ld. like you to hold your comments at this time to any of the proposed resolutions that are listed. on your agenda. So, anyone out here would like to. address. the Town Board on any of the proposed resolutions? (No response.) Hearing none, we'll move on to Resolution No. 1 which is to grant permission to use the Town roads. 1.-Moved by. Councilwoman Cochran, seconded by Justice Edwards, it was RESOLVED that -the Town Board of the Town of Southold hereby grants permission to the Cutchogue. Fire Department to use Town roads: Depot. Lane and New Suffolk . Lane as a. line of march for their annual Halloween Parade to be held at 6:00 P.M. , Saturday, .October 31, .1987.,- prov-ded they secure and file,with the Town Clerk the proper insurance certificafe naming the Town of Southold as an additional insured. 1.-Vote of the Town Board : Ayes:, Councilman Penny, Councilwoman Cochran, Council man Schondebare,. Number 2 is to execute a maintenance agreement. . 2.-Moved by Justice Edwards, seconded by Councilman Penny, it 'was RESOLVED that the Town Board of the Town of Southold hereby authorizes .and directs Supervisor Francis J. Murphy to execute maintenance a!2reements with IBM for the Systerr:/36 computer equipment which has been received by the Town as follows: 1987 - $628. 00;. 1988. - $3, 675. 00. 2. -Vote of the Town Board : Ayes : Councilman Penny, Councilwoman Cochran, Council- man Schondebare, Councilman Stoutenburg, Justice Edwards, Supervisor Murphy. SUPERVISOR MURPHY: Number. 3 is to execute an agreement for the SNAP Program. 3.-Moved by Councilman Stoutenburgh, seconded by Councilwoman Cochran, it was RESOLVED that the Town Board.:of.th.e Town of Southold hereby authorizes and directs Supervisor Francis J. Murphy to execute an agreement between the County of Suffolk, Human Resources Divisior 1,: Offi-ce for the Aging, and the Town of Southold, for the Supplemental Nutrition Assistance Program (SNAP) , for the .term October 1, 1987 through March 31, 1988, at an agreement amount of $44,466. 00. 3.-Vote of the Town Board : Ayes: Councilman Penny, Councilwoman Cochran, Council-' man Schondebare, Councilrr:an Stoutenburg, Justice Edwards, Supervisor Murphy. Number 4 is 'to appoint a Health Aide. 4.-Moved by Councilman Penny, seconded by Councilwoman Cochran, it -was RESOLVED that the Town Board of the Town of Southold hereby appoints Mary Novit as a Health Aide in- the Senior Adult Day. There will only be certain contractors allowed in where they're going to take large amounts out in*one day. We'd applied to $50,000 worth of funding and we've already gotten a pledge from the County for the lion's share of the Town portion--I think the Town is down. to about $4,500 now and the County I believe is around $10,500--I may not have the figures right, but the percentages are close. As you may or may not know, we came very close to losing three more houses this last storm. The owners of the property immediately to the east of Kenney's Beach have just made arrangements to have their houses moved and in another month they would have lost them.
